Tentative Tract 9843 - Approve request for continuance to April 4, 1978. 6. Resolution No. 1215 - Approve Resolution of Intention to revoke Portion 3 of Precise Plan of Street Alignment 70-4. WERE APPROVED ON THE CONSENT CALENDAR BY THE FOLLOWING VOTE: AYES: Stern, Finley, Shea, Newman, Hoffman NOES: None ABSENT: Slates Monica Florian addressed the Commission and stated that the Director of Public Works had submitted a letter to the Planning Commission expressing opposition to Resolution No. 1215 and requested a continuance so that there could be a meeting with property owners in the area. Planning Commission Tuesday•, March 21, 1978 Page 2 CONDITIONAL USE PERMIT NO. 78-4/ENVIRONMENTAL IMPACT REPORT 77-11 Applicant: Wycliffe Associates, Inc. This is a request for 185 unit 14-story elderly housing development located at 18811 Florida Street, on the west side of Florida, 400 ft. south of Main. Dave Eadie clarified the request, stating that it was for 192 units rather than 185. He discussed other issues addressed in the staff report and presented photographs of the subject property. The public hearing was opened on Conditional Use Permit No. 78-4 and Environmental Impact Report 77-11. Commissioner Stern'ralsed questions concerning -the status of the EIR, the matter of offsite improvements including possible controlled cross walks and rapid transit turnouts. Dave Eadie discussed these items at length, describing the interface of these questions as they relate to the development proposal, code requirements and City policy. ON MOTION BY NEWMAN AND SECOND BY HOFFMAN ENVIRONMENTAL IMPACT REPORT NO. 77-11 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Stern, Finley, Shea, Newman, Hoffman NOES: None ABSENT: Slates Further discussion ensued on Conditional Use Permit No. 78-4. Com- missioner Stern inquired about the possiblity of a condition being imposed which would require that a bus stop at Main Street and Florida be installed, and also a crossing device at Main Street being included as a condition. Conrad -Burton addressed the Commission on those issues addressed by Commissioner Stern. He related the problems which the -applicant had been faced with, and stated that he could not respond to these proposed conditions. The public hearing was closed. ON MOTION BY NEWMAN AND SECOND BY HOFFMAN CONDITIONAL USE PERMIT NO. 78-4 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS: 1. The proposed 185 unit elderly housing development furthers the goals, policies, and plans expressed in the General Plan; particular in regard to housing and land use. 2. The property was previously studied for this intensity of land use at the time the specific plan was established. -2-. 3/21/78 - PC Minutes: H.B. Planning Commission Tuesday, March 21, 1978 Page 3 3. The proposal furthers the Housing and Community Development goals of providing additional subsidized units for the elderly. 4. The design of.the facility is situtated so as to mitigate to the greatest extent possible, the impacts of visual and shadow intrusion upon adjacent properties. 5. The proposed project as designed will provide housing in the area which is in keeping with the stated objectives of the multi -story policy plan, environmental and developmental goals of the City as the project meets or exceeds ordinance requirements. 6. The subject proposal meets criteria established in the ordinance code for approval of conditional use permits, in that the location, design, and proposed uses are compatible with the surrounding area; the plan will produce internally a stable and desirable environ- ment, and there is reasonable assurance that the applicant intends to proceed with the execution of the project without undue delay. CONDITIONS OF APPROVAL: 1. The project plans (excepting elevations) received March 15, 1978 shall be the approved plans. 2. The proposed wall on the north, south and westerly property lines shall be decorative masonry and shall be subject to approval by the Planning Department. Said plans shall be approved prior to issuance of building permits. 3. A landscape and irrigation plan shall be subject to approval by the Planning Department. Said plan shall demonstrate screening of parking facilities from Florida Street through the use of intensified landscaping in accordance with criteria so-L forth in Article 979 of the Ordinance Code. Said plans shall also meet or exceed the standard plans and specifications for land- scaping and irrigation on file in the Department of Public Works. 4. The water storage tanks shown at the southwesterly portion of the property shall not exceed four feet in height and shall be covered by turf or other suitable landscaping as approved in the landscape plan. 5. The six contingency parking spaces on the southwest corner of the site shall be improved, if after monitoring the site for a period of one year the Planning Director finds further need for additional on -site parking. Said improvements shall be completed four months from the date of receipt of written notice requiring improvement of the expanded parking area. 6. A revised elevation showing the seven story portion of the multi- story building and precise building materials and colors to be utilized shall be submitted to and subject to approval by the Planning Department. -3- 3/21/78 - PC Minutes: H.B. Offsite improvements as depicted on the site plan sheet shall be ,installed in accord4nce with City specifications. 8.1 The service area enclosure design to the rear of the building shall be subject to approval by the Planning Department. In lieu of grapestake fencing, said enclosure shall incorporate masonry and/oar other acceptable wood treatments.. 9. An overhead feature providing reasonable shelter from the entrance leading to"the parking area shall be constructed. Said design shall be subject to approval by the Planning Department. AYES: Finley, Shea, Newman, Hoffman NOES: Stern ABSENT: Slates ZONE CHANGE NO. 78-1 Applicant: G. P. Building Enterprises, Inc. This is a request for a change of zone from C2 to R3-20 on property located south of Edinger Avenue approximately 350 feet west of Bolsa Chica Street. Monica Florian gave a brief overview of the information contained in the staff report. The public hearing was opened on Zone Change 78-1. David Dahl addressed the Commission and spoke in favor of the zone change. A resident in the area addressed the Commission and presented a one-way sigh which had been removed from the street in the area, stating that it was the third time the sign had been removed by someone pulling it off. George Psoras expressed concern over the pedestrian traffic and spoke in opposition to the proposed zone change. He further stated that he would not like to see the density increased. Another resident addressed the parking -problems in the area. Mr. Psoras again addressed the Commission on the parking problems . The public hearing was closed. Commissioner Newman stated that she would vote against this zone change because of the traffic problems which are in the area. She further stated that fourplexes sounded more reasonable than R3 zoning. -4- 3/21/78 - PC Minutes: H.B. Planning Commission Tuesday, March 21, 1978 Page 5 ON MOTION BY STERN AND SECOND BY FINLEY ZONE CHANGE 78-1 WAS APPROVED BY THE FOLLOWING VOTE:" AYES: Stern, Finley, Shea, Hoffman NOES: Newman ABSENT: Slates CONDITIONAL EXCEPTION NO. 78-3/CONDITIONAL USE PERMIT NO. 78-2 Applicant: Theodore Hennes This is a request to permit an existing stable to encroach into required front, exterior, and rear yard setback on property located at the southwest corner of Ellis and Goldenwest. Monica Florian addressed the Commission on this application and gave a brief background of the use. The public hearing was opened. Theodore Hennes addressed the Commission and requested that Condition No. 4 be changed to permit a six month period to elapse before a review of the use rather than four months as contained in the staff report. The public hearing was closed. Commission discussion ensued. ON MOTION BY SHEA AND SECOND BY NEWMAN CONDITIONAL EXCEPTION NO. 78-3 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: FINDINGS (CONDITIONAL EXCEPTION NO. 78-3) 1. The granting of Conditional Exception No. 78-03 will not be materially detrimental to the public health, safety, and welfare or injurious to the conforming uses or improvements in the sur- rounding horse stables. 2. The requested exception will allow the continuation of a previously City approved stable and therefore insure the preservation and use of substantial property rights. 3. Because the_ subject facility is existing, exceptional circumstances exist that do.not generally apply to the property or class of uses in the same district. 4. There is reasonable assurance that the applicant intends to proceed with the proposed request without undue delay. Planning Commission Tuesday, March 21, 1978 Page 6 "ION MOTION BY SHEA AND SECOND BY NEWMAN CONDITIONAL USE PERMIT NO. 78-02 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: FINDINGS (CONDITIONAL USE PERMIT NO. 78-02)- 1. The proposed use is compatible with existing land use of the surrounding area. 2. The proposed use is consistent with and carries out the objectives of stated City policy relating to the encouragement of active private recreational uses within close proximity to Huntington Central Park. 3. The proposed use is substantially in conformance with the intent and objectives of Article 939, "Temporary Commercial Horse Standards." CONDITIONS OF APPROVAL: 1. The site plan dated February 3, 1978, shall be the approved layout with the maximum horse density not to exceed 100 horses. 2. The applicant shall participate in the cost of the water main located in Ellis Avenue per the Department of Public Works cost breakdown. 3. The applicant shall participate in street improvement on both Goldenwest Street and Ellis Avenue at which time the City requires improvements. 4. Within six (6) months of the approval of this conditional exception and conditional use permit, these items will be rescheduled for review by the Planning Commission to determine compliance with the above stated conditions and requirements of the code. Should the Planning Commission find that the applicant has not complied with all requirements, including conditions of approval,. the con- ditional exception and conditional use permit shall become null and void, and the applicant shall be required to cease and desist the commercial stable operations. Should the Planning Commission find that a reasonable effort has been made by the applicant to comply with all requirements, the conditional exception and conditional use permit shall remain in effect for four years, six months from that review date. King This is a request for one illuminated sign 3 ft. x 10 ft. to be sub- stituted for three existing signs located at 118 llth Street at the southwest corner of Walnut and llth Street. Monica Florian discussed the application with the Commission briefly. The public hearing was opened. Roger King addressed the commission and stated that he would like to keep the sign in the place he requested on his application. The public hearing was closed. ON MOTION BY SHEA AND SECOND BY NEWMAN SPECIAL SIGN PERMIT NO. 78-3 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITION BY THE FOLLOWING VOTE: FINDINGS: 1. The applicant has demonstrated a hardship and a need for a business identification sign. 2. The granting of the request would not constitute a special privilege. 3. The proposed sign will not impact.any of the surrounding properties or land uses. 4. There is reasonable assurance that the applicant intends to proceed with the proposed request without undue delay. CONDITION: The proposed 30 square foot projecting sign shall be located a minimum of fifteen (15) feet from the subject site's south property line at such time as the adjacent property is developed. 'AYES: Stern, Finley, Shea, Newman, Hoffman NOES: None ABSENT: Slates ZONE CHANGE NO. 78-6 Applicant: Initiated by Planning Commission This application is a Planning Commission initiated request to change the zoning on the Warner-Goldenwest Small Lot Redevelopment Area from RA, residential agricultural, to C2, community business. Mr. Manolas addressed the Commission and spoke in favor of the zone change. The public hearing was closed. A.MOTION WAS MADE BY STERN TO APPROVE ZONE CHANGE 78-6 BUT FAILED DUE TO LACK OF A SECOND. Commission discussion ensued. ON MOTION BY STERN -AND SECOND BY NEWMAN ZONE CHANGE NO. 78-6 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Stern, Finley, Shea, Newman, Hoffman NOES: None ABSENT: Slates TENTATIVE TRACT NO. 7534/NEGATIVE DECLARATION 78-11 USE PERMIT NO. 78-18 CONDITIONAL EXCEPTION NO. 78-15 Applicant: Stewart Development Co. II Tentative Tract No. 7534 is a request for a 17 lot industrial sub- division located on the southwest corner of Heil and Gothard. Use Permit No. 78-18 is a request to permit construction of an industrial/limited commercial complex of approximately 300,000 square feet. Conditional Exception No. 78-15 is a request to permit an industrial building to be constructed at zero setback on the south property line of a site abutting a residential use in lieu of the required 45 ft. Dave Eadie addressed the -Commission and -.discussed the appli- cations. The public hearing was opened. There was no one present to speak on these applications, and the public hearing was closed. Commission discussion ensued. Planning Commission Tuesday, March 21, 1978 Page 9 , ON MOTION -BY STERN AND SECOND BY NEWMAN TENTATIVE TRACT NO. 7534 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS: 1. The proposed subdivision of this 17.35 acre parcel of land zoned Ml, light industrial, and general planned general industrial, meets or exceeds design and improvement standards and plans for sub- division maps, and is therefore consistent with the City's General and Specific Plans. 2. The site is physically suitable for industrial development. 3. The property was previously studied for this intensity of land use at the time the land use designation for general industrial was placed on said property. CONDITIONS OF APPROVAL: 1. The tentative map received March 17, 1978, shall be the approved subdivision. 2. All off -site improvements shall be completed in one phase. 3. Drainage for the subdivision shall be approved by the Department of Public Works prior to the recordation of the final map. This system shall be designed to provide for siltation and erosion control both during and after construction of the project. 4. Natural gas shall be stubbed in at the location of cooking facilities,.water heaters, and central heating units. 5. Low -volume heads shall be used on all spigots and water faucets. 6. All building spoils, such as unusable lumber,.wire,.pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 7. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Department. 8. Sewer and drainage facilities shall be installed in accordance with Department of Public Works standards. 9. A detailed soils analysis shall be prepared by a registered soils engineer. The analysis shall include onsite soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, fill properties, foundations, retaining walls, streets, and utilities. -9- 3/21/78 - PC Minutes: H.B. Prior to recordation of a final map, the subdivider shall suf- ficiently demonstrate that Lot 11 meets or exceeds -minimum lot area requirements of the M1 District. AYES: Stern, Finley, Shea, Newman, Hoffman NOES: None ABSENT: Slates ON MOTION BY STERN AND SECOND BY NEWMAN CONDITIONAL EXCEPTION NO. 78-15 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: 1. The existing improvements to the south of the proposed setback encroachment (a 30 ft. setback and property line -wall), the nature of the industrial use (non -manufacturing), and the desirability of an inwardly oriented design in view of the proposed use are all exceptional circumstances which do not apply generally to the property or uses in the same district. 2. The total separation of the mini -warehouse facility from the residential uses to the south is necessary for the preservation and enjoyment of each use's property rights and further buffers the two districts. 3. The project as approved with the conditions will insure that the setback encroachment will not be materially detrimental to the public health, safety and welfare or injurious to the surrounding property or improvements in the neighborhood of the property for which the conditional exception is sought. 4. There is reasonable assurance that the applicant intends to proceed with the execution of the project without undue delay. AYES: Stern, Finley, Shea, Newman, Hoffman NOES: None ABSENT: Slates ON MOTION BY STERN AND SECOND BY NEWMAN USE PERMIT NO. 78-18 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS: 1. The design and improvement of the proposed development will not be detrimental to the welfare of persons residing or working in the vicinity. 2. As the project meets or exceeds plans and specifications for development set by the City, the project as conditionally approved will not be injurious to property and improvements in the vicinity of the uses. 3. The following retail uses shall be permitted in the two buildings abutting Heil Avenue: (Parking ratios for retail uses 1 space per each 200 square feet Of floor area shall be required.) The site plan received March 15, 1978, shall be the approved plan. 3. All elevations for the planned industrial complex shall be sub- ject to approval by the Planning Department. Rear elevations of the mini -warehouse facility facing the park and residential developments shall incorporate architectural treatment such as the use of wood plant-ons or other similar design embellishments to create a compatible buffer. 4. A master conditions, covenants, and restrictions document shall be recorded and shall be binding upon all lots within the sub- division. Further provided, said CC&R's shall declare that outside storage or manufacturing is expressly prohibited. Said CC&R's shall reflect all City requirements stipulated in approval of the tentative map, conditional exception, and use permit petitions and shall be submitted to the Planning Department prior to issuance of building permits. 5. The mini -warehouse facility shall have no wall openings on either the west or south sides of the building. 6. A landscape and irrigation plan demonstrating the method of screen- ing parking areas through the use of intensified landscaping and berming and landscaping in general shall be subject to approval by the Planning Department prior to the issuance of building permits. Individual landscape plans for each lot within the development will be permitted; however, a master landscape con- cept utilizing common elements and treatment for the frontage along Gothard Street and Heil Avenue shall be approved prior to issuance of building permits. All lots within the second phase of the development shall be required to have a planting area of not less than ten (10) feet in width installed along the Gothard/Heil frontages in accordance with the approved landscaping concept prior to occupancy of any first phase building. Fifteen (15) gallon specimen trees shall be planted within the parking area along the westerly boundary of the property, 45 feet on center. All buildings requiring rooftop mechanical screening shall be required to use common screening materials. A concept plan demonstrating the method of screening rooftop mechanical equipment shall be submitted prior to the issuance of building permits and shall be subject to approval by the Planning Department. 8. The westerly border of the property shall be fenced sufficiently to screen the development from adjacent properties. A fencing plan shall be subject to approval by the Planning Department prior to issuance of building permits. 9. Storage of commodities in the mini -warehouse shall be limited to non -hazardous materials. AYES: Stern, Finley, Shea, Newman, Hoffman NOES: None ABSENT: Slates DISCUSSION ITEMS: GARFIELD-GOLDENWEST STUDY - Recommendation of policies to guide future development within the study area. Chuck Clark gave a brief presentation on this study. It was the consensus of the Commission that this item should be placed on the`agenda of the April 4th Planning Commission meeting. PLANNING DEPARTMENT ITEMS: A joint meeting with the Environmental Council was scheduled for 6:00 p.m. on April 18, 1978. COMMISSIONER ITEMS: The Commission directed that an invitation be extended to Vince Moorhouse to give a presentation on proposed pier improvements at the April 18th meeting. STAFF COMMENTS: Monica Florian discussed action of the City Council at its March 20th meeting regarding McFadden Avenue. The Commission stated it had no objections to the proposed closure of McFadden at Bolsa Chica if all the area's residents could agree to it.
