This request is a Categorical Exemption, Class V, California Envir- onmental Quality Act, 1970. John Cope opened the public hearing. Erik Lundquist was present at the meeting. There being no one present to address the Board in regard to this project, the public hearing was closed. Board review took into consideration the prior lot split on the property and possible alternate orientation of the unit on the lot. ON MOTION BY BEHRENS AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 77-44 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. Special circumstances existing on the subject property pose certain developmental constraints on the site: namely, a prior lot split has deprived the site of the original access to an alley which was previously afforded it; the lot split has also resulted in an unusual ratio of lot width to lot depth on the subject site; and there is a significant grade differ- ential on the property. 2. The reorientation of the project on the site to comply with the setback requirement would severely and negatively impact the ability to comply with open space requirements. Minutes, H.B. There is a garage presently existing on the site at a ten (10) foot setback to serve the existing dwelling unit, and revision to provide the required setback would necessitate significant alteration to that existing dwelling and garage. 4. Granting of the variance does not constitute the granting of any special privilege on the property. CONDITIONS OF APPROVAL: 1. The conceptual site plan received and dated August 3, 1977, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: . Traffic circulation and drives; . Parking layout; • Lot area; • Lot width and lot depth; • Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. CE 77-44) (Cont. from 7-10-77) Applicant: Erik Lundquist To permit the addition of one dwelling unit to a site having an existing unit abutting an arterial highway pursuant to Section 9401.4(a) of the Huntington Beach Ordinance Code, located on the south side of llth Street at the intersection of llth and Lake in an R3, Medium -High Density Residential District. This request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. John Cope opened the public hearing. Erik Lundquist was present at the meeting. There being no one present to speak for or against the proposed project, the public hearing was closed. Board review found the request to be in compliance with code requirements and the variance allowed by the conditional exception. ON MOTION BY BEHRENS AND SECOND BY CROSBY USE PERMIT NO. 77-65 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: BZA 8-17-77 Page 2 Minutes, H.B. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: 1. The conceptual site plan received and dated July 11, 1977, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: . To permit division of one 5-acre parcel of land into two (2) separate parcels pursuant to Section 9921 of the Huntington Beach Ordinance Code, located northerly from the west end of Schleicher Drive approximately 630 feet west of Goldenwest Street in an RA-O-CD, Residential -Agricultural, Civic District combined with Oil Production. There being no persons to address the Board in regard to the nega- tive declaration, the public hearing was closed. Jay Panchal was present at the meeting and submitted a revised parcel map which depicts the requested access easement across Parcel 2; he also said that the title company had expressed willing- ness to guarantee that Schleicher Road is a public street and can provide permanent access from Goldenwest Street to the subject property. The applicant indicated his receipt of and concurrence with the suggested conditions of approval forwarded to him pre- viously and agreed to added conditions in regard to the access easements. ON MOTION BY COPE AND SECOND BY CROSBY THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EF- FECT UPON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 77-92 BY THE FOLLOWING VOTE: AYES: COPE, CROSBY, BEHRENS NOES: NONE ABSENT: NONE ON MOTION BY COPE AND SECOND BY CROSBY TENTATIVE PARCEL MAP NO. 77-28 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF THE PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received and dated August 12, 1977, shall be the approved layout. 2. A parcel map shall be filed with and approved by the De- partment of Public Works and recorded with the Orange County Recorder. 3. Water Supply shall be through the City of Huntington Beach water system at the time said parcels are developed. 4. Sewage disposal shall be through the City of Huntington Beach sewage system at the time said parcels are developed. 5. All utilities shall be installed underground at the time said parcels are developed. 6. Compliance with all applicable City ordinances. 7. Prior to approval and recordation of a final parcel map on this property, evidence shall be submitted to the Planning Department demonstrating access to Parcels 1 and 2 over Schleicher Road from Goldenwest Street. This evidence may be some type of recorded instrument or a written guarantee from the applicant's title company that such access exists. The applicant shall also supply the Planning Department with a copy of the recorded document providing an access easement across Parcel 2 to Parcel 1, as indicated on the approved plan. AYES: COPE, CROSBY, BEHRENS NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 77-2 Applicant: Perpetual Income Equities To permit the continued use of an existing service station without the required trash enclosure in lieu of Section 9481.9 of the Huntington Beach Ordinance Code, located at the southwest corner of Goldnewest Street and Edinger Avenue in a C2, Community Business District. This request is a Categorical Exemption, Class V, California En- vironmental Quality Act, 1970. John Cope opened the public hearing. Melvin Levine was present to represent the applicant. He indicated that neither use gener- ates a large amount of trash, one or two plastic bags per week being ample to dispose of that amount which is generated. There being no other persons to speak for or against the proposal, the public hearinq was closed. The Board reviewed the types of use on the location and considered the difficulty of locating a standard trash enclosure outside the building. ON MOTION BY COPE AND SECOND BY BEHRENS CONDITIONAL EXCEPTION NO. 77-2 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. This particular service station has a unique and special type of use in that it constitutes two separate business enter- prises, both of which have been approved by the City in the past. Board of Zoning Adjustments August 17, 1977 Page 6 One is a self-service station which does not generate as much trash as a normal station use; the other is a specialized tuneup operation which also generates less trash than normal. 2. The method of trash disposal proposed by the applicant has been in use for some time and has obviously not proven to be detrimental to surrounding businesses. 3. The applicant has agreed that both the service station opera- tion and the Instatune use shall provide a minimum of two (2) 32-gallon metal trash containers with metal lids, which shall be stored within the lube bay portion of the Instatune build- ing. Violation of that condition will render the approval of this conditional exception null and void. CONDITIONS OF APPROVAL: 1. The plan and proposal submitted and dated January 4, 1977, shall be the approved project, subject to the modification outlined below: a. The service station operation and the Instatune use shall provide a minimum of two (2) each 32-gallon metal trash containers with metal lids, which shall be stored within the lube bay portion of the Instatune building. Violation of this condition will render the approval of this condi- tional exception null and void. Pierce To permit a reduction in the minimum open space dimension from the required fifteen (15) feet to eleven (11) feet for a total of sixteen feet of the rear yard setback in lieu of Section 9103.3.1.1.3 of the Huntington Beach Ordinance Code, located on the north side of Westcliff Drive approximately 340 feet east of Charwood Lane in an R1, Low Density Residential District. This request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. John Cope opened the public hearing. Richard Pierce was present at the meeting. There being no one to address the Board in regard to this project, the public hearing was closed. Board of Zoning Adjustments August 17, 1977 Page 7 011 MOTION BY BEHRENS AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 77-43 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The subject property is developed with generally larger than normal side yard setback with a minimum dimension in the rear width of eleven (11) feet and a length of forty-five (45) feet. There are other side yards also larger than normal. 2. A precedent exists for granting an exception of this nature within the requested limits of the proposal. 3. A substantial amount of open space area will remain on the property, although not quite meeting the dimension require- ments. 4 Granting of this exception will not be materially detrimental to the health, safety, or welfare of persons working or residing in the vicinity. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The site plan received and dated July 27, 1977, shall be the approved layout. 2. Sullivan To permit construction of a wrought iron and pilaster six (6) foot fence at the front property line in lieu of Sections 9103.1 and 9104 of the Huntington Beach Ordinance Code, located on the west side of Graham Street approximately 230 feet south of Fern - hill Circle in an R1, Low Density Residential District. This request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. John Cope opened the public hearing. William Sullivan was present at the meeting. Board of Zoning Adjustments August 17, 1977 Page 8 The Board discussed with the applicant the proposed height of the fence, materials to be used, opening device on the gate, and treatment of the south property line to provide compatibility and continuity with the front fence. ON MOTION BY COPE AND SECOND BY BEHRENS CONDITIONAL EXCEPTION NO. 77-45 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The property abuts an arterial highway and will eventually be directly adjacent to a City park, which would encourage physical trespass and loss of privacy. 2. Construction of this nature would permit the property owner to maintain both security and privacy of his property while still providing visibility and view through the wrought iron fencing. 3. A fence of this nature has been interpreted by the Board as carrying out the intent of the ordinance code. 4. Granting of this request will not be materially detrimental to the health, safety, or welfare of persons residing or work- ing in the vicinity. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The site plan received and dated August 9, 1977, shall be the approved layout. 2. The mechanical gate facility shall be radio controlled. 3. The wall on the south property line shall have a pilaster/ wrought iron design identical with that proposed on the front property line. Said wall shall extend back from the front property line for a linear distance of 2316" to provide a visual cutoff from the park and to provide contin- uity in design with the front wall. 4. Ortlieb To permit installation of a stereo service, sales, and repair use in an existing service station facility pursuant to Section 9472.1 of the Huntington Beach Ordinance Code, located on the northwest corner of Beach Boulevard and Heil Avenue in a C4, Highway Business District. This request is a Categorical Exemption, Class I, California Environmental Quality Act, 197Q. John Cope opened the public hearing. Henry Ortlieb was present at the meeting. There being no persons present to speak for or against the proposal, the public hearing was closed. The Board reviewed deficiencies on the plan with the applicant, pointing out the following areas of concern: the drive access off Beach and the most easterly access on Heil should be deleted; the pump island on Beach Boulevard should be removed from the plan; the parking layout must be depicted on the plan; the landscaping must be increased to comply with code; the trash enclosure loca- tion is not shown; and the existing sign pole, if it is to be retained, should be delineated on the plan with the surrounding proposed landscaping shown. After discussion, it was the consen- sus that a revised plan should be submitted, reflecting the above. ON MOTION BY COPE AND SECOND BY BEHRENS USE PERMIT NO. 77-69 WAS CONTINUED TO THE MEETING OF AUGUST 24, 1977, WITH THE CONCURRENCE OF THE APPLICANT, BY THE FOLLOWING VOTE: AYES: COPE, CROSBY, BEHRENS NOES: NONE ABSENT: NONE USE PERMIT NO. 77-70 Applicant: Taco Bell To permit construction of a 542 square foot addition to a commer- cial structure (said addition to encroach nine (9) fegt into the required 50-foot front setback with the additional landscaping), pursuant to Section 9472 of the Huntington Beach Ordinance Code, located on the east side of Beach Boulevard approximately 1320 feet south of Warner Avenue in a C4, Highway Commercial District. This request is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. John Cope opened the public hearing. Yolanda Stewart was present to represent the applicant. Board of Zoning Adjustments August 17, 1977 Page 11 USE PERMIT NO. 77-71 Applicant: Ring Brothers Corporation To permit construction of: 1) a 3550 square foot addition to an existing building and 2) a 4000 square foot new building within an existing shopping center pursuant to Section 9472.1 of the Huntington Beach Ordinance Code, located on the east side of Beach Boulevard approximately 120 feet north of Terry Drive in a C4, Highway Commercial District. This request is covered by Negative Declaration No. 77-12, adopted by the Board of Zoning Adjustments on February 24, 1977. John Cope opened the public hearing. Marty Schulken was present to represent the application. He indicated that the main changes proposed will be visual, presenting a new facade, and a decrease in the requested retail space. There being no other persons to address the Board in regard to this project, the public hearing was closed. Board review ensued, taking into consideration the present and future uses on the site, parking location, and access to the build- ings. John Cope noted that openings on the east side of the structures must be very carefully controlled to prevent noise in- trusion on the abutting residential properties. It was the consen- sus that limiting exits on that side to emergency and employees only and having the rear parking designated for employees only would help to alleviate that problem. The unemployment office was considered to present special problems which should be handled separately by the Board. ON MOTION BY COPE AND SECOND BY BEHRENS USE PERMIT NO. 77-71 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan received and dated July 29, 1977, shall be the approved layout, subject to the modi- fication described herein: a. Upon application for building permits the plan shall designate the location of employee parking for all the uses on the site. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: • Traffic circulation and drives; . Parking layout; . Lot area; . Lot width and lot depth; • Type of use and its relation to property and improvements in the immediate vicinity; • Past administrative action regarding this property. 2. Access to the building housing the Department of Employ- ment office shall be subject to the approval of the Board of Zoning Adjustments. 5. McGarrigle To permit construction of a 25,200 square foot industrial building pursuant to Section 9511 of the Huntington Beach Ordinance Code, located on the northwest corner of Chemical Lane and Business Drive in an M1-A, Restricted Manufacturing District. This request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. W. J. McGarrigle was present at the meeting. BZA 8-17-77 Page 12 Minutes, H.B. Board of Zoning Adjustments August 17, 1977 Page 13 John Cope pointed out some technical deficiencies in the plan - i.e., one parking space will have to be d6leted to provide an adequate radius turn, and the setback from the cul-de-sac is in- sufficient. The Board discussed alternative ways of handling the deficiency in setback; this could be accomplished either by providing an offset in the building at the location of the en- croachment or filing for a conditional exception to permit the encroachment into the fifteen -foot required setback from the curb line. The plan could also be reversed to eliminate the problem, but the applicant indicated that this would lessen the efficiency of his truck access locations. After extensive discussion it was determined that the application could be conditioned to pro- vide adequate setback and the applicant could pursue which method he will use to obtain it. ON MOTION BY COPE AND SECOND BY BEHRENS ADMINISTRATIVE REVIEW NO. 77-143 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan received and dated August 3, 1977, shall be the approved layout, subject to the following: a. The plan submitted to the Department of Building and Community Development upon application for building permits shall comply with code requirements for land- scaping and setbacks. NOTE: The Board has expressly reviewed and approved the provision of the 48 parking spaces indicated upon the plan. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: • Traffic circulation and drives; . Parking layout; . Lot area; . This request is a Categorical Exemption, Class III, California En- vironmental Quality Act, 1970. Barbara Ash was present to represent the applicant. Board review included the alley dedication and setback and the location of the garages and trash areas on the property. ON MOTION BY BEHRENS AND SECOND BY COPE ADMINISTRATIVE REVIEW NO. 77-144 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan received and dated August 4, 1977, shall be the approved layout, subject to the following: a. If the property directly across the alley from Lot 22 of subject site is vacant, the garage setback on Lot 22 shall be as shown on the 8-4-77 plan. If the adjacent property across the alley is developed, the garage on Lot 22 shall set back an additional two (2) feet from the alley right-of-way line (916" setback). b. The garages shall be constructed at the zero lot line between Lots 20 and 22 and the trash enclosures placed on the opposite side of the garage for each lot. The plan submitted to the Department of Building and Community Development upon application for building permits shall have the above modifications delineated thereupon.
