Board of Zoning Adjustments Wednesday, December 7, 1977 Page 2 REGULAR AGENDA ITEMS: USE PERMIT NO. 77-88 (Cont. from 11/30/77) Applicant: Gary D. Potter To permit the construction of two 8-unit apartment buildings extending more than 150 feet from a public street located on the south side of Aldrich Street, approximately 250 feet west of Beach Boulevard in an R-3, Medium -High Density Residential District. This request is a categorical exemption, Class 5, California Environ- mental Quality Act, 1970. Chairman Eadie opened the public hearing. Mr. Gary Potter, applicant, was present at the meeting. The Board reviewed the landscaping and dining room area dimensions and was informed that the dining room must be set back 2 feet to meet open space requirements. Drive widths and future dedication of street improvements were discussed. There being no other persons present to speak on the application, the Chairman closed the public hearing. Conditions of approval were discussed. ON MOTION BY EADIE AND SECOND BY CROSBY, USE PERZIIT NO. 77-88 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2.' The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan and elevations received December 1, 1977, shall be the approved layout, subject to the modifications described herein: a. The second story portion over the ground floor patios shall be adjusted to provide a clear to sky area of not less than seven (7) feet for the patio as depicted on said plan. Minutes: H.B. Armstrong To permit reduction in side yard setback from five (5) feet required to three (3) feet, for an 870 square foot addition to an existing dwelling constructed at 3-foot side setback located at 405 loth Street on the west side of the street 50 feet north of Orange Avenue in the Townlot Specific Plan Area One, Section A. This request is a categorical exemption, Class 5, California Environ- mental Quality Act, 1970. Chairman Eadie opened the public hearing. Mr. Armstrong, the applicant, was present at the meeting. The Board reviewed the turning radius of the proposal and Chairman Eadie stated that a policy decision has been made by the Planning Director toallowa turning radius to be measured frcm the existing right-of-way -in the_ towr Oldi_ dn3 Townlot r certain instances. There being no other persons present to speak on the application, the Chairman closed the public hearing. Conditions of approval were discussed. ON MOTION BY EADIE AND SECOND BY CROSBY, USE PERMIT NO. 77-95 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: Minutes: H.B. Board of Zoning Adjustments Wednesday, December 7, 1977 Page 4 FINDINGS OF THE BOARD: 1. The main portion of the dwelling already exists at three foot side setback, in conformance with code requirements at the time of con- struction. 2. The use as approved will not be detrimental to the general welfare of persons residing in the vicinity or to property and improvements in the general area. 3. The granting of this request will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received November 10, 1977, shall be the approved layout, subject to the modifications described herein: a. Two and one-half (2-1/2) feet of dedication off the alley shall be shown on the final drawings. b. The rear setback shall be revised to meet ordinance code requirements. The modifications described above shall be depicted upon the plan submitted to the Department of Building and Community Development upon application for building permits. Board of Zoning Adjustments Wednesday, December 7, 1977 Page 5 ADMINISTRATIVE REVIEW NO. 77-205 Applicant: Alfred Mayer To permit construction of a 25,997 square foot industrial building to be located at the northwest corner of Engineer Drive and Spring- dale Street in an M1-A, Restricted Manufacturing District. This request is covered by EIR 77-16, adopted by the City Council on March 18, 1974. The rear wall treatment was discussed by the Board and the applicant. It was the consensus of the Board that the rear wall must be con- structed of some type of masonry to buffer adjacent properties and for aesthetic purposes. The applicant suggested various alternatives to a masonry wall. It was the consensus of the Board to allow the Planning Department to make a final decision on what type of wall the applicant shall construct. The Board discussed changes to the northerly elevations, and land- scaping was also discussed. Conditions of approval were discussed. ON MOTION BY EADIE AND SECOND BY QUINLAN, ADMINISTRATIVE REVIEW NO. 77-205 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received November 16, 1977 shall be the approved layout, sub]ect to the modifications described herein: a. The revised easterly driveway treatment showing increased landscaping on the west side of said drive, shall be shown on revised plans. A plan delineating said modification shall be submitted to the Secretary of the Board. If such plan complies with the modifica- tion outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. C. GENERAL CONDITIONS: 1. The north property line screening treatment shall be sub3ect to approval by the Secretary of the Board. A plan delineating such treatment shall be submitted and approved prior to issuance of building permits. 2. The driveway locations shall'be sub3ect to conformance with Tentative Tract Map 8688X. 3. The northerly elevation shall reflect the following amendments: a. The extension of the west elevation treatment for the extent of one tenant space. b. The overhead door for the eastern most tenant space shall be removed. C. The remainder of elevations shall reflect a two-tone finish for the purpose of exhibiting relief. d. The screening wall shall be located perpendicular to the north property line screening feature near parking stalls 31 and 32 and shall be similar to the west elevation insofar as design and materials are concerned. Board of Zoning Ad3ustments Wednesday, December 7, 1977 Page 7 USE PERMIT NO. 77-86 Applicant: Michael Janes To permit construction of a 105-unit apartment complex located on the north side of Main Street between Delaware and Huntington Streets in an R2 and R3, Two -Family and Limited Multiple Family Residential Districts. This request is covered by Negative Declaration No. 77-117 The Chairman opened the public hearing. Mr. Jorge Alvarez was present to represent the application. The Chairman stated that this application is a proposal for an apart- ment complex which will be converted into a condominium project. He further stated that this application had been approved by the Planning Commission on December 6, 1977 as a condominium project. Conditions of approval were discussed. ON MOTION BY EADIE AND SECOND BY QUINLAN NEGATIVE DECLARATION NO. 77-117 WAS ADOPTED BY THE BOARD OF ZONING ADJUSTMENTS BY THE FOLLOWING VOTE: AYES: Eadie, Crosby, Quinlan NOES: None ABSENT: None ON MOTION BY EADIE AND SECOND BY QUINLAN USE PERMIT NO. 77-86 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: FINDINGS: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: 1. The site plan received and dated November 29, 1977, shall be the approved layout. 2. All details and amenities of the development as shown on the site plan submitted for approval shall be constructed within the develop- ment, such as swimming pool, spa, tennis courts, racquetball courts complex, etc. 3. Prior to the issuance of building permits, all exterior building elevations shall be subject to review and approval by the Planning Department. Minutes: H.B. Said wall shall be a minimum of six (6) feet in height measured from whichever side is higher at finished grade. Materials and design of the wall shall be subject to review and approval by the Planning Department. 5. Prior to the issuance of building permits, the developer shall submit a final landscape plan for review and approval by the Planning Depart- ment and the Department of Public Works. Said landscape plan shall be in conformance with Section 9312.16 of the Huntington Beach Ordin- ance Code and shall indicate all street hardware including pro3ect identification signs, street signs, street lighting, etc. 6. The developer shall provide 1.25 30-inch box trees per unit. The type and placement of such trees shall be sub3ect to review and approval by the Planning Department. 7. The developer shall be responsible for 25 percent of the cost of a traffic signal to be located at the intersection of Main Street and Delaware Street. Said cost participation shall be resolved to the satisfaction of the Department of Public Works prior to the issuance of building permits. 8. All garages within the development shall be equipped with automatic garage door openers. 9. The sewer system for the development shall connect to the existing sewer main in Huntington Street if any occupancy of the development occurs prior to the completion of the Main Street/Beach Boulevard trunk sewer. If occupancy of the units does not occur until after the completion of this trunk sewer line, the development may sewer to either the main in Huntington Street or in Delaware Street. 10. If the developer proposes to provide air conditiQning, the insula- tion in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. 11. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 12. A chemical analysis, as well as tests for physical properties of the soil on sub3ect property, shall be submitted to the City for review prior to the issuance of building permits. 13. The structures on sub3ect property, whether attached or detached, shall be constructed in compliance with the State Acoustical Stand- ards set forth for all units that lie within the 60 CNEL contours of the property. Low -volume heads shall be used on all spigots and water faucets. 16. Crime prevention techniques shall be applied to the design of the project (e.g., single -cylinder locks, etc.). AYES: Eadie, Crosby, Quinlan NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 77-61 Applicant: Craig Etchegoyen/Cager Properties To permit reduction in minimum dimension of open space from fifteen (15) feet required to eleven (11) feet, to permit addition to an existing single-family dwelling located on the west side of Indigo Circle, approximately 500 feet south of Orient Drive in an Rl, Low Density Residential District. This request is a categorical exemption, Class 5, California Environ- mental Quality Act, 1970. Chairman Eadie opened the public hearing. Mr. Mike Frazier was present to represent the application. The Board discussed the proposal. It was noted that the applicant had provided ample open space and that the provisions for dimensionsi_ is a justifiable hardship, and further that the applicant has met with the intent of the Ordinance Code. There being no other persons present to speak on the application, the Chairman closed the public hearing. Conditions of approval and findings were discussed. ON MOTION BY EADIE AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 77-61 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The subject corner lot is the same width as a normal interior lot in the nieghborhood, which presents some difficulty in utilization of the site. 2. The substitute yard space as proposed will provide adequate outdoor living and activity area, and the facilities proposed to be con- structed within the reduced minimum dimension do provide additional recreational facilities, which is the purpose of the open space requirements. This request is a categorical exemption, Class 5, California Environmental Quality Act, 1970. IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 77-209 Applicant: Robert J. Krough, M.D. To permit a 221 square foot addition to an existing medical building, located on the west side of Beach Boulevard, approximately 70 feet south of Newman Street in a C4, Highway Commercial District. This request is a categorical exemption, Class 1, California Environmental Quality Act, 1970. The Chairman opened the public hearing on Conditional Exception No. 77-62. Mr. Krough, applicant, was present to represent the application. The-c being no persons present to speak on the application, the public hearin, was closed. Chairman Eadie pointed out that there were several problems in the plan as submitted and suggested that a meeting with the applicant and staff prior to Board consideration was necessary. Therefore, Chairman Eadie sug- gested a two week continuance on these applications. The applicant concurred on the continuance. Minutes: H.B. This request is a categorical exemption, Class 5, California Environmental Quality Act, 1970. IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 77-206 Applicant: George P. Sepulveda To permit construction of a 24,500 square foot industrial building located on the southeast corner of Enterprise and Lindborg Streets in an M1-A, Light Industrial District. This request was covered in Exemption Declaration No. 74-150, prepared for the industrial tract in which it is located. Mr. Sepulveda, the applicant, was present. The Board discussed the driveway widths and the proposed method of screening for parking along Prodan Drive. Other items discussed by the Board were enclosure of trash area, roof top screening, fencing and cable TV conduit placement. The applicant stated that he had received suggested conditions of approval on Tentative Parcel Map No. 77-49 prior to the meeting. This request is a Categorical Exemption, Class 5, California Environ- mental Quality Act, 1970. Mr. and Mrs. Gabel, the applicants were present. The Chairman noted that the suggested conditions of approval mailed to the applicants were returned to the Planning Department due to being undeliverable. Mrs. Gabel stated that they moved, and that she and her husband would review the suggested conditions of approval at the meeting. Board discussion ensued, and conditions of approval were discussed with the applicant. ON MOTION BY CROSBY AND SECOND BY QUINLAN TENTATIVE PARCEL MAP NO. 77-50 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL FOR ANY PURPOSE: 1. The tentative parcel map received and dated November 23, 1977, shall be the approved layout. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Board of Zoning Adjustments Wednesday, December 7, 1977 Page 14 ADMINISTRATIVE REVIEW NO. 77-210 Applicant: Bolsa Partners To permit construction of three industrial buildings with a total of 37,888 square feet located on the southeast corner of Bolsa Avenue and Graham Street in an M1-A, Restricted Manufacturing District. This request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Mr. Ralph Hastings was present to represent the application. The Board reviewed the application with the applicant's representative and discussion ensued regarding landscaping and irrigation plan, the placement of rooftop mechanical equipment screening was also discussed. It was further noted that the applicant was required to pay for his share of median improvements if the developer of Tentative Tract 8688X (Kaiser Aetna) does not pay for them for Bolsa Avenue. Conditions of approval were discussed. ON MOTION BY EADIE AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 77-210 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received November 23, 1977 shall be the approved layout, sub3ect to the modifications described herein: a. The drivewaysshall be in conformance with Tentative Tract Map 8688X. b. The nominal landscaping buffer shown on the interior property lines shall be removed if a similar treatment is not achievable with adjacent property owners.
