This request is covered by Negative Declaration No. 78-24. Chairman Eadie opened the public hearing on the negative declara- tion request. Carl Steverson and Ron Kendricks, Engineer, were present at the meeting. The Board reviewed the information contained in the negative dec- laration request form and considered mitigation measures applicable to the ultimate construction project on the site. The applicant indicated his receipt of and concurrence with the suggested conditions of approval (with the exception of a condition for street dedication, which has already been accomplished). The mitigating measures which will be applied as conditions to the map were explained to the applicants and were also concurred with. Minutes, H.D. The Board reviewed the parcel map. The secretary was instructed to delete the suggested condition requiring street dedication. ON MOTION BY EADIE AND SECOND BY SPENCER TENTATIVE PARCEL MAP NO. 78-10 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Depart- ment on March 2, 1978, shall be the approved layout. 2. A parcel map shall be filed with, and approved by, the Department of Public Works and recorded with the Orange County Recorder. 3. A copy of the recorded parcel map shall be filed with the Planning Department. B. GENERAL CONDITIONS OF DEVELOPMENT OF SITE: 1. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 2. Low -volume heads shall be used on all spigots and water faucets. 3. All buildinq spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be dis- posed of at an offsite facility equipped to handle them. 4. If outside lighting is included on site, high-pressure sodium vapor lamps shall be used to prevent "spillage" onto adjacent areas and for energy savings. Board of Zoning Adjustments March 29, 1978 Page 3 USE PERMIT NO. 78-19 Applicant: Harbor Bluffs Development To permit construction of five (5) fourplexes abutting an arterial highway located on the southeast corner of Slater Avenue and Van Buren Street in an R2, Limited Multiple -Family Residential District. This project is covered by ND 77-139, prepared for TT10213 in which subject project is proposed to be located. Chairman Eadie opened the public hearing. Frank Buccella was present to represent the application. Secretary Spencer reported that a comment on the project has been received from an abutting property owner, stating that the height of the fence on the east property line of the subject pro- ject is low enough to be a problem to the privacy and security of his residence; he asked that any approval require the fence height to be increased. The applicant explained the existing grade differentials between his property and abutting lots, streets, and the alley. He also presented renderings of the elevations of the project as seen from Slater Avenue. There being no other persons present to ad- dress the Board on the matter, the public hearing was closed. The Board reviewed the submitted site plan and elevations. ON MOTION BY CROSBY AND SECOND BY EADIE USE PERMIT NO. 78-19 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL- LOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to the general welfare of persons residing or working in the vicinity or injurious to property or im- provements in the area. 2. Granting of the Use Permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received and dated March 8, 1978, shall be the approved layout, sub- ject to the following modifications: BZA 3-29-78 Page 3 Minutes, H.B. Board of Zoning Adjustments March 29, 1978 Page 4 a. A 32 foot radius at the intersection of Van Buren and Slater Avenue shall be provided. b. If a separation fence or wall exists on the eastern property line, said fence shall be upgraded to a minimum height of six (6) feet; if no fence exists at this location, the plan shall show a new six (6) foot fence along the east property line. c. The required twenty (20) foot dedication off Slater Avenue shall be shown on the plan. The modifications outlined above shall be depicted upon the plan submitted to the Department of Building and Community Development upon application for building permits. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: • Traffic circulation and drives; . Parking layout; . Lot area; . Lot width and lot depth; • Type of use and its relation to property and improvements in the immediate vicinity; • Past administrative action regarding this property. B. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the state acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. Board of Zoning Adjustments March 29, 1978 Page 5 USE PERMIT NO. 78-20 Applicant: Warner Beach Company To permit construction of a 280 square foot addition to an exist- ing carwash structure located abutting an arterial highway, for the purpose of office and storage space, located on the east side of Beach Boulevard approximately 150 feet south of Warner Avenue in a C4, Highway Commercial District. This request is a Categorical Exemption, Class I(e), California Environmental Quality Act, 1970. Chairman Eadie opened the public hearing. Dick Sass and Don Walch were present at the meeting. There being no one to address the Board in regard to the project, the public hearing was closed. Secretary Spencer reported that research of the files has dis- closed that the building is legally constructed at zero setback on the alley, citing a prior approval in January 1969. The Board concluded that the addition of the small amount of square footage requested would be a minimal increase in buildinq size. Dave Eadie requested that the applicants consider intensifying the landscaping along the Beach Boulevard frontage, perhaps by planting two or three trees within the existing landscaping space. ON MOTION BY SPENCER AND SECOND BY CROSBY USE PERMIT NO. 78-20 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The proposed addition will fulfill a needed use for the exist- ing facility, and its size is a fairly insignificant increase in the bulk of the building. 2. The establishment, maintenance, and operation of the use will not be detrimental to the general welfare of persons residing or working in the vicinity or injurious to property or im- provements in the area. 3. Granting of the Use Permit will not adversely affect the General Plan of the City of Huntington Beach. 4. The proposal is consistent with the City's General Plan of Land Use. This request is covered by Negative Declaration No. 78-25. Chairman Eadie opened the public hearing on the negative declara- tion request. William Goodman and Larry Rains were present at the meeting. The Board reviewed the information contained in the negative dec- laration request form and considered mitigation measures applicable to the ultimate development on the site. ON MOTION BY EADIE AND SECOND BY CROSBY THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE IMPACT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 78-25 WITH THE MITIGATING MEASURES CONTAINED IN CONDITIONS 6 THROUGH 10 IMPOSED ON THE PARCEL MAP, BY THE FOLLOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE The public hearing was closed. Bruce Crosby informed the applicants of modifications to the map required to comply with code. The Board reviewed access to the parcels, requiring reciprocals be- tween the properties and restricting access from Warner Avenue. ON MOTION BY EADIE AND SECOND BY SPENCER TENTATIVE PARCEL MAP NO. 78-11 WAS APPROVED WITH THE FOLLOWING FINDINGS, BY THE FOLLOWING VOTE: BZA 3-29-78 Page 6 Minutes, H.B. Board of Zoning Adjustments March 29, 1978 Page 7 CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning De- partment on March 8, 1978, shall be the approved layout, subject to the following amendments: a. Parcel 2 shall be modified to reflect the code -required standard of 6500 square feet net lot area; said modifi- cation to require an adjustment of the proposed lot line. b. The radius curve at the intersection of Lynn Street and Warner Avenue shall be shown at thirty-three (33) feet. C. A twenty-seven (27) foot halfstreet section shall be shown for Lynn Street. 2. Vehicular access rights on Warner Avenue shall be dedi- cated to the City of Huntington Beach. 3. Reciprocal agreements for ingress -egress across both parcels for access to the site will be required. 4. A parcel map shall be filed with, and approved by, the Department of Public Works and recorded with the Orange County Recorder. 5. A copy of the recorded parcel map shall be filed with the Planning Department. 6. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers. 7. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 8. Low -volume heads shall be used on all spigots and water faucets. 9. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 10. A detailed seismic study prepared by a qualified geo- logist shall be submitted prior to development of the site. Brennen To permit division of one (1) parcel of land into two separate parcels with frontages of 64 feet each, located on the east side of Cameron Street approximately 596 feet south of Slater Avenue in an R3, Limited Multiple -Family Residential District. This project is covered by Negative Declaration No. 77-8, adopted by the Board on March 2, 1977. William Goodman was present at the meeting and indicated his re- ceipt of and concurrence with the suggested conditions of approval forwarded to him. He also said that all required dedications have already been made. ON MOTION BY SPENCER AND SECOND BY CROSBY TENTATIVE PARCEL MAP NO. 78-12 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Depart- ment on March 15, 1978, shall be the approved layout. 2. Board of Zoning Adjustments March 29, 1978 Page 9 MISCELLANEOUS AGENDA ITEMS: USE PERMIT NO. 76-52 (Guiliano's Deli) Applicant: Glen Busby Revised elevations for Guiliano's Deli, a use within a previously approved shopping center located on the southeast corner of Goldenwest Street and Edinger Avenue in a C4, Highway Commercial District. A representative of the applicant was present to explain the changes which had been made to the Edinger Avenue elevation. These changes involve alteration to the roof parapet only, and do not affect color or design of the building. The Board reviewed the proposal. ON MOTION BY EADIE AND SECOND BY CROSBY THE BOARD APPROVED THE ELEVATIONS FOR BUILDING G (NORTH ELEVATION) RECEIVED AND DATED MARCH 29, 1978, BY THE FOLLOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 78-25 (Amended Conditions) Applicant: Seaspray Venture To amend conditions of approval previously imposed on a model home and sales office complex located on the east side of Brook- hurst Street approximately 300 yards south of Hamilton Avenue in an R2-PD District. Secretary Spencer reported that a condition of approval imposed by the Board on March 22 when this project was approved had been inadvertently omitted from the official conditions imposed on the project. The omitted condition was in regard to approval of signing for the project. ON MOTION BY EADIE AND SECOND BY SPENCER THE CONDITIONS OF APPROVAL FOR ADMINISTRATIVE REVIEW WERE AMENDED AS FOLLOWS, BY THE FOLLOWING VOTE: CONDITION No. B-3: Signing for the project in the general vicinity indicated by the applicant is approved, with precise sign location and dimensions to be submitted to the Secretary of the Board for review and approval action.
