CONFORMANCE WITH GENERAL PLAN 78-20 - Find in conformance with the General Plan sale of surplus property north of Terry Park. Acting Secretary Palin stated that this property was purchased a number of years ago when the school district declared it surplus. He further stated that if the Commission felt it should be addressed again it could be included in General Plan Amendment 79-1 and a statement of such included in the report to Council. Commissioner Russell stated_ that there have been. many changes since the industrial designation and he did not favor any change of zoning.at this time; however he felt that in view of those changes another look should be taken at the configuration of the property. Mr. John Behrens, Interim Director of Development Services, addressed the Commission and discussed the merging of Planning and Building Departments. He stated that the City would be advertising on a statewide basis for a Director. He further stated that he did not feel major changes should be made now which might have to be revised with the appointment of a Director. PUBLIC HEARINGS: ZONE CHANGE NO. 78-18 Applicant: Frank H. Ayres & Son Construction This is a request for a change of zone from R2-PD and Oldtown Specific Plan (District 2) to R2. Dave Eadie addressed the Commission and stated that staff was recommending a continuance to allow time to readverse the public hearing with corrected information. The public hearing was opened. There being no one present to speak on this application, the public hearing was closed. Commission discussion ensued. ON MOTION BY STERN AND SECOND BY RUSSELL ZONE CHANGE NO. 78-18 WAS CONTINUED TO NOVEMBER 7, 1978, BY THE FOLLOWING VOTE: AYES: Higgins, Russell, Stern, Finley, Cohen, Bazil NOES: None ABSENT: Paone ZONE CHANGE 78-10/NEGATIVE DECLARATION NO. 78-73 Applicant:Bell & Wilson Building and Development Zone Change 78-10 is a request for a change of zone from C2 to R1 on 1.62 acres, located east of Magnolia Street north of Mediterranean Drive. Planning Commission Tuesday, October 17, 1978 Page 3 TENTATIVE TRACT 10462 Applicant: Bell & Wilson Building and Development Tentative Tract 10462 is a request for an 8 lot subdivision located on the east side of Magnolia Street approximately 70 feet north of Mediteranean Drive. AND: CONDITIONAL USE PERMIT 78-17 Applicant: Bell and Wilson Building and Development Conditional Use Permit 78-17 is a request to redesign parking facilities, construct classroom facilities, and future construction located on the east side of Magnolia Street approximately 70 ft. north of Mediterranean Drive. Dave Eadie addressed the Commission and gave a brief discussion on the applications. The public hearing was opened. Mr. Wilson, the applicant, addressed the Commission and stated that he was in concurrence with the suggested changes. The public hearing was closed. Acting Secretary Palin stated that he had concern on the location of the interior street and would like the Commission to be more specific on Conditions 12 and 13. Commission discussion ensued on conditions to be imposed. The residential zoning is consistent with the land use designation of -the City's General Plan. 2. The subject property is not suitable for development under the present commercial zoning. Richard Derby,1adjoining,pronerty, owner, addressed the Commission and questioned how much'additional;tax would be involved with acceptance•of 6 ft. strip. ON MOTION BY STERN AND SECOND BYICOHEN'TENTATIVE TRACT 10462 WAS APPROVED WITH THE FOLLOWING3FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE:, FINDINGS: 1. The proposed subdivision of this 4.2 acre parcel of land proposed to be zoned R1 which allows 7 units per gross acre is proposed to be constructed having a'density of 2.3 units per gross acre. 2. The property was previously studied for this intensity of land use at the time the land use designations were applied to the subject property. 4. The lot size, depth, frontage, street width, and all other design and improvement features of the proposed subdivision are proposed to be constructed with standard plans and specifications on file with the City as well as in compliance with the State Map Act and supplementary City Subdivision Ordinance. 5. The proposed tract will be consistent with specific plans of the City upon subsequent action concerning the zoning upon the property. CONDITIONS OF APPROVAL: 1. The Tentative Map received October 13, 1978 shall be the approved layout. 2. All recommendations of the foundations & soils investigation performed on the property shall be complied with to the satisfaction of the Director of Building and Community Development. 3. Construction upon Lots 1 and 7 shall be limited to one-story homes. 4. The driveway location upon Lot 1 shall be subject to approval of the Planning Director,provided further that access rights upon the southerly 25 ft. of lot 1 shall be dedicated to the City. 5. Tentative Tract 10462 shall not be recorded unless and until Zone Change 78-10 becomes effective. 6. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers. 7. All,, improvements to the public right-of-way or any private property affected by the extension of "A" Street to Mediterranean Drive shall be the responsibility of the`developer: 12. Improvements to the remaining portion'of.Lot 39 of Tentative Tract 428.4 not utilized for street purposes shall be subject to approval of the Planning Director. If for any reason the residual property not utilized for right-of-way purposes '`for "A" Street is not conveyed or accepted by the adjacent property owners those portion(s) shall be developed as sidewalks by; the applicant., 13. The developer,shall mitigate the potential adverse visual impacts the new north -south` street will create upon 'Lot '58, of Tentative Tract 4284 in a manner a'ccIeptable"to'the Planning' Director . 14. The developer shall submit a 35-year hydrology and hydraulic study and 100-year calculations' ' for 'the protection 'of 'stt6ttires per the Orange County Flood Control District requirements. 15. The sewer, water, and fire'hydrant system shall be subject to City standards. 16. Drainage for the subdivision shall -be subject to the Department of Public Works prior to the recordation of the final map. This system shall be designed to provide for siltation and erosion control both during and after construction of the project. 17. Perimeter walls not less than 6" wide and 6' high shall be constructed along the rear yards of Lots 1 through 7 and along the .side yard of Lots 1 ar}d, 7. abutting the ;Mediterranean Drive single family homes. AYES: .:Higgins, Russell, Stern, Finley, Cohen, Bazil NOES: None ABSENT: Paone, GENERAL PLAN AMENDMENT 78-2 Bill Holman gave a presentation on the.three,areas of concern to be considered in GPA,78-2.as follows: Area of Concern 2.1 - The applicant,,RMJ Corporation requested a change of,designation,from low density residential to commercial on 2 acres located south of Warner Avenue east of Leslie Lane. Area of Concern 2.2 - The City of Huntington Beach requested a change in esignation south of Warner Avenue, east of Bolsa Chica Street, on 16.48 acres from low density residential to medium density residential. -6- 10/17/78 - PC Minutes: H.B. Planning Commission Tuesday, October 17, 1978 Page 7 Area of Concern 2.3 - The City of Huntington Beach requested a change of designation on a 1/2 mile segment located on Atlanta Avenue between Beach Boulevard and Lake Street from major arterial to primary arterial. The public hearing was opened. Area of Concern 2.1 George Arnold, a resident of Green Street, addressed the Commission and spoke against commercial designation. Wellman Bransaron spoke in opposition to the change in designation. Russ Jedenak, applicant, addressed the Commission and spoke in favor of the change of designation. Frank BuCcella preferred office commercial. Acting Secretary Palin stated that office professional was created primarily for large areas of land and that the commercial designation would be adequate to allow proposed office professional use. Area of Concern 2.2 Frank Mola addressed the Commission and stated that a soils study was being prepared with the results to be ready in about four weeks. He stated that there are apartments across the street and adjacent with R2 and R3 zoning. He requested R2 on the dump site to act as a buffer between existing high density apartments to the south. He discussed the grading problems which could be alleviated through use of pole construction. Frank Clendenen addressed the Commission and stated he felt the property Should be zoned R2. Robert Karger addressed the Commission and stated that he felt the area should be changed to R2. Alex Crosman stated that the property should be chanqed to R2. Margaret Carlberg addressed the Commission and stated that as a representative of the Environmental Council she wanted to make sure conditions of approval were imposed to mitigate environmental impacts to the archaeological site. She felt that a portion of the dump site should be acquired or dedicated for neighborhood park site. Discussion ensued on,a possible alternative amendment which desig- nated the northwest_1.66 acres to medium density and left the remaining portion of the area medium density. -7- 10/17/78 Minutes: H.B. Planning Commission Tuesday, October 17, 1978 Page 8 Area of Concern 2.3 Margaret Carlberg, representing the Environmental Council, stated that she felt the environmental documentation was inadequate. Jack Wallace addressed the Commission and expressed concern that the propo.-ed align ment would take land from the Huntington Beach Company and not other property owners. He was assured the GPA was not proposing any specific alignment. Such alignment would be addressed when Precise Plan of Street Alignments come up later on in the process. Jim VanDerhyden addressed the Commission and spoke in favor of proposed width reduction on Atlanta. The public hearing was closed on General Plan Amendment 78-2. Commission discussion ensued. Commissioner Bazil wanted a plot plan for the Commission's review at the time of the zone change public hearing which would address parking and screening from residential. Chairman Finley called a five minute recess at 9:30 p.m. ZONE CHANGE NO. 78-16/NEGATIVE DECLARATION NO. 78-67 Applicant: Richard G. Wilson This is a request for a change of zone from C2 to R3 on 1.55 acres located on the south side of Taylor Drive 250 ft.+ east of Pammy Lane. -9- 10/17/78 - PC Minutes: H.B. Tom King, owner of property back of Groth Chevrolet, addressed the Commission ,and stated that staff had not looked at the traffic problem. He also addressed the parking problems. John Michler, Hunsaker & Associates, addressed the Commission and stated that,the purpose of the zone change is;to provide access.to R3 property,,and further spoke in favor,.of the change. F. Alvarez addressed the Commission and spoke in opposition to the zone change. Barbara,Horwitz addressed the Commission and stated that she would not like to see multi -family dwelling homes in the area. She questioned if the sewer line would be,overloaded with such development. She felt the schools were at capacity in the area, and stated she would the property to remain as it.is orhavesingle family dwellings. Bette Bendorf addressed the Commiss,ion,and spoke on problems of parking and traffic which would be created if the zone change was approved. She further stated that she would prefer single family housing to apartments. The public hearing,was closed. Commission discussion ensued. Commissioner Stern stated that there,is a traffic problem and it was not addressed sufficiently. Planning Commission Tuesday, October 17, 1978 Page 11 CONDITIONAL USE PERMIT NO. 78-21/NEGATIVE DECLARATION NO. 78-94 Applicant: Creative Nursery Center, Inc. This is a request to construct and operate a 3,000 square foot after school care center on a site having an existing pre-achool located at 5432 Heil Avenue on the south side of Heil between Graham Street and Graham Place. Savoy Bellavia stated that he had not information to add to that contained in the staff report with the exception of an alternative for parking layout which he presented to the Commission. The public hearing was opened. Wallace Bartent, architect, addressed the Commission and stated that he would be happy to answer questions. There being no one else present to speak on the application, the public hearing was closed. Commissioner Cohen stated that he would vote for the project because it was an existing use, but was concerned over the landing pattern of the airport in relation to the use. Commissioner Russell felt conditions should be added that would require that the State requirements should be met. ON MOTION BY BAZIL AND SECOND BY COHEN NEGATIVE DECLARATION 78-94 WAS APPROVED WITH THE FOLLOWING VOTE: AYES: Higgins, Russell, Stern, Finley, Cohen, Bazil NOES: None ABSENT: Paone ON MOTION BY COHEN AND SECOND BY BAZIL CONDITIONAL USE PERMIT NO. 78-21 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS• 1. Natural gas shall be stubbed in'at the location of cooking facilities, water heaters, and central heating units. 5. Low volume heads shall be used on all spigots and water faucets. 6. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable materials, shall be disposed of,at an offsite facility;,equipped to handle them. 7. If lighting is included in parking areas, high pressure sodium vapor lamps shall be used for energy saving. Outside lighting shall be sufficiently shielded to prevent spillage of glare onto surrounding properties. 8. The applicant shall redesign and submit a revised plan to the Planning Department for approval of the on -site parking facility. Said parking facility corrections shall include 6 on -site parking spaces, as presented to the Commission as Exhibit "A".
