COMMISSIONERS PRESENT: Higgins, Russell, Stern, Finley, Bzil, Paone COMMISSIONERS ABSENT: Cohen NOTE: A TAPE RECORDING OF THIS MEETING IS ON FILE IN THE PLANNING DEPARTMENT OFFICE. CONDITIONAL USE PERMIT NO. 78-18 Applicant: Donald Peart, AIA - The Church of Jesus Christ of Latter -Day Saints Conditional Use Permit No. 78-18 is a request for construction of a 25,300 square foot church located on 3.71 acres on the south side of Atlanta Avenue between Newland and Magnolia Streets. Chairman Finley stated that the public hearing was continued from the October 3, 1978 meeting and asked if there was anyone present who wished to speak on the application. There being no one present to speak, she closed the public hearing. Commission discussion ensued on the height of the wall, six versus seven feet, the security of the wall and the possibility of using intense landscaping versus a block wall. ON MOTION BY BAZIL AND SECOND BY RUSSELL CONDITIONAL USE PERPdIT NO. 78-18 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: FINDINGS: 1. The proposed facility is in substantial conformance with the Huntington Beach Ordinance Code. 2. The subject site is suitable for the proposed use and will be compatible with surrounding land uses. CONDITIONS OF APPROVAL: 1. The plan received and dated July 31, 1978, shall be the approved layout. 2. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 3. Low volume heads shall be used on all spigots and water faucets. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable materials, shall be disposed of at an offsite facility equipped to handle them. Minutes: H.B. If outside lighting is included on the site, high pressure sodium vapor lamps shall be used to prevent spillage onto the adjacent areas and for energy saving. The placement of said lights shall be no closer than 45 feet from any of the property lines. Lighting shall not exceed an average of one (1) foot candle at ground level. 6. The applicant is to submit finished grade elevations of the church property and the abutting properties to the east, west, and south of the subject site and provide a profile of a six foot high wall at the property line in relation to all finished grades. The Commission at that time will be able to determine the height of the decorative masonry wall to allow the optimum separation between the two uses and along which property lines this wall will be required. The applicant shall submit said information prior to the issuance of building permits for the subject church. AYES: Higgins, Russell, Stern, Finley, Bazil, Paone NOES: None ABSENT: Cohen CODE AMENDMENT NO. 78-8: MISCELLANEOUS REVISIONS Savoy Bellavia addressed the Commission and gave a brief presentation on the code amendment. It was the consensus of the Commission that there would be no need for further review on the code amendment and that it be set for public hearing. CONDOMINIUM CONVERSION ORDINANCE Dave Eadie briefed the Commission regarding the status of the previous draft that had been worked on in 1975 and discussed the nature of the input solicited from the Planning Commission, essentially as outlined in the staff report, to ascertain the Commission's viewpoint in regard to the following three issues: (1) Is it the desire of the Planning Commission to allow existing apartments to convert to condominium ownership? (2) Does the Planning Commission concur with the conceptual approach outlined in the draft ordinance for conversions? (3) If the Planning Commission concurs with the point system approach, would they recommend that a certain level of points be achieved prior to the filing of a formal application for conversion? Discussion ensued and it was the consensus of the Commission that the premise on which the draft ordinance had been prepared is still valid and the Planning Commission will consider the proposed condominium ordinance that had been reviewed in 1975 with modifications to be presented by staff at a later date. -2- 10'/10/78 - PC Minutes: H.B. Planning Commission Tuesday, October 10, 1978 Page 3 GENERAL PLAN INCONSISTENCIES Bill Holman distributed loose leaf notebooks identifying areas within the City where inconsistencies exist between the Land Use Element and the zoning ordinance. A short discussion ensued. Commissioner Stern stated that he wished to establish new criteria to allow small inconsistent uses to be allowed under existing land use designations. Mr.. Holman indicated that the staff will be meeting with the Planning Commission to determine appropriate General Plan Amendments or zoning action. PRESENTATION - BENCH SHELTERS Richard Barnard introduced representatives from the American Bus Shelters Co., Inc., and EKO Shelter Ad Company. Howard Mathews, representing EKO, gave a short presentation explaining his company's bus shelter program. Jean Claude LeRoyer, representing American Bus Shelters Co., Inc., also presented his company's proposal for providing bus shelters at various locations throughout the City. After the presentations the Planning Commission held a discussion and directed staff to prepare a letter to the City Council asking for direction concerning the implementation of a bus shelter program in the City. COMMISSIONERS' COMMENTS: Commissioner Paone inquired as to possibility of the City assuming authority for the issuance of Coastal Development Permits from the California Coastal Commission. Discussion ensued regarding the appropriate procedure to follow and what advantages and drawbacks were related to this process. Staff was directed to investigate the probable time involvement necessary to gain this authority and report back to the Planning Commission. Commissioner Stern requested the staff to investigate the possibility of drafting a development constraint map for the area in and around the Seacliff Phase IV project development. Staff indicated that additional information would be brought forth to the Commission at a later date. Commissioner Russell reported on the meeting he attended with Chairman Finley and residents of the Washington Street area. Commission discussion ensued regarding the status of the Washington Street land use status. -3- 10/10/78 -PC Minutes: H.B.
