Applicant: Foodmaker, Inc.
To permit remodeling and addition to an existing Jack -in -the -Box
restaurant located on the south side of Edinger Avenue approxi-
mately 140 feet east of Springdale Street in a C2, Community Busi-
ness District.
This request is a Categorical Exemption, Class I, California En-
vironmental Quality Act, 1970.
A representative of Foodmaker was present at the meeting and sub-
mitted a new site plan which has provided circulation through the
lot with turnaround in front as requested; two extra parking stalls
have also been delineated on the plan.
The Board reviewed the layout, noting that any approval would be
subject to subsequent plan check and compliance with code.

Applicant: R. M. Thomas AIA & Associates
To permit construction of a 78,350 square foot commercial shopping
center located on the southeast corner of Garfield Avenue and
Magnolia Street in a C2, Community Business District.
This request is covered by Negative Declaration No. 78-57.
Secretary Spencer opened the public hearing on the negative dec-
laration request. Richard Salmonson, owner, Dayton Meyer, and
James Reagin were present at the meeting. Mr. Salmonson outlined
his project for the benefit of the Board and members of the public
who were in the audience.
Charles Percaval addressed the Board as spokesman for the resi-
dents of the adjacent homes in the neighborhood. He questioned
the environmental effects of the project and discussed noise eman-
ating from the retail uses, separation from the residential sites,
landscaping, relative elevations, fire hazards, impacts of dust
and noise during construction, and types of uses which will go
into the center. Others in the audience commented on location of
trash disposal areas, distances from the property line wall to
the nearest buildings, signing of the project, and possible relo-
cation of one of the future restaurant buildings. There being no
other persons to address the Board, the public hearing on the
negative declaration was closed.

Secretary Spencer explained the administrative review process
and the uses permitted in the C2 zone for the information of
those present. The Board reviewed the request, considering the
issues raised at the meeting. It was the consensus that the
applicant and the adjacent homeowners should meet to discuss
their mutual concerns before any action on the project. Pat
Spencer outlined major areas which the Board will address in its
next review and instructed the secretary to forward those con-
cerns to the proponents.
ON MOTION BY SPENCER AND SECOND BY CROSBY ADMINISTRATIVE REVIEW
NO. 78-51 WAS CONTINUED WITH THE CONCURRENCE OF THE APPLICANT TO

Secretary Spencer opened the public hearing on the negative dec-
laration and the use permit applications. Ken Dingler and Hugh
Vanesek were present at the meeting. There being no persons to
speak for or against the proposal, the public hearing was closed.
The Board reviewed the information contained in the negative
declaration request and considered mitigating measures applicable
to the project.

Secretary Spencer noted that the plan has been revised to move
the sub3ect building back as requested and that parking now com-
plies with code. He explained the prior history of the site and
the requirement on the original approval on the building to the

south for provision of access, informing the applicants that
they will be required also to maintain access to the rear of that
property. Provision of inner circulation on the site and loca-
tion of the future property line were also reviewed.
ON MOTION BY SPENCER AND SECOND BY CROSBY USE PERMIT NO. 78-28
WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE
FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to the general welfare of persons residing
or working in the vicinity or injurious to property and improve-
ments in the general area.
2. The granting of a Use Permit will not adversely affect the
General Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of
Land Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The revised plan received and dated June 13, 1978, shall
be the approved layout, subject to the following modifi-
cation:
a. The northerly drive on Edwards Street shall be in-
creased to a width of thirty-five (35) feet and provided
with a radius curb return.
In its approval action, the Board of Zoning Adjustments considered
the following issues in relation to the conceptual plan:
. Traffic circulation and drives;
. Parking layout;
. Lot area;
• Lot width and lot depth;
. Type of use and its relation to property and improvements in
the immediate vicinity;
• Past administrative action regarding this property.
2. A tentative parcel map shall be filed and recorded sep-
arating subject property from the parcel to the south.
Said parcel map shall establish the common property line
in such a manner that the existing construction on the lot
to the south maintains a ten (10) foot setback from the
property line or setback may be permitted at zero property
line if the existing building on the southerly lot
qualifies under established criteria for such setback.

3. Applicant shall provide and maintain common access of
a minimum width of fifteen (15) feet on the southerly
and westerly property lines. A recorded document shall
be submitted to assure maintenance of such access in
perpetuity.
B. GENERAL CONDITIONS:
1. Natural gas shall be stubbed in at the locations of
cooking facilities, water heaters, and central heating
units.
2. Low -volume heads shall be used on all spigots and water
faucets.
3. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
4. If outside lighting is included on site, high-pressure
sodium vapor lamps shall be used to prevent "spillage"
onto adjacent areas and for energy savings.

Applicant: John and Sharon Stevenson
To permit a building addition to encroach five (5) feet into the
10-foot rear yard setback on property located on the southeast
corner of Collie Lane and Galipean Drive in an Rl, Low Density
Residential District.
This request is a Categorical Exemption, Class 5, California En-
vironmental Quality Act, 1970.
Secretary Spencer opened the public hearing. Mr. and Mrs. Stevenson
were present at the meeting to further explain their reasons for
requesting the variance. There being no other persons to address
the Board in regard to this matter, the public hearing was closed.
Board review included consideration of the lot size and configura-
tion of subject property and the relative orientation of the
house adjoining on the encroaching side of the property.

FINDINGS OF THE BOARD:
1. Granting of the conditional exception will not constitute
a grant of special privilege or establish a precedent, as
other exceptions in similar circumstances have previously
been permitted in the City.
2. The encroachment will, in effect, be an encroachment into
a side yard because of the unique layout of the property in
relation to the abutting property (i.e., rear yard of sub-
ject property abuts the side yard of the adjacent property
to the east). Therefore, the encroachment will not have an
adverse effect on the abutting residence and the intent of
the code for separation is maintained.
3. The granting of the conditional exception will not be mater-
ially detrimental to the public welfare or injurious to
property in the same zoning classification.

Board review of the use permit found the plan to be substantially
in compliance with code except that the 28-foot drive width might
not be acceptable to the Fire Department. Chuck Burney informed
the applicant that the Department would permit the drive with the
proviso that he post it "No Parking - Fire Lane," to which Mr.
Condor agreed.

WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE

• 1. Natural gas and 220V electrical shall be stubbed in at
the location of clothes dryers.
2. Natural gas shall be stubbed in at the locations of cook-
ing facilities, water heaters, and central heating units.
3. Low -volume heads shall be used on all spigots and water
faucets.
4. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
5. The structures on subject property, whether attached or
detached, shall be constructed in compliance with the
state acoustical standards set forth for all units that
lie within the 60 CNEL contours of the property.

Ml-A, Restricted Manufacturing District.
This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
Norman Paik was present at the meeting and indicated his receipt
of and concurrence with the suggested conditions of approval pre-
viously forwarded to him. Bruce Crosby said that Public Works
would also require the map to show reciprocal access with the
adjacent property and that access points on Bolsa Chica be re-
stricted, to which the applicant also agreed.

(22-1/2) foot wide reciprocal access easement on the north

laration request. Kenneth Bourguignon was present at the meeting.
The Board reviewed the information contained in the negative
declaration request form (which also addresses the ultimate con-
struction on the site) and considered mitigation measures appli-
cable to the project. There being no persons to address the Board
in regard to this matter, the public hearing was closed.

Mr. Bourguignon indicated his receipt of and concurrence with
the suggested conditions of approval for the parcel map which
had been previously forwarded to him.

Applicant: Kenneth Bourguignon
To permit construction of a 13,305 square foot industrial build-
ing located on the east side of Gothard Street approximately
925 feet south of Slater Avenue in an M1-A-15,000, CD District.
This'request is covered by Negative Declaration No. 78-54, adopted
by the Board upon approval of the previous parcel map (TPM 78-25).
Kenneth Bourguignon was present at the meeting and informed the
Secretary that he has submitted a letter to the Planning Department
indicating that the warehousing shown on the plan will remain as
that use and not be changed to industrial use.
Pat Spencer discussed the separate compound in the rear, noting
that it could lend itself to storage and would lessen the usable,
open parking spaces for the project. Mr. Bourguignon said he
needs the space for secure night parking for trucks and will pro-
vide a rolling gate for easy accessibility. After discussion, it
was the consensus that this was an acceptable approach.

ON MOTION BY SPENCER AND SECOND BY CROSBY ADMINISTRATIVE REVIEW
NO. 78-52 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL-
LOWING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The revised conceptual site plan received and dated June
5, 1978, shall be the approved layout, subject to the fol-
lowing modifications:
a. The plan shall reflect the required twenty-five (25)
foot turning radius.
b. The plan shall reflect a minimum nineteen (19) clear
and accessible parking spaces.
c. The width of the drive off Gothard Street shall be
increased to thirty (30) feet.
The modifications outlined above shall be reflected upon a
plan to be submitted to the Secretary of the Board for review
and approval prior to application for building permits.
2. The following plans shall be submitted to the Secretary
of the Board:
a. Landscape and irrigation plan complying with Article
979 of the Huntington Beach Ordinance Code and land-
scaping specifications on file in the Department of
Public Works.
b. Rooftop mechanical equipment screening plan. Said
plan shall indicate screeninq of all rooftop mechani-
cal equipment and shall delineate the type of material
proposed to screen said equipment.
In its approval action, the Board of Zoning Adjustments considered
the following issues in relation to the conceptual plan:

by the Planning Commission on June 6, 1978.
Secretary Spencer opened the public hearing. Robert Curtis was
present at the meO-ting; there being no persons to address the
Board, the public hearing was closed.
The Board reviewed the request, making special note that only the
elevations were being considered and not any other aspect of the
tract.
ON MOTION BY SPENCER AND SECOND BY CROSBY USE PERMIT NO. 78-40
WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE
FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The granting of the Use Permit will not adversely affect the
General Plan of the City of Huntington Beach.
2. The proposal is consistent with the City's General Plan of
Land Use.
3. The proposal meets the intent of the ordinance code provisions
under which it was reviewed; i.e., to enhance the view from
the arterial highway.

Applicant: Alfred Mayer
To permit construction of a 42,280 square foot industrial build-
ing located on the south side of Bolsa Avenue approximately 888
feet east of Bolsa Chica Street in an M1-A, Restricted Manufactur-
ing District.
This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
Alfred Mayer and Nick Becker were present at the meeting. Board
review found the plan substantially in compliance with code re-
quirements except for a shortage in required landscaping. Chuck
Burney discussed fire equipment access, giving the applicants the
option of increasing drive width to thirty-two (32) feet or in-
stalling sprinklers in the rear building. Mr. Becker indicated
his agreement to the latter.

LOWING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual site plan received and dated May 30, 1978,
shall be the approved layout subject to the modifications
described herein;
a. Both the easterly and westerly drives shall be in-
creased to a"width of twenty-five (25) feet.

b. The plan shall reflect a minimum of six (6) percent
of the site in landscaping.
c. The plan shall note the intention to sprinkler
Building No. 2.
The modifications outlined above shall be delineated upon the
plan submitted to the Department of Building and Community
Development upon application for building permits.
In its approval action, the Board of Zoning Adjustments considered
the following issues in relation to the conceptual plan:
. Traffic circulation and drives;
. Parking layout;
. Lot area;
. Lot width and lot depth;
. Type of use and its relation to property and improvements in the
immediate vicinity;
• Past administrative actions regarding this property.
2. The following plans shall be submitted to the Secretary
of the Board:
a. Landscape and irrigation plan complying with Article
979 of the Huntington Beach Ordinance Code and land-
scaping specifications on file in the Department of
Public Works.
b. Rooftop mechanical equipment screening plan, if appli-
cable. Said plan shall indicate screening of all
rooftop mechanical equipment and shall delineate the
type of material proposed to screen said equipment.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Building No. 2 shall be sprinklered to Fire Department
standards.
