Applicant: Emerald Engineering
To permit a one -parcel parcel map to create a legally divided
parcel pursuant to Section 9921 of the Huntington Beach Ordinance
Code, located at the southeast corner of Milo and Blanton in an
R3, Medium -High Density Residential District.
This request is covered by Negative Declaration No. 77-103.
Jim Palin reported that research has found that the original divi-
sion of this property was accomplished by conveyances in 1946 and
1958 under County auspices and prior to enactment of any county
subdivision regulations. The area was annexed to the City in 1966.
The office of the City Attorney has determined, therefore, that a
parcel map for the establishment of a legal parcel is not required
at this time. The applicant has been notified of these findings
and has concurred with the withdrawal of the applicRtion.

Applicant: Shell Oil Company
To permit construction of a storeroom addition to an existing
service station facility pursuant to Section 9472 of the Hunting-
ton Beach Ordinance Code, located on the northwest corner of
Goldenwest Street and Edinger Avenue in a C4, Highway Commercial
District.
This request is a Categorical Exemption, Class I, California En-
vironmental Quality Act, 1970.
Jim Palin opened the public hearing. No one was present to repre-
sent the application or to address the Board in regard to the
proposal. The public hearing was closed.
Board review ensued, noting particularly that placement of the
landscape planters as shown would interfere with onsite circulation.
ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 77-78 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW-

Board in regard to the proposal, the public hearing was closed.
The request was reviewed by the Board.

ADMINISTRATIVE REVIEW NO. 77-167 (In Conj./UP 77-80)
Applicant: J. J. Byron
To permit construction of a 12, 260 square foot industrial build-
ing pursuant to Section 9511 of the Huntington Beach Ordinance
Code, located on the west side of Industry Lane approximately 120
feet north of Research Drive in an M1-A, Restricted Manufacturing
District.
This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
J. J. Byron was present at the meeting.
Board review found the plan to be in compliance with code require-
ments except for a shortage of 100 square feet in the required
landscaping, which must be provided when the applicant applies for
permits.
ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO.
77-167 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING

south of Palm Avenue in the Townlot Specific Plan Area One, Sec-
tion B.
This request is covered by Negative Declaration No. 77-106.
Jim Palin opened the public hearing on ND 77-106. Jorge Alvarez
was present at the meeting. The Board reviewed the information
contained in the negative declaration request form and considered
mitigation measures applicable to the project. There being no
persons to address the Board on this matter, the public hearing
was closed.
ON MOTION BY PALIN AND SECOND BY QUINLAN THE BOARD, HAVING FOUND
THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE
EFFECT UPON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION
NO. 77-106 WITH THE MITIGATING MEASURES NOS. B-1 THROUGH B-7

Bruce Crosby noted that the City does not have alley dedication
across the alley from Lot 21 of this request; this dedication will
have to be acquired or the plot plan amended to provide the neces-

B. GENERAL CONDITIONS:
1. If the developer proposes to provide air conditioning,
the insulation in ceilings and exterior walls shall be a
minimum of R-19 and R-11, respectively. If no air condi-
tioning is to be provided, the insulation in ceilings and
exterior walls shall be a minimum of R-13 and R-7,
respectively.
2. Natural gas and 220V electrical shall be stubbed in at the
locations of clothes dryers.
3. Natural gas shall be stubbed in at the locations of cook-
ing facilities, water heaters, and central heating units.
4. Low -volume heads shall be used on all spigots and water
faucets.
5. All holding tanks for restroom facilities shall be equipped
for a capacity of 3.5 gallons if such facilities are avail-
able at the time of construction.

6. Crime prevention techniques shall be applied to the
design aspects of the project (e.g., single -cylinder
locks, etc.).
7. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be
disposed of at an offsite facility equipped to handle
them.

and Ronald Drive in a C4, Highway Commercial District.
This request is a Categorical Exemption, Class V, California En-
vironmental Quality Act, 1970.
James Lange and Gary Jones were present to represent the applica-
tion. They indicated their receipt of and concurrence with the
suggested conditions of approval previously forwarded to them.
Jim Palin reviewed the history of the subject site, informing the
Board that this request was filed in compliance with previously
imposed conditions of approval.
ON MOTION BY PALIN AND SECOND BY QUINLAN TENTATIVE PARCEL MAP NO.
77-38 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING

Gene Kermin was present at the meeting and discussed with the
Board the reasons for the tentative map and the requirement for
participation in the drainage assessment district, particularly
the method used in computing the square footage on which charges
are based. After these were explained by the Board, he concurred
with the suggested conditions of approval previously forwarded to
him.

To permit construction of two (2) multi -tenant industrial build-
ings with total square footage of 21,450 feet pursuant to Section
9511 of the Huntington Beach Ordinance Code, located at the
southwest corner of Graham Street and Oceans Street in an M1-A,
Restricted Manufacturing District.
This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
Rod Chamberlain was present at the meeting.
Secretary Palin reviewed the history of this site for the Board's
information. The parcel is a part of the three -parcel TPM 77-19
and was included in composite form on the site plan -submitted -for
AR 77-101 and AR 77-158 which 'have been previously approved. The
composite site plan was required in order to ensure that proper
circulation, points of access, and reciprocal easements were
obtained.
The Board reviewed the application for compliance with the require-
ments placed on the prior applications for reciprocal easements
and circulation. Also considered in detail was the parking pro-
vided, particularly on the rear where parked automobiles or trucks
might block access to the building openings on that wall. Chuck

Burney noted that the Fire Department would probably take access
to the site from the front entry. Bruce Crosby cautioned the
proponent that the 25-foot drive approaches must be increased to
35 feet.
ON MOTION BY PALIN AND SECOND BY QUINLAN ADMINISTRATIVE REVIEW
NO. 77-165 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL-
LOWING VOTE:

1. The conceptual plan received and dated September 8, 1977,
shall be the approved layout, subject to the modifications

a. A two-way drive with a minimum width of twenty (20)
feet shall be provided to the south of Building No. 2
b. The eight (8) parking spaces provided to the rear of
Building No. 1 shall not be considered to satisfy the
requirements of Article 979, and a minimum of three
(3) additional parking spaces shall be provided onsite.
The modifications described above shall be depicted upon the
plan submitted to the Department of Building and Community De-
velopment upon application for building permits.
In its approval action, the Board of Zoning Adjustments considered

facturing District.
This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
Donald Penkoff was present at the meeting.
The Board reviewed the request, pointing out to the applicant
that he could probably reduce the width of the central drive pro-
vided to serve both buildings, thereby allowing him to obtain
increased square footage in the structures and increase the effi-
ciency of his layout. The drive width could be reduced to a total
of thirty-five (35) feet, half on each side of centerline.

ADMINISTRATIVE REVIEW NO. 77-168
Applicant: David L. Levinson
To permit construction of a single-family dwelling pursuant to
Section 9354.16 of the Huntington Beach Ordinance Code, located
at the northeast corner of Acacia Avenue and 18th Street in the
Townlot Specific Plan Area One, Section A.
This request is a Categorical Exemption, Class III, California
Environmental Quality Act, 1970.
David Levinson was present at the meeting.
Jim Palin noted that the plan is 190 square feet over the allowed
footage in the Townlot, and the Board discussed with the appli-
cant the timing of the ordinance which will effect changes in the
Specific Plan. The Board also discussed setbacks and the require-
ment for a maintenance easement at the zero property line.

CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plan received and dated September 13,
1977, shall be the approved layout, subject to the fol-
lowing:
a. The elevations of the structure shall comply with the
elevations submitted for the treatment along Acacia
Avenue.
In its approval action, the Board of Zoning Adjustments considered
the following issues in relation to the conceptual plan:
. Lot area;
• Lot width and depth;
. Type of use and its relation to property and improvements in the
immediate vicinity;
. Past administrative action regarding this property.
2. All applicable fees shall be paid prior to issuance of
building permits.
3. In accordance with City standards and requirements, an addi-
tional two and one-half (2-1/2) feet of right-of-way on
the alley and a twenty (20) foot radius at the corner of
18th and Acacia Shall be dedicated.
B. GENERAL CONDITIONS:
1. This application shall become null and void should the
pending ordinance to effect changes in the requirements of
the Townlot Specific Plan fail to become effective.
2. Evidence of the authorization to construct the garage at
zero setback and the granting of a maintenance easement on
the abutting property shall be submitted to the Building
Department concurrently with application for building
permits.
If the above evidence cannot be submitted for the record,
this approval shall become null and void.

MISCELLANEOUS AGENDA ITEMS:
ADMINISTRATIVE REVIEW NO. 77-155 (Revised Plan)
Applicant: URO Huntington Beach
To review a revised plan for a 34,679 square foot industrial
building located at the southwest corner of Graham Street and
Argosy Drive in an M1-A, Restricted Manufacturing District.
Secretary Palin noted that, although this plan was submitted to
comply with prior conditions of approval, he is not satisfied with
the one-way drive between the building and the Graham Street
right-of-way line. It was his feeling that less adverse effects
would result both onsite and in the general area by providing two
access points on Argosy Drive and deleting this easterly one-way
drive. After extensive discussion and review of the approvals
granted to the north of the site, it was the consensus of the Board
that the previous conditions of approval should be revised.
ON MOTION BY PALIN AND SECOND BY QUINLAN THE CONDITIONS OF APPROVAL
FOR ADMINISTRATIVE REVIEW NO. 77-155 WERE REVISED AS FOLLOWS, BY
THE FOLLOWING VOTE:
REVISED CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The revised plan received and dated September 16, 1977,
shall be the approved layout, subject to the following:
a. The proponent may be permitted to have an additional
drive opening on Argosy Drive. Such driveway open-
ing shall be a minimum of 150 feet from the ultimate
right-of-way line on Graham Street to the centerline
of said drive; this drive shall be posted "Exiting -
Right Turn Only."
b. The one-way drive shown on the easterly side of the
building shall be dliminated and the area incorporated
into landscaping.
c. The plan shall be revised to reflect the same setback
from the ultimate right-of-way line on Graham Street
at the southerly common access drive as :he previously
approved project to the south (AR 77-98). A triangular
reciprocal easement on subject property shall be shown
to the same point and depth on the common property line
as that conditioned on AR 77-98.
2. All other applicable conditions previously imposed shall
continue to apply.
