Shearn/James J. Kubicka To permit the construction of a 32,244 square foot mini -warehouse facility and caretaker's apartment pursuant to Section 9530 of the Huntington Beach Ordinance Code, located on the southeast corner of Mountjoy and Enterprise in an Ml, Light Industrial District. This request is covered by ND 74-150, adopted by the Planning Com- mission on November 19, 1974. No one was present at the meeting to represent the application. Jim Palin indicated to the Board that required information has not yet been submitted by the applicant; namely, a hydrology study addressing the relocation of the storm drain easement across the property. ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 77-120 WAS TABLED INDEFINITELY TO PERMIT SUBMITTAL OF A HYDROLOGY STUDY TO THE DEPARTMENT OF PUBLIC WORKS, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, BEHRENS NOES: NONE ABSENT: NONE Minutes, H.B. Board of Zoning Adjustments August 3, 1977 Page 2 TENTATIVE PARCEL MAP NO. 77-27 Applicant: Douglas Snyder To permit division of an existing parcel into four (4) separate parcels pursuant to Section 9921 of the Huntington Beach Ord- inance Code, located on the northeast corner of Beach Boulevard and Garfield Avenue in a C4, Highway Business District. This request is covered by ND 77-63, adopted by the Board on May 25, 1977, upon approval of a shopping center at the location (UP No. 77-56). No one was present to represent the application, but Jim Palin noted that the applicant has contacted him to indicate his re- ceipt of and concurrence with the suggested conditions of approval. ON MOTION BY PALIN AND SECOND BY BEHRENS TENTATIVE PARCEL MAP NO. 77-27 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Depart- ment on July 13, 1977, shall be the approved layout. 2. A parcel map shall be filed with, and approved by, the Department of Public Works and recorded with the Orange County Recorder. 3. Garfield Avenue and Beach Boulevard shall be dedicated and improved to City standards at the time said parcels are developed. 4. Compliance with all applicable City ordinances. 5. The property shall participate in the local drainage assess- ment district at the time said parcels are developed. 6. A copy of the recorded parcel map shall be filed with the Planning Department. 7. The proponent shall comply with all conditions imposed upon Use Permit 77-56 pertaining to reciprocal easements over and across this property as well as the property to the north for access. 8. The CC&R's for the subject development shall be submitted to the Huntington Beach Planning Department, Department of Public Works, and City Attorney's office for review prior to the recordation of the tentative parcel map. 10. This approval shall in no way affect the amount of signs to be allowed on the property. Signing shall be granted only under a planned sign program for the shopping center; and no parcel created by this division of land shall be granted its individual freestanding sign, but shall parti- cipate in the overall master sign program. AYES: PALIN, CROSBY, BEHRENS NOES: NONE ABSENT: NONE USE PERMIT NO. 77-67 Applicant: Patscheck-Veiga Construction Co. To permit construction of a duplex dwelling unit on an arterial street pursuant to Section 9201.4(a) of the Huntington Beach Ordinance Code, located on the northwest intersection of Warner Avenue and Green Street in an R3, Medium -High Density Residential District. This request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Ray Patscheck was present at the meeting. The plan was reviewed by the Board, with emphasis on architectural treatment and access and turning radius into the garages. ON MOTION BY BEHRENS AND SECOND BY PALIN USE PERMIT NO. 77-67 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL- LOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received and dated July 19, 1977, shall be the approved layout, subject to the modi- fications described herein: a. The drive shall be located a minimum of four (4) feet westerly to accomplish a 25-foot turning radius into the garages. b. The plan shall be modified to delineate the most easterly portion of the drive area on the submitted plan as landscaping, through the relocation of the drive apron as noted in (a) above and as outlined on the approved plan. The revisions as described above shall be delineated on the plan submitted to the Department of Building and Community De- velopment upon application for building permits. NOTE: The stair treatment and the tapered architectural treatment have been expressly reviewed and approved by the Board. However, the applicant is given the option of either retaining or eliminat- ing said architectural treatment on either side of the garages. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; • Lot area; . Lot width and lot depth; . Type.of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Board of Zoning Adjustments August 3, 1977 Page 5 ADMINISTRATIVE REVIEW NO. 77-129 Applicant: Barton Development Company To permit the construction of a 60,000 square foot industrial building and warehousing facility pursuant to Section 9530 of the Huntington Beach Ordinance Code, located on the east side of Gothard Street approximately 1000 feet south of Edinger Avenue in an Ml, Light Manufacturing District. This request is covered by Negative Declaration No. 77-90. Vice-chairman Palin opened the public hearing on the Negative Declaration. Richard Stenton was present to represent the appli- cation. There being no persons present to address the environmental effects of the subject project, the public hearing was closed. Jim Palin noted that review of prior actions on subject property had revealed that the mini -warehouse to the south had been condi- tioned upon approval to provide reciprocal access and parking with the total property, of which the subject request is a part. The applicant said he had no knowledge or record or such easements or reciprocal parking. After discussion of the previous appli- cations processed on the site, applicant was requested to submit a copy of his preliminary title report. The Board reviewed the proposed construction on the site, dis- cussing the number and layout of the buildings, the overhead doors and how noise effects upon the abutting residential units which might result from those doors could be mitigated, and whether the access points indicated upon the plan could be allowed. After extensive review it was the consensus that this request should be continued and that the following additional information is required: Applicant shall submit the preliminary title report and a section showing the grade differential between his property and the rail- road property at the rear of the lot; Bruce Crosby will ascertain what the position of the Department of Public Works will be on the curb cuts; and the staff will further investigate past actions on the site. Jim Palin reported that a request has been received from the applicant for a one week's continuance on this application. ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 77-132 WAS CONTINUED TO THE MEETING OF AUGUST 10, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, BEHRENS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 77-133 Applicant: Foxx Development Corporation To permit the construction of two (2) single-family dwellings pursuant to Section 9354.16 of the Huntington Beach Ordinance Code, located on the east side of 18th Street at the northeast corner of 18th and Pecan Avenue in the Townlot Specific Plan Area One, Section A. Jim Palin reported that a request has been received from the applicant for a one week's continuance on this application. ON MOTION BY BEHRENS AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 77-133 WAS CONTINUED TO THE REGULAR MEETING OF AUGUST 10, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, BEHRENS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 77-135 Applicant: Aezel Construction Corporation To permit the construction of two (2) single-family dwellings pur- suant to Section 9354.16 of the Huntington Beach Ordinance Code, located on the east side of 14 th Street approximately 100 feet south of Pecan Avenue in the Townlot Specific Plan Area One, Sec- tion A. ON MOTION BY PALIN AND SECOND BY BEHRENS ADMINISTRATIVE REVIEW NO. 77-135 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received and dated July 20, 1977, shall be the approved layout, subject to the modi- fication described herein: a. A three (3) foot maintenance easement shall be shown for the zero construction on both the main building and garages. Proof of such easement shall be submitted prior to issuance of building permits. In its approval action, the Board of Zoning Adjustments considered the followinq issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. All applicable fees shall be paid prior to issuance of building permits. 3. In accordance with City standards and requirements, an additional two and one-half (2-1/2) feet of right-of-way on the alley shall be dedicated.
