COMMISSIONERS PRESENT: Finley, Gibson, Slates, Newmam, Hoffman COMMISSIONERS ABSENT: Stern, Shea CONSENT CALENDAR: ON MOTION BY NEWMAN AND SECOND BY FINLEY THE MINUTES OF SEPTEMBER 7, 1977, AND SEPTEMBER 20, 1977, WERE APPROVED BY THE FOLLOWING VOTE: AYES: Finley, Gibson, Slates, Newman, Hoffman NOES: None ABSENT: Stern, Shea ORAL COMMUNICATIONS: None SCHEDULED ITEMS: AMENDMENT TO THE TAYLOR-AND BEACH SPECIFIC PLAN NEGATIVE DECLARATION 77-112 The specific plan area is 80 acres bounded by Talbert Avenue on the north, Beach Boulevard on the east, Taylor Drive on the south, and Southern Pacific Railroad on the west. Chairman Slates stated that Commissioner Stern had recommended that the item be continued. He further stated that Commissioner Stern had submitted a plan as a possible alternative. Chairman Slates reopened the public hearing. Ron Russell addressed the Commission and stated that he had spoken with Ralph Leyva, Traffic Engineer, and found that no study has been made on the tract relative to impact of additional traffic. He felt that such a study should be made. He objected to a street coming up to an intersection against a park site. He requested a continuance to allow time for a.,traffic study to be made. Paul Heartquist addressed the Commission. He stated that he had talked to a great many residents of the area and had come to the conclusion that they are opposed to a through street from Talbert to Taylor and a street adjacent to the park. He was not opposed to a street'from Talbert to Taylor in a broken up fashion to make it difficult to use as a through -street. He also asked for a continuance, He was in opposition to a street adjacent to the park and a straight through __ street. Minutes: H.B. Planning Commission Tuesday, October 4, 1977 Page 2 George Chelius, representing the industrial group on Redondo Circle, addressed the Commission and suggested alternatives. He suggested that a street go down to the park and then turn in to the Foxx development with the reason being that it would provide some buffer with the setback for the whole industrial area and no new residents of the area would be faced with having,to back up to an industrial site. He also proposed that if there has to be residential development in this area that the residential area have requirements for setbacks with greenbelt. Elinor Mattson addressed the Commission concerning the traffic study and requested that a study be made of industrial traffic in the area. Ron Lazar addressed the Commission and discussed the problems which exist between industrial developers and residents in the area. He stated that he felt the Commission should study all alternatives. The public hearing was closed. Chairman Slates requested the Traffic Engineer and Planning staff to review the plans presented by Mr. Heartquist. He further stated that he felt the staff should closely study the need for a street from the north. ON MOTION BY SLATES AND SECOND BY FINLEY AMENDMENT TO THE TAYLOR AND BEACH SPECIFIC PLAN/NEGATIVE DECLARATION 77--112 WAS CONTINUED TO OCTOBER 18, 1977, TO ALLOW STAFF TO REVIEW COMMENTS AND PROPOSALS AND TO ALLOW TIME FOR A TRAFFIC REPORT TO BE MADE BY THE ENGINEERING DEPARTMENT BY THE FOLLOWING VOTE: AYES: Finley, Gibson, Selich, Newman, Hoffman NOES: None ABSENT: Stern, Shea TENTATIVE TRACT NO. 9653/NEGATIVE DECLARATION NO. 77-64 Applicant: Foxx Development Corporation This is a request for a 6 lot subdivision on property located on the west side of Delaware 660 feet + south of Yorktown. Chairman Slates stated that he would abstain since Mr. Foxx was his tenant. Jim Patin stated that he had no information to add to that contained in the staff report. Jim Foxx addressed the Commission and stated that he would be glad to answer any questions the Commission might have. Commission discussion ensued. Planning Commission Tuesday, October 4, 1977 Page 3 ON MOTION BY GIBSON AND SECOND BY NEWMAN TENTATIVE TRACT NO. 9653 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: FINDINGS: The Planning Commission of the City of Huntington Beach does hereby find that the proposed subdivision, along with its design and improve- ments, is consistent with general and specific plans for the area in that: 1. The proposed subdivision of this 2.2+ acre parcel of land zoned R2, which allows 15 units per gross acre, is proposed to be constructed having 15.2 units per gross acre upon the five lots proposed for residential development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation for this type of housing. 3. The property was previously studied for this intensity of land use at the time the land use designation for medium density •residential was placed on said property. 4. The lot size, depth, frontage, street widths, and all other design and improvements features of the proposed subdivision are proposed to be constructed in compliance with standard plans and speci- fications on file with the City, as well as in compliance with the State Map Act and supplementary -City Subdivision Ordinance. CONDITIONS OF APPROVAL: 1. The map received and dated September 9, 1977 shall be the approved layout for this 6-lot subdivision. 2. A drainage system for the subdivision shall be approved by the Department of Public Works prior to or concurrently with approval of a grading plan, and/or recordation of a final map whichever occurs sooner. This system shall be designed to provide for sil- tation and erosion control both during and after construction of the project. This system shall provide for a temporary facility in Delaware Street and a permanent underground pipe facility to extend from the pond area along the westerly portion of the property across subject property to Delaware Street. There shall also be adequate swales maintained during the time of construction to assure that construction of this project does not create additional ponding which may flood the surrounding property. 3. The top five (5) feet of soil upon lots 1-5 shall be removed to allow for recompaction. When such soil has been excavated, the City shall be notified of such removal to allow an evaluation of the remaining fill soil for a possible further excavation and re - compaction below five (5) feet. -3- 10/4/77 - PC .A Minutes: H.B. If the developer proposes to provide air conditioning, the insulatio in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insula- tion in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 6. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 7. An engineering geologist shall be engaged to submit a report indi- cating the ground surface acceleration from earth movement for the .project property. 8. All structures proposed for construction within this subdivision shall be constructed in compliance with the g-factors as indicated by the geologist's report. 9. Calculations for footings and structural members to withstand antici- pated g-factors shall be submitted to the City for review. 10. The structures on subject property, whether attached or detached, shall be constructed in compliance with the State acoustical stand- ards set forth for all units that lie within the 60 CNEL contours of the property. 11. Crime prevention techniques should be applied to the design aspects of the project (e.g., single -cylinder locks, etc.) 12. Low -volume heads shall be used on all spigots and water faucets. 13,. All holding tanks for restroom facilities shall be equipped for a capacity of 3.5 gallons if such facilities are available at the time of construction. AYES: Finley, Gibson, Newman, Hoffman NOES: None ABSTAIN: Slates ABSENT: Stern, Shea ZONE CHANGE NO. 77-23 Applicant: Emerald Engineering This is a request for a change of zone from R5 and R5-0 to Oldtown Specific Plan - District Two or R-2. At the Planning Commission meeting of September 29, 1977 the Commission approved the "Q" suffix for this zone change which will enable the Commission to condition the zone change. -4- 10/4/77 - PC 1 Minutes: H.B. Commissioner Finley stated that while she agreed with this modi- fication she did object to expanding the boundaries of Oldtown Specific Plan. She felt that if we use those standards it should be done by ordinance and not the "Q" Zone. Ross Ivey addreysed the Commission and stated that he lived in a single family home among apartments and would hate to see more apartments. ON MOTION BY GIBSON AND SECOND BY NEWMAN ZONE CHANGE 77-23 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: FINDINGS: 1. The residential zoning is consistent with the land use desig- nation of the City's General Plan. 2. The subject properties are not suitable for development under their present zoning. CONDITIONS OF APPROVAL: 1. Each lot shall have a minimum size of 3,000 square feet and shall be less than 6,000 square feet. 2. Only one (1) single family dwelling shall be constructed on each lot. 3. Building designs including building footprints, building elevations and floor plans shall be submitted for review at the same time the tentative tract is reviewed and approved for development. 4. Zone Change No. 77-23 will become null and void if all of the above conditions are not executed within an 18 month period after its adoption. Huntley and James Allen This is a request for a change of zone from R5 to R2 at property located at 7792 Warner,(on the south side of Warner between Ash and Oak). John Cope briefly discussed this application and the property as it presently exists'. It was the staff's recommendation that a change from R5 to "Q" R2 be approved so that it could be conditioned to mitigate potential adverse effects. A vugraph was presented. The public hearing was opened. Tom Huntley, one of the applicants, addressed the Commission and stated that it would not be economically feasible to cut the number of lots from 5 to 4. He requested that the Commission approve the R2 zone. He discussed the conditions in the staff report. The public hearing was closed. Commission discussion ensued. ON MOTION,BY NEWMAN AND SECOND BY GIBSON NEGATIVE DECLARATION NO. 77-86 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Finley, Gibson, Slates, Newman, Hoffman NOES: None ABSENT: Stern, Shea ON MOTION BY SLATES AND SECOND BY NEWMAN ZONE CHANGE NO. 77-15 WAS DENIED BECAUSE THE PROPERTY IS NOT SUITED FOR R2 AND THE APPLICANT DID NOT AGREE TO COMPLY WITH THE "Q" ZONING BY THE FOLLOWING VOTE: AYES: Finley, Gibson, Slates, Newman, Hoffman NOES: None ABSENT: Stern, Shea ZONE CHANGE NO. 77-17 Applicant: Classic Development Corporation This is a request for a change of zone from M1 to R2 on property located at 7550 Ellis Avenue west of Huntington Street. A vugraph was presented. John Cope stated that he had no information to add to that contained in the staff report. He advised the Commission that Commissioner St had suggested that the request should be continued to allow time for restudying the area and possibly retaining the M1 zoning. 1 r -6- 10/4/77 - PC Minutes: H.B. Planning Commission Tuesday, October 4, 1977 Page 7 The public hearing was opened. Morrie Nickle addressed the Commission in behalf of Classic Develop- ment. He requested that the Commission take action rather than con- tinue. Dennis Graham, homeowner in an adjacent area, questioned the impact future residential development would have on the schools. Commissioner Finley requested information on the underpass to Ellis and was advised by Mike Zambory that within two or three weeks they will be calling for bids. Further Commission discussion ensued. ON MOTION BY HOFFMAN AND SECOND BY NEWMAN ZONE CHANGE NO. 77-17 WAS APPROVED WITH THE FOLLOWING FINDINGS AND WITH THE RECOMMENDATION THAT THE SECOND READING OF THE ORDINANCE BE WITHHELD BY THE CITY COUNCIL UNTIL SUCH TIME AS AN APARTMENT COMPLEX DEVELOPMENT HAS BEEN APPROVED BY THE CITY BY THE FOLLOWING VOTE: 1. The Land Use Element of the General Plan designates the subject property as medium density residential. Therefore, the requested R2 zoning (medium density residential) is consistent with and actually implements the General Plan designation. 2. The resulting residential uses will be more compatible with the —` existing residential uses to the immediate east and north. AYES: Gibson, Slates, Newman, Hoffman NOES: Finley ABSENT: Stern, Shea Commissioner Finley stated that she voted against the zone change for the same reason she voted against the General Plan Amendment. Chairman Slates stated that if the zone change is approved by the City Council he felt that any plans for development should be reviewed by the Planning Commission prior to the hearing by the Board of Zoning Adjustments. LOCAL COASTAL PROGRAM WORK PROGRAM The staff requested review and comment on draft Local Coastal Program Work Program document that specifies issues to be addressed, major work tasks to be completed, and costs to be incurred in complying with requirements of the California Coastal Act of 1976 for the preparation of Local Coastal Program. Monica Florian addressed the Commission and stated that no action was required by the Commission on this item. -7- 10/4/77 - PC Minutes: H.B. Chairman Slates directed the staff to prepare a letter for his Signature to the City Council stating that the Commission did not review the Local Coastal Program Work Program as a body but individually. Should the Council wish Commission action on this item, please so direct. Mike Zambory stated that there were right-of-way problems which were causing projects to be split up with long delays. He was requested to report back on the possibility of installing a stop sign on Heil to facilitate pedestrian traffic. ON MOTION BY SLATES AND SECOND BY FINLEY THE STAFF WAS DIRECTED TO INCLUDE A FEASIBILITY REPORT ON CHANGING THE ZONING IN THE GOTHARD CORRIDOR FROM M1 TO M1-A IN THE PACKETS OF OCTOBER 14 FOR DISCUSSION AT JOINT CITY COUNCIL/PLANNING COMMISSION MEETING OF OCTOBER 17, 1977, WITH THE STAFF DIRECTED TO SET THE CHANGE OF ZONE FOR PUBLIC HEARING AT THE PLANNING COMMISSION MEETING OF OCTOBER 18, 1977, BY THE FOLLOWING VOTE: AYES: Finley, Gibson, Slates, Newman, Hoffman NOES: None ABSENT: Stern, Shea STAFF' S COMMENT: Secretary Selich stated that -there will be a public hearing on the General Plan Amendment 77-2 at the City Council meeting of October 17, 1977, which will be preceded by a joint City Council/Planning Commission meeting.
