ON MOTION BY STERN AND SECOND BY FINLEY, THE CONSENT CALENDAR WAS APPROVED, WITH THE MINUTES OF SEPTEMBER 29, 1977 APPROVED AS AMENDED, BY THE FOLLOWING VOTE: AYES: Stern, Finley, Slates, Newman, Hoffman NOES: None ABSENT: Gibson, Shea ORAL COMMUNICATIONS: None SCHEDULED ITEMS: AMENDMENTS TO TAYLOR/BEACH SPECIFIC PLAN/NEGATIVE DECLARATION NO. 77-112 Ms. Emilie Johnson made the subject presentation. She stated that since the October 4, 1977 public hearing before the Planning Co, -mission, the Department of Public Works conducted a traffic study'and based on this study as well as the Citizen's group meetings, the Planning Staff recom- mends the following: 1. Change the park site configuration to reflect the latest efforts of the City's Department of Recreation, Parks, and Human Services. 2. Bring the land use of the specific plan into conformity with the General Plan. 3. Remove the buffer zone on Taylor Drive from Delaware Street east. Minutes: H.B. Incorporate Precise Plan of Street Alignment No. 74-3,(Redondo Circle) which serves the existing industrial development at Talbert Avenue and the railroad. 5. Extend Redondo Circle 330 feet east to intersect an unnamed north/ south street also being proposed to serve industrial property. 6. Continue plans for the closure of Taylor Drive. These recommendations do not include a proposal for a north/south street. Approval of the above six revisions is based on the following: 1. Recent General Plan revisions to the Land Use Element have mandated changes to the Specific Plan; said Specific Plan hereby reflects those changes. 2. Existing industrial development within the Specific Plan Area mandated revisions to the circulation system within the Specific Plan Area; said Specific Plan reflects these street alignment revisions. 3. Said Specific Plan revisions insure desirable and necessary buffers between the existing and future industrial development and the existing and future residential developments. Viewgraphs were shown and Commission discussion ensued. The Chairman opened the public hearing. Mr. Ron Russell addressed the Commission and thanked them for granting the previous continuance. He further stated that the staff report summarized the meeting held between the homeowners and industrial representative, and that approximately-75 percent of the people in his tract agree with the proposal as outlined by staff. The Chairman closed the public hearing. Planning Commission Tuesday, Oct. 18, 1977 Page 3 ZONE CHANGE NO. 77-10 APPLICANT: DAVID STITZ AND CHARLES STONE A proposal for a change of zone from C4 to R4 located on the north side of Pacific Coast Highway, 200 ft. west of Anderson Street in a C4, Highway Commercial area. The applicant was not present. Mr. John Cope addressed the Commission and stated that the applicant had requested withdrawal of his application. Commission discussion ensued. ON MOTION BY FINLEY AND SECOND BY SHEA, ZONE CHANGE NO. 77-10 WAS WITHDRAWN, PER APPLICANT'S REQUEST, BY THE FOLLOWING VOTE: AYES: Stern, Finley, Slates, Shea, Newman, Hoffman NOES: None ABSENT: Gibson CONDITIONAL USE PERMIT NO. 77-20 APPT,TCANT ! ROT,T.Y PTlT,ASKT & ASS0CTATFS TNC _ This is a request for construction of a women's athletic club located at 16857 Algonquin Arv�# Huntington Beach in a C4, Highway Commercial Area. 154yo.-I' Mr. Cope addressed the Commission and stated that he had no additional input to the staff report presented to Commission. Commissioner Newman questioned why the proposed use has already had their grand opening prior to obtaining approval from the Planning Commission. Mr. Cope answered that the building for the use was already in existence and that the applicant's were allowed to make modifications to the interior at their own risk, pending outcome of Planning Commission meeting. The Chairman opened the public hearing. Mr. Rolly Pulaski, applicant, was present and stated that he was available to answer any questions the Commission may have regarding the proposed project. The Commission had no further questions of the applicant. Mr. Stern stated for the record that the -procedure of this application was a bit awkward and felt that he was being forced into a position. He was hopeful that the Commission and City would not be placed in a similar situation in the future. ON MOTION BY SHEA AND SECOND BY FINLEY, CONDITIONAL USE PERMIT NO. 77-20 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS BY THE FOLLOWING VOTE: -3- PC 10/18/77 Minutes: H.B. The proposed -design and layout of the use will provide for a compatible land use with both existing commercial uses and existing surrounding residential.uses. CONDITIONS OF APPROVAL: 1. "The site plan and floor plans dated September 20; 1977 shall be the approved layout. 2. Fire safety systems shall be subject to review and approval by the Fire Department prior to occupancy of the building. 3. Signing for the use shall be subject to the present requirements of Article 976. CURTIS A proposal to permit the reduction of minumum lot frontage and minimum lot width for cul-de-sac lots located on the east side of Lynn Street, 346 ft. south of, Warner Ave. in an,R-3, Medium -High Residential District. IN, CONJUNCTION WITH: TENTATIVE TRACT NO. 9941 APPLICANT: ROBERT F. CURTIS A proposal for a 10 lot subdivision located on the east side of Lynn Street, 346 ft. south of Warner Ave,. in an R-3, Medium -High Residential District. Mr. Jim Palin stated that the applicant has been working on a more desirable layout. He further stated that the applicant had requested to meet with the Subdivision Committee to further review his revised plan. 1 The,Chairman opened the public hearing., No one was present to speak on the proposal. The applicants represen- tative, Mr.. Hermansen, however, stated he was available to answer any , questions the Commission may have. Planning Commission Tuesday, October 18, 1977 Page 5 ON MOTION BY SHEA AND SECOND BY NEWMAN NEGATIVE DECLARATION NO. 77-23 WAS ADOPTED BY THE FOLLOWING VOTE: AYES: Stern, Finley, Gibson, Slates, Shea, Newman, Hoffman NOES: None ABSENT: None ON MOTION BY SHEA AND -SECOND BY NEWMAN CONDITIONAL EXCEPTION NO. 77-05 AND TENTATIVE TRACT 9941 WERE APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS BY THE FOLLOWING VOTE: FINDINGS OF APPROVAL - CONDITIONAL EXCEPTION NO. 77-05 1. The minor lot width reduction has been necessitated by the combination of the site being located within a problem subdivision area, and the fact that Lynn Street was recently increased from a 50 foot to a 54 foot right-of-way. 2. A reduction is not inconsistent with limitations on surrounding properties, since they also are subject to the constraints of past illegal subdivision activities. 3. The reduction allows for an innovative subdivision that yields less units than a conventional R3 subdivision and therefore, is not materially detrimental to the public welfare or injurious to the properties in the general vicinity. FINDINGS OF APPROVAL - TENTATIVE TRACT 9941 1. The proposed subdivision of this 2.5 acre parcel of land is zoned R3-22 which allows 22 units per gross acre and is proposed to be con- structed having 22 units per gross acre. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of housing. 3. The property was previously studied for this intensity of lane] use at the time the land use designation for Medium High Density Resi- dential was placed upon said property. 4. The lot, size, depth, street width, and all other desi:Yn improve- ment features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifications on file with the City, as well as in compliance with the State Map Act and supplemental City ordinances. -5- PC 10/18/77 Minutes: H.B. Planning Commission Tuesday, October 18, 1977 Page 6 CONDITION OF APPROVAL - CONDITIONAL EXCEPTION NO. 77-05 1. The site plan received and dated June 8, 1977, shall be the approved plan for type and location of all structures. CONDITIONS OF APPROVAL - TENTATIVE TRACT 9941 1. 'Tentative Map 9941 received and dated June 8, 1977 shall be the approved layout. 2. Sewer and water main systems shall be installed in Lynn Street from Warner Avenue south to the southerly boundary of the proposed subdivision. 3. A minimum of a 12 foot travel lane on each side of the centerline of Lynn Street shall be constructed by the developer from Warner Avenue to the northerly boundary of the -subdivision. Such con- struction shall be in compliance with the standard plans and specifications of the Department of,Public Works. 4. Detailed plans for the treatment within the cul-de-sac shall be submitted to the Planning Department for review and approval action prior to issuance of building permits. 5. Plans for the private patio walls on "A" Street shall be submitted to the Planning Department for approval action. Such plans shall indicate the type of material and design of the walls of private yard areas on lots 2, 3, 8, and 9. 6. Drainage for the subdivision shall be approved by the Department of Public Works prior to recordation of,a final map. This system shall be designed to provide for siltation and erosion control both during and after construction of the project. 7. If the developer proposes to provide,air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-ll,,respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall,be a minimum of R-13 and R-7, respectively. 8. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers. 9. Natural gas shall be stubbed in at the locations of coo,-ing facilities, water heaters, and central heating units. 10. Low volume heads shall be used on all spigots and water faucets. 11. All holding tanks for restroom facilities shall be equipped for a capacity of 3.5 gallons if such facilities are available at the time of construction. 12. Crime prevention techniques should be applied to the design aspects of the project (e.g., single -cylinder locks, etc.). -6- PC 10/18/77 I Minutes: H.B. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an, offsite facility equipped to handle them. 14. The structures on subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. 15. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the project property. 16. All structures proposed for construction within this development shall be constructed in compliance with the g-factors as indicated by the geologist's report. 17. Calculations for footings and structural members to withstand anticipated g-factors shall be submitted to the City for review. AYES: Stern, Finley, Gibson, Slates, Shea, Newman, Hoffman NOES: None ABSENT: None TENTATIVE TRACT NO. 9081 APPLICANT: PHILIP & MARIE CURRIE A proposal for a one lot subdivision located on the east side of Florida, 600 feet north of Garfield Avenue in an R3, Medium -High Density Residential District. Mr. Cope addressed the Commission,and stated that he had no further input to the staff report presented to Commission. In answer to a question raised by Commissioner Stern, Mr. Cope stated that the structure was originally built for a condominium conversion in the future. At time of construction, the structure could have been utilized as an apartment complex or as a planned residential development. Commissioner Stern suggested several changes to the conditions of approval, which indicated that the project is constructed. Mr. Ed Ross, agent for the applicant, addressed the Commission and stated that he had no objections to the suggested changes to the conditions of approval as made by Commissioner Stern. Mr. Ross stated that the proposed Tentative Tract had been approved previously and that proceedings for a Final Map had been started, but that the time statute had run out on Tentative Tract 9081, thus.he had to refile, and once again seek approval. Planning Commission Tuesday, October 18, 1977 Page 8 ON MOTION BY SHEA AND SECOND BY NEWMAN, TENTATIVE TRACT NO. 9081 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS AS AMENDED, BY THE FOLLOWING VOTE: FINDINGS: The Planning Commission of the City of Huntington Beach does hereby find that the proposed subdivision, along with its design and im- provements, is consistent with general and specific plans for the area in that: 1. The proposed subdivision of the 1.137 acre parcel of land zoned R3 (which allows 25 units per gross acre) is proposed having only 17.54 units per gross acre. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation for this' type of housing. 3. The property was previously approved for this intensity of land use at the time the land use designation for medium density resi- dential was placed on said property. 4. The parcel size, depth, frontage, street widths, and all other design and improvement features of the proposed subdivision are proposed in compliance with standard plans and specifications on file with the City, as well as in compliance with the State Map Act and supplementary City Subdivision Ordinance. CONDITIONS OF APPROVAL: 1. The tentative map received and-dat,ed September 23, 1977 shall be the approved layout. 2. The sewer, water, and fire hydrant system have been designed to City standards. 3. The water system is through the City of Iuntington Beach's water system. 4. The sewage disposal is through the City of Huntington Beach's sewage system. 5. Planning Commission Tuesday, Oct. 18, 1977 age 9 ISCELLANEOUS: Chairman Slates informed the Commission that he had requested a review of the plot plan for Administrative Review No. 77-180 by the Commission prior to Board action. Mr. Jim Palin presented a plot plan to the Commission -for Administrative Review No. 77-180, a proposal to permit construction of an 18,000 sq. ft. industrial building located on the east side of Gothard Street, approx- imately 625 ft. south of Slater Avenue in an M1-A-15,000 CD Light Industrial Civic District. Mr. Palin explained Board of Zoning Adjustments procedures on subject application and stated that application will be conditioned by the Board to meet ordinance code requirements. He further noted that this partic- ular application will also be reviewed by the Design Review Board, being within the CD District. Mr. Palin requested a special meeting of the Subdivision Committee to further discuss Tentative Tract 9941. Subdivision Committee agreed to meeting. ORAL COMMUNICATIONS: Mr. Bruce Greer addressed the Commission and stated it was his intention to avoid blight in the industrial corridor. He objected to a tin building being moved onto Crystal Street as a permanent use. He further stated that he had brought this situation to the attention of the City Council. George Chelius of the Gothard Industrial Group addressed the Commission and requested that Council and Planning Commission advise future devel- opers of the Gothard Industrial Corridor on how to make their buildings attractive and pleasant. STAFF'S COMMENTS: Director Selich informed the Commission that the City Council has re- quested a special report on Zone Case No. 77-22. He explained that Council is asking the Commission to review its previous decision in light of recent General Plan hearings and to advise Council of its current feelings on the issue. Council is also asking for a similar review of the area immediately to the west of the zone change site. The Commission discussed several areas of concern regarding the zone hange. Commissioner Newman stated that since the rest of the Gothard Corridor would be industrial, this area should probably also stay industrial. -9- PC 10/18/77 Minutes: H.B. Planning Commission Tuesday, October 18, 1977 Page 10 ON MOTION BY STERN AND SECOND BY FINLEY, THE COMMISSION RECOMMENDS TO THE CITY COUNCIL THAT ZONE CHANGE 77-22 BE RECONSIDERED FOR INDUSTRIAL USE. ' , - Commissioner Shea expressed concern that the area had been studied for a year and she saw no new evidence to justify reconsideration. Com- missioner Gibson concurred. Commissioner Finley informed the Commission of testimony given at the Council hearing regarding the City Yard and its impact on surrounding residential uses. Mr. Zambory explained the activities taking place in the Yard that might be objectionable to residents. Commissioners Stern and Gibson asked about potential noise problems and if noise studies had been conducted. Director Selich explained that acoustical studies were being required of the developer. Commissioner Slates stated that sufficient safeguards could be designed into the project and that the problems discussed did not warrant re- consideration. VOTE: AYES: Stern, Finley, Newman, Hoffman NOES: Shea, Slates, Gibson ABSENT: None Commissioner Finley clarified that the Commission is not actually acting on the zone change, but responding to C.ouncil's request as to how they feel since the action taken on the Gothard Corridor. ON MOTION BY STERN AND SECOND BY FINLEY, STAFF WAS DIRECTED TO INFORM CITY COUNCIL THAT THE -PLANNING COMMISSION WOULD RECOMMEND REDESIGNATION OF THE FIVE (5) ACRE SITE ADJACENT TO ZONE CHANGE 77-22 BACK TO INDUSTRIAL ZONING. Commissioner Gibson stated that he felt the action taken on the Gothard Corridor did not change the decision the Commission made on this area.
