COMMISSIONERS PRESENT: Stern, Gibson, Slates, Shea, Newman Commissioner Finley arrived at 7:15 p.m. Commissioner Hoffman arrived at 7:50 p.m. COMMISSIONERS ABSENT: None NOTE: A TAPE RECORDING OF THIS MEETING IS ON FILE IN THE PLANNING DEPARTMENT OFFICE. CONSENT CALENDAR ON MOTION BY STERN AND SECOND BY SHEA THE MINUTES OF NOVEMBER 1, 15, AND 29 WERE APPROVED BY THE FOLLOWING VOTE: AYES: Stern, Gibson, Slates, Shea, Newman NOES: None ABSENT: Finley, Hoffman SCHEDULED ITEMS: GENERAL PLAN AMENDMENT NO. 77-3/ENVIRONMENTAL IMPACT REPORT NO. 77-13 Chairman Slates stated that input on each area of concern would be taken separately along with the action. He then declared the public hearing open. 2.1 - South of Edinger Avenue/West of Bolsa Chica Street This is a request fora. change of designation from commercial to high density residential. The applicant is G.P. Building Enterprises, Inc. The Planning Department recommended a redesignation to high density residential. Gary Potter addressed.the Commission and spoke in favor of the change of designation. Dr. Amy, property owner in the area, addressed the Commission and spoke in_opposition to the change of designation. He felt his property would decrease in value if high density is allowed. He further cited traffic as a problem which would have to be contended with. George Psoras addressed the Commission and stated that he felt the property should remain commercial. Ms. Psoras addressed the Commission and concurred with Mr. Psoras. J. L. Martin addressed the Commission and expressed concern, about parking in the area if it were changed to high density residential. 'Dr. J'. R. Commissioner Finley arrived at 7:15 p.m. ON MOTION BY NEWMAN AND SECOND BY SHEA COMMERCIAL DESIGNATION ON AREA 2.1 WAS RETAINED BY THE FOLLOWING VOTE: AYES: Gibson, Slates, Shea, Newman NOES: Stern ABSTAIN: Finley ABSENT: Hoffman Chairman Slates then declared the hearing open on Area 2.2. 2.2 - North of Indanapolis Avenue/East of Beach Boulevard. This is a request from the Planning Commission to have staff analyze land use potentials for the area. The Planning Department recommended that it retain its commercial designation. There was no one present to speak on this area. The public hearing was closed. Commission discussion ensued. ON MOTION BY SLATES AND SECOND BY SHEA COMMERCIAL DESIGNATION ON AREA 2.2 WAS RETAINED BY THE FOLLOWING VOTE: AYES: Stern, Finley, Gibson, Slates, Shea, Newman NOES: None ABSENT: Hoffman Chairman Slates stated that areas of concern 2.3 and 2.4 have been continued to General Plan Amendment 78-1 and that no public hearing would be held on these items nor any Commission action taken. Area '2.3 is located south of Atlanta/East of Beach Boulevard. It is a request by Sassoon-Mayer Development Company for a change of designation from commercial to high density residental (8.32 gross acres) 1.57 gross acres to remain commercial. Area 2.4 located north of Pacific Coast Highway contains 106.9 gross acres and is a request by Daon for a change of designation from Planning Reserve and medium density residential to low, medium,high density residential, commercial and industrial. Chairman Slates opened the public hearing on Area 2.5. 2.5 - South of Slater Avenue/East of railroad right-of-way. This is a request for a change from industrial to medium density resident The City Council referred this item back to the.Commission because of -2- 12/6/77 - PC Minutes: H.B. Planning Commission Tuesday, December 6, 1977 Page 3 a procedural error. The property contains 18.89 gross acres. The Planning Department's recommendation was to redesignate to medium density residential. Louis Graziadio addressed the Commission and stated that he did not feel the property was suitable for quality industrial development. He gave a brief history of the property. He stated that he planned to build low and moderate income housing. He introduced Mr. Ramella, Mr. Chapman, and Ms. Bppts pt The Center For Planning & Research. Mr. Ramella addressed.the Commission and discussed the proposed change of designation. He presented slides of the area and discussed the topography. Commissioner Hoffman arrived at 7:50 p.m. Mr. John Chapman addressed the Commission and spoke in favor of the redesignation, stating that because of topography, location, and peat problems the property would best be developed as residential. He further discussed the need for low cost housing in Huntington Beach. Ms. Boots Holly ,stated that the City needs more low and moderate income housing as re- flected in the Housing Assistance Plan. -- Mr. Graziadio handed out two letters to the Commission. Gerald Jones addressed the Commission and stated that he felt the site was suitable for an industrial park which would be an economic asset to the City. He felt that residential in an industrial area would create more problems. He further stated that he felt low cost housing should be in a residential area. John Silver addressed the Commission and discussed the problems of schools for children in the area if the property was developed residential. He felt the area should be developed as M-1. Ron Lazar addressed the Commission and spoke in opposition to resi- dential development. Bruce Greer addressed the Commission and spoke against residential. He felt that a redesignation to residential would constitute spot zoning. George Challas spoke in opposition to residential in the area. Dr. James Fell spoke in opposition to residential. Gordon Offstein spoke in opposition, stating that low income housing should be in another area of the community. Van Harrison spoke in favor of retaining the industrial designation. Mark Porter addressed the Commission and spoke in favor of retaining the industrial designation. He requested that the Commission reaffirm previous decision to retain an industrial designation of the property. W. L. ON MOTION BY SHEA AND SECOND BY NEWMAN AREA 2.5 WAS REDESIGNATED TO MEDIUM DENSITY RESIDENTIAL BY THE FOLLOWING VOTE: AYES: Gibson, Slates, Shea, Newman, Hoffman NOES: Stern, Finley ABSENT: None Commissioner Finley discussed the problems with residential adjacent to industrial. She felt that while it might take a long time Area 2.5 should be developed industrial. Commissioner Stern concurred with Commissioner Finley's statement. The Chairman opened the public hearing on Area 2.6. 2.6 - Ministerial item/Timing of General Plan Amendments. This is a ministerial item and proposes that General Plan Amendment dates be scheduled at the beginning of the calendar year by Commission resolution. The staff recommended approval of Item 2.6. There was no one present to speak on this item. The public hearing was closed. Commission discussion ensued. Planning Commission Tuesday, December 6, 1977 Page 5 Chairman Slates called a five minute recess at 8:55 p.m. Commissioner Gibson was excused at this time. PRESENTATION ON OCTD MASTER PLAN REVISIONS. A presentation was given by Bob Hartwig of the Transit District regarding the Master Plan revision process currently underway, the alternatives under consideration and their implications for Huntington Beach. The Master Plan will establish priorities for Community Fixed -Route and Dial -A -Ride service, and will provide long range direction regarding mass transit corridors and the regular fixed route grid bus service. DRAFT FOURTH YEAR HOUSING AND COMMUNITY DEVELOPMENT BLOCK GRANT APPLICATION/NEGATIVE DECLARATION NO. 77-131 Chairman Slates stated that public testimony would be taken at the beginning of the meeting and that discussion by the Commission would take place as the last item on the agenda with a decision to be made at -that time. The public hearing was opened. Gordon Offstein addressed the Commission and stated that he felt it should be incumbent on the City to direct one million dollars expressly for,development of low income housing. Dean Albright, a member of the Citizens Advisory Committee, spoke on -improvements recommended by the Citizens Advisory Committee. The public hearing was closed at that time. When this item came up -for discussion as the last item on the agenda only four Commissioners were present with Commissioners Shea, Finley, and Gibson absent. Commission discussion ensued. A MOTION WAS MADE BY NEWMAN TO APPROVE THE DEPARTMENT HEADS' RECOMMENDATIONS FOR -PRIORITIES. THE MOTION DIED FOR LACK OF A SECOND. A MOTION WAS MADE BY STERN TO APPROVE THE CITIZENS ADVISORY COMMITTEE'S RECOMMENDATIONS FOR PRIORITIES. THE MOTION DIED FOR LACK OF A SECOND. Because of the importance of.discussion on this item, Chairman Slates stated that this item would be continued to an adjourned meeting on December 13, 1977. ADMINISTRATIVE REVIEW NO. 77-113 - APPEAL TO DENIAL BY BOARD OF ZONING ADJUSTMENTS ON NOVEMBER 9, 1977 This is a request to permit the operation of a board and care home to house five (5),mentally disordered adult female persons. Planning Commission Tuesday, December 6, 1977 Page 6 subject property is located at 17832 Queens Lane, approximately 400 ft. north of Slater Avenue in an R3, Medium High Density Residential, district. Dave tadie stated that he had no information to add to that contained in the staff report. The public hearing was opened. Dora Odum, applicant, addressed the Commission and discussed the need for this.type of facility. She stated that it was a place for residents to be rehabilitated so that they could go back into independent living. Sylvester White spoke in favor of the use. Marie Cruise spoke in favor of the use. Dorothy Quick stated that she had worked with the people for approxi- mately five years and was in favor of the use. Lorri Renia spoke in favor of it. Christine Sutt spoke in favor of the use and stated,that the girls are not a threat to the neighborhood. A. Castiano spoke in opposition to this use. Sheril-1 Mallaho stated that the facilities are not of a therapeutic nature as there is no yard nor park nearby. She was opposed to it, and did not feel it was in an appropriate neighborhood. James Hunt addressed the Commission and stated this type of operation constituted the running of a business and does require full time employee on the site. He spoke in opposition to this use and stated that it was not the proper location for the use. The public hearing was then closed. Commission discussion ensued. ON MOTION BY NEWMAN AND SECOND BY SHEA APPEAL TO DENIAL OF ADMINISTRATIVE REVIEW NO. 77-113 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE: 1. The functional aspects of the facility limit the ability to care for the patients on a 24-hour basis, as two separate dwelling units would be utilized without the benefit of immediate supervision by .a house parent in each separate unit. 2. This type of operation constitutes running a business. 3. The level of training of the supervisors is inadequate. -6- 12/6/77 - PC I 1 Minutes: H.B. The intent of the provisions of the ordinance code concerning uses of this kind is to provide a home environment which is healthful and physically safe for the care of persons on a 24-hour basis. A home environment implies continuing, immediate supervision. Since this use is proposed in a four -unit apartment complex of which two units are currently occupied by patients under inter- mediate care, not only is there a lack of a normal home environment, but the placement of 24-hour care patients in the remaining two units would tend to inhibit development of a normal home environ- ment. 5. The high density of'the neighborhood, combined with statistics showing an above -average level of crime in the immediate area (in addition to neighboring property owners' testimony reporting vandalism, etc.) tend to reduce the positive potential for rehabilitation of this type of patient. AYES: Slates, Shea, Newman, Hoffman NOES: Stern, Finley ABSENT: Gibson Commissioner Finley stated that she voted against the motion because she felt that something should be done about this problem. She was concerned because the state law permits this use in residential areas. Commissioner Hoffman was requested to give his professional opinion. He stated that he felt that these people would be better off if hospitalized. Deputy City Attorney Travis stated that state law does require cities to allow this type of use. CONDITIONAL USE PERMIT NO. 77-14/NEGATIVE DECLARATION 77-83 Applicant: Foxx Development Corporation IN CONJUNCTION WITH: TENTATIVE TRACT NO. 8197 Applicant: Foxx Development Corporation Conditional Use Permit No. 77-14 and Tentative Tract 8197 are requests to permit the construction of a 61 unit planned residential development on a 9.45 acre site. The project concept is a single family detached unit with oversized private yard areas clustered around a common open space and recreation area. Chairman Slates stated that he would be abstaining on these items and turned the chair over to Vice Chairman Shea. -7- 12/6/77 - PC Minutes: H.B. Jim Foxx, applicant, addressed the Commission and stated that he had read the suggested conditions and was in agreement with them. Gordon Offstein inquired if anything had been brought to the attention of the City Attorney regarding the subject property. Deputy City Attorney Mark Travis stated that had not been advised by the City Attorney of any matter pertaining to these applications. Jim Foxx stated that nothing had been brought to his attention about any irregularities. The public hearing was closed. Commission discussion ensued. ON MOTION BY HOFFMAN AND SECOND BY NEWMAN NEGATIVE DECLARATION 77-83 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Stern, Finley, Shea, Newman, Hoffman NOES: None ABSENT: Gibson ABSTAIN: Slates ON MOTION BY HOFFMAN AND SECOND BY NEWMAN CONDITIONAL USE PERMIT NO. 77-1 AND TENTATIVE TRACT 8197 WERE APPROVED .WITH THE FOLLOWING CONDITIONS AND FINDINGS BY THE FOLLOWING VOTE: CONDITIONAL USE PERMIT NO. 77-14 FINDINGS: 1. The proposed subdivision of this 9.45 acre parcel of land zoned R-1 (which allows 6.5 units per gross acre) is proposed to be constructed having 6.46 units per gross acre. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation for this type of housing. 3. Planning Commission Tuesday, December 6, 1977 Page 9 CONDITIONAL USE PERMIT NO. 77-14 CONDITIONS OF APPROVAL: 1. The site plan received and dated November 18, 1977 shall be the approved layout. 2. All details and amenities of the development as shown on the site plan submitted for approval shall be constructed within the develop- ment, such as the recreational building, swimming pool, spa, and tennis courts. 3. Prior to the issuance of building permits, all exterior building elevations shall be subject to review and approval by the Planning Department. The applicant shall be required to provide special architectural treatment for those units abutting the City park and Taylor Street. 4. The CC&R's and association rules shall set forth provisions for the exclusive use of the open parking spaces within the project as well as a prohibition on the storage of recreational vehicles in such open parking spaces. 5. A decorative masonry wall shall be constructed to City specifications along Taylor Street and on the north property line. Said wall shall be six (6) inches wide and a minimum of six (6) feet in height. The height of said wall shall -be measured from whichever side is higher at finished grade. The architectural design of said wall shall be approved by the Planning Department. The structural design shall be approved by the Department of Public Works. 6. A decorative wall shall be constructed on the easterly side of the public access easement. Said wall shall be a minimum of 6 ft. in height measured from whichever side is higher at finished grade. The extent and type of fencing on the westerly side of the access easement shall be subject to review and approval by the Planning Department. 7. All interior fencing design and materials shall be reviewed and approved by the Planning Department prior to the issuance of building permits. Unit entry garden walls shall be architecturally and materially consistent with the buildings they serve. 8. Prior to the issuance of building permits, the developer shall submit a final landscape plan for review and approval by the Planning Department and Department of Public Works. Said landscape plan shall be in conformance with Section 9312.16 of the Huntington Beach Ordinance Code and shall specify in detail all private street hardware including project oi.dentification signs, street signb'y street lighting, etc. -9- 12/6/77 - PC Minutes: H.B. The developer shall be required to provide in the CC&R's provisions for the maintenance of all front yards as indicated on the preliminary landscape plan. 10. The developer shall be required to include within the Department of Real Estate Public Report a statement that lots 28 through 33 as indicated on the approved site plan will be within close proximity of a public access easement, which will provide pedestrian access to the adjacent city park site for those residential properties to the north. 11. If the developer proposes to provide air conditioning, the insu- lation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 12. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 13. A chemical analysis, as well as tests for physical properties of the soil on subject property, shall be submitted to the City for review prior to the issuance of building permits. 14. The structures on subject property, whether attached or detached, shall be constructed in compliance with the State Acoustical Standards set forth for all units that lie within the 60 CNEL contours of the property. 15. Energy saving lighting, such as high pressure sodium vapor lamps, shall be used in recreation areas. 16. Low volume heads shall be used on all spigots and water faucets. 17. Crime prevention techniques shall be applied to the design of the project (e.g., single -cylinder locks, etc.). 18. All building walls which are constructed on a zero lot line, or an easement line shall be of maintenance free solid decorative masonry for the first story of the dwelling and the second story shall be constructed with maintenance free decorative masonry or masonry veneer with a minimum thickness of two (2) inches. r, -10- 12/6/77 - PC Minutes: H.B. The proposed subdivision of this 9.45 acre parcel of land zoned R-1 (which allows 6.5 units per gross acre) is proposed to be constructed having 6.46 units per gross acre. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation for this type of housing. 3. The property was previously studied for this intensity of land use at the time the land use designation for low density residential was placed on said property. 4. The lot size, depth, frontage, street widths, and all other design and improvements features of the proposed subdivision are proposed 'to be constructed in compliance with standard plans and speci- fications on file with the City, as well as in compliance with the State Map Act and supplementary City Subdivision Ordinance. CONDITIONS OF APPROVAL: 1. The tentative map received and dated November 18, 1977 shall be the approved layout. 2. Taylor Street shall be dedicated and improved at the full 60-foot right-of-way. 3. The sewer, water, and fire hydrant systems shall be subject to City standards. 4. Vehicular access rights to Taylor Street shall be dedicated to the City of Huntington Beach, except at the private entry drive inter- section. 5. Drainage for the subdivision shall be approved by the Department of Public Works prior to the recordation of a final map. This system shall be designed to provide for siltation and erosion control both during and after construction of the project. 6. The developer shall indicate on the final tract map a ten (10) foot public access easement the purpose of which is to provide access to the adjacent city park for those residential properties to the north. • The location of said easement shall be as approved on the tentative map. The project will consist of two-story, 2- and 3-bedroom units with common open space including two tennis courts, two racquet- ball courts, swimming pool, sauna, jacuzzi, offstreet parking, and landscaping. Chairman Slates stated that he would be abstaining.from this item and Vice -Chairman Shea continued to chair the meeting. The public hearing was opened. George Alvaraz addressed the Commission and discussed the model on display. He stated that he agreed with the conditions of approval outlined in the staff report. The public hearing was closed. All details and amenities of the development as shown on the site plan submitted for approval shall be constructed within the develop- ment, such as swimming pool, spa, 'tennis courts, racquetball courts complex, etc. 3. Prior to the issuance of building permits, all exterior building elevations shall be subject to review and approval by the Planning Department. 4. The CC&R's and association rules shall set forth provisions for a restriction on the storage of recreational vehicles in open parking spaces. 5.'
