This request is covered by Negative Declaration No. 77-66, adopted by the Planning Commission on June 21, 1977, upon adoption of Conditional Exception No. 77-04. Chairman Eadie reopened the public hearing. Thomas Drummond was pre- sent to represent the applicant. There being no persons to speak for or against the proposal, the public hearing was closed. The revised plans now show access being taken from MacDonald Street to the "corner" lot abutting the future Parkside Lane. The Board considered access easements and exterior side setbacks off Parkside, and the applicant was advised of the private open space and lot coverage requirements which it is incumbent upon him to meet. ON MOTION BY EADIE AND SECOND BY CROSBY USE PER14IT NO. 77-104 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW- ING VOTE: Minutes, H.B. Board of Zoning Adjustments January 18, 1978 Page 2 FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to property or improvements in the vicinity of such use, or injurious to the general welfare of persons residing or working in the vicinity. 2. Substantial compliance with code requirements has been achieved. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised site plan received and dated January 16, 1978, shall be the approved layout, subject to the modifications described herein: a. The plan shall be revised per code requirements as discussed with the applicant. b. A 20-foot radius shall be shown on the site plan. c. The five-foot strip abutting the precise-plannei future Parkside Lane shall be indicated on the site plan with a dotted line and marked as "future street." The modifications outlined above shall be delineated on the site plan submitted to the Department of Building and Community Develop- ment upon application for building permits. 2. Reciprocal easements between the separate properties for mutual access shall be filed for recordation prior to issu- ance of building permits. 3. All applicable fees shall be paid prior to issuance of building permits. AYES: EADIE, CROSBY, QUINLAN NOES: NONE ABSENT: NONE USE PERMIT NO. 77-96 Applicant: Beach Motors To permit construction of an 1100 square foot sales office building within an existing auto dealership located on the west side of Beach Boulevard approximately 520 feet north of Slater Avenue in a C4, Highway Commercial District. This request is a Categorical Exemption, Class III, California En- vironmental Quality Act, 1970. Chairman Eadie opened the public hearing. Bob Williamson was present at the meeting for the applicant. There being no one present to address the Board in regard to the project, the public hearing was closed. The Board reviewed the request, noting the temporary nature of the use. ON MOTION BY CROSBY AND SECOND BY EADIE USE PERMIT NO. 77-96 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW- ING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to property and improvements in the vicinity of such use or building or injurious to the general welfare of persons residing or working in the vicinity. 2. The granting of a Use Permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan received and dated December 30, 1977, shall be the approved layout for the temporary structure. BZA 1-18-78 Page 3 Minutes, H.B. Traffic circulation and drives; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. All applicable fees shall be paid prior to issuance of permits. B. GENERAL CONDITIONS: 1. This approval shall be for a one-year period. 2. Skirting shall be provided around the bottom of the temporary structure to block the wheels and undercarriage from view. AYES: EADIE, CROSBY, QUINLAN NOES: NONE ABSENT: NONE USE PERMIT NO. 77-98 Applicant: Classic Development Corporation To permit construction of a 104-unit apartment complex with appur- tenant amenities located on the south side of Ellis Avenue approxi- mately 640 feet west of Delaware Street in an Ml, Light Industrial District (zoning to R2, Medium Density Residential pending). This request is covered by ND 77-119. Chairman Eadie opened the public hearing. Morrie Nichol, Mike Peter- son, and Kent Bourland were present to represent the application. Ron Russell, Chairman of the Industrial/Commercial Committee and past president of the Five Points Homeowners Association was present also. Mr. Russell reported that the only concern the Industrial League and the residents in the area had was that adequate buffering be pro- vided between the subject project and the industrial property to the south. Mr. Eadie informed him that the industrial setback re- quirement serves as buffering for the residential, and any physical barrier between the properties will be incumbent on the developer of the adjacent industrial sites. Mr. Nichol did, however, indi- cate that it is their present plan to build a block wall along both the southerly and westerly property lines of the complex. The Board reviewed the information contained in the negative dec- laration prepared for the project. Specifically, the Environmental Council's recommendation that an EIR be prepared was discussed, with the consensus being that with the mitigating measures proposed by the Environmental section the negative declaration has adequately addressed the environmental aspects of the project. Board of Zoning Adjustments January 18, 1978 Page 5 Retention of the onsite trees was also reviewed, taking into con- sideration the lack of data on the age and condition of said trees. ON MOTION BY CROSBY AND SECOND BY EADIE THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 77-119 WITH THE MITIGATING MEASURES CONTAINED IN CONDITIONS OF APPROVAL C-1 THROUGH C-9 IMPOSED ON THE USE PERMIT, BY THE FOLLOWING VOTE: AYES: EADIE, CROSBY, QUINLAN NOES: NONE ABSENT: NONE There being no other persons to address the Board, the public hear- ing was closed. Dave Eadie reviewed for the Board's information the modifications to the plan which staff and the applicant have worked out. The applicants were advised that they should consider in the design of their perimeter wall the need for a future section of a cul-de-sac or bulb at the southerly end of the project, thereby precluding any future necessity for realignment of the fence. Bruce Crosby also outlined the street improvements which his Department will require on Ellis Avenue. ON MOTION BY QUINLAN AND SECOND BY CROSBY USE PERMIT NO. 77-98 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW- ING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to property and improvements in the vicinity of such use or building and will not be injurious to the general welfare of persons residing or working in the vicinity. 2. The granting of a Use Permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan and elevations received and dated January 9, 1978, shall be the approved layout, subject to the modifications outlined herein: a. The easement for the existing 21-inch water line loc- ated in the vacated right-of-way of Huntington Street BZA 1-18-78 Page 5 Minutes, H.B. Board of Zoning Adjustments January 18, 1978 Page 6 shall be shown on the plan, and all structures located at least five (5) feet from the easement line. b. The plan shall show the entire project shifted five (5) feet to the south, to provide for zero setback on the southerly property line and an average twenty (20) foot setback on the Ellis Avenue frontage. The modifications outlined above shall be depicted upon the plans submitted to the Department of Building and Community Development upon application for building permits. 2. Building permits for this project will not be issued until the rezoning (ZC 77-17) becomes effective. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: Traffic circulation and drives; . Parking layout; Lot area; . Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 3. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. The interior units within the water area shall be svrinklered in compliance with Fire Department standards. 2. The drives from the laundry rooms on both the east and west sides of the project shall be red -lined and posted "no park- ing." C. GENERAL CONDITIONS: 1. A detailed seismic study prepared by a qualified geologist shall be submitted prior to development of the site. The study shall indicate the potential for ground rupture and make recommendations regarding structural and foundation design. 2. Trees (minimum 30" box) shall be planted onsite at a ratio of 1.25 trees per unit. 3. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers. Natural gas shall be stubbed in at the locations of cook- ing units, water heaters, and central heating units. 5. Low -volume heads shall be used on all spigots and water faucets. 6. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall he disposed of at an offsite facility equipped to handle them. 7. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. 8. Double -paned windows shall be installed within any units facing onto the adjacent arterial highway. 9. If outside lighting is included on site, high-pressure sodium vapor lamps shall be used to prevent "spillage" onto adjacent areas and for energy savings. AYES: EADIE, CROSBY, QUINLAN NOES: NONE ABSENT: NONE USE PERMIT NO. 77-107 Applicant: Robert F. Curtis Development To permit the establishment of a two-story restaurant (approximately 8375 total square feet, seating capacity of 198) within an existing commercial building located on the south side of Warner Avenue approximately 150 feet west of Bolsa Chica Road in a C4, Highway Commercial District. This request is a Categorical Exemption, Class II, California En- vironmental Quality Act, 1970. Chairman Eadie opened the public hearing. Robert Curtis was present at the meeting and submitted a revised concept, which includes an additional 1,000 square feet of space on the second floor. He noted that the actual seating plan has not been worked out, but will be submitted at a later date. He also informed the Board that the center is 85 percent leased, with no space for another retail use to come in. All other uses are offices operating from 8:00 or 9:00 a.m. to 5:00 p.m., with the exception of one other restaurant with night- time hours located at the opposite end of the center from the sub- ject building. Dave Eadie noted that a complaint had been received from Etta Billingsley (address unknown) on Friday, January 13. BZA 1-18-78 Page 7 Minutes, H.B. Board of Zoning Adjustments January 18, 1978 Page 8 Mrs. Billingsley's stated concern was over the lack of available parking in the shopping center. There being no other persons to address the Board in regard to the subject proposal, the public hearing was closed. The Board reviewed the new plan and the information submitted, con- sidering the magnitude of reduction in parking spaces vs. the proposed use, the day -vs. -night criterion upon which said reduction can be allowed, and the walking distance from available parking to the various uses. Regis Quinlan and Chuck Burney noted that in actual operation the occupancy load may be greater than indicated by the seating capacity of the use, based upon experience with other facilities of like nature. ON MOTION BY EADIE AND SECOND BY CROSBY USE PERMIT NO. 77-107 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW- ING VOTE: FINDINGS OF THE BOARD: 1. The applicant has demonstrated sufficient justification for the reduction in parking spaces; i.e., the restaurant use will generate its greatest parking need during the nighttime hours and will not have a significant need for day parking, whereas the office and retail uses on the site are primarily daytime opera- tions. Therefore, no substantial impact on the overall parking within the center will result from this use. 2. The establishment, maintenance, and operation of the use will not be materially detrimental to property and improvements in the vicinity of such use, nor have an injurious effect on the general welfare of persons residing or working in the vicinity. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual site plan received and dated Janu- ary 18, 1978, shall be the approved layout, and the floor plan received and dated December 28, 1977, shall be the approved layout for the originally requested restaurant space. 2. The reduction in parking spaces authorized by this approval shall be for fifteen (15) spaces. 3. The applicant shall submit a detailed, dimensioned floor plan for both the originally requested space and the 1,000 square foot additional space delineated on the 1-18-78 plan. If staff review of that floor plan determines that there is additional shortage of parking spaces, the applicant shall r�l BZA 1-18-78 Page 8 Minutes, H.B. This request is a Categorical Exemption, Class I, California Envir- onmental Quality Act, 1970. Chairman Eadie opened the public hearing. Evan James and Peter Dement were present at the meeting; there being no other persons to address the Board in regard to this request, the public hearing was closed. The Board reviewed the use permit. ON MOTION BY EADIE AND SECOND BY CROSBY USE PERMIT NO. 78-1 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW- ING VOTE: FINDINGS OF THE BOARD: 1. There is not an excessive number of overhead doors of this type in relation to the other buidlings in the area. 2. The establishment of the use will not be detrimental to property and improvements in the vicinity of such use. 3. The proposal is consistent with the City's General Plan of Land Use. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. The overhead doors shall be compatible in color and material with the front elevation of the building in which they are located. Evan James and Peter Dement were present at the meeting. The Board reviewed the code requirements for the benefit of the applicants and informed them of problems which have been encountered within the Lusk tract of vehicles stacking up in front of the overhead doors, requesting that to be taken into consideration on the plan. Also discussed were setbacks and drive easements. ON MOTION BY EADIE AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 78-1 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. This request is a Categorical Exemption, Class I(e), California Environmental Quality Act, 1970. Chairman Eadie opened the public hearing. James Brewster was pre- sent at the meeting. There being no one to address the Board for or against the proposed addition, the public hearing was closed. Board review ensued. AYES: EADIE, CROSBY, QUINLAN NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 77-128 Applicant: James Kubilka/Gary Shearn To permit construction of a 19,400 square foot industrial building located at the southeast corner of Mountjoy Drive and Enterprise Lane, approximately 800 feet easterly from Gothard Street in an Ml, Light Industrial District. This request is covered by Exemption Declaration No. 74-150 approved for the tract in which subject property is located. James Kubilka was present at the meeting and submitted revised plans for his project. These changes involve slight change in setbacks, relocation of parking places, added landscaping in front of the park- ing stalls, and provision of a 25-foot in -and -out driveway. Chuck Burney said that the Fire Department has no problems with the circu- lation and drive width. Dave Eadie discussed the elevations of the building and instructed the applicant to submit front and rear elevations to the Planning Department for review and approval. The elevations should show a grill, two-tone treatment, or other method of treatment to give aesthetic relief, and carry said treatment around the corners of the building. TO BE APPROVED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plan received and dated January 18, 1978, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: . Traffic circulation and drives; • Parking layout; • Lot area; . Rooftop mechanical equipment screening plan. Said plan shall indicates screening of all rooftop mechanical equipment and shall delineate the type of material pro- posed to screen said equipment. 3. Proof of the location of the easement depicted upon the approved plan shall be submitted. 4. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. The one-way drive shall be adequately signed or posted for "no entry," at an appropriate location. This request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Dan Lewis, agent for the applicant, was present at the meeting. The request was reviewed by the Board. ON MOTION BY QUINLAN AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 78-2 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan and elevations received and dated January 6, 1978, shall be the approved layout as amended to reflect code requirements. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: . Traffic circulation and drives; • Parking layout; • Lot area; .
