ROLL CALL Present: Bartlett, Coen, Siebert, Shenkman Absent: Gibbs, Wieder CALL FOR SPECIAL MEETING The City Clerk read the Call for Special Meeting which had been received and consented to by a majority of the City Council prior to 7:00 P.M., on Sunday, March 12, 1978, for the purpose of holding an Executive Session to discuss litigation matters. ROLL CALL Present: Bartlett, Coen, Gibbs, Siebert, Shenkman Absent: Wieder, Pattinson RESOLUTIONS - SPECIAL MUNICIPAL ELECTION - JUNE 6, 1978 The City Clerk presented Resolution Nos. 4601, 4602, 4603 and 4604 relative to a Special Municipal Election to revise the City Charter. The Assistant City Administrator reviewed the alternatives available to Council relative to the proposed measures as contained in Resolution No. 4602. He also referred Council to the letter written on the matter from Mr. Pat Coughlan, Consultant. Considerable discussion was held between the Council and staff regarding the format of the proposed measures. A motion was made by Gibbs, second by Bartlett, to approve Set #2 - Measures. The motion failed by the following vote: AYES: Gibbs, Bartlett NOES: Coen, Siebert, Shenkman ABSENT: Wieder, Pattinson A motion was made by Gibbs, seconded Bartlett, to approve Set #3 - Measures. The motion failed by the following vote: AYES: Gibbs, Bartlett NOES: Coen, Siebert, Shenkman ABSENT: Wieder,,Pattinson A motion was made by Coen, seconded Shenkman, to reconsider their action disapproving Set #2 - Measures. The motion carried by the following vote: AYES: Bartlett, Coen, Gibbs, Siebert, Shenkman NOES: None ABSENT: Wieder, Pattinson On motion by Gibbs, second Bartlett, Council adopted Set #2 - Measures by the following roll call vote: El 210 Page 2 - Council Minutes - 3/13/78 AYES: Bartlett, Coen, Gibbs, Shenkman NOES: Siebert ABSENT: Wieder, Pattinson Councilman Siebert informed the Council that he would like to withdraw from parti- cipation in the writing of arguments for City measures. On motion by Coen, seconded Gibbs, Council supported Measure G -that the Office of the City Attorney be appointive. Motion carried by the following vote: AYES: Bartlett, Coen, Gibbs, Siebert, Shenkman NOES: None ABSENT: Wieder, Pattinson On motion by Coen, second Gibbs, Council supported Measure B - that the Office of the City Clerk be appointive. Motion carried by the following vote: AYES: Bartlett, Coen, Gibbs, Siebert, Shenkman NOES: None ABSENT: Wieder, Pattinson On motion by Coen second Gibbs, Council supported Measure J -that the Office of the City Treasurer be appointive. Motion carried by the following vote: AYES: Bartlett, Coen, Gibbs, Siebert, Shenkman NOES: None ABSENT: Wieder, Pattinson On motion by Coen, second Bartlett, Council took no position on Measure E relative to City Council term limitation. The motion carried by the following vote: AYES: Bartlett, Coen, Gibbs, Siebert, Shenkman NOES: None ABSENT: Wieder, Pattinson On motion by Coen, second Siebert, Council took no position on Measure F relative to City Council compensation and expenses. Motion carried by the following vote: AYES: Bartlett, Coen, Gibbs, Siebert, Shenkman NOES: None ABSENT: Wieder, Pattinson On motion by Coen, second Bartlett, Council requested that Mr. Harold Bauman, former Chairman of the disbanded Charter Revision Committee, or his designee, write an argu- ment in favor of ballot Measure F pertaining to City Council compensation and expenses. The motion carried by the following vote: AYES: Bartlett, Coen, Gibbs, Siebert, Shenkman NOES: None ABSENT; Wieder, Pattinson On motion by Coen, second Bartlett, Council took a position in favor of Measure D - Housekeeping. Page 3 - Council Minutes - 3/13/78 The Clerk was directed to give Resolution Nos. 4601, 4602, 4603 and 4604 a reading by title: RESOLUTION NO. 4601 - ADOPTED - WRITTEN ARGUMENTS FOR CITY MEASURES _ "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, AUTHORIZING CERTAIN OF ITS MEMBERS TO FILE A WRITTEN ARGUMENT FOR CITY MEASURES." RESOLUTION NO. 4602 - ADOPTED - REQUEST TO COUNTY - CONSOLIDATION - "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF ORANGE TO CONSOLIDATE A SPECIAL MUNICIPAL ELECTION OF THE CITY OF HUNTINGTON BEACH WITH THE STATEWIDE PRIMARY ELECTION TO BE HELD ON JUNE 6, 1978, PURSUANT TO SECTION 23302 OF THE ELECTION CODE." RESOLUTION NO. 4603 - ADOPTED -- NOTICE OF ELECTION - "A RESOLUTION OF THE CITY COUNCIL OF.THE CITY OF HUNTINGTON BEACH ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTTION TO BE HELD IN SAID CITY ON JUNE 6, 1978 FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY MEASURES CONCERNING A REVISED CHARTER AND CONSOLIDATING SAID ELECTION WITH THE STATEWIDE PRIMARY ELECTION TO BE HELD ON SAID DATE." RESOLUTION NO. 4604 - ADOPTED - REBUTTAL ARGUMENTS - "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH PROVIDING FOR THE FILING OF REBUTTAL ARGUMENTS FOR CITY MEASURES SUBMITTED AT THE MUNICIPAL ELECTIONS." On motion by Gibbs, second Bartlett, Council waived further reading of Resolution Nos. 4601, 4602, 4603 and 4604 by the following roll call vote: AYES: Bartlett, Coen, Siebert, Shenkman, Gabbs NOES: None ABSENT: Wieder, Pattinson On motion by Gibbs, second Coen, Council adopted Resolution Nos. 4601, 4602, 4603, and 4604 by the following roll call vote: AYES: Bartlett, Coen, Gibbs, Shenkman NOES: Siebert ABSENT: Wieder, Pattinson TERRY VS CITY LITIGATION On motion by Shenkman, second Gibbs, Council authorized the City Administrator to transfer $25,000 from the City Attorney's Salaries Account to the City Administrator's Office for the purpose of establishing a special account for litigation, specifically the Terry lawsuit and authorized the expenditure of said funds for the purpose of engaging expert witnesses, for research, for reimbursement of travel and other associated expenses as authorized by the City Administrator. Motion carried by the following roll call vote: AYES: Bartlett, Siebert, Coen, Gibbs, Shenkman NOES: None ABSENT: Wieder, Pattinson Page 4 - Council Minutes - 3/13/78 OLYMPIC SKATEBOARD PARK - SCHEDULED FOR 4/17/78 COUNCIL AGENDA The City Administrator informed Council of a communication from the Recreation and Parks Commission dated March 10, 1978, recommending to the City Council that the Olympic Skateboard Park item be moved to the April 17, 1978 City Council meeting to allow more time to review the draft Environmental Impact Report. On motion by Bartlett, second Shenkman, Council approved the request from the Recrea- tion and Parks Commission that the subject of the Olympic Skateboard Park at Hunting- ton Central Park be placed on the April 17, 1978 Council Agenda. Motion carried by unanimous vote: AYES: Bartlett, Coen, Gibbs, Siebert, Shenkman NOES: None ABSENT: Pattinson, Wieder ADJOURNMENT On motion by Bartlett, second Shenkman, the adjourned regular meeting of the City Council of the City of Huntington Beach adjourned to March 20, 1978 at 6:00 P.M. in the Council Chambers.
