This request is a Categorical Exemption, Class 5, California En- vironmental Quality Act, 1970. USE PERMIT NO. 78-32 (In Conj./CE 78-31)(Cont. from 6-7-78) Applicant: Gary Schmidt To permit construction of a 17,383 square foot shopping center located on the west side of Beach Boulevard approximately 380 feet north of Adams Avenue in a C4, Highway Commercial District. This request is covered by Negative Declaration No. 78-48. Chairman Eadie reopened the public hearing. There was no one present to represent the application, nor were any persons present in the audience to address the Board in regard to the proposal. The public hearing was closed. Minutes, H.B. Board of Zoning Adjustments June 21, 1978 Page 2 Secretary Spencer reported that the plan does not comply with requirements of the code and the mandatory processing date will have passed before the next scheduled meeting of the Board. Since no continuance can be granted without the applicant's con- currence, the Board's only option is to deny the subject requests without prejudice, permitting the applicant to reapply if he so desires. ON MOTION BY EADIE AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 78-31, USE PERMIT NO. 78-32, AND NEGATIVE DECLARATION NO. 78-48 WERE DENIED WITHOUT PREJUDICE, BY THE FOLLOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 78-51 (Cont. from 6-14-78) Applicant: R. M. Thomas AIA & Associates To permit construction of a 78,350 square foot commercial shopping center located on the southeast corner of Garfield Avenue and Magnolia Street in a C2, Community Business District. This request is covered by Negative Declaration No. 78-57. Chairman Eadie opened the public hearing on the negative declara- tion request. James Reagin and Russ Jednak were present. The Board reviewed the information contained in the negative declaration request form and considered mitigating measures appli- cable to the project. The public hearing was closed. ON MOTION BY EADIE AND SECOND BY SPENCER THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 78-57 WITH THE MITIGATING MEASURES CONTAINED IN GENERAL CONDI- TIONS 2 THROUGH 5 IMPOSED ON THE AD:"IINISTRATIVE REVIEW, BY THE FOLLOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE Secretary Spencer reported that the applicants have met with property owners and residents in the area. Mr. Reagin and Mr. Jednak discussed the results of that meeting, and Jerry Bramlett, one of the neighboring residents, described the areas in which agreement had been reached. Board of Zoning Adjustments June 21, 1978 Page 3 ON MOTION BY EADIE AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 78-51 WAS APPROVED WITH THE FOLLOWING CONDITIONS , BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan and front elevations received and dated May 22, 1978, shall be the approved layout, subject to the following modifications: a. Location of trash areas shall be shown a distance of at least fifty (50) feet from the easterly property line wall. b. The main entry drive on Garfield Avenue shall be lined up with the entry drive into the shopping center to the north across Garfield. C. The plan shall show modifications to the main entry drive on Magnolia Street as follows: (1) a revised drawing shall be submitted showing location of the ex- isting drive into the K-Mart complex across Magnolia to the west and coordination of the drive on subject property with the K-Mart drive to hermit possible future installation of left turn lanes; (2) deletion of the interior median in the subject entry drive; and (3) provision of 90° parking adjacent -to the restaur- ant building No. 2. The modifications outlined above shall be delineated upon the plan submitted to the Department of Building and Community Development upon application for permits, except that (c) shall be first subject to the approval of the Secretary of the Board. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: • Traffic circulation and drives; . Parking layout; • Lot area; . Lot width and lot depth; . Type of use and its relation to_property and improvements in the immediate vicinity; • Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and BZA 6-21-78 Page 3 Minutes, H.B. Board of Zoning Adjustments June 21, 1978 Page 4 landscaping specifications on file in the Department of Public Works. Said plan shall depict 20-inch specimen size box trees set at no more than 25 feet on center along the easterly planter area abutting the single-family residential tract. b. Rooftop mechanical equipment screening plan, if ap- plicable. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. c. A lighting plan prepared by a lighting engineer shall be submitted. Said plan shall depict all lighting directed inward on the subject site and away from the abutting residential properties. d. If the pad for restaurant building No. 1 is diminished, a plan showing the disposition of the remaining prop- erty involved shall be submitted for the precise de- sign of parking in that space. e. Rear elevations of the structures on the easterly property line. 3. If the nature of the restaurant uses changes (i.e., if a drive -through restaurant is proposed) the use will be referred back to the Board of Zoning Adjustments for review and approval action. 4. If the building pad for restaurant building No. 1 is dim- inished, the size shall be diminished beginning from the easterly boundary of that pad. NOTE: Signs as delineated on the approved plan are not part of the approval of this request. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. A decorative masonry wall shall be constructed along the southerly and easterly boundaries of the subject site. Said wall shall be a Minimum height of seven (7) feet on the east property line of subject property, measured from whichever side is higher; any step down in height of this wall shall occur at a property line of the abutting resi- dential area. The wall along the southerly property line of subject property shall be a minimum height of six (6) feet, measured from whichever side is higher. 2. A planned sign program for the entire center shall be submitted to the Planning Department. 3. The most westerly driveway on Garfield Avenue shall be posted "right turn only." Hours of activity (such as deliveries and sweeping opera- tions) shall be prohibited between the hours of 10:00 p.m. and 7:00 a.m. 2. Natural gas shall be stubbed in at the locations of cook- ing facilities, water heaters, and central heating units. 3. Low -volume heads shall be used on all spigots and water faucets. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 5. If outside lighting is included on site, high-pressure sodium vapor lamps shall be used to prevent "spillage" onto adjacent areas and for energy savings. Beard To permit a reduction in minimum dimension for open space for a 200 square foot room addition located on the east side of Snug Harbor Circle approximately 175 feet south of Half League Drive in an Rl, Low Density Residential District. This request is a Categorical Exemption, Class 5, California En- vironmental Quality Act, 1970. Chairman Eadie opened the public hearing. Donald Beard was present at the meeting. There being no one to address the Board in regard to this matter, the public hearing was closed. Board review considered the size and location of the sub3ect property. ON MOTION BY SPENCER AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 78-33 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The placement of the dwelling is such that it does not afford the same area in the rear yard that is provided other homes in the immediate area. BZA 6-21-78 Paqe 5 Minutes, H.B. The subject lot backs up to the Talbert channel; thus, the addition will not encroach on the privacy or open space of any neighboring residential unit. 3. The minimum square footage of open space is still maintained on the lot and only the dimension of that open space is affected by the addition. 4. The granting of the conditional exception will not constitute a grant of special privilege inconsistent upon other proper- ties in the vicinity and under an identical zone classification. 5. Because of special circumstances applicable to the subject property, including size, shape, topography, location, or surroundings, the strict application of the zoning ordinance is found to deprive the subject p � property of privileges enjoyed by other properties in the vicinity and under identical zone �I classifications. 6. The granting of a conditional exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 7. The granting of a conditional exception will not be materially detrimental to the public welfare or injurious to property in the same zone classifications. 8. The granting of the conditional exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: A. This request is covered by Negative Declaration No. 78-64. Chairman Eadie opened the public hearing on the negative declara- tion request. Gerald Leonardi was present to represent the appli- cant. The Board reviewed the information contained in the nega- tive declaration request form and considered mitigation measures applicable to the project. There being no one to speak for or against the proposed project, the public hearing was closed. ON MOTION BY EADIE AND SECOND BY SPENCER THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 78-64 WITH THE MITIGATING MEASURES CONTAINED IN CONDITIONS C1 THROUGH C4 IMPOSED ON THE ADMINISTRATIVE REVIEW, BY THE FOLLOW- ING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE Secretary Spencer reported that the site plan complies with code except for a slight discrepancy in square footage of landscaping and improper delineation of alley dedication. ON MOTION BY CROSBY AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 78-54 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan and the elevations received and dated May 31, 1978, shall be the approved layout, subject to the following: The plan shall reflect the required two and one-half (2-1/2) foot alley dedication. The modification depicted above shall be delineated on the plan submitted to the Department of Building and Community Development upon application for building permits. The following plans shall be submitted to the Secretary of the Board for review and approval: a. A landscaping plan designed so that that portion of the property at the corner of 5th and Main will be planted to inhibit and discourage its use by pedes- trians. NOTE: The Board has recognized and considered the fact that in two areas the property does not meet strict interpretation of code requirements. It was the Board's determination that this constitutes a very minor encroachment not significant enough to require a variance and, further, that the intensified landscaping proposed for the site constitutes sufficient re- placement for the small loss in square footage. b. Rooftop mechanical equipment screening plan, if appli- cable. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Board of Zoning Adjustments June 21, 1978 Page 9 CONDITIONAL EXCEPTION NO. 78-34 Applicant:' Ronald and Marie Palmer To permit reduction in open space, a 6-foot wall within a front yard setback and 6-inch encroachment of two walking decks on property located on the north side of DeVille Circle approxi- mately 400 feet east of Landau Lane in an R1, Low Density Residential District. This request is a Categorical Exemption, Class 5, California En- vironmental Quality Act, 1970. Chairman Eadie opened the public hearing. The applicants were not present but Richard Christman, who is planning to purchase the property, was at the meeting. There being no one to address the Board on the matter, the public hearing was closed. Board review centered on the unusual configuration of the lot, which had been created by establishment of the freeway right-of- way. ON MOTION BY EADIE AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 78-34 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The unique configuration of the lot poses substantial hard- ship in locating a unit on the site. 2. The encroachment into the side yard is negligible in view of the narrowness of the property, which reduces even further toward the rear of the lot. 3. The granting of the conditional exception will not constitute a grant of special privilege inconsistent upon other proper- ties in the vicinity_ and under an identical zone classifica- tion. 4. Because of special circumstances applicable to the subject property, including size, shape, topography, location or sur- roundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification. 5. This request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Chairman Eadie opened the public hearing. No one was present to represent the applicant or to speak on the project, and the public hearing was closed. Board review ensued. ON MOTION BY SPENCER AND SECOND BY EADIE USE PERMIT NO. 78-42 WAS APPROVED WITH THE FOLLWOING FINDINGS AND CONDITIONS, BY THE FOL- LOWING VOTE: FINDINGS OF THE BOARD: 1. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The site plan received and dated June 6, 1978, shall ne the approved conceptual layout, as amended to reflect the following: The overhead door shall be set back from the front prop- erty line a minimum of twenty-five (25) feet. The modification outlined above shall be depicted on the plan submitted to the Department of Building and Community Devel- opment upon application for building permits. This request is a Categorical Exemption, Class 1, California Environmental Quality Act, 1970. Chairman Eadie opened the public hearing. Frank Chavez and Mr. Feldini were present at the meeting to explain the purpose of the exception request. There being no other persons to address the Board, the public hearing was closed. ON MOTION BY EADIE AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 78-35 WAS APPROVED WITH THE FOLLOWING FINDINGS,AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The Edison Company has indicated that it is again consider- ing expansion into the front portion of its property, which is presently unimproved; therefore, any street improvements which would be installed for this subject use might have to be torn out again within the near future. There are other con- straints on the property (e.g., the coast trunk sewer, widen- ing of the highway, and other imminent planning matters) which present logistical hardship in action to require street im- provements for this superficial and temporary use. 2. Since the Board has conditioned this use so that the approval shall expire the day after Labor Day, 1978, granting of this conditional exception will not adversely affect the General Plan of the City of Huntington Beach. 3. Granting of the conditional exception will not be materially detrimental to the public welfare or injurious to property in the same zone classification. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF PERMITS: 1. The site plan received and dated June 5, 1978, shall be the approved layout, subject to all conditions imposed on Administrative Review No. 78-55. ON MOTION BY EADIE AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 78-55 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF PERMITS: 1. The site plan received and dated June 5, 1978, shall be the approved conceptual layout, subject to the following: a. The plan shall be modified to show no access to the property from Pacific Coast Highway. 2. The project shall comply with all seasonal parking lot standards set forth in the ordinance code. B. GENERAL CONDITION: 1. This approval shall terminate the day after Labor Day, 1978. This request is a Categorical Exemption, Class 1, California Envir- onmental Quality Act, 1970. Chairman Eadie opened the public hearing. Frank Chavez and Mr. Feldini were present at the meeting. There being no persons to address the Board in regard to the request, the public hearing was closed. Secretary Spencer informed the Board that curbs and gutters are already installed on the perimeter of the site and that the applicants are operating on a short-term lease with CalTrans, the owner of the property. The property on which the lot is proposed to be located is owned by Cal Trans and is under a 30-day lease to the Park- ing Company of America. 2. This request is a Categorical Exemption, Class 1, California En- vironmental Quality Act, 1970. Frank Chavez and Mr. Feldini were present at the meeting. The Board reviewed the projected use. The subject use was approved at the Board's June 14, 1978, meeting. Secretary Spencer reviewed the existing sign on the premises for the Board's information, noting that it does not meet present sign criteria. He further noted that the restaur- ant chain is no longer installing this particular type sign at its new facilities.
