Rentals To permit an industrial structure for a pre -mix concrete facility to be constructed in excess of the 40-foot height limit to a maxi- mum height of forty-five (45) feet on property located on the west side of Nichols Street approximately 350 feet south of Warner Avenue in an Ml, Light Industrial District. This request is a Categorical Exemption, Class 5, California En- vironmental Quality Act, 1970. Chairman Eadie opened the public hearing. Daryl Boyer and Stan Hefay were present at the meeting. There being no persons present to address the Board on this matter, the public hearing was closed. The Board reviewed the proposed use of the portion of the project which will exceed the district height limitations and determined that it is strictly a mechanical device intended for use as a dust collector. As such it is exempt from the regulations of the ord- inance pertaining to building heights, and the conditional exemp- tion request is not necessary. ON MOTION BY CROSBY AND SECOND BY EADIE CONDITIONAL EXCEPTION NO. 78-16 WAS WITHDRAWN WITH THE CONCURRENCE OF THE APPLICANT, BY THE FOLLOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE Minutes, H.B. Board of Zoning Adjustments April 12, 1978 Page 2 ADMINISTRATIVE REVIEW NO. 78-29 (In Conj./CE 78-16) Applicant: H.B. Rentals To permit construction of a pre -mix concrete facility located on the west side of Nichols Street approximately 350 feet south of Warner Avenue in an Ml, Light Industrial District. This request is covered by Negative Declaration No. 78-26. Chairman Eadie opened the public hearing on the negative declara- tion request, noting that the transmittal from the Environmental Resources Section contains no recommendations for mitigating measures applicable to the project. Daryl Boyer and Stan Hefay were present at the meeting. The Board reviewpd the information contained in the environmental document, and the public hearing was closed. ON MOTION BY EADIE AND SECOND BY CROSBY THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 78-26 BY THE FOLLOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE Secretary Spencer noted that a revised plan for the project has been submitted showing the structure farther from Nichols Street. The Board discussed drive access and traffic flow on -site. Bruce Crosby advised the applicants of the required dedication off Nichols and informed them of the requirement for a street improve- ment plan to be submitted prior to issuance of building permits. Also, some architectural or cosmetic treatment of the tower was suggested to relieve the starkness of that structure and diminish its visual impact from surrounding properties. ON MOTION BY EADIE AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 78-29 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised site plan received and dated April 11, 1978, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: i . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. A landscaping and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and land- scaping specifications on file in the Department of Public Works shall be submitted to the Secretary of the Board for review and approval. 3. The method of screening the upper portion of the facility shall be subject to the approval of the Secretary of the Board. AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 78-19 Applicant: Lester L. & Darcia S. Blanchard To permit a direct entry garage to set back ten (10) feet from the front property line on property located on the north side of the cul-de-sac of Wayfarer Lane approximately 500 feet north of Mistral Drive in an R1, Low Density Residential District. This request is a Categorical Exemption, Class 5, California En- vironmental Quality Act, 1970. Chairman Eadie opened the public hearing. Bill Churchill was present at the meeting to represent the applicants, and submitted the following 3ustification for the request: 1) the applicant is requesting only equal opportunity under the law, as other dwellings presently exist in the harbor area with similar setbacks; 2) the subject lot is the last vacant lot on the street and will not create a precedent for subsequent requests of this nature; and 3) the very nature of the cul-de-sac street construction poses difficulties in siting structures on the lots. Ed Silveri, 16201 Wayfarer Lane, spoke in opposition to the grant- ing of the request and submitted a petition in opposition signed by 15 local property owners. He cited existing traffic congestion and lack of parking on the street. Neal West, 16246 Tisbury, representing the Review Board of the Huntington Harbour Homeowner's Association, also spoke against the request, for the same reasons put forward by Mr. Silveri. There being no other persons to address the Board, the public hearing was closed. BZA 4-12-78 Page 3 Minutes, H.B. Board of Zoning Adjustments April 12, 1978 Page 4 Board review ensued. Pat Spencer observed that no on -street parking would be available through the present layout and in his opinion the hardship is self-imposed through the design of the proposed structure. Dave Eadie informed the applicant's representative that previous construction in the area at setbacks less than presently required were allowed under code requirements that have been changed because of the problems resulting from their application, and these should not be used to justify the present request. It was his feeling that the two separate drives on one property would estab- lish a precedent in the area. Bruce Crosby expressed the opinion that granting of the request would constitute granting of special privilege. ON MOTION BY EADIE AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 78-19 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE: REASONS FOR DENIAL: 1. The configuration of the subject property is not significantly different from the majority of lots in the Huntington Harbour area, which have been able to achieve layouts to meet code requirements. 2. The double garage situation without availability of any on - street parking immediately in front of the proposed dwelling diminishes the possibility of providing needed guest parking. 3. Although the proposed building is of unique design, alterna- tive design approaches could be utilized which would allow a structure to be reasonably sited on the lot within code re- quirements. 4. The precedents cited by the applicant (delineated on Exhibit A in the project file, and received March 20, 1978) reflect different situations from the proposal under consideration, in that the side -on garage treatments shown in that exhibit permit two on -site surface parking spaces to be achieved in addition to the parking area within the garages themselves. 5. For the reasons stated above, the Board has determined that the applicant has failed to demonstrate sufficient hardship on the property to justify granting of the proposed setback reduction. Lusk & Son To permit consolidation of four (4) existing lots into two (2) new lots, on property located on the east side of Transistor Lane between Engineer Drive and Machine Drive in an Ml-A, Re- stricted Manufacturing District. This request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. The proposal was reviewed by the Board. ON MOTION BY EADIE AND SECOND BY SPENCER TENTATIVE PARCEL MAP NO. 78-13 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Depart- ment on March 27, 1978, shall be the approved layout. 2. Vehicular access rights to Springdale Street shall be dedicated to the City of Huntington Beach except at locations approved by the Board of Zoning Adjustments. 1 3. A parcel map shall be filed with, and approved by, the Department of Public Works and recorded with the Orange County Recorder. 4. A copy of the recorded parcel map shall be filed with the Planning Department. AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 78-14 Applicant: Kaylor Company - Dave Kaylor To create one (1) lot from two existing lots on property located on the eEst side of Chemical Lane approximately 273 feet south of McFadden Avenue in an Ml-A, Restricted Manufacturing District. This request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. BZA 4-12-78 Page 5 Minutes, H.B. Board of Zoning Ad3ustments April 12, 1978 Page 6 Dave Kaylor, Daryl Boyer, and Jim Hetzler were present at the meeting. The applicant indicated his receipt of and concurrence with the suggested conditions of approval previously forwarded to him. The applicant discussed his future plans for constructing another building, to comprise a condominium project on the site, and noted that his present plans have taken that project into consid- eration insofar as roof loading, etc. He inquired if the City would require any future map for that project or if the present application would suffice. After discussion, it was the opinion of the Board that, if the Subdivision Map Act permits the tenta- tive parcel map act to serve that purpose, it is likely that the City would follow the same procedure. The applicant was, however, instructed to check with the legal department of the BIA for a more definitive answer. ON MOTION BY CROSBY AND SECOND BY EADIE TENTATIVE PARCEL MAP NO. 78-14 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL FOR ANY PURPOSE. 1. The tentative parcel map received by the Planning Depart- ment on March 27, 1978, shall be the approved layout. 2.
