Applicant: Erik Lundquist
To permit the addition of one dwelling unit to a site having an
existing unit abutting an arterial highway pursuant to Section
9401.4(a) of the Huntington Beach Ordinance Code, located on the
south side of llth Street at the intersection of llth and Lake in
an R3, Medium -High Density Residential District.
This request is a Categorical Exemption, Class III, California
Environmental Quality Act, 1970.
John Cope informed the Board that there is a deficiency in the pro-
posed garage setback. The applicant has determined to file for a
conditional exception to permit this variance, and has asked for a
week's continuance on this request.

Gothard Street approximately 1000 feet south of Edinger Avenue in
an Ml, Light Manufacturing District.
This request is covered by Negative Declaration No. 77-90.
John Cope opened the public hearing on the Negative Declaration.
Richard Stenton was present to represent the application. The
Board reviewed the information contained in the negative declara-

tion request and considered mitigating measures applicable to
the project. There being no persons present to address the Board
in regard to the request, the public hearing was closed.
ON MOTION BY COPE AND SECOND BY BEHRENS THE BOARD, HAVING FOUND
THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EF-
FECT UPON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION
NO. 77-90 WITH THE MITIGATING MEASURES NOS. B1 THROUGH B7 IMPOSED
UPON THE ADMINISTRATIVE REVIEW, BY THE FOLLOWING VOTE:

Mr. Stenton informed the Board that he had not been able to obtain
a preliminary title report as previously requested, but that there
are no remaining easements on the subject site. He also reported
that a field survey has indicated a grade differential between the
floor elevations of his proposed building and the top of the rail-
road track bed of approximately four (4) feet with the property
elevation being the lower.
The Board considered the orientation of Building B in regard to this
grade differential, considering that the elevation, distance from
property line, the wall, and a restriction requiring the overhead
doors at the rear of this building closed except when actually in
use would serve to buffer noise generated by the project.
Tentative signing plans are that each tenant will be given a 1 x 6
foot sign picking up colors from the building. Also reviewed were
drive access and landscaping.

B. GENERAL CONDITIONS:

k' 1. If the developer proposes to provide air conditioning, the
insulation in ceilings and exterior walls shall be a mini-
mum of R-19 and R-11, respectively. If no air conditioning
is to be provided, the insulation in ceilings and exterior
walls shall be a minimum of R-13 and R-7, respectively.
2. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
3. Energy -saving lighting, such as High pressure sodium vapor
lamps, shall be used in parking lots.
4. Crime prevention techniques shall be applied to the design
of the project (e.g., single -cylinder locks, etc.).
5. Low -volume heads shall be used on all spigots and water
faucets.
6. All holding tanks for toilet facilities shall be equipped
I for a capacity of 3.5 gallons if such facilities are avail-
able at the time of construction.
7. The overhead doors at the rear of the buildings, abutting
the residential property, shall remain closed except when
in actual use for loading -unloading purposes.

Environmental Quality Act, 1970.
Rick Nowling was present at the meeting.
John Cope pointed out to the Board that the proposal involves
revision to a prior approval, and that the project is already in
the ground based upon that prior approval. Revisions involve no
change in the footprint other than elimination of some wing walls;
major changes in the front elevation have been made. The Board
reviewed the revised plan and the prior conditions; it was the
consensus that maintenance easements should be added to the approval.

ADMINISTRATIVE REVIEW NO. 77-133 (Cont. from 8-3-77)
Applicant: Foxx Development Company
To permit the construction of two (2) single-family dwellings pur-
suant to Section 9354.16 of the Huntington Beach Ordinance Code,
located on the east side of 18th Street at the northeast corner of
18th and Pecan Avenue in the Townlot Specific Plan Area One, Sec-
tion A.
This request is a Categorical Exemption, Class III, California
Environmental Quality Act, 1970.
Rick Nowling was present at the meeting.
The applicant informed the Board that on this project also the
slab is already poured and the plumbing in the ground; however, the
work has been done in conformance with the original approval. The
Board discussed the purpose of the present application, and it was
determined that AR 77-133 could be withdrawn and revised floor plans
and elevations submitted under the prior application with an accom-
panying letter of explanation.

To permit the construction of a 28,075 square foot commercial com-
plex pursuant to Section 9472 of the Huntington Beach Ordinance
Code, located at the southeast corner of Center Drive and Gothard
Street in a C4, Highway Commercial District.
This request was covered by Negative Declaration No. 76-52, approved
for this project by the Environmental Review Board on June 22, 1976
John Cope opened the public hearing on the Use Permit. Earl Welk
And the project's architect were present at the meeting. There
being no one present to address the Board on the subject project,
the public hearing was closed.
Board review found the project to be in compliance with code require-
ments except for a shortage of approximately 2000 square feet of
landscaping and the width of the drive approaches. Applicants
i were also notified of the need for preparing a signing program for
the total center.

CONDITIONAL EXCEPTION NO. 77-42
Applicant: Robert L. Atkins
To permit location of three (3) support posts for a patio structure
within the required ten (10) foot side yard setback in lieu of
Section 9103.2.2 of the Huntington Beach Ordinance Code, located
at the northeast corner of Woodboro Drive and Oldglen Street in an
R1, Low Density Residential District.
This request is a Categorical Exemption, Class III, California
Environmental Quality Act, 1970.
John Cope opened the public hearing. Dorothy Atkins and Michael
Schiller were present at the meeting and pointed out which portions
of the proposed structure had already been built before the need
for the variance was discovered. There being no other persons to
address the Board in regard to the proposal, the public hearing was
closed.
The Board reviewed the layout of the property and the siting of the
unit thereon, the materials to be used in the patio and the fencing,
the height of the perimeter wall, and possible alternate locations
for the posts.
ON MOTION BY COPE AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO.
77-42 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY
THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The unusual size and configuration of subject site, which is a
reverse corner lot with a rear property line dimension of
59.24 feet (approximately 6 feet less than normal for such lot),
impose certain constraints on the property and is found to be
sufficient justification of hardship for qranting of this
variance.
2. The proposed encroachment by the three supporting posts will not
be detrimental to properties in the immediate vicinity.
3. The applicant is willing and able to carry out the intentions
for which subject variance has been granted.

Applicant: W. Sterling Buck & Associates
To permit construction of a fourteen (14) unit apartment building
pursuant to Section 9202.3.1.3 of the Huntington Beach Ordinance
Code, located on the west side of Holly Street approximately 335
feet south of Garfield Avenue in an R3, Medium -High Density Resi-
dential District.
This project is covered by Negative Declaration No. 75-73, adopted
by the Board of Zoning Adjustments on November 26, 1975.
John Cope opened the public hearing. Paul La Porte was present to
represent the application. No one was present to speak for or
against the subject project, and the public hearing was closed.
John Cope pointed out that a recent change of zone on the property
to R2, Medium Density Residential, will result in a reduction of
at least two units in the project. He suggested that the appli-
cant reassess his proposal to conform to present zoning.

Ordinance Code, located northerly from the west end of Schleicher
Drive approximately 630 feet west of Goldenwest Street in an
RA-O-CD, Residential -Agricultural, Civic District combined with Oil
Production.
This request is covered by Negative Declaration No. 77-92.
John Cope opened the public hearing on the negative declaration.
Jay Panchal was present at the meeting; lie explained the present
use of the property and indicated that there are no plans for de-
velopment of which he is aware. The public hearing on the nega-
tive declaration was closed.
The Board discussed the legal status of Schleicher Road for provid-
ing access to these parcels, and also noted that the northerly lot
would become a landlocked parcel unless some provision is made for
access from Schleicher across the southe-rly lot. After extensive
discussion it was the Board's determination that no action could
be taken until documentation is submitted on the Schliecher access

across the southerly parcel.

as possible through locating of windows, use of finish materials,
and colors.

Board review found no deficiency in the plans. John Behrens pointed
out that in the construction of this project and the preceding one
it will be necessary to take extra precautions when the slabs are
cut for the interior modifications that the moisture barrier not be
damaged.
