CONDITIONAL EXCEPTION NO. 77-63
Applicant: Tustin Village, Inc.
To permit the reduction of required side yard setback from five
(5) feet to three (3)feet, located on the west side of Delaware
Street approximately 54 feet north of Rochester Avenue in the
Oldtown Specific Plan, District Two.
CONDITIONAL EXCEPTION NO. 77-64
Applicant: Tustin Village, Inc.
To permit the reduction of the required side yard setback from five
(5) feet to three (3) feet, located on the west side of Delaware
Street approximately 80 feet north of Toronto Avenue in the Oldtown
Specific Plan, District.Two.
CONDITIONAL EXCEPTION NO. 77-65

To permit reduction of the required side yard setback from five (5)
feet required to three (3) feet, located on the east side of
California Street approximately 108 feet south of Springfield Avenue
in the Oldtown Specific Plan, District Two.
CONDITIONAL EXCEPTION NO. 77-66
Applicant: Tustin Village, Inc.
To permit the reduction of the required side yard seLback from five
(5) feet to three (3) feet, located on the east side of California
Street approximately 79 feet north of Rochester Avenue in the Oldtown
Specific Plan, District Two.
The above requests are Categorical Exemptions, Class V, California
Environmental Quality Act, 1970.

Chairman Eadie opened the public hearings on the four above items
concurrently. Mike Jager was present at the meeting. He ex-
plained that the project has been in plan check for 120 days,
partly due to delay in the process and partly due to problems he
is experiencing with the oil operations and easements on the site.
'He noted that since his project was filed the ordinance has
changed and that to change plans drawn under the previous ordinance
requirements would impose a hardship. There being no other per-
sons present to address the Board in regard to these projects, the
public hearing was closed.
After Board review of the timing of the code change in relation to
the subject requests and the differing requirements under the old
and new provisions, the applicant was referred to the Planning De-
partment to ascertain if the plans would comply with the old code
requirements. Mr.'Jager returned to the meeting and requested
a continuance of one week in order to check the plans and make a
determination as to which ordinance would be used.
ON MOTION BY QUINLAN AND SECOND BY CROSBY CONDITIONAL EXCEPTIONS
NOS. 77-63, 77-64, 77-65, AND 77-66 WERE CONTINUED AT THE REQUEST
OF THE APPLICANT TO THE REGULAR MEETING OF DECEMBER 21, 1977, BY
THE FOLLOWING VOTE:

USE PERMIT NO. 77-97
Applicant: The Buccola Company
To permit the construction of a 26,720 square foot shopping center
located on the east side of Beach Boulevard approximately 220
feet north of Garfield Avenue in a C4, Highway Commercial District.
This request is covered by Negative Declaration No. 77-63, adopted
by the Board on May 25, 1977.
Chairman Eadie opened the public hearing. John Praisler was
present at the meeting and explained the changes in the plan from
the previously approved layout. These consist of a 50 percent
reduction in the fifty -foot setback from Garfield Avenue with the
balance of the setback in landscaping, an increase in size of
Building A and a decrease in size of Building B, and a four -space
reduction in parking provided. There being no persons present to
speak for or against the proposal, the public hearing was closed.
Board review ensued. Dave Eadie reviewed the conditions previously
imposed on the shopping center, noting that plan check has shown
the project to be in conformance with the ratio of parking spaces
to restaurant seating capacity; therefore, Condition 1-B of the
prior conditions may be deleted.

ON MOTION BY EADIE AND SECOND BY QUINLAN USE PERMIT NO. 77-97
WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE
FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the general vicinity of such
use or building.
2. The granting of a Use Permit will not adversely affect the
General Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of
Land Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received and dated November 29, 1977, shall
be the approved layout, subject to the modifications
described herein:
a. The revised plan shall reflect the maximum of two and
one-half (2-1/2) foot projection on the parking stall
depth.
b. The plan shall indicate the proposed reciprocal ease-
ments between the subject property and the adjoining
property to the north. A copy of the recorded ease-
ments shall be submitted to the Planning Department.
C. Minimal raised landscaped planters shall be installed
at both the most easterly and westerly parking stalls
to the south of Building C, to protect vehicles in
those spaces from backing movements of the spaces op-
posite.
The modifications outlined above shall be depic`ed upon the
plan submitted to the Department of Building and Community De-
velopment upon application for building permits.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:

. Parking layout;
. Lot area;
. Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity;
Past administrative action regarding this property.
2. A landscape and irrigation plan shall be submitted to the
Board of Zoning Adjustments for review and approval action.
3. A rooftop mechanical equipment screening plan, if appli-
cable, shall be submitted to the Planning Department. Said
plan shall indicate screening of all rooftop mechanical
equipment and shall delineate the type of material proposed
to screen said equipment.
4. The elevations received and dated May 24, 1977, shall con-
tinue to the the approved elevations for the facility (see
UP 77-56).
5. Subject property shall be graded to bring it as close as
possible to the grade on the abutting property to the north,
if such common elevation does not already exist.
B. GENERAL CONDITIONS:
1. A tentative parcel map shall be filed and recorded prior
to issuance of a certificate of occupancy.
2. Covenants shall be filed and recorded to cover the recip-
rocal parking and access agreements on each parcel.
3. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
4. Energy -saving lighting, such as high pressure sodium vapor
lamps, shall be used in parking lots.
5. Crime prevention techniques shall be applied to the pro-
ject (e.g., single -cylinder locks, etc.).
6. Low -volume heads shall be used on all spigots and water
faucets.

USE PERMIT NO. 77-100
Applicant: Cager Properties
To permit the construction of four fourplex dwelling units located
on the east side of Brookhurst Street west of the Santa Ana River,
approximately 1062 feet north of Banning Avenue in an R3, Medium -
High Density Residential District.
This request is covered by Negative Declaration No. 77-98, adopted
by the Board of Zoning Adjustments on September 7, 1977.
Chairman Eadie opened the public hearing. No one was present to
represent the application or to address the Board in regard to the
project, and the public hearing was closed.
Chairman Eadie noted that the applicant has indicated a wish to
withdraw this application; however, no letter to that effect has
as yet been filed.
ON MOTION BY EADIE AND SECOND BY QUINLAN USE PERMIT NO. 77-100
WAS CONTINUED TO THE REGULAR MEETING OF DECEMBER 21, 1977, BY THE

ADMINISTRATIVE REVIEW NO. 77--212
Applicant: William J. Sullivan
To permit the construction of a 4,000 square foot industrial
building located on the west side of Enterprise Lane approximately
235 feet north of Mountjoy Drive in the Ml, Light Industrial
District.
This request is covered by Exemption Declaration No. 74-150, ad-
opted by the Planning Commission upon approval of the industrial
tract in which the project is located.
William Sullivan, Eugene V. Springer, and Carl Brooks were present
to represent the application.
Dave Eadie noted that the request submitted is for the first phase
of a two-phase project, and asked the applicant to outline the
total plans for the property. Mr. Sullivan reported that both
buildings are to be constructed for the State Recreation and Parks
Department, the present building as a vehicle maintenance facility
and the future building as a two-story administration building.
He indicated that the new building pad will be on the southeast
corner of the property, with parking to the north of the entry in
a quantity complying with code requirements and landscaping in-

stalled in a 12- or 13-foot strip along the total street frontage
of the site. The Board informed the applicants of the require-
ment that the entire 6 percent of the site required to be in
landscaping will be required to be installed in conjunction with
this first phase of the project, as well as full street improve-
ments for the entire street frontage.
Also reviewed by the Board were the proposed fencing and the
wash and steam pad shown on the plans.
ON MOTION BY CROSBY AND SECOND BY QUINLAN ADMINISTRATIVE REVIEW
NO. 77-212 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL-
LOWING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual site plan as amended and the elevations re-
ceived and dated December 2, 1977, shall be the approved
layout, subject to the modifications described herein:
a. The note designating a "wash and steam pad" shall be
amended to reflect a wash pad only.
b. The drive approach width shall not be less than twenty-
five (25) feet. The treatment of said drive (width,
location, and type) shall be to the approval of the
City's Traffic Engineer.
The modifiations described above shall be depicted on the plans
submitted to the Department of Building and Community Develop-
ment upon application for building permits.
In its approval action, the Board of Zoning Adjustments considered
the following issues in relation to the conceptual plan:
Traffic circulation and drives;
Parking layout;
. Lot area;
. Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity;
Past administrative action regarding this property.
2. A landscape and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works
shall be submitted to the Planning Department for approval.
Said landscaping plan shall denote the full six (6) percent
of site area in landscaping required for the total site,

to be installed in a strip on the front of the property
of sufficient width to accommodate the required square
footage.
3. All applicable fees shall be paid prior to issuance of
building permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. The full six (6) percent landscaping area shall be in-
stalled at the time of the initial phase of the total
development.
2. The chain link fencing indicated on the plan shall be of
chain link and redwood slat construction to adequately
screen the project.
3. The overhead doors shall be treated in a manner compatible
with the colors and materials used on the building itself.
C. GENERAL CONDITION:
1. The portion of the property remaining vacant after con-
struction of the initial phase shall be maintained in a
clean and weed -free condition.

Applicant: Anacal Engineering Company
To permit the consolidation of several portions of property and
two entire lots into one parcel, located on the northwest corner
of Atlanta Avenue and Magnolia Street in a C4, Highway Commer-
cial District.
This request is covered by Exemption Declaration No. 74-135,
previously adopted by the Board.

No one was present to represent the application. After discussion
the Board agreed that the application can be approved contingent
upon receipt of the applicant's writter concurrence with the condi-
tions of approval prior to the next regular meeting.

1. The tentative parcel map received by the Planning Depart-
ment on December 6, 1977, shall be the approved layout.
2. A parcel map shall be filed with, and approved by, the
Department of Public Works and recorded with the Orange
County Recorder.
3. A copy of the recorded parcel map shall be filed with the
Planning Department.
4. This approval shall be reconsidered by the Board of Zon-
ing Adjustments at its December 21, 1977, meeting if the
applicant has not verified in writing to the Secretary of
the Board that he concurs with the. conditions of approval,
by that date.

Applicant: H.B. Junior Women's Club
To permit operation of a Soap Box Derby to be held on January 28,
1978, between the hours of 11:00 a.m. to 3:00 p.m. (approximately)
located on Ellis Avenue between Goldenwest and Edwards Streets.
Project will include concessions for serving of hot dogs, cold
drinks, and popcorn.
Cheryl Simmons was present at the meeting to explain the applica-
tion.
The Board reviewed the request. Bruce Crosby presented recommenda-
tions from the Department of Public Works. Among the items dis-
cussed by the Board were access, parking (on- or off-street) to
be provided, and provision of adequate insurance. The applicant in-
dicated that it had not been determined whether parking would be
provided on adjacent property or would be totally in the streets;
she has requested permission to use a parcel of City-Dwned land,
however. The applicant was advised of the proper personnel to a
contact in Fire and Public Works to obtain onsite inspection and
information on street barricading and traffic control.

CONDITIONS OF APPROVAL:
1. The applicant shall submit a certificate of insurance form
to the License Division of the Finance Department ten (10)
days prior to the event. If insurance is not obtainable
and/or proof is not filed, this approval shall become null
and void.
2. An onsite inpsection by the Fire Department will be required
prior to the event. The signing for traffic control, place-
ment of the portable sanitation facilities and concession
booths, and parking if provided shall be to the approval of
the Fire Department.
3. The only access point shall be from Edwards Street, and no
access shall be taken from Goldenwest Street.
4. Barricades shall be set up and taken down by the applicants,
to the approval of the Department of Public Works.
