CONDITIONAL EXCEPTION NO. 77-62/ADMINISTRATIVE REVIEW NO. 77-209
Applicant: Robert J. Krogh, M.D.
The requests are respectively: to permit reduction in parking spaces
for an existing medical building from 10 required to 9 provided and
to permit construction of a 221 square foot addition to an existing
medical building located on the west side of Beach Boulevard approxi-
mately 70 feet south of Newman Street in a C4, Highway Commercial
District.
Chairman Eadie reopened the public hearing; no one was present at the
meeting in regard to these requests, and the public hearing was closed.
Mr. Eadie explained that the applications will require continuance to
allow the proper time for the legal notice for a revised conditional
exception.

NO. 77-62 AND ADMINISTRATIVE REVIEW NO. 77-209 WERE CONTINUED TO
THE REGULAR MEETING OF JANUARY 11, 1978, BY THE FOLLOWING VOTE:

REGULAR AGENDA ITEMS:
CONDITIONAL EXCEPTION NO. 77-67 (Cont. from 12-28-77)
Applicant: Aezel Construction Corporation, Inc.
To permit waiver of a requirement for a recorded maintenance ease-
ment between two abutting single-family dwellings located'on the
east side of 14th Street approximately 100 feet south of Pecan Avenue
in the Townlot Specific Plan Area One, Section A.
This request is a Categorical Exemption, Class V, California Envir-
onmental Quality Act, 1970.
Chairman Eadie opened the public hearing. Robert F. Garrett, owner
of subject property, was present to represent the application, ex-
plaining that his neighbor is willing to allow access but will not
agree to a recorded easement for that purpose. There being no other
persons to address the Board in regard to this matter, the public
hearing was closed.
The Board reviewed the proposal with the applicant, outlining the
necessary findings of hardship upon which any approval must be based
and considering alternative ways of siting the buildings on the lot
to eliminate the need for a maintenance easement.
ON MOTION BY EADIE AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO.
77-67 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE:
REASONS FOR DENIAL:
1. The applicant has failed to demonstrate sufficient hardship to
justify granting of the conditional exception, as alternate lay-
outs are available to permit construction of the dwellings on
the site.
2. Granting of the conditional exception would constitute granting
of special privilege.
3. Granting of the request could mandate trespass on adjacent prop-
erties whenever maintenance became necessary.

USE PERMIT NO. 77-105
Applicant: Robert G. Jenkins
To allow truck doors in a previously approved industrial building to
face a public street on property located at the southwest corner of
Chemical Lane and Research Drive in a 100-M1-A-20,000, Restricted
Manufacturing District.
This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
Chairman Eadie opened the public hearing. There being no persons
present to address the Board in regard to this request, the public
hearing was closed.
Board review ensued.
ON MOTION BY QUINLAN AND SECOND BY CROSBY USE PERMIT NO. 77-105 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING
VOTE:
FINDINGS OF THE BOARD:
1. The proposed location of the truck doors is consistent with other
properties in the surrounding area.
2. There is not an excessive number of these types of doors existing
in the area at the present time.
3. The proposed use will not be detrimental to properties and im-
provements in the same general area and zoning classification.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual site plan received and dated December 20, 1977,
shall be the approved layout.
In its approval action, the Board of Zoning Adjustments considered
the following issues in relation to the conceptual plan:
. Traffic circulation and drives;
. Parking layout;
. Lot area;
. Lot width and lot depth;
. Type of use and its relation to property and improvements in the im-
mediate vicinity;
. Past administrative action regarding this property.

2. All applicable fees shall be paid prior to issuance of
building permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. The overhead doors shall be painted with colors compatible
with those used on the building itself.

MISCELLANEOUS AGENDA ITEMS:
ADMINISTRATIVE REVIEW NO. 77-124 (Revised)
Applicant: Stanley A. Smith
Revised plan for a 24,560 square foot industrial/office building loc-
ated on the north side of Industrial Drive approximately 142 feet
east of Chemical Lane in a 100-M1-A-20,000, Restricted Manufacturing
District.
AR 77-124 and TPM 77-44 have been approved for the subject site. The
Board reviewed the revised plan in relation to the previously approved
layout, noting that the applicant has deleted parking to leave a large
open area which might be used for storage or outside industrial
activity of some nature. Regulations in effect concerning outside
storage and screening required were discussed, with the consensus of
the Board being that Planning staff should contact the applicants and
work out screening details prior to approval of the revised plan.
If problems arise which cannot be resolved, the revised plan should
come back to the Board for further review.
ON MOTION BY QUINLAN AND SECOND BY CROSBY THE REVISED PLAN FOR ADMIN-
