CONDITIONAL EXCEPTION NO. 78-41 (Cont. from 7-12-78)
Applicant: R. D. Cox
To permit construction of a 6-foot chain link fence With screening
material over fencing above a 6-foot block wall for a tennis
court, located at Sugar Drive and Rushmoor Street in an R1, Low
Density Residential District.
This request is a Categorical Exemption, Class 5, California En-
vironmental Quality Act, 1970.
Chairman Eadie reopened the public hearing. No one was present
to represent the application or to address the Board in regard to
the request, and the public hearing was closed.
The Board reviewed the request.
ON MOTION BY EADIE AND SECOND BY CROSBY CONDITIONAL EXCEPTION
NO. 78-41 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The unique configuration of the property in question results
in a large portion of the lot being taken up in front yard
area; therefore, although the lot is large, a hardship is

encountered which requires siting of the tennis court in the
front yard of the property.
2. A lot of this same square footage with a normal configura-
tion and in the same zoning classification would allow con-
struction of the tennis court in the rear yard without
I encroaching upon setback requirements for the court or the
screening wall.
3. The granting of the conditional exception will not constitute
a grant of a special privilege inconsistent upon other prop-
erties in the same circumstances and zone classification.
4. The granting of the conditional exception will not be materi-
ally detrimental to the public welfare or injurious to
property in the same zone classifications.
5. The granting of the conditional exception will not adversely
affect the General Plan of the City of Huntington Beach.
CONDITIONS OF APPROVAL:
A. TO BE C014PLETED PRIOR TO ISSUANCE OF PERMITS:
1. The conceptual site plan received and dated June 22,
1978, shall be the approved layout.
In its approval action, the Board of Zoning Adjustments consid-
ered the following issues in relation to the conceptual plan:
. Lot area;
• Lot width and lot depth;
. Type of use and its relation to property and improvements in
the immediate vicinity;
. Past administrative action regarding this property.

To permit relocation of nursery and expansion of a loading dock
within an existing retail use located at the southwest corner of
Adams Avenue and Brookhurst Street in a C4, Highway Commercial
District.
This request is a Categorical Exemption, Class 1, California
Environmental Quality Act, 1970.

Mike Stangl was present to represent the applicant and respond
to concerns voiced by the followinq members of the audience:

Annette Archiego - 9881 Kings Canyon Drive.
Secretary Spencer also noted that a letter has been received in
regard to the request from Mr. & Pairs. Eric Young outlining their
concerns on noise, etc. The speakers from the audience addressed
the future use of the present nursery site; the noise and other
impacts to be anticipated from the expanded docks; the possibility
of relocating the dock to the other end of the structure;, removal
of the chain link fence at the rear of the store; and other
general discussion about hours of operation, storage against the
rear wall, and the general unsightly condition of the property at
present.
Mr. Stangl explained that location of the 4-bay loading dock as
shown should relieve congestion, and further noted that there
should be no future need for trucks to be using the back alleyway
at the rear of the store, nor should there be any need to trans-
port goods by fork lift through that alley. He said that FedMart
will not be using the area now occupied by the nursery for any
retail or storage use, and agreed to removal of the existing
fence. He explained the loading operations used by his firm, and
assured the audience that no niqht loading or unloading would
occur.
Mrs. Archiego suggested that, since traffic through the alley
would be minimal, perhaps the speed bumps could be removed and
thus alleviate some of the noise impacts upon the adjoining resi-
dences. There being no other persons to address the Board, the
public hearing was closed.
Board review followed. Bruce Crosby said that the Traffic Divi-
sion had reviewed the plan and found no problems with the location
of the docks as proposed. Pat Spencer expressed concern with the
location and treatment of the trash disposal area. The Board
considered and discussed the issues raised by the above residents
whose homes abut the use.
ON MOTION BY EADIE AND SECOND BY SPENCER USE PERMIT NO. 78-49
WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE
FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to the general welfare of persons residing
or working in the vicinity or injurious to property and im-
provements in the area.

2. The granting of a Use Permit will not adversely affect the
General Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of
Land Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The site plan received and dated June 30, 1978, shall be
the approved conceptual layout.
In its approval action, the Board of Zoning Adjustments consid-
ered the following issues in relation to the conceptual plan:
. Traffic circulation and drives;
. Type of use and its relation to property and improvements in the
immediate vicinity;
Past administrative action regarding this property.
2. A plan showing type, design, and location of the trash
disposal area shall be submitted to the Secretary of the
Board for his review and approval.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. The fence enclosing the area formerly used as a nursery by
the Two Guys store shall be removed.
2. The speed bumps shall be removed from the back of the
store.
C. GENERAL CONDITIONS:
1. Hours of operation insofar as deliveries are concerned
shall be limited to the hours between 7:00 a.m. and
6:00 p.m.
2. Hours of sweeping operations on the site shall be between
the hours of 7:00 a.m. and 10:00 p.m.

This request is a Categorical Exemption, Class 4(e), California
Environmental Quality Act, 1970.
Wesley Cohen was present at the meeting.
Pat Spencer informed the Board that a communication has been
received from the Police Department indicating that they see no
particular problem with granting of the request. The concerns
of the Board had been with traffic and parking, but the applicant
has been able to obtain the use of a nearby parking lot and sub-
mitted a letter of authorization from the property owner of said
lot. Mel Ott informed the applicant of the requirements of the
Fire Department as far as access and the use of the tent are
concerned.
ON MOTION BY CROSBY AND SECOND BY EADIE ADMINISTRATIVE REVIEW
NO. 78-63 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE
FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
1. The plot plan and application description received and dated
July 5, 1978, shall be the approved project.
2. The applicant shall obtain all necessary electrical permits.
3. An onsite inspection by the Fire Department shall be required
prior to the event.

To permit minor lot line adjustments to Lots 106, 107, 108, and
109 in Tract 8040 located on Marina Bay Drive approximately 300
feet from the cul-de-sac of that street in an R1, Low Density
Residential District.
This request is a Categorical Exemption, Class 5, California En-
vironmental Quality Act, 1970.
The Board reviewed the request, which is being processed under
County procedures for Lot Line Adjustment.
