HomeMy WebLinkAbout1978-10-18t MINUTES HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS Room B-8 - Civic Center 2000 Main Street Huntington Beach, California WEDNESDAY, OCTOBER 18, 1978 - 1:15 PM BOARD MEMBERS PRESENT: SPENCER, EADIE, CROSBY CITY STAFF PRESENT: CHUCK BURNEY, FIRE DEPARTMENT MINUTES: ON MOTION BY CROSBY AND SECOND BY SPENCER THE MINUTES OF THE REGULAR MEETING OF OCTOBER 4, 1978, WERE APPROVED AS TRANS- CRIBED, BY THE FOLLOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE REGULAR AGENDA ITEMS: USE PERMIT NO. 78-59 Applicant: Shutter Shak (Chris Kent) To permit the construction of a 140 square foot, drive -through photo kiosk located within a shopping center on the northeast corner of Pacific Coast Highway and Warner Avenue in a C4, Highway Commercial District. This request is a Categorical Exemption, Class 3, California En- vironmental Quality Act, 1970. Chairman Eadie opened the public hearing. Chris Kent, Susan Belmonte, Mark Duval, and John Neilson were present to represent the application. There being no persons to speak for or against the proposal, the public hearing was closed. Secretary Spencer reported that a similar use formerly occupied the proposed location. A field check has verified that adequate parking remains in the center to accommodate this and other com- mercial uses operating there at present. The elevations of the structure were reviewed by the Board. Minutes, H.A. Board of Zoning Adjustments October 18, 1978 Page 2 ON MOTION BY CROSBY AND SECOND BY EADIE USE PERMIT NO. 78-59 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to the general welfare or injurious to property and improvements in the area. 2. The granting of a Use Permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF PERMITS: 1. The conceptual site plan received and dated September 18, 1978, and the elevations received and dated October 10, 1978, shall be the approved layout, subject to the follow- ing: a. Prior to application for building permits, the appli- cant shall submit to the Secretary of the Board for his approval a colored rendering of the proposed building and snapshots of the shopping center, to make sure that the proposed structure is compatible in color and theme to the entire center. In its approval action, the Board of Zoning Adjustments consid- ered the following issues in relation to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 78-54 Applicant: The Buccola Company To permit reduction in height of a required separation wall from 6 feet to 5 feet ±, located at the northeast corner of Beach Boulevard and Garfield Avenue in a C4, Highway Commercial District. This request is a Categorical Exemption, Class 5, California En- vironmental Quality Act, 1970. BZA 10-18-78 Page 2 1 I Minutes, H.B. Board of Zoning Ad)ustments October 18, 1978 Page 3 Chairman Eadie opened the public hearing. John Praisler was pre- sent at the meeting and explained his reasons for the request. There being no other persons to address the Board, the public hearing was closed. Secretary Spencer reported that when the wall was constructed the City's grading engineer had inspected it and indicated that he felt the finished grades on both sides of the wall would meet the criteria for the six-foot wall. However, subsequent grading on the commercial side of the wall has resulted in the grade differential and the present sub -standard height of the separation wall. The review by the Board included consideration of the finding of hardship and exceptional circumstance required for approval of the request; also considered were possible alternative means of correcting the problem, such as the addition of one or two courses to the top of the existing fence. After extensive discussion, it was the consensus that the request should be con- tinued to permit applicant time to review the fence construction to determine the feasibility of adding extra courses and to allow time to contact the property owners involved. ON MOTION BY EADIE AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 78-54 WAS CONTINUED WITH THE CONCURRENCE OF THE APPLICANT TO THE REGULAR MEETING OF OCTOBER 25, 1978, BY THE FOLLOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 78-38 Applicant: Steve O'Dell To permit creation of legal lot lines on property located on the west side of Green Street approximately 570 feet south of Heil Avenue in an R2, Medium Density Residential District. This request is covered by Negative Declaration No. 78-74, adopted by the Board on July 12, 1978. Steve O'Dell was present at the meeting and indicated his receipt of and concurrence with the suggested conditions of approval previously forwarded to him. ON MOTION BY EADIE AND SECOND BY SPENCER TENTATIVE PARCEL MAP NO. 78-38 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: BZA 10-18-78 Page 3 Minutes, H.B. Board of Zoning Ad]ustments October 18, 1978 Page 4 CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF A CERTIFICATE OF OCCUPANCY: 1. The tentative parcel map received by the Planning Depart- ment on October 10, 1978, shall be the approved layout. 2. A parcel map shall be filed with, and approved by, the Department of Public Works and recorded with the Orange County Recorder. 3. Copies of the recorded parcel map shall be filed with the Planning Department and with the Department of Public Works. AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE MISCELLANEOUS AGENDA ITEMS: USE PERMIT NO. 78-12 (Revision) Applicant: David Silver To permit modification in materials for a perimeter fence for two previously approved triplexes abutting an arterial street loc- ated on the north side of Warner Avenue approximately 220 feet west of Nichols Street in an R2, Two -Family Residential District. Secretary Spencer informed the Board that, although there is no code requirement for a block wall and the applicant was not condi- tioned to provide one in his earlier approval, the plans for the project had shown such a wall. Applicant now wishes to replace the wall with a wooden fence and needs Board action approving that change. It was the determination of the Board that the modifica- tion should be permitted. ON MOTION BY SPENCER AND SECOND BY EADIE USE PERMIT 78-12 AS RE- VISED WAS APPROVED WITH THE FOLLOWING STIPULATION, BY THE FOLLOW- ING VOTE: The applicant's request to substitute a wooden fence for the block wall shown on his approved plans is granted. However, a revised plan incorporating the wooden fence shall be submitted to the Secretary of the Board for approval and incorporation into the permanent file for the project. The Board reviewed the elevations as submitted. ON MOTION BY EADIE AND SECOND BY SPENCER THE ELEVATIONS FOR USE PERMIT NO. 78-41 WERE APPROVED AS SUBMITTED ON OCTEBER 13, 1978, BY THE FOLLOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE PLOT PLAN AMENDMENT NO. 76-11 (Revised) Applicant: Gene Royer To permit modifications to a previously approved plan for Tentative Tract 5813, a planned residential development located on the east side of Pacific Coast Highway north of Anderson Street. Secretary Spencer informed the Board that these revisions are to the Bayport Condominiums, Tract 5813, and provide what the staff considers a better layout for the project. The revisions con- sist of a reorientation of Buildings 3 and 5 and attachment of buildings to meet separation requirements. The proposed layout was reviewed by the Board. ON MOTION BY SPENCER AND SECOND BY EADIE, THE REVISED PLAN FOR PLOT PLAN AMENDMENT NO. 76-11 RECEIVED AND DATED OCTOBER 18, 1978, WAS APPROVED BY THE FOLLOWING VOTE: AYES: SPENCER, EADIE, CROSBY NOES: NONE ABSENT: NONE THERE BEING NO FURTHER BUSINESS, arles P.
