USE PERMIT NO. 78-54
Applicant: Anthony Industries, Inc.
To permit construction of a drive -through restaurant located on
the northeast corner of Edinger Avenue and Edwards Street in
a C4, Highway Commercial District.
This request is covered by Negative Declaration No. 78-83.
Chairman Eadie opened the public hearings on the negative declara-
tion and the use permit applications. John Harlan was present to
represent the application.
The Board reviewed the information contained in the negative dec-
laration request and considered the suggested mitigating measures
applicable to the project.
ON MOTION BY LIPPS AND SECOND BY EADIE THE BOARD, HAVING FOUND
THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE
EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION
NO. 78-54 WITH THE MITIGATING MEASURES CONTAINED IN CONDITIONS

The public hearing was closed.
The Board discussed the proposal, considering how the lots were
originally divided and the adjacent land use (the immediately
adjoining parcel is occupied by a drive -through dairy store).
Bruce Crosby informed the Board that the Traffic Engineer has
requested that the northerly drive be modified to a two-way, in
and out drive, to avoid conflict with vehicles which might try
to enter from Edwards Street.
Walt Lipps requested some sort of protective treatment on the
easterly property line, to avoid damage to the abutting structure
from vehicles in the parking lot. The applicant was asked to
present a plan for this treatment which could include planting of
trees in every other triangular space between spaces, curbs, etc.
ON MOTION BY CROSBY AND SECOND BY LIPPS USE PERMIT NO. 78-54
WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE
FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to the general welfare of persons residing
or working in the vicinity or injurious to property and im-
provements in the area.
2. The granting of the Use Permit will not adversely affect the
General Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of
Land Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan received and dated July 17,
1978, shall be the approved conceptual layout, subject
to the following modification:
The northerly drive on Edwards Street shall be widened
to accommodate two-way traffic, per standard plans for
such drive on file in the Department of Public Works.
The plan submitted to the Department of Building and Community
Development upon application for building permits shall
depict the above modification.
In its approval action, the Board of Zoning Adjustments consid-
ered the following issues in relation to the conceptual plan:

. Traffic circulation and drives;
. Parking layout;
Lot area;
. Lot width and lot depth;
. Type of use and its relation to property and improvements in
the immediate vicinity;
. Past administrative action regarding this property.
NOTE: Signs for the use are not a part of this approval.
2. A tentative parcel map segregatinq the subject project
from the adjacent properties shall be filed with the
City.
3. The following plans shall be submitted to the Secretary
of the Board for review and approval:
a. A plan showing the treatment of the easterly property
line for that nortion of the parking lot adjacent to
the existing commercial building, designed to provide
protection for the building.
b. Landscape and irrigation plan complying with Article
979 of the Huntington Beach Ordinance Code and land-
scaping specifications on file in the Department of
Public Works.
B. TO BE COMPLETED PRIOR TO OCCUPANCY OF THE BUILDING:
1. The tentative parcel map noted above shall be recorded
in the Orange County Recorder's office.
C. GENERAL CONDITIONS:
1. Natural gas shall be stubbed in at the locations of
cooking facilities, water heaters, and central heating
units.
2. Low volume heads shall be used on all spigots and water
faucets.
3. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
4. If outside lighting is included onsite, high-pressure
sodium vapor lamps shall be used to prevent "spillage"
onto adjacent areas and for energy savings.

TENTATIVE PARCEL MAP NO. 78-34
Applicant: Cove Development Company
To permit division of one lot into two smaller parcels located
on the east side of Gothard Street approximately 405 feet north
of Mountjoy Drive in an Ml, Light Industrial District.
This request is covered by ED 74-150, adopted by the Board of
Zoning Adjustments on October 1, 1974.
Rod Emery was present at the meeting and indicated his receipt
of and concurrence with the suggested conditions of approval pre-
viously forwarded to the proponent.
Board review ensued, including determination on timing of con-
struction on the lot.
ON MOTION BY LIPPS AND SECOND BY EADIE TENTATIVE PARCEL MAP NO.
78-34 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW-
ING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO OCCUPANCY OF BUILDINGS ON THE
PROPERTY:
1. The tentative parcel map received by the Planning Depart-
ment on July 26, 1978, shall be the approved layout.
2. A parcel map shall be filed with, and approved by, the
Department of Public Works and recorded with the Orange
County Recorder.
3. Copies of the recorded parcel map shall be filed with
the Huntington Beach Planning Department and the Depart-
ment of Public Works.

located on the south side of Walnut Avenue approximately 50

This request is covered by Negative Declaration No. 78-84.
No one was present to address the Board for or against the pro-
posed project. In the discussion of the project, Bruce Crosby

noted that the request may require a parcel map, as the building
appears to cross lot lines. It was the consensus that the appli-
cation should be continued to permit applicant to be present

78-66 WAS CONTINUED TO THE REGULAR MEETING OF AUGUST 16, 1978,

Applicant: Harbor Engineers & Constructors
To permit construction of a 25,000 square foot industrial build-
ing located on the east side of Bolsa Chica Street approximately
125 feet south of Bolsa Avenue in an Ml-A, Restricted Manufactur-
ing District.
This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
No one was present to represent this application, and it was the
determination of the Board that the applicant should be on hand
to discuss parking problems on the site.

To permit construction of a 3,300 square foot office commercial
building located on the north side of Pacific Coast Highway approxi-
mately 100 feet west of 7th Street in a C3, General Business
District.
This request is covered by Negative Declaration No. 78-87.
Chairman Eadie opened the public hearing on the negative declara-
tion. Kevin Crook was present at the meeting. The Board reviewed
the information contained in the negative declaration request
form and considered the recommended mitigation measures applicable
to the project.

ON MOTION BY EADIE AND SECOND BY CROSBY THE BOARD, HAVING FOUND

The public hearing for the negative declaration was closed.
Board review found the site plan to be substantially in compliance
with code requirements. Bruce Crosby asked that the plan reflect
the proper dedication of two and one-half (2-1/2) feet instead of
the twelve feet now shown on the site plan.
ON MOTION BY LIPPS AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO.
78-70 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING

A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual site plan received and dated July 24, 1978,
shall be the approved layout, subject to the following
modification:
A revised plan shall be submitted depicting proper dedi-
cation and correct lot lines.
The modification noted above shall be delineated upon the plan
submitted to the Department of Building and Community Develop-
ment upon application for building permits.
In its approval action, the Board of Zoning Adjustments considered
the following issues in relation to the conceptual plan:
. Traffic circulation and drives;
. Parking layout;
Lot area;
. Lot width and lot depth;
. Type of use and its relation to property and improvements in
the immediate vicinity;
. Past administrative action regarding this property.
2. A landscape and irrigation plan shall be submitted to the
Secretary of the Board for review and approval. Said
plan shall comply with Article 979 of the Huntington Beach
Ordinance Code and landscaping specifications on file in
the Department of Public Works.

Restricted Manufacturing District.
ADMINISTRATIVE REVIEW NO. 78-68
Applicant: Architectural Team III
Industrial building located on the north side of Engineer Drive
approximately 60 feet from the intersection of Engineer and Pipe-
line Lane in an M1-A, Restricted Manufacturing District.
Secretary Lipps reported that the applicant has requested certain
modifications to the approved site plans for the subject applica-
tions which he feels were made necessary by the conditions of
approval imposed on the projects.
ON MOTION BY LIPPS AND SECOND BY EADIE THE BOARD DETERMINED TO
RECONSIDER ADMINISTRATIVE REVIEW NO. 78-67 AND ADMINISTRATIVE RE-
VIEW NO. 78-68 BY THE FOLLOWING VOTE:

Secretary Lipps informed the Board that the applicant has requested
to reduce the 30-foot common drive between these two properties
to 27 feet to make up for some of the square footage lost from the
buildings by the required setback of the overhead doors. He also
plans to set the doors back the full 45 feet to allow for the area
the Board had required to be striped and posted "loading -unloading
only."
The Board discussed the effect of the request on the site plan.
ON MOTION BY LIPPS AND SECOND BY EADIE THE FOLLOWING MODIFICATIONS
TO THE PRIOR CONDITIONS OF APPROVAL FOR ADMINISTRATIVE REVIEW NO.
78-67 AND ADMINISTRATIVE REVIEW NO. 78-68 WERE ALLOWED, BY THE
FOLLOWING VOTE:
MODIFICATIONS PERMITTED:
1. The truck loading door shall set back 45 feet from the front
property line.
2. Width of the common drive between subject properties may be
reduced from 30 to 27 feet.
