R. Peterson To permit the construction of a new single-family dwelling and a one -bedroom apartment on a site having two existing apartment units pursuant to Section 9161.4(2) of the Huntington Beach Ordinance Code, located at the southwest corner of Indianapolis Avenue and Florida Street in the Oldtown Specific Plan district. This request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Jim Palin reopened the public hearing. No one was present to address the Board on this request, and the public hearing was closed. Mr. Palin reported that the applicant has requested an indefinite continuance on this item to permit plans to be finalized. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 77-57 WAS CONTINUED WITH THE STIPULATION THAT THE PUBLIC HEARING ON THE REQUEST SHALL BE READVERTISED BASED ON SUBMITTAL OF REVISED PLANS, TO A DATE UNCERTAIN, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, QUINLAN NOES: NONE ABSENT: NONE Minutes, H.B. Board of Zoning Adjustments September 14, 1977 Page 2 USE PERMIT NO. 77-77 Applicant: Dollar Rent a Car To permit establishment of a car and truck rental agency pursuant to Section 9472 of the Huntington Beach Ordinance Code, located on the east side of Beach Boulevard extending from the corner of Beach and Blaylock Drive to approximately 250 feet northerly thereof in a C4, Highway Commercial District. This request is a Categorical Exemption, Class I, California En- vironmental Quality Act, 1970. Jim Palin opened the public hearing. Jim Maxwell was present at the meeting to represent the application, explaining that the use had been cited because no authorization had been issued for the truck rentals and because there had been encroachment of the dis- play area beyond the legal setback limit. There being no other persons to address the Board in regard to this project, the public hearing was closed. Board review considered the difficulty of developing the subject site, the signing for the use, and the applicant's expressed willingness to correct the setback violation. The Board instructed the proponent that some modification to the sign area might be required to comply with code provisions. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 77-77 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL- LOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plan received and dated August 30, 1977, shall be the approved layout, with the stipulation that BZA 9-14-77 Page 2 1 Minutes, H.B. Board of Zoning Adjustments September 14, 1977 Page 3 any vehicles over six (6) feet in height shall be dis- played behind the sight angle line as delineated thereon. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: . Traffic circulation and drives; Parking layout; Lot area, width, and depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. All applicable fees shall be paid prior to issuance of building permits. B. GENERAL CONDITIONS: 1. The signing on the property shall be in compliance with provisions of the ordinance code in effect at the time of this approval. AYES: PALIN, CROSBY, QUINLAN NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 77-47 Applicant: James W. Moore To permit a ten (10) foot reduction in required driveway width in lieu of Section 9206.9 of the Huntington Beach Ordinance Code, located on the south side of Holt Avenue approximately 50 feet east of Parkside Lane in an R3, Medium -High Density Residential District. This request is a Categorical Exemption, Class V, California Envir- onmental Quality Act, 1970. Jim Palin opened the public hearing. Mr. Moore was present at the meeting and outlined for the Board his efforts to obtain concur- rence from the adjacent property owner for reciprocal easements be- tween the two properties. There being no other persons present to address the Board, the public hearing was closed. The Board, after reviewing the proposal, determined that it would still be preferable to obtain a 20-foot access, and the applicant concurred to a continuance to permit City staff to attempt to con- tact the adjacent property owner and explain the advantaqes to both properties which the reciprocal easement would provide. Board of Zoning Adjustments September 14, 1977 Page 4 ON MOTION BY PALIN AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 77-47 WAS CONTINUED WITH THE CONCURRENCE OF THE APPLICANT TO THE MEETING OF SEPTEMBER 28, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, QUINLAN NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 77-36 Applicant: Emerald Engineering To permit a one -parcel parcel map to create a legally divided lot pursuant to Section 9921 of the Huntington Beach Ordinance Code, located on the southeast corner of Milo and Blanton in an R3, Medium -High Density Residential District. This request is covered by Negative Declaration No. 77-104. Don Baker was present at the meeting. The Board discussed with the applicant the present configuration of the property and the date the property was originally divided into that configuration. Jim Palin explained to Mr. Baker that, if the conveyance took place prior to 1957, a parcel map is not required; however, if the convey- ance occurred after 1957, it is not a legal division of land and the layout will have to be amended to include the property at the corner of Lynn and Milo as Parcel 2. This two -parcel division of land would then legally create both parcels at the same time. Mr. Baker questioned the need for this procedure, stating that he has previously processed one -parcel lot splits under identical circumstances. The Board discussed whether or not there has been any use permit filed for the proposed development on the subject parcel, noting that there is no record of any use permit having been processed for the development on the Lynn Street parcel. Extensive review followed, and the Board determined that a title report should be submitted establishing the date of the original conveyance of the property. ON MOTION BY PALIN AND SECOND BY CROSBY TENTATIVE PARCEL MAP NO. 77-36 WAS CONTINUED AT THE REQUEST OF THE APPLICANT TO THE MEETING OF SEPTEMBER 21, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, QUINLAN NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 77-164 Applicant: Daniel B. Lewis To permit the construction of an 11,500 square foot tilt -up industrial building pursuant to Section 9511 of the Huntington BZA 9-14-77 Page 4 Minutes, H.H. Board of Zoning Adjustments September 141 1977 Page 5 Beach Ordinance Code, located on the east side of Connector Lane approximately 400 feet south of Engineer Drive in an MI -A, Restricted Manufacturing District. This request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Daniel Lewis was present at the meeting. Jim Palin informed hinq that there is a discrepancy in dimensions between the site plan and the legal description of the property which -will have to be corrected by noting on the plan the true recorded property dimen- sions. Other areas of concern were pointed out to the proponent, including striping of the parking, trash areas, setback requirements, and rooftop mechanical equipment screening. He was informed of the need for the site plan to reflect the location of the conduit for cable television facilities. ON MOTION BY PALIN AND SECOND BY QUINLAN ADMINISTRATIVE REVIEW NO. 77-164 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan received and dated September 6, 1977, shall be the approved layout, subject to the fol- lowing: a. The setback on the interior side yard, if adjacent to an already constructed or approved for construction project with open yard area at that location, may be a six {6} or eight (8) inch setback. If not adjacent to such project, the building must be constructed at zero setback. The modification described above shall be delineated, if nec- essary, upon the plan submitted to the Department of Building and Community Development upon application for building permits. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: . Traffic circulation and drives; Parking layout; . Lot area; . AYES: PALIN, CROSBY, QUINLAN NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 77-37 Applicant: Panchal Engineering Inc. To permit consolidation of eight (8) lots into one parcel pursu- ant to Section 9921 of the Huntington Beach Ordinance Code, located on the west side of Green Street approximately 221 feet north of Pearce Street in an R2, Medium Density Residential District. This request is a Categorical Exemption, Class V, California Ev- vironmental Quality Act, 1970. Bill Wonacott was present to represent the application; he indi- cated his receipt of and concurrence with the suggested conditions of approval previously forwarded to the applicant. The Board reviewed the layout, noting that the conditions will have to be amended to require specific dedication and improvement on the access easements to be provided at both the northerly and southerly property lines. Bruce Crosby informed the applicant that dedication and improvement will be immediately required on the north easement, but that an offer of dedication can be made for the south easement and rejected by the City Council until such time as the access is actually needed, when it will be picked up by the City. Mr. Wonacott concurred with the amendment to the conditions. ON MOTION BY PALIN AND SECOND BY QUINLAN TENTATIVE PARCEL MAP NO. 77-37 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Depart- ment on September 7, 1977, shall be the approved layout. 2. A parcel map shall be filed with, and approved by, the De- partment of Public Works and recorded with the Orange County Recorder. 3. Green Street and the southerly four (4) feet of the alley on the northerly property line between subject property and TT 9635 shall be dedicated and improved to City stand- ards at the time said parcel is developed. 3ZA 9-14-77 Page 6 L1 Minutes, H.B. Board of Zoning Adjustments September 14, 1977 Page 7 The northerly fourteen (14) feet of the access easement at the southerly property line of subject property shall be dedicated to City standards at the time said parcel is developed. 4. Water supply shall be through the City of Huntington Beach water system at the time said parcel is developed. 5. Sewage disposal shall be through the City of Huntington Beach sewage system at the time said parcel is developed. 6. All utilities shall be installed underground at the time said parcel is developed. 7. Compliance with all applicable City ordinances. S. The property shall participate in the local drainage assess- ment district at the time said parcel is developed. 9. A copy of the recorded parcel map shall be filed with the Planning Department. AYES: PALIN, CROSBY, QUINLAN NOES: NONE ABSENT: NONE MISCELLANEOUS AGENDA ITEMS: USE PERMIT NO. 77-71 Applicant: Ring Brothers Corp. Revised site plans to comply with previously imposed conditions of approval for: 1) a 3550 square foot addition to an existing build- ing and 2) a 4000 square foot new building within an existing shopping center located on the east side of Beach Boulevard approxi- mately 120 feet north of Terry Drive in a C4, Highway Commercial District. Board review of the plans found that they substantially complied with the conditions imposed upon the use permit. Chuck Burney noted that when the parking is striped at the rear of the building it must be done in a manner which will preclude parked autos from blocking the rear exit doors. ON MOTION BY CROSBY AND SECOND BY PALIN THE REVISED SITE PLANS RECEIVED AND DATED SEPTEMBER 14, 1977, WERE APPROVED, BY THE FOLLOW- ING VOTE: AYES: PALIN, CROSBY, QUINLAN NOES: NONE ABSENT: NONE BZA 9-14-77 Page 7 Minutes, H.B. Board of Zoning Adjustments September 14, 1977 Page 8 USE PERMIT NO. 77-75 (Reconsideration) Applicant: Ronald B. Jessner To permit construction of a 16-unit apartment complex pursuant to Section 9161.4 of the Huntington Beach Ordinance Code, located on Hess Circle at the end of the cul-de-sac approximately 300 feet north of Utica Avenue in an R2, Medium Density Residential District. Mike Halley and Ron Jessner were present at the meeting and requested that the Board reconsider this use permit, citing their failure to receive the prior notice of the meeting on September 7. The Board had at that meeting continued their request to the October 51 1977, meeting. ON MOTION BY PALIN AND SECOND BY CROSBY THE BOARD DETERMINED TO RECONSIDER ITS PRIOR ACTION, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, QUINLAN NOES: NONE ABSENT: NONE The Board discussed the legality and prior conveyance of the build- ing site, the drainage for the property, and how access for emergency equipment will be provided. When he submits a revised plan the applicant was also requested to submit the following: 1) grading plan for the site; 2) rough sketch showing location and footprint of the houses to the east, so that the effect of the pro- posed tennis court can be determined and methods of buffering con- sidered; 3) east/west sections through the property showing what is proposed for the retaining wall and pad height elevations; 4) eleva- tion of the property to the south and the proposed elevation of the property to the north. On the grading plan, the applicant was instructed to attempt to coordinate his plan with what is proposed to the south. Mr. Jessner submitted a rough revised plan for the Board's considera- tion. This plan will be reviewed by Planning and other involved departments, and the applicants will be present at the BZA staff review meeting at 9:30 a.m. Monday, September 19, to discuss the project prior to submitting their revised plans. ON MOTION BY PALIN AND SECOND BY QUINLAN USE PERMIT NO. 77-75 WAS CONTINUED TO THE MEETING OF SEPTEMBER 28, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, QUINLAN NOES: NONE ABSENT: NONE BZA 9-14-77 Page 8 Minutes, H.R. Board of Zoning Adjustments September 14, 1977 Page 9 TEMPORARY SIGN REQUEST Applicant: Vendome Liquors To permit two (2) grand opening banners and some pennants to be installed for a period of thirty days for the Vendome Liquor store located on the west side of Magnolia Street south of Gar- field Avenue in an existing shopping center. The request was reivewed by the Board.
