Chairman Slates announced the resignation of Commissioner Gibson which was effective December 19,1977. CONSENT CALENDAR: ON MOTION BY STERN AND SECOND BY NEWMAN THE MINUTES OF DECEMBER 6, 1977 AND DECEMBER 13, 1977 WERE APPROVED BY THE FOLLOWING VOTE: AYES: Stern, Finley, Slates, Newman, Hoffman NOES: None ABSENT: Shea GENERAL PLAN CONFORMANCE NO. 77-16 ON MOTION BY FINLEY AND SECOND BY NEWMAN THE COMMISSION FOUND GENERAL PLAN CONFORMANCE NO. 77-16 TO BE IN CONFORMANCE WITH THE GENERAL PLAN BY THE FOLLOWING VOTE: AYES: Stern, Finley, Slates, Newman, Hoffman NOES: None ABSENT: Shea ORAL COMMUNICATIONS: None SCHEDULED ITEMS: Chairman Slates stated that he would have to abstain on the first item and turned the meeting over to Commissioner Newman. TENTATIVE TRACT NO. 10169/NEGATIVE DECLARATION NO. 77-129 Applicant: Robert Jarrard & Associates Tentative Tract No. 10169 is a request to subdivide an approximately 1.82 acre site into 15 parcels which are proposed to be developed with common wall single-family homes located on the'east side of Lake between Adams and Springfield. John Cope stated that at the Subdivision Committee meeting held on December 9th the major consideration was the right-of-way width on Lake Street. Minutes: H.B. Planning Commission Tuesday, December 20, 1977 Page 2 Bob Jarrard, applicant, addressed the Commission and stated that he was in agreement with all the•conditions suggested by the staff with the exception of No. 1 which required that the map be revised to reflect a 55 foot half street section on the easterly side of Lake Street. Margaret Carlberg, representing the Environmental Council, addressed the Commission and spoke in behalf of retaining the eucalyptus trees or replacing them with fast growing trees which would also grow tall. Commission discussion ensued. Commissioner Stern stated that he would be voting with duress as he felt the Lake Street realignment issue should be resolved first, second that the Pacific Electric right-of-way/ transportation corridor should be resolved, and third that specific projects could then be approved. ON MOTION BY HOFFMAN AND SECOND BY NEWMAN NEGATIVE DECLARATION NO. 77-129 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Stern, Finley, Newman, Hoffman NOES: None ABSTAIN: Slates, Shea ABSENT: None A MOTION WAS MADE BY NEWMAN AND SECONDED BY HOFFMAN TO APPROVE TENTATIVE TRACT 10169 WITH CONDITION NO. 1 to READ "THE TENTATIVE MAP RECEIVED AND DATED DECEMBER 16, 1977 SHALL BE THE APPROVED LAYOUT SUBJECT TO THE MAP BEING REVISED TO REFLECT A 50 FOOT HALF STREET SECTION ON THE EASTERLY SIDE OF LAKE STREET." The Commission was advised that the Tract would become approved on 12/31/77 under Section 66452.4 of the Subdivision Map Act. PRECISE PLAN OF STREET ALIGNMENT NO. 77-3 Applicant: Initiated by the Planning Department Precise Plan of Street Alignment No. 77-3 is a proposal to precisely align Atlanta Avenue between Lake Street and Beach Boulevard, and Lake Street between Orange Avenue and Walnut Street. Both streets are proposed to be 100 ft. right-of-ways. Chairman Slates stated that the staff had recommended that it may be desirable to delay discussion of the new alignment until such time a the Lake Street situation is reconsidered, and further that the staff recommended that PPSA 77-3 be tabled indefinitely. 1 -2- 12/20/77 - PC Minutes: H.B. Gordon Offstein addressed the Commission and stated that if the Commission was going to table this item he did not have any state- ment to make. The public hearing was closed. ON MOTION BY SLATES AND SECOND BY STERN PRECISE PLAN OF STREET ALIGNMENT NO. 77-3 WAS TABLED BY THE FOLLOWING VOTE: AYES: Stern, Finley, Slates, Shea, Newman, NOES: None ABSENT: None TRAILS IMPLEMENTATION PLAN NEGATIVE DECLARATION 77-135 - RESOLUTION NO. 1208 This is an implementing program for the establishment and maintenance of bicycle trails and equestrian trails within the City of Huntington Beach. Rich Barnard briefly discussed this item, and Commission discussion ensued. The public hearing was opened. Margaret Carlberg addressed the Commission in behalf of the Environ- mental Council. She stated that the Environmental Council strongly supported the recommendation that the jogging trails be a part of recreation and parks activity and further supported recommendation for bike trail maintenance. The public hearing was closed. ON MOTION BY STERN AND SECOND BY FINLEY NEGATIVE DECLARATION NO. 77-135 AND RESOLUTION NO. 1208, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HUNTINGTON BEACH RECOMMENDING ADOPTION OF THE TRAILS IMPLEMENTATION PLAN AND DELETION OF THE RECREATIONAL TRAILS ELEMENT FROM THE GENERAL PLAN, WAS APPROVED BY THE FOLLOWING VOTE: AYES: Stern, Finley, Slates, Shea, Newman, Finley NOES: None ABSENT: None PLANNED SIGN PROGRAM 77-3 - APPEAL Applicant and Appellant: Heath and Company and West Coast Soccer League This is an appeal to the Planning Department's denial of three (3) proposed signs of an approved planned sign program located in the Old World commercial complex located on the north side of Center Drive, approximately 650 ft. east of Gothard Street. -3- 12/20/77 - PC Minutes: H.B. Commissioner Newman felt that there should be adequate signing but expressed concern over proliferation of liquor store signs. Commissioner Shea stated that she felt this was a unique project in the City and needed all the exposure possible. The public hearing was opened. Mr. Joe Bischof addressed the Commission and spoke in favor of the signs which were being appealed. The public hearing was closed. Chairman Slates stated that the three signs would be taken up individually with votes to be cast on each individual sign. Margrave This is a request for a change of zone from C4 to R1 located approximately 320 ft. south of Adams Avenue and approximately 697 feet east of Brookhurst Street. John Cope stated that he had no information to add to that contained in the staff report. The public hearing was opened. There being no one present to speak on this item, the Chairman closed the public hearing. Commission discussion ensued. ON MOTION BY STERN AND SECOND BY NEWMAN ZONE CHANGE NO. 77-30 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: 1. State Planning Law mandates that zoning shall be consistent with the City's General Plan. 2. The proposed low density residential zoning is compatible with the existing surrounding land uses. AYES: Stern, Finley, Slates, Shea, Newman, Hoffman NOES: None ABSENT: None ZONE CHANGE 77-31 Applicant: Robert E. Jarrard and Thomas A. Bernatz Commissioner Shea stated that she would abstain on this item due to a possible conflict of interest. Zone Change 77-31 is a request for a change of zone from C4 to R2 at the southeast corner of Terry Drive and Viewpoint Lane. John Cope stated that he had no information to add to that contained in the staff report. The public hearing was opened. Bob Jarrard stated that he would be coming back to the Commission with a tentative map after approval of the zone change. The public hearing was closed. Commission discussion ensued. ON MOTION BY NEWMAN AND SECOND BY STERN ZONE CHANGE 77-31 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: 1. These lots are then anticipated to be developed with multi -family residential units. The property is located northeasterly of Pearce and Green Streets. John Cope presented an aerial vugraph of the property. Commission discussion ensued. ON MOTION BY NEWMAN AND SECOND BY SHEA NEGATIVE DECLARATION 77-132 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Stern, Finley, Slates, Shea, Newman, Hoffman NOES: None ABSENT: None ON MOTION BY NEWMAN AND SECOND BY SLATES TENTATIVE TRACT NO. 10042 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLO?)ITTC VOTE . FINDINGS: 1. The proposed subdivision of this 3.4 acre parcel of land zoned R2 (which allows 14.89 units per gross acre) is proposed to be con- structed having 14.45 units per gross acre. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation for this type of housing. 3. The property was previously studied for this intensity of land use at the time the land use designation for low density residential was placed on said property. 4. The lot, size, depth, frontage, street widths, and all other design and improvements features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifi- cations on file with the City, as well as in compliance with the State Map Act and supplementary City Subdivision Ordinance. -6- 12/20/77 - PC Minutes: H.B. All vehicular access rights to Green Street shall be dedicated to the City of Huntington Beach. 3. Prior to the issuance of building permits, all two-story structures abutting Green Street shall be subject to review and approval by the Planning Department. 4. Drainage for the subdivision shall be approved by the Department of Public Works prior to recordation of a final map. 5. Lots 1 and 2, 3 and 4, 5 and 6, 7 and 8, 10 and 11, 12 and 13 shall have reciprocal driveway easements as indicated on the tentative map. Said easements shall be recorded as a part of the final map. 6. A six (6) foot high by six (6) inches wide perimeter wall shall be installed along the perimeter of those lots abutting Green Street. The height of said wall shall be measured from the highest finished grade on either side of the wall. The materials and design of the wall shall be subject to approval by the Plan- ning Department. 7. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers. 8. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 9. Low volume heads shall be used on all spigots and water faucets. 10. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 11. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the state acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. Planning Commission Tuesday, December 20, 1977 Page 8 TENTATIVE PARCEL MAP 77-48/CONDITIONAL EXCEPTION 77-10 NEGATIVE DECLARATION 77-133 Applicant: Nader Land Development Tentative Parcel Map No. 77-48, in conjunction with Conditional Ex- ception No. 77-10, filed on November 21, 1977, is a request to allow a 115 ft. parcel of land to be subdivided into two parcels, one having 60 ft. of frontage and the other having 55 ft. of frontage in lieu of the 60 ft. as required by the Ordinance Code. The public hearing was opened on Conditional Exception No. 77-10. There being no one present to speak on this application, the Chairman closed the public hearing. Commission discussion ensued. ON MOTION BY NEWMAN AND SECOND BY SHEA NEGATIVE DECLARATION NO. 77-133 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Stern, Finley, Slates, Shea, Newman, Hoffman NOES: None ABSENT: None ON MOTION BY NEWMAN AND SECOND BY SHEA CONDITIONAL EXCEPTION NO. 77-10 WAS APPROVED WITH THE FOLLOWING FINDING BY THE FOLLOWING VOTE: This request will not be detrimental to the public health, safety, and welfare of the community as the development proposed upon the two parcels is proposed at the same intensity as that of surrounding uses. The Planning Commission of the City of Huntington Beach does hereby find that the proposed subdivision along with its design improve- ments is consistent with the General and Specific Plans in the area in that: a. The two lot division of land and the development of a fourplex and a triplex is in keeping with much of the existing develop- ment in the area. b. Reciprocal drive easement shall be provided between the two par- cels to provide vehicular ingress and egress for both parcels over the common drive. 5. ORAL COMMUNICATIONS: None COMMISSIONERS' COMMENTS: Chairman Slates requested that staff make arrangements for a dinner the week of January 15th.
