USE PERMIT NO. 78-5 (In Conj./CE 78-3) Applicant: John King To permit construction of a duplex abutting an arterial highway on property located at the northwest corner of Warner Avenue and Nichols Street in an R2, Two -Family Residential District. Secretary Eadie reported that it is necessary to continue these items to permit filing of the revised plan. Board of Zoning Adjustments March 8, 1978 Page 2 REGULAR AGENDA ITEMS: USE PERMIT NO. 77-103 (Cont. from 1-11-78) Applicant: Lee Segal To permit a truck well in a previously approved industrial build- ing to face a public street, located on the north side of Argosy Drive approximately 365 feet east of Bolsa Chica Road in an M1-A, Restricted Manufacturing District. This request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Chairman Eadie reopened the public hearing. Lee Segal was present at the meeting. There being no one present to speak for or against the proposal, the public hearing was closed. Chairman Eadie reported that Triton Lane is now dedicated and the truck wells in Building B can be considered. The Board and the applicant discussed timing of issuance of permits in relation to actual completion of the street. It was determined that TT 8688"X" and the conditions imposed thereon will take precedence, and the staff will investigate to determine if those conditions allow . issuance of building permits prior to street construction. The truck wells were found in substantial compliance with code. ON MOTION BY EADIE AND SECOND BY CROSBY USE PERMIT NO. 77-103 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. Since this is the first request of its nature on Triton Lane, the Board concludes that the use will not result in an excess number of such facilities on that street. 2. The requested use is an appropriate use in an appropriate zon- ing district. 3. The establishment, maintenance, and operation of the use will not be detrimental to the general welfare or injurious to property and improvements in the immediate vicinity. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The site Plan received and dated March 6, 1978,shall be the approved location for the truck door openings, sub- ject to compliance with all code requirements for depth of driveway from Triton Lane. NOTE: Conditions of Approval imposed upon TT 8688"X" state that the streets within the tract may be constructed in phases; however, the Department of Public Works has indicated that the intention is to handle construction in a single phase. Please contact Bruce Crosby in the Department of Public Works for further information, since issuance of building permits is contingent upon completion of street improvements. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: The overhead doors shall be architecturally treated and painted in a manner compatible with the building elevation in which they are located. Smith To permit a five (5) foot encroachment into the required rear yard setback, located at the north end of the cul-de-sac of Upperlake Circle approximately 360 feet north of Lakeview Drive in an R1, Low Density Residential District. This request is a Categorical Exemption, Class 5, California Envir- onmental Quality Act, 1970. Chairman Eadie opened the public hearing. Wayne Smith was present at the meeting and presented his reasons for requesting the variance. There being no other persons to speak for or against the pro3ect, the public hearing was closed. The Board reviewed the request, considering the depth of the lot, the present siting of the dwelling on the lot, and the orientation of the proposed addition facing an arterial street. ON MOTION BY EADIE AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 78-8 WAS APPROVED WITH THE FOLLOWING FINDINGS AND RECOMMENDA- TIONS, BY THE FOLLOWING VOTE: BZA 3-8-78 Page 3 Minutes, H.B. Board of Zoning Adjustments March 8, 1978 Page 4 FINDINGS OF THE BOARD: 1. The lot configuration and size of the property impose a hard- ship on any attempt to locate a reasonably adequate addition to the dwelling. 2. The location of the encroachment, fronting on the arterial highway, will not be detrimental to adjacent residential pro- perties. 3. Minimum open space per code requirement is maintained on the remainder of the lot. 4. Strict conformance to the ordinance code would deprive the applicant of en]oyment of substantial property rights. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan received and dated February 14, 1978, shall be the precise approved layout. In its aaproval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: . Lot area; . Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. All applicable fees shall be paid prior to issuance of building permits. AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE USE PERMIT NO. 78-12 Applicant: David Silver To permit construction of two (2) triplexes abutting an arterial street, located on the north side of Warner Avenue approximately 220 feet west of Nichols Avenue in an R2, Two -Family Residential District. This request is a Categorical Exemption, Class 3, California En- vironmental Quality Act, 1970. Chairman Eadie opened the public hearing. Gary Schmidt was present to represent the application. The Board discussed the plan with the applicant, pointing out that parking on Warner Avenue will probably not be allowed; therefore, the project must provide all required parking onsite, which the present plan does not do. Reciprocal access easements will be a re- quirement on the project, since neither lot can stand on its own to meet code requirements. Possible alternative layouts were reviewed which would provide adequate open space and parking, and it was the consensus of the Board to continue the request for a revised plan. ON MOTION BY EADIE AND SECOND BY CROSBY USE PERMIT NO. 78-12 WAS CONTINUED WITH THE CONCURRENCE OF THE APPLICANT TO THE REGULAR MEETING OF MARCH 22, 1978, BY THE FOLLOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 78-9 Applicant: Alpine Civil Engineers, Inc. To permit division of an existing 85-foot residential lot into two separate lots of 40 and 45 foot widths, respectively. This request is covered by Negative Declaration No. 78-18. Chairman Eadie opened the public hearing on the negative declaration request, noting that the Environmental Resources Division has recom- mended adoption of the request without any proposed mitigating measures. There being no persons to address the Board on the matter, the public hearing was closed. ON MOTION BY CROSBY AND SECOND BY SPENCER THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED ND 78-18, BY THE FOLLOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE Bruce Beaton, owner, and Jim Miller were present to represent the application and submitted a plot plan showing the precise locations of the existing buildings on the property. Mr. Miller indicated that he had received and concurred with the suggested conditions of approval previously forwarded to him. The Board discussed the pro- ject, considering the setbacks of the buildings from the interior lot line. The applicant amended the revised plan to depict sethack of each building from the new property line dividing them (four (4) and four and one-half (4-1/2)feet respectively). Board of Zoning Adjustments March 8, 1978 Paqe 6 ON MOTION BY CROSBY AND SECOND BY SPENCER TENTATIVE PARCEL MAP NO. 78-9 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: ' CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Department on February 14, 1978, shall be the approved layoutyas amended thereon to show four (4) and four and one-half (4-1/2)'feet, respectively, for setback of the existing structures on the site from the property line dividing Parcel 1 and Parcel 2 on that map. 2. A parcel map shall be filed with, and approved by, the Department of Public Works and recorded with the Orange County Recorder. 3. A copy of the recorded parcel map shall be filed with the Planning Department. B. GENERAL CONDITION: 1. At the time of redevelopment of the parcels, street and and alley dedication shall be made to the approval of the Department of Public Works. Desatoff To permit construction of a 14,540 square foot commercial building as an addition to an existing shopping center, located on the north side of Adams Avenue approximately 340 feet west of Magnolia Street in a C2, General Business District. This request is covered by Negative Declaration No. 78-17. Chairman Eadie opened the public hearing on the negative declaration request. Mr. Desatoff and Irving Snyder, owner, were present at the meeting. The Board reviewed the negative declaration request information and considered mitigation measures applicable to the project." There being no persons present to address the Board in regard to this matter, the public hearing was closed. ON MOTION BY EADIE AND SECOND BY CROSBY THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 78-17 BZA 3-8-78 PAGE 6 Minutes, H.B. Board of Zoning Adjustments !March 8, 1978 Page 7 WITH THE MITIGATING MEASURES CONTAINED IN CONDITIONS Cl THROUGH C4 IMPOSED ON THE ADMINISTRATIVE REVIEW, BY THE FOLLOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE The Board review found the proposed new construction to be sub- stantially in conformance with code requirements, and the review consisted primarily of revisions to the existing drive and parking layouts to better serve the entire facility. Also requested was upgrading of the existing trash locations to comply with code. Pat Spencer noted that, although present code requirements for turning radii in commercial call for a 27-foot radius, the center was originally laid out for 25-foot radius and he saw no problem with continuing that dimension in the parking lots. ON MOTION BY EADIE AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 78-18 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan received and dated February 14, 1978, shall be the approved layout, subject to reorientation of the parking layout as discussed. A revised plan depicting the parking reorientation noted above shall be submitted to the Secretary of the Board for approval prior to application for building permits. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: .Traffic circulation and drives; • Parking layout; • Lot area; . Lot width and lot depth; • Type of use and its relation to property and improvements in the immediate vicinity; • Past administrative action regarding this property. 2. All applicable fees shall be paid prior to issuance of building permits. 3. The following plans shall be submitted to the Secretary of the Board: a. Landscaping and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscap- ing specifications on file in the Department of Public Works. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material pro- posed to screen said equipment. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Resealing and restriping of the parking lot shall be com- pleted in compliance with the approved plan. 2. Paving on the northerly drive shall tie into the existing drive and shall be paved out. 3. Trash areas on the site shall be restored to code require- ments for enclosure with masonry wall and a solid gate. C. GENERAL CONDITIONS: 1. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 2. Low -volume heads shall be used on all spigots and water faucets. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 4. If outside lighting is included onsite, hiqh-pressure sodium vapor lamps shall be used to prevent "spillage" onto adjac- ent areas and for energy savings. Warmington To permit construction of a 3-unit model home complex and installa- tion of directional sign on property located at the intersection of Brookhurst Street and Bushard Street in an R2, Two -Family Resi- dential District. This request is covered by EIR 74-3, prepared for the tract in which subject models are to be located. A representative of the applicant was present at the meeting. The applicant submitted a request to add another subdivision dir- ectional sign on Brookhurst Street to increase the visibility of the site from that right-of-way. BZA 3-8-78 Page 8 C 1 Minutes, H.B. ON MOTION BY SPENCER AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 78-22 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan received and dated February 21, 1978, shall he the approved layout, with one additional sub- division directional sign approved to be located on Lot 45 of the sub]ect tract. The project shall comply with all applicable provisions of the ordinance code. 2. All applicable fees shall be paid prior to issuuance of building permits. 3. The parking area for the model complex shall be screened by a low wall and/or landscaping. No one was present to represent the application. The request was reviewed by the Board. ON MOTION BY CROSBY AND SECOND BY SPENCER SPECIAL EVENT NO. 78-1 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1.
