Chairman Eadie reported that a request has been received for con- tinuance of this item. Board of Zoning Adjustments December 28, 1977 Page 2 REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 77-57 (Cont. from 12-21-77) Applicant: Don and Carolyn Spargur To permit a reduction of two and one-half (2-1/2) feet in the re- quired driveway width for an existing office building located on the north side of Pacific Coast Highway approximately 505 feet east of Mariner Drive in a C4, Highway Commercial District. This request is a Categorical Exemption, Class V, California Envir- onmental Quality Act, 1970. Chairman Eadie opened the public hearing. Mr. and Mrs. Spargur were present at the meeting. The Board discussed with the applicants the exact location of the proposed use and the jurisdiction under which the original entitlement had been granted. There being no other persons to speak either for or against the proposal, the pub- lic hearing was closed. Board discussion ensued. ON MOTION BY EADIE AND SECOND BY ELLSTROM CONDITIONAL EXCEPTION NO. 77-57 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The placement of the existing building on the site precludes reasonable placement of a drive which would meet existing code requirements. 2. The remaining development on the site is in substantial conform- ance with City code requirements. 3. Granting of the conditional exception will not be materially detrimental to the public welfare or in3urious to property in the same zoning classification. 4. The granting of the conditional exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan received and dated December 6, 1977, shall be the approved layout. To permit waiver of a requirement for a recorded maintenance ease- ment between two abutting single-family dwellings located on the east side of 14th Street approximately 100 feet south of Pecan Avenue in the Townlot Specific Plan Area One, Section A. This request is a Categorical Exemption, Class V, California En- vironmental Quality Act, 1970. Chairman Eadie opened the public hearing. No one was present to address the Board in regard to this request, and the public hear- ing was closed. It was the determination of the Board that the applicant should be present durinq any discussion of his proposal. ON MOTION BY EADIE AND SECOND BY ELLSTROM, CONDITIONAL EXCEPTION NO. 77-67 WAS CONTINUED TO THE REGULAR MEETING OF JANUARY 4, 1978, TO PERMIT THE APPLICANT TO BE PRESENT, BY THE FOLLOWING VOTE: AYES: EADIE, ELLSTROM, QUINLAN NOES: NONE ABSENT: NONE USE PERMIT NO. 77-104 Applicant: Edie Larson To permit construction of three 8-unit apartments upon property exceeding 150 feet from a public street, located on the north side of MacDonald Street approximately 483 feet west of Beach Boulevard in an R3, Limited Multi -Family Residential District. This request is covered by Negative Declaration No. 77-66, adopted by the Planning Commission on June 21, 1977, upon adoption of C.E. 77-04. BZA 12-28-77 Page 3 Minutes, H.B. Board of Zoning Adjustments December 28, 1977 Page 4 Chairman Eadie opened the public hearing. Tom Drummond was pre- sent to represent the applicant. There being no persons to address the Board either for or against the proposed project, the public hearing was closed. The Board reviewed the request with the applicant. Dave Eadie pointed out that Parkside Lane is presently not in existence and cannot be improved because the great majority of the dedication of street right-of-way will have to come from the school site. Therefore, even though this applicant will be required to dedicate five feet of right-of-way and observe legal setbacks from this pre- cisely -planned future street, the Board cannot permit any access to be taken from Parkside; this will require redesign of the units on the corner lot to provide access from MacDonald Street. The applicant was given the alternative of a continuance to submit revised plans for the total project or approval of the two units located on the inside lots with a condition that a revised plan be submitted for the unit on the corner lot. It was his determination that the request be continued and a complete revised plan be sub- mitted. The secretary was instructed to supply Mr. Drummond with a copy of the plan check for the project to aid him in the redesign. ON MOTION BY EADIE AND SECOND BY QUINLAN USE PERMIT NO. 77-104 WAS CONTINUED WITH THE C014CURRENCE OF THE APPLICANT TO THE REGULAR MEETING OF JANUARY 11, 1978, BY THE FOLLOWING VOTE: AYES: EADIE, ELLSTROM, QUINLAN NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 77-52 Applicant: Tri State Engineering Company To permit division of one (1) parcel of land into two (2) separate lots, located on the northwesterly corner of Warner Avenue and Pacific Coast Highway in a C4, Highway Commercial District. This request is covered by Negative Declaration Request No. 77-136. Al Lebot was present at the meeting and indicated that the appli- cant has received and does concur with the suggested conditions of approval. The Board reviewed the parcel map, questioning: 1) the future use of the remaining lineal strip of property; 2) the impact on the service station site (e.g., deletion of parking stalls, future relocation of those stalls, and general impacts); and 3) relation- ship of both sites to the existing commercial development. Board of Zoning Adjustments December 28, 1977 Page 5 ON MOTION BY EADIE AND SECOND BY ELLSTROM NEGATIVE DECLARATION NO. 77-136 AND TENTATIVE PARCEL MAP NO. 77-52 WERE CONTINUED WITH THE CONCURRENCE OF THE APPLICANT TO THE REGULAR MEETING OF JANUARY 11, 1978, BY THE FOLLOWING VOTE: AYES: EADIE, ELLSTROM, QUINLAN NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 77-215 Applicant: Larry Mancebo (Foxx Development) To permit construction of a model complex and temporary sales office located on the west side of 17th Street approximately 75 feet north of Pecan Avenue in the Townlot Specific Plan Area One, Section B. This request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Larry Mancebo was present at the meeting. Board review included consideration of setback, sight angle require- ments, location of access to the units, and time period for which the use has been requested. ON MOTION BY EADIE AND SECOND BY QUINLAN ADMINISTRATIVE REVIEW NO. 77-215 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The layout received and dated December 14, 1977, shall be the approved layout, as amended to show the trailer -office relocated directly abutting Building C. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: . Traffic circulation and drives; Parking; . Lot area, width, and depth; Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. All applicable fees shall be paid prior to issuance of permits. AYES: EADIE, ELLSTROM, QUINLAN NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 77-69 Application: Michael A. Lund To permit reduction in driveway depth requirement from 22 feet to 10 feet and reduction in rear yard setback from 10 feet to 5 feet for an addition to a single-family dwelling located on the north- east corner of Sands Drive and Hammon Lane in an R1, Single -Family Residential District. This request is a Categorical Exemption, Class I, California En- vironmental Quality Act, 1970. Chairman Eadie opened the public hearing. Michael Lund was present at the meeting and addressed the Board to further explain the in- tended purpose and use of the sub]ect addition. There being no other persons to address the Board in regard to this matter, the public hearing was closed. Board review ensued, considering the addition in relation to the existing dwelling, the provision of onsite parking, and the possi- bility of some future conversion of the addition to a rental unit because of the lack of any interior connection between the dwelling and the second -story rooms. ON MOTION BY EADIE AND SECOND BY ELLSTROM CONDITIONAL EXCEPTION NO. 77-69 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. Reduction of the breezeway area between the addition and the existing residence to eliminate the need for a setback encroach- ment is not feasible, due to the present floor plan configura- tion on the existing residence. 2. The necessity for a full-length drive apron is negated, insofar as there is ample onsite parking in addition to garage space existing on site on the Hammon Lane lot frontage. 3. The requested building addition does not exceed allowable per- centages of lot coverage and must be located as shown to provide required open space and still logically attach itself to the main building. The subject property is adjacent to a single-family resi- dence havinq a substantial rear yard setback of 33 feet from the property line; thus, the 5-foot encroachment into the rear yard will not adversely impact adjacent property. 5. The size of the subject addition is minimal from the standpoint of building width. The encroachment is neces- sary and it would impose a hardship on the property owner to require the full 10-foot setback, based on the site considerations as mentioned. 6. The subject proposal would not adversely affect any other adjacent property in the immediate area. 7. Ample onstreet parking is available on this corner lot to augment the existing onsite parking. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan received and dated September 15, 1977, shall be the approved layout, subject to the follow- ing modification: The plan submitted to the Department of Building and Com- munity Development upon application for building permits shall be amended to delineate immediate interior access to the main dwelling from the upstairs living area of the proposed addition. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: . Parking layout and drives; . Lot area; • Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. The elevations as submitted with the approved plan shall be adhered to. 3. The proponent shall install automatic garage door openers on the Sands Drive garage. 4. Morton To permit division of one lot into two separate parcels located on the north side of Liberty Street approximately 500 feet west of Beach Boulevard in an R2, Medium Density Residential District. Mr. Morton was present at the meeting. He read and concurred with suggested conditions of approval for the request. He explained that the lot split has in effect existed for many years and the request will merely leqalize an existing situation. Dave Eadie amended the map at the meeting to include both lots within the blue border, numbering them 1 and 2; the applicant agreed to this amendment. Jerry Ellstrom explained the fees required for both feeder lines and water lines which the applicant is required to install to get water from the main lines to his property. ON MOTION BY ELLSTROM AND SECOND BY QUINLAN TENTATIVE PARCEL MAP NO. 77-54 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received and dated December 21, 1977, shall be the approved layout, with the amendments as noted thereon. 2. A parcel map shall be filed with and approved by the De- partment of Public Works and recorded with the Orange County Recorder. 3. A copy of the recorded parcel map shall be filed with the Planning Department. 4. All applicable fees shall be paid prior to issuance of building permits on the site. Board of Zoninq Ad3ustments December 28, 1977 Page 9 shopping center located at Edinger Avenue and Goldenwest Street. Said sign has overall dimensions (including sign support structure) of 7'9" by approximately 13 feet. The Board reviewed the request.
