COMMISSIONERS PRESENT: Higgins, Russell, Stern, Finley, Cohen, Bazil, Paone COMMISSIONERS ABSENT: None NOTE: A TAPE RECORDING OF THIS MEETING IS ON FILE IN THE PLANNING DEPARTMENT OFFICE CONSENT CALENDAR: ON MOTION BY HIGGINS AND SECOND BY RUSSELL THE FOLLOWING ITEMS ON THE CONSENT CALENDAR WERE APPROVED BY THE FOLLOWING VOTE: MINUTES OF MAY, 30, 1978 MINUTES OF JUNE 6, 1978 AS AMENDED CONFORMANCE WITH GENERAL PLAN 78-16 - Find in conformance with the General Plan proposed bike lane on Newland from Edinger to Pacific Coast Highway, and on Slater from Newland to Graham AYES: Higgins, Russell, Stern, Finley, Cohen, Bazil, Paone NOES: None ABSENT: None ORAL COMMUNICATIONS: None PUBLIC HEARINGS: CONDITIONAL USE PERMIT NO. 78-8 Applicant: Arlene Weaver This is a request for a Home Day Care Center located at 7681 Everest Circle'. Monica Florian addressed the Commission and stated that the request was for a day care facility for nine children ranging in age from 3 to 15 years. She further stated that the staff was recommending approval based on the care of six children rather than nine based on three major issues, i.e., availability of space for nine children, traffic problems and parking; and commercial use in a low density residential area. The public hearing was opened. Mitch Haddad, attorney for Ms. Weaver, addressed the Commission and spoke in favor of the use remaining in operation with nine children as.it presently exists. She stated that she rhad operated this facility for five years with no complaints from resi- dents in the area. The public hearing was closed. Commission discussion ensued. ON MOTION BY RUSSELL AND SECOND BY COHEN NEGATIVE DECLARATION NO. 78-39 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Higgins, Russell, Stern, Finley, Cohen, Bazil, Paone NOES: - None ABSENT: None ON MOTION BY PAONE AND SECOND BY STERN CONDITIONAL USE PERMIT WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: 1. There is adequate open space outside and inside for the use. 2. The location of the facility is close to an arterial highway and does not bring traffic into the interior of the tract. 3. Traffic trips are minimal on a residential street of this length. 4. The facility is situated on a cul-de-sac and is not a through street. 5. The facility has the complete support of the neighborhood as evidenced by the petitions favoring the use. 6. The facility has been in existence for more than three years without any objections from neighbors. AYES: Higgins, Russell, Stern, Finley, Cohen, Bazil, Paone NOES: None ABSENT: None TENTATIVE TRACT 10248/CONDITIONAL USE PERMIT NO. 78-3/ ENVIRONMENTAL IMPACT REPORT NO. 78-1 This is a request for a 146 unit planned residential development located on the northwest corner of Atlanta and Beach. Dave Eadie briefly summarized the issues identified in the staff report and elaborated on the subdivision analysis. The public hearing was opened. -2- 6/20/78 - PC Minutes: H.B. Planning Commission Tuesday, June 20, 1978 Page 3 Jim Christensen, representing Frank H. Ayres & Son Construction, addressed the Commission and discussed the sewer problem and drainage in the area. He felt that they were capable of handling utility problems which might arise. He expressed concern over the Local Coastal Program plan. Commissioner Stern felt that a condition should be imposed to state that landscaping along Beach Boulevard would conform to regulations promulgated by the Public Works Department in the next thirty or sixty days. Jim Christensen stated that wording could be included in the CC&R's to include maintenance of open space area. Commissioner Stern stated that he would hope to provide space on west side of Delaware for recreational vehicle storage. Commissioner Bazil stated he would like to see space for recreational vehicles but did not feel it should be taken from open space. He felt that a meandering walk should be located on the easterly side of the project between "C" and °.D" Streets. Commissioner Cohen questioned the drainage and noise along Beach and Atlanta. The public hearing was closed. Commissioner Higgins expressed concern over sanitary sewer capacity, the dividing of the project by Delaware, the site elevation relative" to the elevation of Beach Boulevard, the adequacy of sound and site control for Beach Boulevard, the reorientation of additional berms with trees between parallel rows of buildings, and the lack of uniform dispersement of parking. He felt that it would not adversely influence the Local Coastal Program plan. Planning Commission Tuesday, June 20, 1978 Page 4 ON MOTION BY STERN AND SECOND BY RUSSELL RESOLUTION NO. 1221, A RESOLUTION OF INTENTION OF THE PLANNING COMMISSION TO ADOPT A PRECISE PLAN OF STREET ALIGNMENT FOR ATLANTA AVENUE BETWEEN BEACH BOULEVARD AND HUNTINGTON STREET, WAS APPROVED BY THE FOLLOWING VOTE: AYES: Higgins, Russell, Stern, Finley, Cohen, Bazil, Paone NOES: None ABSENT: None A MOTION WAS MADE BY STERN TO APPROVE TENTATIVE TRACT 10248 SUBJECT TO FINDINGS AND CONDITIONS. Commissioner Bazil felt there should be better allocations of on -street guest parking on "C" Street. Commissioner Paone wanted plans for landscape drawn up in accordance with the landscape corridor concept. Commissioner Stern suggested that the tract should not be approved but rather the Commission should wait for the Coastal Commission to make a decision on the sewer. Chairman Finley felt that a decision prior to the approval of the Local Coastal Program plan would be poor judgment. Commissioner Russell expressed concern over the Local Coastal Program plan and the sewer issue. THE MOTION FAILED FOR LACK OF A SECOND. It was the consensus of the Commission that the staff investigate the following areas: Additional guest parking along "C" Street, provide meandering walkway along open space corridor between "C" and "D" Streets to work with the developer in establishing a landscape plan in accord- ance with the concept of the landscape corridor discussed in the Scenic Highways Element. Planning Commission Tuesday, June 20, 1978 Page 5 CONDITIONAL EXCEPTION NO. 78-06/TENTATIVE PARCEL MAP NO. 78-21/ NEGATIVE DECLARATION NO. 78-25 Applicant: William Goodman Conditional Exception No. 78-6 is a request to permit the creation o-f a corner lot 31 sq. ft. short of code requirements located at 4721 Warner. Tentative Parcel Map No. 78-21 is a -request to divide an existing lot into 2 parcels of 6000 sq. ft. and 6469 sq. ft. Monica Florian addressed the Commission and stated that the staff was recommending approval. She further stated that the amount of dedication is significant enough to constitute a hardship. The public hearing was opened. William Goodman addressed the Commission and stated that he was present to answer any questions. The public hearing was closed. Commission discussion ensued. ON MOTION BY BAZIL AND SECOND BY RUSSELL NEGATIVE DECLARATION NO. 78-25 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Higgins, Russell, Stern, Finley, Cohen, Bazil, Paone NOES: None ABSENT: None ON MOTION BY BAZIL AND SECOND BY COHEN CONDITIONAL EXCEPTION NO. 78-06 WAS APPROVED FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE: 1. The amount of dedication required constitutes an exceptional circumstance applicable to the land that does not apply generally to the property or class of uses in the same district. 2. The conditional exception is necessary for the preservation and enjoyment of substantial property rights. 3. The granting of such conditional exception will not be materially detrimental to the public health, safety, and welfare or injurious to the conforming land, property, or improvements in the neighborhood of the property for which such conditional exception is sought. 4. The applicant is willing and able to carry out the purposes for which the conditional exception is sought; he will proceed to do so without unnecessary delay.' Planning Commission Tuesday, June 20,, 1978 Page 6 ON MOTION BY BAZIL AND SECOND BY COHEN TENTATIVE PARCEL MAP NO. 78-21 WAS APPROVED WITH THE FOLLOWING FINDINGS AND -CONDITIONS BY THE FOLLOWING VOTE: FINDINGS,: 1. The proposed map is consistent with the General Plan. 2. The design of the proposed subdivision is consistent with the General Plan. 3. The site is physically suitable both for the proposed multiple residential use and the proposed density. 4. The design of the subdivision will not cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. 5. The design of the subdivision will not cause serious health problems. 6. The design will not conflict with any public easements. CONDITIONS OF APPROVAL: 1. The tentative parcel map received by the Planning Department on ,May 5, 1978, shall be the approved layout. 2. 'A parcel map shall be filed with, and approved by, the Department of Public Works and recorded with the Orange County Recorder. 3. Copies of the recorded parcel map shall be filed with the Planning Department and the Department of Public Works. 4. A circulation easement on Parcel 2 as shown on the tentative parcel map received by the Planning Department on May 5, 1978, shall be placed on the recorded parcel map. 5. Vehicular access rights on Warner shall be dedicated to the City of Huntington Beach. AYES: Higgins, Russell, Stern, Finley, Cohen, Bazil, Paone NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 78-05 Applicant: Richard Borges This is a request to permit 3 residential units on a lot with less than 6,000 net square feet located on the west side of B Street, 330 feet south of centerline of Warner Avenue. - -6- 6/20/78 - PC Minutes: H.B. Planning Commission Tuesday, June 20, 1978 Page 7 Monica Florian addressed the Commission and stated this lot was similar to other lots and could adequately support two units. She further stated that granting the conditional exception would constitute a special prigilege and set a precedent for other gimilar properties on "BY Street. The public hearing was opened. Richard Borges addressed the Commission and spoke in favor of the request, stating that when he purchased the property it was com- mercial. Keith Roberts addressed the Commission and spoke in opposition to the request. He further stated that he did not want the area zoned R3 but would prefer that it remain R2. The public hearing was closed. ON MOTION BY HIGGINS AND SECOND BY PAONE CONDITIONAL EXCEPTION NO. 78-05 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE: 1. The subject site is not unusal or subject to exceptional cir- circumstances and is in fact quite normal with respect to other such lots throughout the City. 2. Granting the conditional exception would constitute a special privilege above and beyond those rights enjoyed by other similar properties. 3. Granting the conditional exception would set a precedent on the basis of which all other similar sized lots could expect increased densities. Such an increase of densities would be contrary to the intent of the existing zoning district. AYES: Higgins, Russell, Stern, Finley, Cohen, Bazil, Paone NOES: None ABSENT: None ZONE CHANGE NO. 78-7/NEGATIVE DECLARATION NO. 78-47 Applicant: William Tater This is a request for a change of zone from C3 to R4 on property located at 708 Pacific Coast Highway. Monica Florian addressed the Commission and reviewed the informatior contained in the staff report. She stated that this zone change request was inconsistent with the policies and intent of the General Plan because the intent of the High Density designation was to encourage block consolidation and facilitate large scale development. The General Plan presumes such development is better suited to this key location across from the beach and more potential will exist for high quality design and maximum aesthetics. Further, the General Plan expres-ly states that a continuation of four-plex and small apartment development is to be discouraged along Pacific Coast Highway. -7- 6/20/78 - PC Minutes: H.B. Planning Commission Tuesday, June 20, 1978 Page 8 She recommended that the zone change request be denied without prejudice at this time and that staff be directed to prepare a Specific Plan to implement the General Plan. Such a Specific Plan would enable the City to designate target blocks with maximum potential for consideration, help insure compatible development of mixed use blocks and allow for appropriate infilling of partially developed blocks. The public hearing was opened. William Tater addressed the Commission and stated that he needed to know what he could do with his property. He stated that he had previously been denied a commercial project by the Coastal Commission. The public hearing was closed. ON MOTION BY STERN AND SECOND BY RUSSELL NEGATIVE DECLARATION NO. 78-07 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Higgins, Russell, Stern, Finley, Cohen, Bazil, Paone NOES: None ABSENT: None A MOTION WAS MADE BY STERN AND SECONDED BY PAONE TO SPPROVE ZONE CHANGE NO. 78-7. Commission discussion ensued with Chairman Finley suggesting that the "Q" zone be placed on the zone change, addressing parking, access, noise attenuation, and landscaping. COMMISSIONER STERN WITHDREW HIS MOTION AND COMMISSIONER PAONE WITHDREW HIS SECOND TO APPROVE ZONE CHANGE 78-7. ON MOTION BY STERN AND SECOND BY RUSSELL ZONE CHANGE NO. 78-7 WAS CONTINUED TO JULY 18, 1978, TO ALLOW TIME FOR READVERTISING FOR THE "Q" ZONE BY THE FOLLOWING VOTE: AYES: Higgins, Russell, Stern, Finley, Bazil NOES: Cohen, Paone ABSENT: No The public hearing was reopned and continued to July 18, 1978. Commissioner Paone stated that he felt it was mandatory for the Planning Commission to approve the zone change as requested. Planning Commission Tuesday, June-'20, 1978 Page 9 ON MOTION BY STERN AND SECOND BY PAONE THE STAFF WAS DIRECTED TO PREPARE A SPECIFIC PLAN FOR THE AREA BETWEEN WALNUT AND PACIFIC COAST HIGHWAY FROM SIXTH TO GOLDENWEST WHICH WOULD IMPLEMENT THE GENERAL PLAN BY THE FOLLOWING VOTE: AYES: Higgins, Russell, Stern, Finley, Cohen, Bazil, Paone NOES: None ABSENT: None Commissioner Higgins was excused from the meeting at 11:00 p.m. CODE AMENDMENT NO. 78-6/NEGATIVE DECLARATION NO. 78-63 "POLITICAL SIGNS" Dave Eadie stated that this ordinance had been prepared at the direction of the City Council. Chairman Finley opened the public hearing. Seeing no one present to speak on this code amendment, Chairman Finley closed the public hearing. Commission discussion ensued on the maximum size and color theme of the signs, as well as length of time signs should be permitted to remain. Staff was directed to return with additional revisions to the ordinance. ON MOTION BY STERN AND SECOND BY PAONE CODE AMENDMENT NO. 78-6 AND NEGATIVE DECLARATION NO. 78-63 WERE CONTINUED TO JULY 18, 1978, BY THE FOLLOWING VOTE: AYES: Russell, Stern, Finley, Cohen, Bazil, Paone NOES: None ABSENT: Higgins The public hearing was reopened and continued to July 18, 1978. CODE AMENDMENT NO. 78-5 "MISCELLANEOUS SETBACK REMOVALS: This is an amendment to the Huntington Beach Ordinance Code removing special setback requirements in the following areas: The southeast corner of Warner Avenue and Beach Boulevard, west of Beach Boulevard, between Indianapolis Avenue and Atlanta Avenue, the southwest corner of Atlanta Avenue and Beach Boulevard, and the northeast corner of Los Patos Avenue and Green Street. Dave Eadie addressed the Commission and reviewed the contents of the code amendment. The public hearing was opened. Jim Palin addressed the Commission and reviewed the draft agreement. The staff was directed to obtain a copy of Mission ViejoIsagreement with the Bench Ad Ccmpany for study and prepare criteria for review of advertising copy. APPOINTMENT OF PLANNING COMMISSION REPRESENTATIVES TO HOUSING AND COMMUNITY DEVELOPMENT CITIZENS ADVISORY COMMITTEE. Commissioner Paone was appointed as an alternate to serve on this Committee along with Chairman Finley. APPOINTMENT OF TWO PLANNING COMMISSION REPRESENTATIVES TO PARKS ANALYSIS COMMITTEE Commissioners Paone and Cohen were appointed to serve on this_. committee. SUBDIVISION COMMITTEE APPOINTMENT Chairman Finley appointed Commissioner Higgins to serve on this committee as an alternate in place of herself. LOCAL COASTAL PROGRAM Chairman Finley appointed Frank Higgins to serve with her on the Local Coastal Program Committee. ORAL COMMUNICATIONS: None PLANNING DEPARTMENT ITEMS Secretary Selich discussed the action of the City Council at its June 19th meeting.
