Zone Change No. 78-10 is a request for a change of zone from C2 to R1
on 1.62 acres on the east side of Magnolia St. approximately 70 ft.
north of Mediterranean.
Conditional Use Permit No. 78-17 is a request to redesign parking
facilities, construction of classroom facilities, and future
construction of a church facility.

Tentative Tract 10462 is a request for an 8 lot subdivision on
4.2 acres.
Dave Eadie addressed the Commission and stated that the developer
had requested additional time to obtain agreements with adjacent
property owners as to the treatment of surrounding property.
He stated that this would be the second continuance to allow time
for the developer to work out problems.
The public hearing was opened.
R. C. Switzer stated that he had some questions he would like to ask
and inquired if he would be renotified so that he could address the
Commission at that time. Dave Eadie stated that the public will be
renotified. at the applicant's expense.
ON MOTION BY STERN AND SECOND BY BAZIL ZONE CHANGE 78-10, CONDITIONAL
USE PERMIT NO. 78-17, TENTATIVE TRACT NO. 10462, AND NEGATIVE

Applicant: Tad Nakase
This is a request for continued use of existing office in conjunction
with wholesale nursery located at 9441 Krepp Drive on the north
side of Krepp, west of Bushard.
Monica Florian addressed the Commission and reviewed the four issues
of concern. She stated that letters of support of the use had been
received from neighbors in the area, that the site was unique in terms
of establishing a precedent, that a parking and traffic inspection
revealed that the parking was not particularly congested.
The public hearing was opened and closed with no one present who wished
to address the Commission.
Commission discussion ensued concerning the conditions of approval
which should be imposed on the applicant.

FINDINGS:
1. The office operations are an ancillary part of the overall nursery
operations which is a permitted use in the R1 pursuant to the
approval of a conditional use permit.
2. Single family dwelling has maintained the appearance of such and
commercial operations have been oriented to the rear of the property
abutting the Edison right-of-way.
3. The existing office facility is compatible with the surrounding
land uses.
4. There are no signs or advertising identifying the nursery and
parking has been found to be adequate to the site.
CONDITIONS OF APPROVAL:
1. The site plan received and dated May 4, 1978 shall be the approved
layout.
2. All parking, ingress and egress relating to the office portion
of the operation or the nursery portion of the operation shall be
located on the Edison easement right-of-way to the north of
the subject property.
3. No signs or any other form of advertising shall be placed on
the single family dwelling advertising the existing wholesale
nursery.
4. At such time as the nursery use is abated, the subject single
family dwelling shall be reverted to a dwelling and fence shall
be constructed between the subject.site and the Edison right-of-way.

REALIGNMENT
Acting Director Jim Palin addressed the Commission and discussed the
design of Ilternative 10, stating that the alignment should be shown on
the Circulation Plan as a primary arterial with 100 foot of right-of-way
rather than as a secondary arterial with 80 foot right-of-way. He
further stated that that staff was recommending a change to the
City's adopted Circulation Plan of Arterial Streets and Highways that
would allow the Planning Commission to pursue Atlanta/Lake Precise Plan
of Street Alignment 77-3, Alternative 10 with 100 foot right-of-way
to be included in General Plan Amendment 78-2. He further stated that

the staff was recommending that further action on revocation of the
existing Atlanta/Orange Precise Plan of Street'Alig•nment 70=4 and
development of an alternative precise plan of street alignment be
tabled until after the adoption of General Plan Amendment 78-2
and the completion of the Citywide Transportation Study.
Jim VanDerhyden addressed the Commission and requested clarification
on time frames involved and further stated that he felt the 100 ft.
right-of-way would be preferable.
Commission discussion ensued.
ON MOTION BY RUSSELL AND SECOND BY BAZIL THE STAFF WAS DIRECTED TO
INCLUDE AMENDMENT TO CIRCULATION PLAN IN GENERAL PLAN AMENDMENT 78-2
AND TO TABLE REVOCATION OF PRECISE PLAN OF STREET ALIGNMENT 70-4

ADMINISTRATIVE REVIEW NO. 78-84 (referred by Board of Zoning Adjustments)
Applicant: Josef Bischof
This is a request for approval of Oktoberfest, a special event from
September 25, 1978 through November 10, 1978, to be held in the
Old World Complex located at 7561 Center Drive.
Dave Eadie addressed the Commission and stated that this is a
traditional German festival which would include dining, dancing,
and band music. Fie further discussed the conditions of approval the
staff was recommending. He stated that there was on file an amended
letter agreeing to provide 440 spaces instead of 360 for the month
and a one-half period.
Mr. Bischof addressed the Commission and stated that their plans were
to bring a band from Europe and their expenditures would be in excess
of $100,000.
Commissioner Pone felt -hat the music playing from 10 o'clock to
midnight would present i noise problem to adjacent apartment dwellers.
Commissioner Paone felt, as did Commissioner Stern, that the applicant
should submit a conditional use permit application. He also felt that
the fire department should study the access, that some means of
containing the noise after 10:00 p.m. should be explored, that the
Police Department notify the Planning Department of complaints.
Further discussion ensued among the Commissioners.

ON MOTION BY PAONE AND SECOND BY STERN ADMINISTRATIVE REVIEW NO. 78-84
WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
1. The site plan received August 29, 1978 shall be the approved layout
in concept. However, tent placement is conceptual only and fire
code regulations will supersede conceptual plan.
2. All fire protection equipment shall be kept clear and accessible
for Fire Department equipment and operations.
3. The access drives shall be kept clear at all times. No parking
will be allowed within any of the drive widths leading to the
fire protection equipment or fire access roadway.
4. A Security Guard shall be on duty at the applicant's expense during
hours of business to insure that vehicles are parked only in
designated parking stalls.
5. Fire Department equipment is required for the tent facility.
6. The applicant shall obtain all necessary electrical permits.
7. An onsite inspection by the Fire Department shall be required
prior to the event.
8. A certificate of insurance form shall be filed in the License
Division of the Finance Department ten (10) days prior to the
event.
9. Temporary traffic control devices such as stop signs, flashers,
cross walks, etc., shall be installed in accordance with the
requirements of the City Engineer at the applicant's expense.
A cash bond of $2,000 shall be posted to insure installation of
these devices prior to the event.
10. An application for a Conditional Use Permit shall be filed by
September 8, 1978 anC a public hearing set for October- 3, 1978.
11. The Administrative Review shall terminate upon approval of the
Conditional Use Permit.
12. Notice of the public hearing shall be provided to the tenants
of the adjacent apartment buildings ten days prior to the date
of the hearing. The City will furnish sufficient notices to be
distributed to the said tenants by the owners of the apartment
buildings.

SIGN CODE
Dave Eadie addressed the Commission and outlined the topic of
discussion material. He indicated that the staff was soliciting
Commissioners' comments in regard to any portions of the Sign Code
which they feel are deficient as well as outlining the staff's
concerns. He elaborated on each point of concern and possible
remedies which could be pursued to improve the Sign Code.
Planning Commission discussion ensued in regard to the practical
applications of the Sign Code in relation to current philosophy
on signing in the City.
Staff strongly recommended that modifications to the Sign Code be
of a housecleaning nature and not substantive insofar as the
Sign Code has only been administered for two years.
It was the consensus of the Planning Commission that the modi-
fications suggested by the staff and elaborated on by the Planning
Commission should be undertaken. However, no substantive changes
to the basic foundations of the Sign Code, e.g., sign height, area,
and number of signs, should be modified at this time.
The staff was directed to address signing problems in the coastal
zone to correct all the issues identified in the staff report.

REVISIONS IN THE SIGN CODE WAS APPROVED BY THE FOLLOWING VOTE:

A subcommittee consisting of Commissioners Stern, Russell, and Paone
was formed to review the Sign Code.
PETITION TO REZONE IN THE DOWNTOWN AREA
The area of concern is a 12.3 acre predominantly residential
neighborhood in the Downtown area bounded by Third Street on the
northwest, Lake Street on the east and southeast, and Walnut
Avenue on the southwest. The petition on file in the Planning
Department was for a change of zone from C3 to residential. The
staff recommendation was that the area should be included in
General Plan Amendment as residential instead of commercial.

PLANNING DEPARTMENT ITEMS
Acting Secretary Palin stated that there would be a joint Planning
Commission/City Council tour of the City on September 16, 1978.
COMMISSIONER ITEMS
Commissioner Russell requested a study session on all precise plan
of street alignments pending in the downtown area.
Commissioner Paone stated that it should be mandatory for a City
Attorney to be present at all Planning Commission meetings.
Chairman Finley expressed concern over the Planning staff attrition
and wanted to know what the Commission could do to assist in staff
relations.
Commissioner Paone requested staff to investigate amending the
ordinance to require increased dedication in the bluff areas of
the City.
Commissioner Russell requested that staff investigate development
in the Commodore Circle area to see if anything could be done to
improve conditions there.
