CONSENT CALENDAR: MINUTES OF JANUARY 17, 1978 GENERAL PLAN CONFORMANCE 78-1 - Find in conformance with the General Plan proposed street improvements on McFadden near Gothard GENERAL PLAN CONFORMANCE 78-2 - Find in conformance with the General Plan proposed sewer trunk mains in Main Street and Beach Boulevard. ON MOTION BY STERN AND SECOND BY NEWMAN THE CONSENT CALENDAR WAS APPROVED BY THE FOLLOWING VOTE: AYES: Stern, Finley, Newman, Hoffman NOES: None ABSENT: Slates, Shea ORAL COMMUNICATIONS: None PUBLIC HEARINGS: PRECISE PLAN OF STREET ALIGNMENT 78-1/NEGATIVE DECLARATION 78-3 This is a request by the City Council to restrict vehicular access between residential and industrial areas on McFadden Avenue between Chemical Lane and Cambay Lane. Bill Derrick gave a brief introduction to the traffic engineer's report on the McFadden Avenue closure. Ralph Leyva, assisted by Bruce Gilmer, presented five alternative strategies. Chairman Finley opened the public hearing. Sandy Radzai addressed the Commission and discussed the problem . of making a left turn on Bolsa Chica. She stated that rather than close it altogether Alternative 3 should be considered. This would prohibit left turns from Bolsa Chica onto McFadden. Minutes: H.B. Planning Commission Tuesday, February 7, 1978 Page 2 Karl Schopp addressed the Commission on Alternative 3. Fred Trueman spoke in favor of closure. John Bitui spoke in favor of keeping McFadden open. He preferred Alternative 1 which would retain existing conditions. Mervin C.-Woodcock spoke in favor of Alternative 4 which provides complete closure. Jack Tatham spoke in favor of speed bumps on McFadden and agreed with Ms. Radzai's statements. Teresa Mester discussed the traffic problems on Bolsa Chica. Laura Denny expressed concern for school children crossing McFadden. Barbara Smead addressed the problem of getting onto Bolsa Chica from McFadden. Gus Sharkey spoke in favor of Alternative 1. He stated that if Alternative 3 is selected a longer green light should be provided from McFadden to Bolsa Chica. He was also in favor of a stop sign on Chemical Lane and speed bumps. Richard Frankel spoke in favor of No. 4. Ralph Leyva, Traffic Engineer, stated that there were no speed bumps on public streets in Huntington Beach, since the City might be liable in case of damage. Rudy Brebrick spoke in favor of keeping the street open. He stated that he felt 95% of residents on McFadden wanted it to remain open with improved signs. Sandy Laurie spoke on the problems presently in the area. Martin Walsh spoke in favor of keeping McFadden open. William Selby stated that he would like to have the street closed with a park put in. Robert Adam stated that he would like to see Alternative 4 adopted. Peter Leppin spoke in .favor of leaving McFadden open. Glenn Davis addressed the Commission and expressed concerns over the traffic problems in the area. While she did not suggest any alternative she stated that she felt something should be done to alleviate the present problems. Imogene Powers spoke in favor of closure of McFadden. ON MOTION BY STERN AND SECOND BY NE,WMAN ALTERNATIVE NO. 6 WAS APPROVED WHICH RECOMMENDED THAT STOP SIGNS BE INSTALLED AT CHEMICAL AND CAMBAY AND ADDITIONAL SIGNAGE FOR TRUCKS TO PROCEED ON GRAHAM AND ARGOSY BY THE FOLLOWING VOTE: AYES: Stern, Finley, Newman, Hoffman NOES: None ABSENT: Slates, Shea P: Chairman Finley called a five minute recess at 9:00 p.m. CONDITIONAL USE PERMIT 77-25/NEGATIVE DECLARATION NO. 77-138 Applicant: Sunshine Tree Farms This is a request to expand an existing wholesale nursery by adding approximately 3.4 acres of land and by allowing retail/wholesale sales to the general public between 9:00 a.m. and 5:00 p.m. seven days a week. The property is located at 19222 Ward Street on the southeast corner of Garfield and Ward. Monica Florian gave a brief background of the history of this application. Chairman Finley opened the public hearing. There was no one present to speak on this application and the Chairman closed the public hearing. Commission discussion ensued. ON MOTION BY NEWMAN AND SECOND BY STERN NEGATIVE DECLARATION NO. 77-138 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Stern, Finley, Newman, Hoffman NOES: None ABSENT: Slates, Shea ON MOTION BY NEWMAN AND SECOND BY STERN CONDITIONAL USE PERMIT NO. 77-25 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS: 1. The proposed use is compatible with the surrounding uses. 2. The proposed use has resulted in positive environmental effects, including weed and rodent control and an improvement in the visual aesthetics of the site. CONDITIONS OF APPROVAL: 1. The site plan dated December 19, 1977 shall be the approved layout. 2. All interior roads and travelways shall have either gravel or all weather surfacing. 4. Twetty-seven (27) on site parking spaces shall be provided. 5. Hours of operation on Sunday shall be limited to between 9:00 a.m. and 5:00 p.m. 6. Only one (1) on site sign shall be permitted. Said sign shall have a maximum height of 8 feet and shall be limited to 32 square feet. 7. All street dedication and improvements shall be made at the time Garfield Avenue is improved between Ward Street and the Santa Ana River. AYES: Stern, Finley, Newman, Hoffman NOES: None ABSENT: Slates, Shea PRECISE PLAN OF STREET ALIGNMENT/77-7/NEGATIVE DECLARATION 78-8 Applicant: Initiated by Planning Commission This is a request to provide access to landlocked property located on the south side of Heil Avenue, 300 feet west of Graham Street. Chairman Finley opened the public hearing. Bill Sullivan addressed the Commission and spoke in opposition to this precise plan of street alignment, stating that he would have to give up some property if it was approved. Bob Stellrecht addressed the Commission and stated that he concurred with Mr. Sullivan's objections. Donald Peart, architect for the dhurch, spoke in favor of the proposed alignment. The public hearing was closed. Commission discussion ensued. Planning Commission Tuesday, February 7, 1978 Page 5 ON MOTION BY NEWMAN AND SECOND BY STERN PRECISE PLAN OF STREET ALIGNMENT NO. 77-7 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITION BY THE FOLLOWING VOTE: FINDINGS: 1. The proposed street will provide needed access to both existing and future developments abutting Graham Place. 2. AYES: Stern, Finley, Newman, Hoffman NOES: None ABSENT: Slates, Shea ZONE CHANGE NO. 77-21 Applicant: Initiated by the Planning Department This zone change from RA to C2 was initiated by the Planning Staff in September of 1977 in an effort to implement the previously approved Land Use Element (December, 1973) designation of commercial/retail. General Plan Amendment No. 77-3 analyzed this site and determined that the area should maintain a designation of commercial. The property is located on the northeast corner of Beach Boulevard and Indianapolis Monica Florian addressed the Commission and gave a brief review of the history of this zone change. The public hearing was opened. There being no one present to speak on this application the public hearing was closed. Commission discussion ensued. ON MOTION BY NEWMAN AND SECOND BY STERN ZONE CHANGE NO. 77-21 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: FINDINGS: 1. The Land Use Element of the General Plan designates the subject .property as general commercial. Therefore, the proposed C2 zoning (community business district) is consistent with the City`s General Plan. 2. The resulting commercial uses will be compatible with the surround- ing land uses. Warmington Co. This is a request for a change of zone from R2 to R1. This request was filed by the applicant to comply with one of the conditions of approval of Tentative Tract 5664. The R1 zoning will eliminate the possibility of rental units being added to the proposed single family neighborhood. Monica Florian gave a brief background report on this zone change. The public hearing was opened. There was no one present to speak on this application and the public hearing was closed. Commission discussion ensued. ON MOTION BY HOFFMAN AND SECOND BY NEWMAN ZONE CHANGE 78-3 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: 1. The proposed R1 zoning is consistent with the City's General Plan and compatible with existing surrounding land use. 2. The proposed R1 zoning will satisfy one of the conditions of approval on Tentative Tract 5664. AYES: Stern, Finley, Newman, Hoffman NOES: None ABSENT: Slates, Shea The Commission directed staff to initiate a GPA on this property to low density. CONDITIONAL EXCEPTION NO. 78-01 Applicant: Harbor Bluffs Development IN CONJUNCTION WITH: TENTATIVE TRACT NO. 10213/NEGATIVE DECLARATION NO. 77-139 Applicant: Harbor Bluffs Development Conditional Exception No. 78-01 is a request for a one (1) foot lot frontage reduction on five lots. Tentative Tract No. 10213 is a request for a 5 lot subdivision located on the south side of Slater and` -east side of Van Buren. Dave Eadie addressed the Commission and gave a brief history of the applications. He noted that there were two alternatives, with the staff recommending approval of Alternative 1. The public hearing was opened. Gary Chapman, a resident of the neighborhood, spoke against the development, stating that there was flooding in the area and he did not feel additional development should be permitted without additional environmental information. -6- 2/7/78 - PC Minutes: H.B. The public hearing was closed. Commission discussion ensued. ON MOTION BY NEWMAN AND SECOND.BY HOFFMAN NEGATIVE DECLARATION NO. 77-139 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Stern, Finley, Newman, Hoffman NOES: None ABSENT: Slates, Shea ON MOTION BY NEWMAN AND SECOND BY HOFFMAN CONDITIONAL EXCEPTION NO. 78-01 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: 1. The subject property's size and dimensional configuration dictate a more desirable and efficient layout from an open space and traffic perspective if all of the lots were to be oriented to Slater Avenue. 2. The one (1) foot reduction in lot frontage will result in a better unit to unit orientation and thus allow each lot to be developed in the same manner. 3. The frontage reduction will allow all lots to front onto Slater Avenue and thus be consistent with the surrounding developed properties. 4. The submitted design alternatives indicate the applicant's willing- ness and ability to complete the requested development as proposed. AYES: Stern, Finley, Newman, Hoffman NOES: None ABSENT: Slates, Shea ON MOTION BY NEWMAN AND SECOND BY HOFFMAN TENTATIVE TRACT NO. 10213, ALTERNATIVE 1, WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS: 1.- The proposed subdivision of this 1.5 acre parcel of land zoned R2 (which allows 14.89 units per gross acre) is proposed to be con- structed having 13.24 units per gross acre. 2. The property was previously studied for this intensity of land use at the time the land use designation for low density resi- dential was placed on said property. 4. The lot size, depth, frontage, street widths, and all other design and improvements features of the proposed subdivision are pro- posed to be constructed in compliance with standard plans and specifi- cations on file with the City, as well as in compliance with the State Map Act and supplementary City Subdivision Ordinance. CONDITIONS OF APPROVAL: 1. The tentative map received and dated January 20, 1978 and indicated as Alternative No. 1, shall be the approved layout. 2. The sewer, water, and fire hydrant systems shall be subject to City standards. 3. Drainage for the subdivision shall be approved by the Department of Public Works prior to the recordation of a final map. This system shall be designed to provide for siltation and erosion control both during and after construction of the project. 4. Natural gas and 220V electrical shall be stubbed in at the locations of clothes dryers. 5. Natural,gas shall be stubbed in at the locations of water heaters and central heating units. 6. Low volume heads shall be used on all spigots and water faucets. 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 8. The structures on the subject property, whether attached or de- tached, shall be constructed in compliance with the State Acoustical Standards set forth -for all units that lie within the 60 CNEL contours for the property. 9. A chemical analysis as well as tests for physical properties of the soil on the subject property shall be submitted to the City for review prior to the issuance of building permits. Planning Commission Tuesday, February 7, 1978 Page 9 TENTATIVE TRACT NO. 9908/NEGATIVE DECLARATION NO. 77-82 Applicant: Robert Steilrecht This is a request to subdivide approximately 10.3 acres into 43 lots, which are proposed to be developed with single family homes. The property is located at the northwest corner of Slater and Gothard. Dave Eadie gave a brief presentation on this application. A MOTION WAS MADE BY NEWMAN AND SECONDED BY HOFFMAN TO APPROVE NEGATIVE DECLARATION NO. 77-82. Commissioner Stern stated that he would vote against this project because he feels the initial study is incomplete and there should be an EIR, because of soils, noise and archaeological problems which have not been addressed. Dave Eadie stated there was a preliminary soils investigation and analysis done as part of the environmental analysis. Secretary Selich stated that an agreement had been reached with an archaeological group at Cal State Fullerton with the property owner entering into a contract with Cal State Fullerton to conduct a study prior to any construction being done. VOTE: AYES: Finley, NOES: Stern ABSENT: Slates, Newman, Hoffman Shea Tentative Tract No. 9908 and Negative Declaration No. 77-82 were automatically continued to February 22, 1978. Secretary Selich stated that he would look into the three questionable areas raised by Commissioner Stern. TENTATIVE TRACT NO. 10179 Applicant: Robert E. Jarrard This is a request to subdivide approximately 2.7 acres into ten (10) lots which in turn will be developed with multi -family residential units located on the southeast corner of Viewpoint Lane and Terry Drive. Monica Florian stated that a letter had been received from the High School District commenting on overcrowding of the school district which" could occur with additional development. She further stated that she had been unable to contact the school district to discuss the matter. Bob Jarrard addressed the Commission and stated that he had been un- successful in attempts to reach the concerned member of the High School District. He further stated that when the Negative Declaration was applied for there were no comments from the School District. Commission discussion ensued. -9- 2/7/78 - PC Minutes: H.B. The subdivision of this 2.7 acre parcel which will be zoned R2, which allows 14.89 units per acre, is proposed to be developed having 14.81 units per acre. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation for this type of housing. 3. The property was previously studied for this intensity of land use at the,.time the land use designation for medium density residential was placed on,said property. 4. The lotrsize, depth, frontage, street widths, and all other design and improvement features of the proposed subdivision are proposed .to be constructed in compliance with standard plans and specifi- cations on file with the City, as well as in compliance with the State Map Act and supplementary City Subdivision Ordinance.
