Applicant: Stewart Development Co. II
To permit an industrial building to be constructed at zero set-
back on the south and west property lines of a site abutting
a residential district, located on the southwest corner of Heil
Avenue and Gothard Street in an Ml, Light Industrial District.
This request is a Categorical Exemption, Class 5, California En-
vironmental Quality Act, 1970.
USE PERMIT NO. 78-18 (In Conj./CE 78-15)
Applicant: Stewart Development Co. II
To permit construction of an industrial/limited commercial complex
of approximately 300,000 square feet, located on the southwest
corner of Heil Avenue and Gothard Street in an Ml, Light Industrial
District.
This request is covered by Negative Declaration No. 78-11.
Chairman Eadie opened the public hearing on the conditional excep-
tion, the use permit, and the negative declaration request. There
were no persons present to address the Board either in favor of or
in opposition to the requests, and the public hearing was closed.
The Chairman informed the Board that it is the recommendation of
the Planning Department that these items be referred to the Planning
Commission to be heard in conjunction with Tentative Tract 7534
filed for the project.

CONDITIONAL EXCEPTION NO. 78-10 (In Conj./UP 78-16)
Applicant: Gary Peters
To permit a reduction of the required 25 foot turning radius and
a reduction in drive width from the required twenty (20) feet to
fifteen (15) feet, on property located on the north side of Warner
Avenue between Lynn and Hoskins Streets in an R3, Limited Multiple
Family Residential District.
This request is a Categorical Exemption, Class 5, California En-
vironmental Quality Act, 1970.
Chairman Eadie opened the public hearing. There was no one pre-
sent to represent the applicant nor to address the Board on this
item, and the public hearing was closed.
The Board reviewed the request, considering the prior approval
granted by C.E. 76-54 and the provision of reciprocal easements
between subject property and the abutting parcel to the north.
ON MOTION BY CROSBY AND SECOND BY SPENCER CONDITIONAL EXCEPTION
NO. 78-10 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. If each lot were designed to stand on its own, the project
would create a traffic hazard either by providing access from
the local streets and/or by providing reciprocal easements for
ingress -egress from Warner Avenue for both Lots 1 and 2.
2. Granting of the exception will not set a precedent, nor will
it be detrimental to the health, safety,and welfare of persons
residing or working in the area.
3. Granting of the conditional exception does afford the property
owner his property rights under the zoning ordinance.
4. The size, shape, and configuration of the subject site after
dedication creates substantial hardship.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual site plan received and dated February 22,
1978, shall be the approved layout, subject to submitted
proof of recordation of the reciprocal easements between

Applicant: Gary Peters
To permit construction of two (2) duplexes abutting an arterial
highway, located north of Warner Avenue between Lynn and Hoskins
Streets in an R3, Limited Multiple Family Residential District.
This request is a Categorical Exemption, Class 3, California
Environmental Quality Act, 1970.
The plan was reviewed by the Board, considering the prior approval
granted by U.P. 76-56. It was specifically noted that the Board
had relied on the original approval and the fact that reciprocal
easements are indicated; if these easements do not, in fact, exist
the Board will condition an approval to become null and void.
Bruce Crosby noted that street improvement plans will be required
prior to issuance of permits and curbs, gutters, and paving will
be installed prior to framing inspection on the site.
ON MOTION BY CROSBY AND SECOND BY SPENCER USE PERMIT NO. 78-16
WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE
FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to the general welfare or in3urious to
property and improvements in the immediate vicinity.
2. The granting of a Use Permit will not adversely affect the
General Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of
Land Use.

CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual site plan received and dated February 22,
1978, shall be the approved layout, subject to the fol-
lowing modification:
The building encroachment into the exterior side yard
shall be adjusted to meet code requirements for exterior
setbacks prior to issuance of building permits.
The plan submitted to the Department of Building and Community
Development upon application for building permtis shall re-
flect the above modification.
In its approval action, the Board of Zoning Adjustments considered
the following issues in relation to the conceptual plan:

To permit a reduction in side yard setback from the required five
(5) feet to forty (40) inches for an addition to a single-family
dwelling located on the west side of Edwards Street approximately
162 feet north of Fallingwater Drive in an Rl, Single -Family
Residential District.
This request is a Categorical Exemption, Class 5, California
Environmental Quality Act, 1970.

Chairman Eadie opened the public hearing. Mr. Bergeron was pre-
sent at the meeting. Pat Spencer read a letter of protest from
the resident of 17731 Edwards Street, abutting the sub3ect site
on the north. The applicant said that he had vlanned no windows
in the encroaching wall for protection of privacy, that siting
of the addition in the rear yard would require removal of a patio
and a number of fruit trees, and that reduction of the room size
to conform to setback would result in such a small area that it
would be practically unusable. There being no other persons to
speak in favor of or in opposition to the proposal, the public
hearing was closed.
Board review ensued, considering alternative locations for the
addition and the existence of any physical hardship which could
justify the request.
ON MOTION BY SPENCER AND SECOND BY CROSBY CONDITIONAL EXCEPTION
NO. 78-11 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING

REASONS FOR DENIAL:
1. Applicant has failed to demonstrate sufficient hardship to
justify granting the request for variance.
2. Alternatives exist for siting the addition elsewhere on the
site in compliance with code requirements.

To permit zero setback for a patio cover and an 8-foot high wind-
screen on property located on the northwest corner of Main Street

This request is a Categorical Exemption, Class I, California En-
vironmental Quality Act, 1970.
Chairman Eadie opened the public hearing. There was no one present
to represent the application or to address the Board on this request,
and the public hearing was closed.
Board review determined that the size and configuration of the
lot presented substantial hardship in providing any reasonable
alternative for the proposed improvements on the site.

ON MOTION BY EADIE AND SECOND BY SPENCER CONDITIONAL EXCEPTION
NO. 78-12 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDI-
TIONS, BY THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The irregular configuration of the subject property poses
a hardship on siting of improvements on the lot.
2. The proposed exception for property line setback abuts a
public right-of-way; therefore, it would not result in any
infringement on the adjacent properties or in any adverse
effect on the neighboring residents.
3. The granting of the conditional exception is necessary in
order to preserve the enjoyment of substantial property
rights on the subject site.
4. Granting of the conditional exception will not adverselv
affect the General Plan of the City of Huntington Beach.

Oldtown Specific Plan, Area 1.

Chairman Eadie opened the public hearing. Mike Frazier was present
at the meeting; there being no persons to address the Board in
regard to this matter, the public hearing was closed.
Board review included discussion on the intent of the code in re-
lation to this property - whether the exterior side yard setback
requirements had been set up in relation to a public street and
not an alley. Bruce Crosby informed the applicant that the addi-
tional required alley dedication will further reduce the size of
the property and affect garage setbacks.
ON MOTION BY CROSBY AND SECOND BY SPENCER CONDITIONAL EXCEPTION
NO. 78-13 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1.
The Board has interpreted the intent of the code requirement
for a five (5) foot setback based on the side yard being ad-
jacent to a street and not an alley.
2.
In most instances alley dedication would be taken off the
depth of a lot; in this instance the alley dedication will
come off the width of the lot, rendering the subject site al-
most unbuildable if the strict interpretation of the code is
required to be imposed.
3.
Strict application of the zoning ordinance would deprive the
subject property of privileges enjoyed by other properties in
the same zoning classification.
4.
Granting of the conditional exception will not be materially
detrimental to the public welfare or injurious to properties
in the general area.
5. Granting of the conditional exception will not adversely affect
the General Plan of the City of Huntington Beach.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual site plan received and dated February 24,
1978, shall be the approved layout, subject to the modi-
fications described herein:
a. The plan shall be revised to reflect a two and one-half
(2-1/2) foot dedication off the southerly alley (as
well as the easterly alley) and the corner cutoff at
the intersection of the two alleys changed to reflect
that additional dedication.

b. The garage setbacks shall be changed from 15 feet
and 12 feet to 12'6" and 9'6", respectively, to
reflect the alley dedication.
The modifications outlined above shall be reflected on the
plan submitted to the Department of Building and Community
Development upon application for building permits.

To permit a 27.5 square foot encroachment into the front yard
setback and a 75 square foot reduction in required landscaping for
an industrial building located on the northeast corner of Systems
Drive and Manufacture Lane in an Ml-A, Restricted Manufacturing
District.
This request is a Categorical Exemption, Class 5, California En-
vironmental Quality Act, 1970.
Chairman Eadie opened the public hearing. Sid Lance was present
at the meeting and addressed the Board to justify his request,
citing the irregular shape of his property and past variances of
this nature granted within the industrial tract (C.E. 77-46).
There being no other persons to address the Board, the public hear-
ing was closed.
Board review determined the encroachment and reduced landscaping
to be minimal and 3ustified by prior actions within the industrial
park.
ON MOTION BY SPENCER AND SECOND BY CROSBY CONDITIONAL EXCEPTION
NO. 78-14 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The minimal intrusion into the front setback is 3ustified be-
cause of the intrusion of the cul-de-sac into the property.

2. A precedent has been established within the industrial park
for a variance of this type.
3. The reduction of landscaping included in the request was
found to be a minimal reduction.

affect the General Plan of the City of Huntington Beach.

To permit construction of a 10,360 square foot industrial build-
ing located at the northeast corner of Systems Drive and Manu-
facture Lane in an M1-A, Restricted Manufacturing District.
This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
Sid Lance was present at the meeting.
Board review of the layout found the pro3ect to be in substantial
compliance with code other than the exceptions granted by the
previously approved conditional exception. Possible alternative
landscaping was reviewed with the applicant.

The 3-foot planter beginning 15 feet in back of the front
property line shall be eliminated and 20" box trees 45
feet on center shall be delineated along the north property
line.
The modification outlined above shall be depicted upon the
plan submitted to the Department of Building and Community De-
velopment upon application for building permits.
In its approval action, the Board of Zoning Adjustments considered
the following issues in relation to the conceptual plan:

ADMINISTRATIVE REVIEW ITO. 78-21
Applicant: Ronald O'Neal & Gary M. Schmidt
To permit construction of an 11,000 square foot, multi -tenant
industrial building located on the south side of Talbert Avenue
approximately 148 feet west of Redondo Circle in an Ml-A, Re-
stricted Manufacturing District.
This request is covered by Negative Declaration No. 74-169,
adopted by the Board for the industrial tract in which the sub-
ject project is located.
Ronald O'Neal and Gary Schmidt were presept at the meetinq.
Bruce Crosby requested that the plan should designate Talbert
Avenue; he also advised the developers of the need for a street
improvements plan to be submitted prior to building permits, with
curbs, gutters, and paving to be installed prior to framing in-
spection. The Board requested that a copy of the agreement for
reciprocal easements by submitted to the City; these easements are
delineated upon a recorded parcel map for the site.
Board review found the plan to be substantially in compliance
with code, except for provision for corner cutoff which, upon
further review, was deemed unnecessary because of the one-way drive
adjacent to the corner of the building.

This request is covered by ND 77-5, approved by the Planning Com-
mission on March 1, 1977, upon approval of the tentative tract.
No one was present to represent the application. The Board wished
to discuss such matters as access from Brookhurst Street, parking,
and phasing of the construction with the applicant and determined
to continue the request to permit applicant to be present.

To permit establishment of a parts and service center for automobiles
within an existing building located on the west side of Chemical
Lane approximately 90 feet south of the intersection of Chemical
and Business Drive in an Ml-A, Restricted Manufacturing District.
This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
Ed Felter and John Houlihan were present at the meeting. Mr. Felter
described his operation, emphasizing that there would be no body
work or spray painting done, nor any ma]or repairs.
The Board discussed the use. Mel Ott reported that it has not yet
been determined whether or not such occupancy is allowable in the
industrial park, and the consensus of the Board was that any
approval action would reserve the right to reconsider the reauest
and possibly rescind or modify the approval at the next Board meet-
ing.
