Monica Florian addressed the Commission and gave a brief history of this zone change request. The public hearing was opened. A�resident of the area addressed the Commission and spoke in favor of R1 zoning for the area. The public hearing was closed. Commission discussion ensued. The proposed Oldtown Specific Plan - District One zoning is con- sistent with the City's;General Plan. 2. The proposed uses permitted by the Oldtown Specific Plan zoning will be compatible with existing and proposed surrounding land uses. Curtis Development Appellant: Etta E. Billingsly This request, to permit the establishment of a two-story restaurant, approximately 8,375 total square feet, located on the south side of Warner Avenue, approximately 150 feet west of Bolsa Chica Street, was approved by the Board of Zoning Adjustments at its January 18, 1978, meeting. It was appealed by Ms. Etta E. Billingsly. Dave Eadie addressed the Commission and gave a brief background of the application. He presented a vugraph of the area. The public hearing was opened. There was no one present to speak on this appeal, and Chairman Finley closed the public hearing. Commission discussion ensued. ON MOTION BY SLATES AND SECOND BY NEWMAN APPEAL TO USE PERMIT NO. 77-107 WAS DENIED BY THE FOLLOWING VOTE: AYES: Slates, Stern, Finley, Shea, Newman, Hoffman NOES: None ABSENT: None SPECIAL SIGN PERMIT NO. 78-1 Applicant: Federal Sign Company This application is a request by the applicant to add an additional 60 sq. ft. freestanding sign to a shopping center located at 18035 Beech Boulevard, on the west side of Beach, 215 ft. south of Talbert. Monica Florian addressed the Commission and stated that the staff was recommending denial because a hardship had not been shown by the applicant and that approval of such a sign could establish a pre- cedent for other tenants. Art Davidson, representing Federal Sign Company, addressed the Commission and spoke in behalf of the owner of the restaurant, stating that additional sign coverage would assist in bringing in more business to the restaurant. Lee Collins, owner of the premises, spoke in behalf of Mr. Garcia, operator of the restaurant. He stated that he felt a hardship existed due to the sign exhibited by Winchell's Donut shop. Commissioner Shea stated that she did not feel that the sign would aid in this type of business and was not in favor of it. Mr. Joe Garcia, owner of the restaurant, addressed the Commission and handed out to the Commission (1) Statement of Earning of La Fiesta Grande from July 1, 1977, to December 31, 1977, prepared by El Key Sausage Co., Inc., (2) Letter from Henry C. Hopkins, Attorney at Law, re YEZY Radio Station, Inc., concerning a claim for $1,596.40, (3) Letter from Sonitrol dated February 7, 1978 concerning delinquent account in the amount of $355.00, and (4) Notice to Pay Rent or Quit from Robert L. Baranov, Attorney at Law, for a total bill of $12,830.92. These documents have been made a part of the permanent file. Mr. Garcia discussed the fact that he was losing money which he felt was due in part to lack of signing. Art Davidson again addressed the Commission and explained that the proposed sign would belong to the sign company and would be kept up by them. The public hearing was closed. Commission discussion ensued. ON MOTION BY SLATES AND SECOND BY NEWMAN SPECIAL SIGN PERMIT NO. 78-1 WAS APPROVED FOR A PERIOD OF 18 MONTHS WITH A REVIEW TO BE CONDUCTED AFTER 12 MONTHS FOR THE FOLLOWING REASONS AND BY THE FOLLOWING VOTE: 1. Strict compliance with Article 976 will result in a substantial economic hardship to the applicant; and 2. The proposed or existing sign will not adversely affect other I signs in the area; and 3. The proposed or existing sign will .got Le detrimental to the property to-zated in the vicinity of such sign; and i 4. Planning Commission Wednesday, February 22, 1978 Page 4 CODE AMENDMENT NO. 78-1 This is an Ordinance of the City of Huntington Beach amending the Huntington Beach Ordinance Code by amending certain sections thereof for the purpose of clarifying application processing deadlines. Dave Eadie gave a brief history of this code amendment. The public hearing was opened on this code amendment. There being no one present to speak on it, the Chairman closed the public hearing. ON MOTION BY SLATES AND SECOND BY NEWMAN CODE AMENDMENT NO. 78-1 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Slates, Stern, Finley, Shea, Newman, Hoffman NOES: None ABSENT: None Chairman Finley called a recess at 7:50 p.m. TENTATIVE TRACT NO. 9908/NEGATIVE DECLARATION NO. 77-82 Subdivider: Robert Stellrecht This is a request for a 43 lot subdivision of property located on the northwest corner of Slater and Gothard Street. These applications were continued from the Planning Commission's February 7, 1978 regular meeting for the purpose of gaining additional information regarding the initial study/negative declaration on the project. Dave Eadie addressed the Commission and discussed the four additional conditions of approval suggested by the staff. A vugraph was presented. Commissioner Stern felt a noise report should be studied. COMMISSIONER STERN MADE A MOTION TO APPROVE NEGATIVE DECLARATION WITH AN ADDITIONAL CONDITION THAT WOULD REQUIRE A NOISE EASEMENT. THE MOTION DIED FOR LACK OF A SECOND. Commission discussion ensued. Planning Commission Wednesdal, February 22, 1978 Page 5 ON MOTION BY SLATES AND SECOND BY SHEA A STRAW VOTE WAS TAKEN TO ELIMINATE CONDITION NO. 15., WHICH REQUIRED THAT ALL DWELLING UNITS ABUTTING THE CITY YARD SHALL BE ONE STORY STRUCTURES. VOTE: AYES: Slates, Shea, Newman, Hoffman NOES: Stern, Finley ABSENT: None Chairman Finley expressed her concern with the relationship of the active noisy area of the City Yard to this new residential area. The noise orientation of the City Yard has been away from the existing residential developments on two sides toward what was industrially zoned land. With this development that protection is now gone and the City is faced with the prospect of having a facility that will impact a residential area. She asked the staff to recommend conditions which would address this external noise problem and the vulnerability of the City Yard to complaints and lawsuits in future years. Condition No. 15, to require one-story homes abutting the City Yard, is designed to lessen the noise impacts of City Yard activities on those residences. She also requested a definite condition requiring that the real estate report reflect the potential noise problems from the City Yard. - ON MOTION BY SLATES AND SECOND BY SHEA TENTATIVE TRACT NO. 9908 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS: 1. The proposed subdivision of this 10.3 acre parcel of land zoned R1 (which allows 7 units per gross acre) is proposed to be con- structed having 4.17 units per gross acre. 2. :_The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation for this type of housing. 3.'_ The property was previously studied for this intensity of land_ use at the time the land use designation for low density resi- dential was placed on said property. 4. The lot size, depth, frontage, street widths, and all other design and improvements features of the proposed subdivision are pro- posed to be constructed in compliance with standard plans and specifications on file with the City, as well as in compliance with the State Map Act and supplementary City Subdivision Ordinance. -5- 2/22/78 - PC Minutes: H.B. The sewer, water, and fire hydrant systems shall be subject to City standards. 3. Drainage for the subdivision shall be approved by the Department of Public Works prior to the recordation of -a final map. This system shall be designed to provide for siltation and erosion control both during and after construction of the project. 4. Natural gas -and 220V electrical shall be stubbed in at the locations of clothes dryers. 5. Natural gas shall be stubbed in at the locations of water heaters, and central heating units. 6. Low volume heads shall be used on all spigots and water faucets. 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 8. A chemical analysis as well as tests for physical properties of the'soil on the subject property shall be submitted to the City .for review prior to the issuance of building permits. 9. Prior to approval of a final map on the subject property, a final grading plan shall be submitted to the Planning Department for review and approval, indicating that all lots within the subdivision have a minimum level pad area of 5,500 square feet. 10. Prior to the issuance of building permits for any lots within the subdivision, detailed calculations based on final building plans shall be submitted to the Planning Department and Building Depart- ment for review and approval. Said calculations shall insure that interior noise levels for all structures shall not exceed the California Noise Insulation Standards of 45 db CNEL. 11. Prior to the issuance of any grading or building permits, the subdivider shall submit to the Planning Department for review and approval a final archeological report clearing the entire site of all archeological testing and/or salvaging. Said report shall be in writing from the Public Antiquities Salvage Team. 12. Prior to the issuance of building permits, the developer shall submit to the Planning Department for review and approval, a fully dimensioned site plan for all lots within the subdivision. 13. A detailed soils analysis shall be prepared by a soils engineer. The analysis should include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regard- ing grading, fill properties, foundations, retaining walls, streets and utilities. -6- 2/22/78 - PC �J 1 H.B. Planning Commission Wednesday, February 22, 1978 Page 7 14. The north, east and south property walls depicted on the tentative map shall be acoustically designed to reduce noise levels. Said wall designs shall be subject to approval by the Planning Department. 15. All dwellings upon the site shall be subject to review by the Design Review Board. The property is located on the west side of Lawson Lane approximately 490 feet south of Adams Avenue. Dave Eadie briefly discussed the layout of the project and presented a vugraph. Randy Blanchard, representing Sand Dollar Development, addressed the Commission and stated that he would be happy to answer any questions. Mr. Britt addressed the Commission and spoke in favor of the project. Commission discussion ensued. The proposed subdivision of this 3.16 acre parcel of land zoned Rl (which allows 7 units per gross acre) is proposed to be con- structed having 5.06 units per gross acre. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation for this type of housing. 3. Improvements to the remaining portion of Lot No. 4, Tract 5197, not utilized for street purposes shall be subject to approval of the Planning Director. 10. The developer shall mitigate the potential adverse visual impacts the new east/west street will create upon Lot 46, Tract 5197, in a manner acceptable to the Planning Director. 11. An eight (8) foot masonry wall shall be constructed along the north and west property lines of the subdivision. 12. Conveyances between lots 3, 4, and 5 of Tract 5197 for the purpose of extending "B" Street to Lawson Lane and adjusting lot lines shall be recorded by separate instrument prior to recordation of the final map of the proposed subdivision. 13. All improvements to the public right-of-way or any private property necessitated by the extension of "B" Street to Lawson Lane shall be the responsibility of the developer. Investments This is a request for a 9 lot industrial subdivision located on the south side of'Hamilton approximately 820 ft. east of Newland Street. Dave Eadie referred to a letter from the applicant requesting a continuance to a March meeting, copies of which were distributed to the Commission. Commissioner Stern noted a typographical error in the Tract No. which should have read #9843 instead of #9483. Randy Blanchard of Sand Dollar Development confirmed the fact that the tract number should have been #9843. Tentative Parcel Map No. 77-45 is a request to permit the consolidation of all or a portion of 11 lots into 2 lots. Commissioner Slates stated that he would have to abstain. Charles Hermansen addressed the Commission and stated that he would be pleased to answer any questions. Commission discussion ensued. Planning Commission Wednesday, February 22, 1978 Page 12 ON MOTION BY STERN AND SECOND BY SHEA RESOLUTION NO. 1214, A RESOLUTION OF INTENTION OF THE PLANNING COMMISSION OF THE CITY OF HUNTINGTON BEACH TO REZONE THE WARNER-GOLDENWEST REDEVELOPMENT PROJECT, WAS APPROVED BY THE FOLLOWING VOTE: AYES: Slates, Stern, Finley, Shea, Newman, Hoffman NOES: None ABSENT: None WASHINGTON STREET STUDY This is a Special Study on the Washington Street Area including a recommended improvement plan for review and direction. It was noted that while this is not a public hearing, area residents were notified of Study Session. Chuck Clark addressed the Commission and discussed the recommended program for improving the area. Chairman Finley asked if there was anyone who wished to speak on this study. Ed Varela addressed the Commission and stated that he was very much opposed to an alley. David Silver stated that he was against putting in the alley. Stuart O'Quinn spoke against putting in an alley. Manuel Torres wanted the area changed to R3,which he felt would bring developers into the area. Mr. Solimon felt that if the zone was R3 it would encourage developers to come in and he was in favor of R3. Ed Varela again addressed the Commission and complained about lack of street improvements., Bill Longley stated that the City could buy the land and widen the street. He felt Warner could be improved by some other funding. It was the consensus of the Commission that this study be continued to April 4th for further discussion. ORAL COMMUNICATIONS: None COMMISSIONER ITEMS Review of Environmental Information Forms - submitted by Commissioner Stern.
