Raines Construction To permit a reduction of the required common recreation and leis- ure area per Section 9320.14 of the Ordinance Code from 3200 square feet required to 960 square feet provided and to satisfy the bal- ance with private patios and balconies attached to the units; property is located on the east side of Cameron Street approximately 256 feet north of Newman Avenue in an R3, Medium High Density Residential District. This request is a Categorical Exemption, Class 5, California Envir- onmental Quality Act, 1970. Chairman Eadie opened the public hearing. Mr. Raines was present at the meeting. There being no persons to address the Board for or against the proposed variation, the public hearing was closed. Board review included the unique dimensions of the parcel and prior entitlement in the area for a similar request. It was the consen- sus of the Board that the proposed plan would provide better use of the property and that sufficient hardship exists to justify the request. ON MOTION BY EADIE AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 78-44 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. A hardship is found to exist on the site which makes strict application of the zoning ordinance difficult; namely, the ex- cessive depth and minimal width of the lot. Minutes, H.B. The granting of the Conditional Exception will not consti- tute a grant of special Privilege inconsistent upon other properties in the vicinity and under the same zone classi- fication. 3. The project as designed provides amenities which, while not completely in compliance with the ordinance code, neverthe- less result in a reasonable and acceptable development of the site. 4. The granting of the Conditional Exception will not be mater- ially detrimental to the public welfare or injurious to property in the same zone classification. 5. The granting of the Conditional Exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised site plan received and dated July 25, 1978, shall be the approved layout, subject to all conditions of approval imposed upon Use Permit No. 78-51. In its approval action, the Board of Zoning Adjustments consid- ered the following issues in relation to the conceptual plan: .Lot area; • Lot width and depth; • Type of use and its relation to property and improvements in the immediate vicinity; . Raines Construction To permit the construction of a twelve (12) unit apartment build- ing on property located on the east side of Cameron Street approximately 256 feet north of Newman Avenue in an R3, Medium High Density Residential District. This request is covered by Negative Declaration No. 78-81. Chairman Eadie opened the public hearings on the Negative Declara- tion and the Use Permit. Mr. Raines was present at the meeting. ON MOTION BY EADIE AND SECOND BY CROSBY THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 78-81 WITH THE MITIGATING MEASURES CONTAINED IN CONDITIONS B1 THROUGH B5 IMPOSED ON THE USE PERMIT, BY THE FOLLOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE There being no persons to speak for or against the proposal, the public hearing was closed. Secretary Spencer informed the Board that the revised plan is now substantially in compliance with the code, except for minor cor- rections involving minimum open space dimension and building separation which can be corrected by subsequent relocation of struc- tures. The revised plan meets Fire Department requirements. ON MOTION BY EADIE AND SECOND BY SPENCER USE PEIUIIT NO. 78-51 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW- ING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to the general welfare of persons residing or working in the vicinity or injurious to property and im= provements in the area. 2. The granting of a Use Permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised site plan received and dated July 25, 1978, shall be the approved conceptual layout subject to the modifications as shown on the Plan Check Copy (enclosed in the Conditions of Approval sent to the applicant). A revised plan reflecting the above -noted modifications shall be submitted to the Department of Building and Community Develonment upon application for building permits. Past administrative action regarding this property. B. GENERAL CONDITIONS: 1. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers. 2. Natural gas shall be stubbed in at the locations of Cook- ing facilities, water heaters, and central heating units. 3. Low -volume heads shall be used on all spigots and water faucets. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 5. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the state acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. Janecek To permit construction of three (3) units abutting an arterial highway, on property located on the south side of Alhambra Street approximately 525 feet east of Silver Street in an R2, Medium Densitv Residential District. This request is a Categorical Exemption, Class 5, California En- vironmental Quality Act, 1970. Chairman Eadie opened the public hearing. ON MOTION BY SPENCER AND SECOND BY CROSBY USE PERMIT NO. 78-52 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWINr VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to the general welfare of persons residing or workinq in the vicinity or injurious to property and im- provements in the area. 2. The granting of a Use Permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The site layout and elevations received and dated July 6, 1978, shall be the approved layout, subject to the following: The rear elevations shall be modified by some type of plant ons or other architectural treatment around the second story window, compatible to the design of the building and subject to the approval of the Secretary of the Board. In its approval action, the Board of Zoning Adjustments consid- ered the following issues in relation to the conceptual plan: • Type of use and its relation to property and improvements in the immediate vicinity; . Kessinger or David Beatty To permit the construction of a 13'6" x 16' storage building on an existing church site located on the south side of Heil Avenue approximately 660 feet east of Edwards Street in an R1, Low Density Residential District. Chairman Fadie opened the public hearing. Mr. Kessinger and Mr. Beatty were present; there being no persons to address the Board in regard to this request, the public hearing was closed. Board review ensued, finding the request in compliance with code. ON MOTION BY SPENCER AND SECOND BY CROSBY PLOT PLAN AMENDMENT NO. 78-4 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The amendment does not constitute a substantial change or addition. 2. The proposed use of the property remains the same. 3. The density has not been increased on the site. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan received and dated July 10, 1978, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: . Lot area; . Lot width and lot depth; • Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. Earl Corporation To permit construction of a 4,800 square foot bank building loc- ated at the northwesterly corner of Pacific Coast Highway and Warner Avenue in a C4, Highway Commercial District. Board of Zoning Adjustments July 26, 1978 Page 7 Chairman Eadie opened the public hearing. Jerry Leonardi and Marvin Diefendorf were present to represent the application. Mr. Leonardi noted that his company has received a letter of agreement from the Exxon Corporation in regard to relocation of a planter on the site. There being no other persons to address the Board, the public hearing was closed. Secretary Spencer informed the Board that a traffic diagram has been submitted as a result of the prior environmental review. The diagram is intended to show access and parking in relation to the adjacent service station and the two major arterial streets. Dave Eadie discussed signing of the project, pointing out that the proximity of the use to the intersection of Pacific Coast Highway and Warner Avenue and its location next to the City's Joint Use Facility make signing a major consideration. He said that the Board would require a sign lower in height than normally allowed by code, and after discussion it was determined that the sign height would be tied to the height of the sign at the Joint Use Facility. ON MOTION BY CROSBY AND SECOND BY EADIE USE PERMIT NO. 78-53 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to the general welfare of persons resid- ing or working in the vicinity or injurious to property and improvements in the general area. 2. The granting of a Use Permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The site plan and elevations received and dated July 6, 1978, shall be the approved layout, with the exception of the logo shown thereon, which must meet requirements of the Ordinance Code. In its approval action, the Board of Zoning Adjustments consid- ered the following issues in relation to the conceptual plan: . Traffic circulation and drives; • Parking layout; . A landscaping and irrigation plan shall be submitted to the Secretary of the Board. Said plan shall comply with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. B. GENERAL CONDITIONS: 1. If a detached sign is requested for the project in the future, said sign shall not exceed the height of the sign at the City's neighboring Joint Use Facility. Kennedy To permit the construction of four (4) industrial buildings with total of 32,000 square foot area, located on the south side of Talbert Avenue approximately 1230 feet west of Beach Boulevard in an M1-A, Restricted Manufacturing District. This request is covered by Negative Declaration No. 78-75. Chairman Eadie opened the public hearing on the negative declara- tion. Ted Kennedy and Mr. Babitz were present at the meeting. The Board reviewed the information contained in the negative dec- laration request form and considered the mitigating measures pro- posed by the Environmental Resources section. These proposed mitigating measures were submitted to the applicant (Mr. Babitz) prior to Board action. ON MOTION BY EADIE AND SECOND BY CROSBY THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 78-75 WITH THE MITIGATING MEASURES CONTAINED IN CONDITIONS Bl THROUGH B4 IMPOSED ON THE ADMINISTRATIVE REVIEW, BY THE FOLLOW- ING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE The public hearing was closed. Board of Zoning Adjustments July 26, 1978 Page 9 From two revised plans submitted, the Board selected the one labeled "alternate master plan," and both Mr. Kennedy and Mr. Babitz agreed that this plan should be the proposed layout for the project. The plan was found generally in compliance with code except for lack of a corner cutoff on Building A. The Board also felt that further review of the elevations would be required. Bruce Crosby informed the proponents that no parking will be allowed on Talbert Avenue and that dedication will be required from that right-of-way. ON MOTION BY CROSBY AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 78-59 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The Alternate Master Plan as delineated on the revised site plan received and dated July 21, 1978, shall be the approved layout, sub3ect to the following modification: a. The southwest corner of Building A shall be modified to reflect a 10' x 10' corner cutoff for visual pur- poses in relation to the drive. The modification outlined above shall be depicted upon the plans submitted to the Department of Building and Community Development upon application for building permits. NOTE: The monument sign depicted is not a part of this approval, but shall be reviewed separately by the Planning Department. In its approval action, the Board of Zoning Adjustments consid- ered the following issues in relation to the conceptual plan: . Traffic circulation and drives; • Parking layout; • Lot area; . Lot width and lot depth; • Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board for review and approval: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and land- scaping specification on file in the Department of Public Works. Rooftop mechanical equipment screening plan. Said Plan shall indicate screening of all rooftop mech- anical equipment and shall delineate the type of material proposed to screen said equipment. c. Elevations for the project structures. 3. No trash container locations shall be within fifty (50) feet of the easterly property wall. B. GENERAL CONDITIONS: 1. Natural gas shall be stubbed in at the locations of cook- ing facilities, water heaters, and central heating units. 2. Low -volume heads shall be used on all spigots and water faucets. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 4. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Department. To permit division of a single parcel of land into two (2) separ- ate parcels located on the southwest corner of Bolsa Avenue and Edwards Street in a C4, Highway Commercial District. This request is covered by ND 78-44, adopted by the Board of Zon- ing Adjustments on June 14, 1978. Secretary Spencer reported to the Board that conditions required of this tentative map upon the approval of Use Permit No. 78-28 have not been complied with. As no one was present at the meet- ing to discuss this matter with the Board it was the consensus that the request be continued to permit applicant's input or com- pliance with prior conditions. Board of Zoning Adjustments July 26, 1978 Page 11 ON MOTION BY EADIE AND SECOND BY SPENCER TENTATIVE PARCEL MAP NO. 78-29 WAS CONTINUED TO THE REGULAR MEETING OF AUGUST 9, 1978, BY THE FOLLOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE MISCELLANEOUS AGENDA ITEMS: REVOCATION PROCEEDINGS Brought by the Planning Department Proposal to institute revocation of a Home Occupation Permit for Crystal Custom Pools, located at 10322 Maikai Drive, Hunt- ington Beach. Chairman Eadie opened the public hearings. No one was present at the hearing to represent the holder of Home Occupation Permit No. 427, Mr. James Jones. Virginia Dalton, adjacent resident to the subject use, was present at the meeting and addressed the Board to describe conditions existing on the site. Bob Kirby, Land Use Technician, addressed the Board to describe the actions taken in response to citizens complaints by the Land Use Division, noting that no response has been received from the operator -of the home occupation nor any apparent effort made to correct the violations. There being no other persons present to address the Board, the public hearing was closed. The Board reviewed the information contained in a communication dated July 25, 1978, in opposition to the occupation; the memo from the Land Use Division requesting revocation action; and the testimony received at this meeting. ON MOTION BY SPENCER AND SECOND BY CROSBY THE BOARD REVOKED HOME OCCUPATION PERMIT NO. 427 FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE: REASONS FOR REVOCATION: 1. Storage of equipment outside the premises. 2. Parking overnight of a commercially licensed vehicle within the front yard setback of the premises. No one was present to represent the application. Board review ensued. ON MOTION BY SPENCER AND SECOND BY EADIE SPECIAL EVENT NO. 78-6 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan and project description received July 17, 1978, shall be the approved project. 2. The applicant shall obtain all necessary electrical permits. 3. An onsite inspection by the Fire Department shall be required prior to the event.
