This request is covered by Negative Declaration No. 78-91. Chairman Eadie opened the public hearings on the Negative Declara- tion and Use Permit applications. Paul Westberg and Ed Emerick were present to represent the application. The Board reviewed the information contained in the negative dec- laration request form and considered the mitigating measures applicable to the project which had been recommended by the Envir- onmental Resources section of the Planning Department. Board of Zoning Adjustments August 23, 1978 Page 2 ON MOTION BY EADIE AND SECOND BY CROSBY THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT UPON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARA- TION NO. 78-91 WITH THE MITIGATING MEASURES CONTAINED IN THE CONDITIONS C1 THROUGH C4 IMPOSED UPON THE USE PERMIT, BY THE FOLLOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE There being no persons to address the Board for or against the proposed project, the public hearing was closed. The Board reviewed the type of use proposed for the site, land- scaping to screen the use, and the need for a tentative parcel map to consolidate the lots. The timing on the map was discussed with the applicants. ON MOTION BY CROSBY AND SECOND BY EADIE USE PERMIT NO. 78-55 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL- LOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan received and dated August 3, 1978, shall be the approved layout, subject to the modi- fication below: The landscape area in front of the most southerly display pad shall be not less than nine (9) feet in width. In its approval action, the Board of Zoning Adjustments consid- ered the following issues in relation to the conceptual plan: . Traffic circulation and drives; • Parking layout; . Lot area; • Lot width and lot depth; • Type of use and its relation to property and improvements in the immediate vicinity; • Past administrative action regarding this property. 2. A landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscap- ing plans on file in the Department of Public Works shall be submitted to the Secretary of the Board for review and approval. 3. A Tentative Parcel Map for consolidation of the lots com- prising the subject site shall be filed with the City. B. TO BE COMPLETED PRIOR TO CERTIFICATE OF OCCUPANCY: 1. The tentative parcel map shall be recorded with the Orange County Recorder's office. C. GENERAL CONDITIONS: 1. Natural gas shall be stubbed in at the locations of cook- ing facilities, water heaters, and central heating units. 2. Low -volume heads shall be used on all spigots and water faucets. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 4. If outside lighting is included onsite, high-pressure sodium vapor lamps shall be used to prevent "spillage" onto adjacent areas and for energy savings. Knudtson To permit the construction of six (6) apartment units located on the west side of Elm Street approximately 380 feet south of Cypress Avenue in an R2, Medium Density Residential District. This project was addressed in ND 77-25, adopted by the Board of Zoning Adjustments on March 16, 1977. Chairman Eadie opened the public hearing. Ron Knudtson and Nicholas Lavada were present at the meeting. There being no persons present to speak for or against the proposal, the public hearing was closed. Pat Spencer noted that a question on the lot configuration had been resolved by a determination that the lot existed in its pre- sent configuration prior to 1946. Board review found the proposal to be substantially in compliance with code requirements. Bruce Crosby pointed out that the 30-foot halfstreet section as shown should be only a 26-foot halfstreet; the applicants said the extra four feet would be incorporated into their landscaping. ON MOTION BY CROSBY AND SECOND BY SPENCER USE PERMIT NO. 78-56 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to the general welfare of persons residing or working in the vicinity or injurious to property and im- provements in the vicinity of such use or building. 2. The granting of the Use Permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan received and dated August 4, 1978, shall be the approved layout, subject to the follow- ing modification: The site plan shall reflect a halfstreet section of twenty-six (26) feet. B. GENERAL CONDITIONS: 1. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers. 2. Natural gas shall be stubbed in at the locations of cook- ing facilities, water heaters, and central heating units. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 4. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the state acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. 5. To permit modernization of an existing service station located at Pacific Coast Highway and 7th Street in a C3, General Business District. This request is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. Secretary Spencer informed the Board that the applicant has re- quested a week's continuance for this item. BZA 8-23-78 Page 5 Minutes, H.B. Board of Zoning Ad3ustments August 23, 1978 Page 6 ON MOTION BY EADIE AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 78-73 WAS CONTINUED AT THE REQUEST OF THE APPLICANT TO THE REGULAR MEETING OF AUGUST 30, 1978, BY THE FOLLOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 78-79 Applicant: George W. Applegate To permit an Arts & Crafts show to be held on September 2, 3, and 4, 1978, on property located on the northwest corner of Pacific Coast Highway and 6th Street in a C3, General Business District. This request is a Categorical Exemption, Class 4(e), California Environmental Quality Act, 1970. George Applegate was present at the meeting. Bruce Crosby reported that both the Police Department and the Traffic Engineer have express'ed grave concerns with the project taking place on Pacific Coast Highway on Labor Day weekend. The concerns were primarily with additional traffic added to the already congested highway and parking on the street. Safety of pedestrians attempting to get to the site was also a concern. Mr. Applegate noted that there is a pedestrian crosswalk in PCH at 6th Street; that he has 15 parking spaces onsite, which can be increased to 22 with valet parking; and that he purposely chose this weekend because in his opinion the amount of traffic he would add to the expected weekend traffic would be minimal. He also informed the Board that no food would be served onsite other than within the existing restaurant. After further discussion it was the opinion of the majority of the Board that the applicant had satisfactorily responded to the traffic concerns. ON MOTION BY CROSBY AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 78-79 WAS APPROVED WITH THE FOLLOWING CONDITONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: 1. The site layout and description received and dated August 15, 1978, shall be the approved project. 2. Hours of operation shall be limited to the hours between 10:00 a.m. and 5:00 p.m. on September 2, 3, and 4, 1978. BZA 8-23-78 Page 6 Minutes, H.B. None of the participants in the Arts and Crafts show shall use the spaces in applicant's parking lot, but these shall be left free and clear for use by customers. 4. The applicant shall obtain all necessary electrical permits. 5. An onsite inspection by the Fire Department shall be required prior to the event. 6. A certificate of insurance form shall be filed in the License Division of the Finance Department ten (10) days prior to the event. AYES: SPENCER, CROSBY NOES: EADIE ABSENT: NONE MISCELLANEOUS AGENDA ITEMS: ADMINISTRATIVE REVIEW NO. 78-82 Applicant: Home of Pacific Boats To permit a special event permit to display flags and banners for a grand opening sale August 26 through September 30, 1978, loc- ated at the northwest corner of Beach Boulevard and Alhambra Avenue in a C4, Highway Commercial District. The Board reviewed the request. ON MOTION BY EADIE AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 78-82 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The application and project description received and dated August 18, 1978, shall be the approved project. 2. The applicant shall obtain all required electrical permits. 3. An onsite inspection by the Fire Department shall be required prior to the event. USE PERMIT NO. 76-29 (In Conj./CE 76-22) Applicant: D'Ambra, Inc. To permit establishment of an office -professional use in an existing building with a nonconforming side yard setback located on the south side of Main Street, approximately 170 feet east of Florida Street in an R5 Office -Professional District. Secretary Spencer reviewed the history of continuances on these projects, noting that the applicant has several times been in- formed of the need to resolve the applications. It was also noted that Dave Adler has (since the time of filing of the sub- ject requests) processed an Administrative Review on the property and demolished the existing structure.
