HomeMy WebLinkAbout1978-10-04MINUTES HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS Room B-7 - Civic Center 2000 Main Street Huntington Beach, California WEDNESDAY, OCTOBER 4, 1978 - 1:15 PM BOARD MEMBERS: SPENCER, EADIE, CROSBY CITY STAFF PRESENT: MEL OTT, FIRE DEPARTMENT MINUTES: ON MOTION BY CROSBY AND SECOND BY SPENCER, THE MINUTES OF THE REGULAR MEETING OF SEPTEMBER 20, 1978, WERE APPROVED AS TRANSCRIBED, BY THE FOLLOWING VOTE: AYES: SPENCER, CROSBY NOES: NONE ABSENT: NONE ABSTAIN: EADIE REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 78-52 Applicant: Mr. and Mrs. Thomas Lee Cloud To permit construction of a 6-foot fence at zero front setback in lieu of the required 15 foot front yard setback on property located on the southwest corner of Hillhead Circle and Newland Street in an R1, Low Density Residential District. This request is a Categorical Exemption, Class 5, California En- vironmental Quality Act, 1970. Chairman Eadie opened the public hearing. Mrs. Cloud was present at the meeting; there being no other persons to address the Board in regard to the proposal, the public hearing was closed. Dave Eadie reported that a field inspection of the property has been made and identified certain constraints on the dwelling unit which would justify at least a portion of the wall. The Board discussed alternative wall configurations (such as a partial step down or jog to create a recess for landscaping) which would serve to lessen the impact on adjacent property, and the applicant agreed to modify the layout. ON MOTION BY EADIE AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 78-52 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: Minutes, H.B. Board of Zoning Adjustments October 4, 1978 Paqe 2 FINDINGS OF THE BOARD: 1. Exceptional circumstances are found to exist because of the width of the subject lot and the orientation of the dwelling unit on the lot. 2. The dwelling unit is situated where Newland Street narrows to two lanes, and the resulting additional traffic noise from decelerating vehicles is considered to justify this re- lief from code requirements in order to attenuate said traffic noise intrusion. 3. The granting of the Conditional Exception will not constitute a grant of special privilege and is necessary in order to preserve the enjoyment of one or more substantial property rights. 4. The granting of the Conditional Exception will not be materi- ally detrimental to the public welfare or injurious to property and improvements in the same zone classifications. 5. The granting of the Conditional Exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF PERMITS: 1. The conceptual site plan received and dated August 31, 1978, shall be the approved layout, subject to modifica- tions reviewed with the applicant this date. 2. The design and improvement of the proposed wall shall be subject to the approval of the Secretary of the Board. Said design shall reflect the criteria outlined by the Board. 3. The wall shall be of decorative masonry construction, sim- ilar to and compatible with the wall along Newland Street. Schmidt To permit the construction of two commercial buildings containing a total of 10,292 square feet, located at the southwest corner of Beach Boulevard and Yorktown Avenue in a C2, Community Business District. Chairman Eadie opened the public hearinq on the negative declara- tion request. Gary Schmidt was present at the meeting. The Board reviewed the information contained in the negative declara- tion and the transmittal from the Environmental Resources Division. ON MOTION BY CROSBY AND SECOND BY SPENCER THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 78-108 WITH THE MITIGATING MEASURES CONTAINED IN CONDITIONS B-1 THROUGH B-4 IMPOSED ON THE ADMINISTRATIVE REVIEW, BY THE FOL- LOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE Board review of the revised plan found it to be in general conform- ance with requirements; the applicant was advised of the required screening of the parking lot and the alternatives for that screen- ing available under the code. Pat Spencer discussed the need for future reciprocal access with the property to the south, and Mr. Schmidt indicated that the developer would be agreeable to such treatment. ON MOTION BY EADIE AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 78-92 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plan and elevations received and dated September 21, 1978, shall be the approved layout, subject to the modifications described herein: a. The treatment at the terminus of the two onsite drives shall be modified to reflect a turning radius per Fire Department standards. b. The trash area shall be relocated. C. The two drive approaches shall be increased to a width of thirty-five (35) feet, with radius type curb returns. A plan delineating said modifications shall be submitted to the Secretary of the Board. Board of Zoning Adjustments October 4, 1978 Page 4 modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relatinq to the conceptual plan: • Traffic circulation and drives; • Parking layout; • Lot area; • Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; • Past administrative action regarding this property. 2. The applicant shall file an irrevocable offer of dedica- tion to provide for a common reciprocal drive with the property to the south in the future. Said offer of dedi- cation shall be to the approval of the office of the City Attorney as to form and content. 3. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and land- scaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material pro- posed to screen said equipment. B. GENERAL CONDITIONS: 1. Natural gas shall be stubbed in at the locations of cook- ing facilities, water heaters, and central heating units. 2. Low -volume heads shall be used on all spigots and water faucets. 3. All buildinq spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 4. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. Simon & Jude Church To permit an annual fund raising carnival on October 13, 14, and 15, 1978, on property located on the northeast corner of Magnolia Street and Indianapolis Avenue in an R1, Low Density Residential District. This request is a Categorical Exemption, Class 4(e) California Environmental Quality Act, 1970. The request was reviewed by the Board. ON MOTION BY EADIE AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 78-93 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: 1. The site layout and project description received and dated September 25, 1978, shall be the approved project. 2. The applicant shall obtain all necessary electrical permits. 3. An onsite inspection by the Fire Department shall be required prior to the event. 4. A certificate of insurance form shall be filed in the License Division of the Finance Department ten (10) days prior to the event. AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE MISCELLANEOUS AGENDA ITEMS: ADMINISTRATIVE REVIEW NO. 78-94 Applicant: Edison High School Football Boosters To permit a pumpkin sales lot to be used from October 8 to October 30, 1978, on property located on the east side of Beach Boulevard approximately 660 feet south of Yorktown Avenue in a C2 District. This request is a Categorical Exemption, Class 4(e), California Environmental Quality Act, 1970. The Board reviewed the request, noting that the present applica- tion will not cover the Christmas tree sales lot. The likelihood of patrons pulling off the road and parking rather than entering the lot was also considered. BZA 10-4-78 Page 5 Minutes, H.B. Board of Zoning Adjustments October 4, 1978 Page 6 ON MOTION BY SPENCER AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 78-94 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: 1. The project description and layout received and dated October 3, 1978, shall be the approved project for the pumpkin sales lot only. 2. This approval shall extend from October 8 through October 30, 1978. 3. The applicant shall obtain all necessary electrical permits. 4. A certificate of insurance form shall be filed in the License Division of the Finance Department ten (10) days prior to the event. AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 78-95 Applicant: Huntington Beach Jaycees To permit operation of a Haunted House between the hours of 6:00 and 10:00 p.m. from October 20 through October 30, 1978, on property located on the east side of Beach Boulevard approximately 300 yards north of Adams Avenue in a C2 District. This request is a Categorical Exemption, Class 4(e), California Environmental Quality Act, 1970. David M. Burtch was present to represent the applicants. He out- lined the project and submitted a certificate of insurance for the Board's review. In its consideration, the Board cautioned the applicant to meet with the Fire Department as soon as possible to work out safety requirements in regard to the tent and the parking. ON MOTION BY SPENCER AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 78-95 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan and project description received and dated October 3, 1978, shall be the approved project, sub3ect to Fire Department inspection and approval. BZA 10-4-78 Page 6 Minutes, H.B. An onsite inspection by the Fire Department shall be required prior to the event. 4. Review of wall design for a previously approved 82-unit apartment complex located on the northwest corner of Wichita Avenue and Huntington Street in an R2-0-CD, Medium Density combined with Oil and Civic Districts. This review is a requirement of Condition C-4 originally imposed on the entitlement of the project. The Board discussed the pro- posed fencing, finding the wrought iron and slumpstone construction satisfactory. ON MOTION BY SPENCER AND SECOND BY CROSBY THE FENCING PLAN RECEIVED AND DATED OCTOBER 4, 1978, WAS APPROVED BY THE FOLLOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE USE PERMIT NO. 78-56 (Landscaping Plan) Applicant: Ronald Knudtson Review of landscaping for a previously approved 6 apartment units located on the west side of Elm Street approximately 380 feet south of Cypress Avenue in an R2, Medium Density Residential District. The proposed landscaping layout was reviewed by the Board.
