Board of Zoning Adjustments June 14, 1978 Page 6 FINDINGS OF THE BOARD: 1. Granting of the conditional exception will not constitute a grant of special privilege or establish a precedent, as other exceptions in similar circumstances have previously been permitted in the City. 2. The encroachment will, in effect, be an encroachment into a side yard because of the unique layout of the property in relation to the abutting property (i.e., rear yard of sub- ject property abuts the side yard of the adjacent property to the east). Therefore, the encroachment will not have an adverse effect on the abutting residence and the intent of the code for separation is maintained. 3.
