Secretary Selich presided over this part of the meeting and declared
the nominations open for Chairman.

This is a request for a 146 unit planned residential development
located on the northwest corner of Atlanta and Beach.
Dave Eadie addressed the Commission and discussed the landscape/open
space concept, Beach Boulevard landscape corridor concept, guest parking, and
recreational vehicle parking issues.
The public hearing was opened.
Ren Newcomb, representing Ayres Construction Company addressed
the Commission and spoke briefly on the project.
Commissioner Higgins expressed concern over Delaware Street dividing the
project and the fact that the major open space was not uniformly
distributed throughout the project. He also expressed concern over
the guest parking not being properly distributed.
Chairman Finley concurred with Commissioner Higgins on division of
Delaware and how it affected the open space.
Commissioner Paone discussed the calculation of open space.
Commissioner Bazil agreed with Commissioner Higgins and felt that a re-
duction of two units in the vicinity of the swimmi--g pool area would
improve the site layout.
Commissioner Stern discussed the landscaping.

Commissioner Cohen requested that the following comments be made
a part of the minutes:
I cannot in all conscience approve this Conditional Use Permit and
Tentative Tract. It is about time the staff and this Commission
and City Council and most importantly the City of Huntington Beach
stop granting these permits to developers of all kinds until everyone
has an opportunity to reevaluate their decision. Concerning this
project in particular, isn't it about time we have sufficient sewers
in place to handle the increase in population. Isn't it time we
consider our overcrowded school system before we let developers put
new students in our schools? Isn't it time we look and listen to the
sound of Beach Boulevard before we permit further residential units
along that busy thoroughfare? Isn't it time we consider the possibility
of major flooding in the Santa Ana River plain which sets in the
middle of this project? Isn't it time we consider the expense that
this City and the taxpayers will be subject to when this project is
completed? For example, the project calls for 7.54 units per acre
and the staff states that anything over 5 units per acre the City
loses money on. All show a net loss to the City. Yet we are thinking
of approving this. Finally, isn't it about time that this developer
or any developer consider what his project will look like and become
five or ten years from now. It seems that their interest is now and
not what it will be in the future. When I was appointed Planning
Commissioner I vowed that I would look to the future,develop foresite
and plan not for today but for many yeaXs from now. I feel that most
of us are not considering the future. We are putting the cart before the
horse when we permit developers to build a house on a piece of land
before we have a chance to plan the street around that house, before
the sewers are placed to accommodate that house, before police, fire
and other City services are sufficient to properly service that house.
I think we should stop. I think we should stop this out of control
expense. Let us look at the planning of our predecessors and attempt
to right their wrongs or change their thinking or maybe even confirm
some of their steps, but let's not plunge head long into our work
without some thought of where we are going or where we want to be in
the future, and I think that this Commission better do it because if
we don't the people will.

This is a request for a reduction in minimum lot area for 2 units
located 385 feet north of Pecan on the east side of Thirteenth Street.
Monica Florian addressed the Commission and stated that at its May 2,
1978 meeting the Planning Commission continued the proposal to no
date certain pending preparation of a code amendment to allow similar
requests. She further stated that the applicant had requested that
the Conditional Exception be heard prior to completion of the code
amendment. Ms. Florian stated that the staff was recommending
approval as before as it felt that the site is unique in size and
the Townlot Specific Plan was prepared for standard 50 ft. lots,
and that the granting of this exception would not allow development
that is inconsistent with the area.
The public hearing was opened.
Warren Michaelis addressed the Commission and spoke in favor of the
granting of this exception.
Commissioner Stern stated that he did not agree with Finding #3
in the staff report.

EXCEPTION 78-04 BECAUSE FINDING #3 COULD NOT BE MADE.

the "Q" zone in the zone change, which would require readvertising.

REVOCATION OF PORTION 3, PRECISE PLAN OF STREET ALIGNMENT 70-4
ATLANTA AVENUE/LAKE STREET
Secretary Selich stated that the staff report indicated that work
is being done to come up with alternative alignments but that
th staff has not completed an analysis yet.
He stated that the staff was recommending adoption of Resolution
of Intention No. 1225 to revoke Precise Plan of Street Alignment
No. 708, table the revocation of Portion 3 of Precise Plan of
Street Alignment No. 70-4, and adopt a new Precise Plan of Street
Alignment (PPSA 78-4) for the intersection of Atlanta Avenue and
Lake Street.

Jim Vanderhyden addressed the Commission and stated he would like
to know what alternatives there would be.

This is a request for a proposed addition of 1069 square feet to
existing facility necessitating the reduction of required play area
per child. This facility is located at 7945 Aldrich, on the north
side of Aldrich, 180 ft. + west of Beach.
Monica Florian addressed the Commission and stated that while the staff
was recommending denial of the Conditional Exception and Conditional
Use Permit, a survey of other cities in Orange County reflected that
Huntington Beach has the highest requirement for outdoor play area.
She further stated that perhaps the staff should be directed to initiate
a Code Amendment changing the requirements for outdoor play areas for
day care facilities.

Ms. Griffiths, a teacher from the day care center, addressed the
Commission and spoke in favor of the requests.
Art Berkowitz addressed the Commission and spoke in favor of the use.

This is a request for a 1 lot subdivision, 68 units on 10.5 acres
located on the south side of Yorktown 1400 feet westerly of Newland
Street.
Dave Eadie addressed the Commission and discussed the information
contained in the staff report as well as some suggested additional
conditions.
Commissioner Cohen felt that a new EIR should be prepared since the
old EIR was prepared in 1975.
The public hearing was opened.
George Stringer spoke in favor of the project.
Commissioner Higgins complimented Mr. Stringer on the project.

3. The property was previously studied for this intensity of land use
at the time the land use designation for medium density residential
was placed on said property.
4. The parcel size, depth, frontage, street widths, and all other
design and improvements features of the proposed project are pro-
posed to be constructed in compliance with standard plans and speci-
fications on file with the City, as well as in compliance with the
State Map Act and supplementary City Subdivision Ordinance.
CONDITIONS OF APPROVAL:
1. The site -plans acid floor plans received June 30, 1978, and the tentative
map received and dated May 2, 1978, shall be the approved layout.
2. Drainage for the subdivision shall be approved by the Department of
Public Works prior to the recordation of a final map. This system
shall be designed to provide for siltation and erosion control both
during and after construction of the proposed project.
3. A decorative masonry wall shall be constructed to City specification
along Yorktown and Coldwater. Said wall shall be six inches wide
and six feet high. The height of said wall shall be measured from
whichever side is higher at finished grade. The architectural
design of said wall shall be approved by the Planning Department.
The structural design shall be approved by the Department of Public
Works and shall be included as a part of the street improvement
plans. The intent of this condition is to improve the street scene
along Yorktown.
4. Landscape planter area shall be provided at locations along Yorktown
and Coldwater Lane as shown on the approved tentative map. Such
planter shall conform to the plans and specifications on file with
the Department of Public Works and the requirements of the Planning
Commission.
5. The developer shall install full street improvements on Coldwater
Lane with the exception that no sidewalk shall be constructed along
the westerly right-of-way lane at this time.
6. A 14 foot setback shall be provided from the ultimate right-of-way
of the adjacent arterial highways to the living quarters of the
units adjacent to such highways.
7. The structures shall be constructed in compliance with the State
Acoustical Standards set forth for multi- or attached units, for
all units that lie within the 60 CNEL contours on this property.
8. If the developer proposes to provide air conditioning, the insulation
in ceilings and exterior walls shall be a minimum of R-19 and R-11,
respectively. If no air conditioning is to be provided, the
insulation in ceilings and exterior walls shall be a minimum of
R-13 and R-7, respectively.

9. All building spoils, such as unusable lumber, wire, pipe, and other
surplus or unusable material, shall be disposed of at an offsite
facility equipped to handle them.
10. Natural gas and 220 V electrical shall be stubbed in at the location
of clothes dryers. Natural gas shall be stubbed in at the locations
of cooking facilities, water heaters, and central heating units.
11. An engineering geologist shall be engaged to submit a report to the
City indicating the ground surface acceleration from earth movement
for subject property.
12. All structures proposed for construction within this project shall
be constructed in compliance with the g-factors as indicated by
the engineering geologist's report.
13. Calculations for footings and structural members to withstand
anticipated g-factors shall be submitted to the City for review.
14. A chemical analysis as well as tests for physical properties of
the soils on subject property shall be submitted to the City for
review prior to the issuance of building permits.
15. The developer shall participate in fifty percent (50%) of the cost
of a new traffic signal at the intersection of Yorktown and Coldwater.
16. No final map shall record until the Pacific Coast Highway Trunk Sewer
is approved by the California Coastal Commission or an alternative
sewer system acceptable and designed to both the City and the Orange
County Sanitation District is approved.

9. All building spoils, such as unusable lumber, wire, pipe, and other
surplus or unusable material, shall be disposed of at an offsite
facility equipped to handle them.
10. Natural gas and 220 V electrical shall be stubbed in at the location
of clothes dryers. Natural gas shall be stubbed in at the locations
of cooking facilities, water heaters, and central heating units.
11. An engineering geologist shall be engaged to submit a report to the
City indicating the ground surface acceleration from earth movement
for subject property.
12. All structures proposed for construction within this project shall
be constructed in compliance with the g-factors as indicated by
the engineering geologist's report.
13. Calculations for footings and structural members to withstand
anticipated g-factors shall be submitted to the City for review.
14. A chemical analysis as well as tests for physical properties of
the soils on subject property shall be submitted to the City for
review prior to the issuance of building permits.
15. The developer shall participate in fifty percent (50o) of the cost
of a new traffic signal at the intersection of Yorktown and Coldwater.
16. No final map shall record until the Pacific Coast Highway Trun;c Sewer
is approved by the California Coastal Commission or an alternative
sewer system acceptable and designed to both the City and the Orange

Dave Eadie addressed the Commission and discussed the history of the
applications. He stated that the project is under construction on
Tentative Tract 10447, having been approved under Administrative
Review 78-49 and that all the conditions imposed under this application
had been met.
The public hearing was opened.
Howard Subnick addressed the Commission and spoke in opposition to
Precise Plan of Street Alignment No. 78-3, stating that he felt there
should be two exits'on Gothard-instead of one and no openings cn}o Heil Avenue.
Secretary Selich stated that a portion of the street is approved as a
private street by the BZA on the Administrative Reivew and that
action on the tract map will not eliminate that opening onto Heil.
He stated the purpose of the precise plan is to insure a continuation
of the street to the south through the X map area with access onto
Gothard.
The Commissioners were concerned about traffic problems on Heil and re-
quested staff and developer to see if any other alternatives were
available.
Bill Burke addressed the Commission and stated that all the rough
grading had been done and construction was underway. He further stated
that he had made every effort to comply with all conditions imposed by
the staff and had worked with staff very closely.
A MOTION WAS MADE BY STERN AND SECONDED BY RUSSELL TO DENY TENTATIVE
TRACT 10447.

This is a request for a 5 lot subdivision on 43.3 acres located in
the area between Atlanta and Indianapolis and Magnolia and Newland.
George Stringer addressed the Commission and stated that he would
be happy to answer any questions posed by Commission members.

ON MOTION BY COHEN AND SECOND BY BAZIL TENTATIVE TRACT 5419 WAS APPROVED
WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE:
FINDINGS:
1. The proposed subdivision of this 43.3 acre parcel of land zoned R1
(which allows 7 units per gross acre) is proposed to be constructed
having approximately 6.46 units per gross acre.
2. The General Plan has set forth provisions for this type of land
use as well as setting forth objectives for implementation for this
type of housing.
3. The property was previously studied for this intensity of land use
at the time the land use designation for medium density residential
was placed on said property.
4. The lot size, depth, frontage, street width, and all other design
and improvement features of the proposed subdivision are proposed
to be constructed in compliance with standard plans and specifications
on file with the City, as well as in compliance with the State Map
Act and supplementary City Subdivision Ordinance.
CONDITIONS OF APPROVAL:
1. The tentative map received June 27, 1978, shall be the approved
map.
2 The sewer, water, drainage and fire hydrant systems shall be
designed to City standards. Prior to recordation of a final map
the drainage system shall be designed to provide for siltation and
erosion control both during and after construction.
3. Vehicular access rights shall be dedicated to the City along

This is four apartment buildings totaling 14 units located between
Brookhurst Street and the Santa Ana River approximately 1,062 feet
north of Banning Avenue. The applicant is Cager Properties, 16680
Mt. Erin, Fountain Valley, California 92708.
The building elevations abutting the Santa Ana River Greenbelt for
Use Permit No.78-38 were approved on January 4, 1978, but the Coastal
Commission withheld approval of the elevations. The applicant
forwarded revised elevations for the Planning Commission's review.
Commissioner Paone stated that his law firm had done legal work for
this company and he would therefore have to abstain.
Commissioner Stern stated that he did not like the elevations.
Commission discussion ensued.

Commissioner Stern stated he felt the matter of a public street should

Commissioner Russell concurred with Commissioner Stern in street issues
being brought before the public. He expressed concern about street
improvements on Talbert and Redondo Circle on the southeast corner.

Chairman Finley stated that it was her feeling that any Planning
Commissioner participating in the HCD Block Grant Committee should
refrain from voting on any of the issues.
She further stated that she would like the Planning Commission to
recommend to the City Council policy concerning the Local Coastal Plan.
Commissioner Stern suggested a study session on the Townlot and Old
Town Specific Plan.
STAFF COMMENTS:
Secretary Selich discussed the preparation of Resolutions for the
former Planning Commissioners and a "No Host" dinner meeting to be held
in their honor during the month of August.
He also discussed the action of the City Council at its July 3, 1978
meeting.
