K. Earl Corporation To permit the reduction of the minimum commercial parking stall width from 9'0" required to 8'6" for interior stalls and from 1210" required to 1116" for end stalls in lieu of Section 9791(d) and to permit the reduction in the total number of parking spaces provided from 247 required to 222 in lieu of Section 9793.1(c) of the Huntington Beach Ordinance Code, located on the south side of Edinger Avenue approximately 150 feet west of Parkside Lane in a C2, Community Business District. This request is a Categorical Exemption, Class V, California En- vironmental Quality Act, 1970. Jim Palin reopened the public hearing on the Conditional Excep- tion. John Gray was present to represent the request. There being no one present to address the Board either in favor or in opposition to the request, the public hearing was closed. Board review ensued, taking into consideration the amount of square footage which will be devoted to storage only. ON MOTION BY BEHRENS AND SECOND BY PALIN CONDITIONAL EXCEPTION NO. 77-48 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: Minutes, H.B. Board of Zoning Adjustments October 12, 1977 Page 2 FINDINGS OF THE BOARD: 1. The strict application of ordinance code requirements for parking is found to be excessive in this case, due to the use of a significant portion of the structure for storage and filing purposes. The Board therefore finds that provision of one parking space per 1000 feet of storage area (8.6 spaces) is adequate for that portion of the structure. 2. Granting of the Conditional Exception will not be materially detrimental to the public welfare or injurious to property in the same zone classification. 3. Granting of the Conditional Exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: 1. The conceptual site plan received and dated September 8, 1977, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: • Traffic circulation and drives; . Parking layout; . Lot area; . This request is covered by Negative Declaration No. 77-109. Jim Palin opened the public hearing on the negative declaration request. The Board reviewed the information in the request form and considered mitigating measures applicable to the project. ON MOTION BY PALIN AND SECOND BY BEHRENS ADMINISTRATIVE REVIEW NO. 77-166 WAS ADOPTED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received and dated September 8, 1977, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: • Traffic circulation and drives; . Parking layout; • Lot area; . Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. GENERAL CONDITIONS: 1. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a mini- mum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 6. If lighting is included onsite, "spillage" of light into ad3acent areas shall be avoided by the use of low -intensity lighting and/or shields added to lighting fixtures. The most energy -efficient light sources available that can pro- vide an aesthetically effective level of illumination shall be selected (e.g., high-pressure sodium vapor or metal halide lighting). 7. Inside buildings, the most energy -efficient means of light- ing, heating, and cooling interior spaces shall be used. Hoffman To permit the construction of a 5,000 square foot industrial build- ing pursuant to Section 9511 of the Huntington Beach Ordinance Code, located on the north side of McFadden Avenue approximately 400 feet east of Gothard Street in an Ml, Light Industrial District. This request and the tentative parcel map filed in conjunction, TPM 77-40, are covered by Negative Declaration No. 77-111. The public hearing on the negative declaration was opened. Frank Hoff- man Jr. and Frank Hoffman III were present at the meeting. The Board reviewed the information contained in the negative declara- tion request and considered mitigating measures applicable to the project. There being no one present to address the Board in regard to this matter, the public hearing was closed. ON MOTION BY PALIN AND SECOND BY CROSBY THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT UPON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 77-111 WITH THE MITIGATING MEASURES CONTAINED IN CONDITIONS C-1 THROUGH C-4 IMPOSED ON THE ADMINISTRATIVE REVIEW, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, BEHRENS NOES: NONE ABSENT: NONE The revised plan was found to be in compliance with code provisions as required at the prior hearing. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received and dated October 12, 1977, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: . Traffic circulation and drives; • Parking layout; . The parcel map for this site shall reflect the true offset easement for ingress/egress, as shown and amended upon the approved site plan received October 12, 1977. 3. The easements for signalization at this location on McFadden Avenue shall be shown upon the final parcel map to be recorded for this site. 5. A landscaping and irrigation plan shall be submitted to the Department of Building and Community Development concur- rently with application for building permits. 6. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Trees shall be installed with a minimum size of fifteen (15) gallons along the westerly property line. C. GENERAL CONDITIONS: 1. Thompson, Jr. To permit construction of a 55,066 square foot industrial build- ing pursuant to Section 9511 of the Huntington Beach Ordinance Code, located on the south side of Argosy Drive approximately 1143 feet west of Graham Street in an Ml-A, Restricted Manufacturing District. This request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Mr. Thompson, Greg Joyce, Willard Walters, and John Bowler were present to represent the application. Bruce Crosby reported that review of the parcel map for this property shows that the subject site does abut residential uses and will have to maintain the required forty-five (45) foot set- back per code requirement. The Board informed the applicant of his option to file a conditional exception to waive that require- ment if he so desires. Board review also considered the configura- tion of the reciprocal access from Argosy Drive and the request of the applicant to have the parking space requirement computed on a basis of 1/1000 for the actual areas used for warehousing. It was the consensus of the Board that this parking calculation ratio could be allowed. ON MOTION BY BEHRENS AND SECOND BY PALIN ADMINISTRATIVE REVIEW NO. 77-173 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan received and dated September 23, 1977, shall be the approved layout, subject to the modi- fications described herein: 1 BZA 10-12-77 Page 6 1 Minutes, H.B. A reciprocal access easement shall be provided at the east property line of subject property to provide reciprocal access between this site and the site adjacent to the east. Said easement shall be a tri- angular easement with a base of 22'6", penetrating the property to a depth of 45 feet. b. The plan shall depict the required forty-five (45) foot setback from the residential properties abutting at the rear of subject site. The modifications outlined above shall be delineated upon the plan submitted to the Department of Building and Community Development upon application for building permits. AYES: PALIN, CROSBY, BEHRENS NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 77-50 Applicant: Evan James To permit a reduction in the width of a drive abutting a building with openings from 30 feet required to 26 feet provided, in lieu of Section 9517(c) of the Huntington Beach Ordinance Code, located at the northwest corner of Machine Drive and Connector Lane in an M1-A, Restricted Manufacturing District. This request is a Categorical Exemption, Class V, California En- vironmental Quality Act, 1970. Jim Palin opened the public hearing. Evan James and Juergen Lotter were present at the meeting. The applicants had nothing further to add to their request and no persons were present to ad- dress the Board on this matter. The public hearing was closed. BZA 10-12-77 Page 7 Minutes, H.B. Board of Zoning Ad3ustments October 12, 1977 Page 8 Bruce Crosby noted that the drive approach aprons will be required to be a minimum of thirty-five (35) feet, not 25 as indicated on the plan. The Board discussed the basis of the requirement for thirty foot drives when originally written into the code, and reviewed the special circumstances on subject property which 3ustify exception from that requirement. ON MOTION BY PALIN AND SECOND BY NO. 77-50 WAS APPROVED WITH THE BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: CROSBY CONDITIONAL EXCEPTION FOLLOWING FINDINGS AND CONDITIONS, 1. When the provision for the30 foot clear width driveway was drafted into the ordinance code, it did not take into consid- eration the siting of a building with perpendicular parking on the offside of such driveway. 2. Sufficient provision for the maintaining of an unobstructed 20-foot drive width can be afforded through restrictions on the interior of the building for loading -unloading purposes only. 3. Granting of this conditional exception will not be materially detrimental to the public welfare or injurious to property in the same zone classification. 4. Granting of this conditional exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan received and dated September 28, 1977, shall be the approved layout subject to the modifi- cation described herein: a. The interior floor area of the building directly inside the openings shall be striped and posted "loading - unloading only" for a depth of 39 feet of the building. The modification described above shall be delineated upon the plan submitted to the Department of Building and Community Development upon application for building permits. 2. AYES: PALIN, CROSBY, BEHRENS NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 77-51 Applicant: US Life Savings To permit a commercial buiding to encroach by 562 square feet into the required sight angle setback in lieu of Section 9432.8.1 of the Huntington Beach Ordinance Code, located on the southwest corner of Garfield Avenue and Beach Boulevard in a C2, Community Business District. This request is covered by Negative Declaration No. 77-63, previously adopted for the shopping center in which subject request is located. Jim Palin opened the public hearing. John Praisler was present to represent the application. There being no one present to address the Board in regard to this project, the public hearing was closed. Board review ensued. ON MOTION BY BEHRENS AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 77-51 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The intent of the code requirement is satisfied by the siting of the subject building, and strict application of the code require- ment to this property would impose a hardship on the project without any benefit resulting from such action. 2. Granting of the conditional exception does not constitute setting of a precedent, as other encroachments on similar locations have been permitted within the required sight angle area. 3. Granting of the conditional exception will not be materially detri- mental to the public welfare or injurious to property in the same vicinity or in the same zone classification. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan received and dated September 30, 1977, shall be the approved layout. This request is covered by -Negative Declaration No. 77-113. Jim Palin opened the public hearing on the negative declaration. Jack King was present to represent the request. The Board reviewed the information contained in the negative declaration request form; there being no persons present to address the Board in regard to this matter, the public hearing was closed. ON MOTION BY PALIN AND SECOND BY BEHRENS THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 77-113 BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, BEHRENS NOES: NONE ABSENT: NONE The applicant submitted a prior parcel map granted by the City in' 1962 for a four -lot division of land on the sub]ect site. The present request is necessary because this original map was never recorded, and the owners presently desire to convey title separately. Board review considered the legal status of the previous map, the layout of the buildings on the lots, and whether or not required fees had ever been paid. The tentative parcel map received by the Planning Department on September 23, 1977, shall be the approved layout excepting that, if the proponent can obtain concurrence from the owner of the parcel indicated as "Parcel D" on the 1962 parcel map submitted to the Board on October 12, the parcel map may be recorded as a three -parcel map including Parcel D, thereby providing legal separation for that lot as well as the subject properties. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. A copy of the recorded parcel map shall be submitted to the Planning Department. This request is a Categorical Exemption, Class I, California Envir- onmental Quality Act, 1970. No one was present at the meeting to represent the application. It was the consensus of the Board that the proposed dual use of the property and problems related thereto (particularly the swimming pool sales facility on the front of the property) required the pre- sence of the applicant. ON MOTION BY BEHRENS AND SECOND BY PALIN ADMINISTRATIVE REVIEW NO. 77-174 WAS CONTINUED,TO PERMIT APPLICANT TO BE PRESENT AT THE MEETING, TO THE REGULAR MEETING OF OCTOBER 19, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, BEHRENS NOES: NONE ABSENT: NONE BZA 10-12-77 Page 11 Minutes, H.B. Lightner To permit construction of a single-family dwelling pursuant to Sec- tion 9354.16 of the Huntington Beach Ordinance Code, located on the east side of 14th Street approximately 50 feet north of Acacia Avenue in the Townlot Specific Plan Area One, Section A. This request is a Categorical Exemption, Class III, California Ev- vironmental Quality Act, 1970. Tod Schooler was present to represent the applicant. The Board reviewed the site layout and determined that the facilitv as shown was readily adaptable to a two -unit, illegal dwelling in the zoning district. A MOTION WAS MADE BY PALIN AND SECONDED BY BEHRENS TO DENY ADMINIS- TRATIVE REVIEW NO. 77-176. In the following discussion, the applicant explained the owner's planned use of the area over the garage, which is provided with its own separate entry by outside stairway, a separate bath, and wet bar arrangement. Methods of revision to bring the project into compliance with R1 standards were reviewed with Mr. Schooler, and it was deter- mined to permit the applicant time to review his project and submit a revised site plan. ON MOTION BY BEHRENS AND SECOND BY PALIN THE MOTION TO DENY WAS TABLED TO OCTOBER 26, 1977, AT WHICH TIME A VOTE BASED UPON A REVISED PLAN WILL BE TAKEN. The request was reviewed by the Board. ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 77-178 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: 1. Mel Ott reported that the Fire Department has no objections to the project, other than requiring conformity with State Fire Marshal's standards for use of the tent. ON MOTION BY PALIN AND SECOND BY BEHRENS ADMINISTRATIVE REVIEW NO. 77-179 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The site plan and request received and dated October 11, 1977, shall be the approved project. 2. The applicant shall obtain all necessary electrical permits. 3. The project shall comply with all requirements of the State Fire Marshal and all City fire codes, and an onsite inspection by the Fire Department shall be required prior to the event. 4. A certificate of insurance form shall be filed in the License Division of the Finance Department ten (10) days prior to the event.
