Applicant: The Buccola Company
To permit reduction in height of a required separation wall on
property located at the northeast corner of Beach Boulevard and
Garfield Avenue in a C4, Highway Commercial District.
This request is a Categorical Exemption, Class 5, California En-
vironmental Quality Act, 1970.
No one was present to address the Board in regard to this proposal.
Secretary Spencer reported that the applicant wishes a further
continuance.

NO. 78-54 WAS CONTINUED AT THE REQUEST OF THE APPLICANT TO THE

CONDITIONAL EXCEPTION NO. 78-56
Applicant: Glenn Maurer
To permit construction of a patio cover within the ten (10) foot
exterior side yard setback on property located on the southwest
corner of Norfolk Drive and Newland Street in an R1, Low Density
Residential District.
This request is a Categorical Exemptign, Class 5, California
Environmental Quality Act, 1970.
Chairman Lipps opened the public hearing. Glenn Maurer was pre-
sent at the meeting and justified his request as providing a
better utilization of his yard space and as an aid in attenuating
the traffic noise from Newland Street. There being no other
persons to address the Board, the public hearing was closed.
The Board reviewed the request, considering the type of construc-
tion and the location of the vertical support members for the
patio and the finding of hardship which must be made for the
granting of the request. It was explained to the applicant that
the photos he had submitted in his request were of houses permitted
to go to zero setback at the time of original construction.
After extensive discussion it was the consensus that no unusual
circumstances exist on the property to justify the exception to
code requirements.
ON MOTION BY LIPPS AND SECOND BY SPENCER CONDITIONAL EXCEPTION
NO. 78-56 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING
VOTE:
REASONS FOR DENIAL:
1. There are no special circumstances of size, shape, or topo-
graphy existing on the subject site which would deprive the
property of privileges enjoyed by other properties in the
vicinity and under identical zone classifications.
2. Granting of the request would constitute a grant of special
privilege inconsistent upon other properties in the vicinity
and under the same zone classification.
3. Granting of the conditional exception is not necessary to
preserve the enjoyment of one or more substantial property
rights.
4. It is physically possible to erect the proposed structure on
the site in such a manner that its vertical members would be
within the code -mandated setbacks.

ADMINISTRATIVE REVIEW NO. 78-89
Applicant: Thomas J. Horan
To permit construction of a 20,000 square foot industrial build-
ing located on the west side of Commerce Lane approximately 575
feet south of McFadden Avenue in an M1-A, Restricted Manufactur-
ing District.
Secretary Spencer reported to the Board that the plan distri-
buted with this request had been found unacceptable when it was
originally filed and the applicant so notified. Attempts to
obtain a clear, readable plan which could be processed by the
plancheckers have been unsuccessful.
ON MOTION BY CROSBY AND SECOND BY SPENCER ADMINISTRATIVE REVIEW
NO. 78-89 WAS DENIED WITHOUT PREJUDICE FOR FAILURE OF THE APPLI-
CANT TO SUBMIT A LEGIBLE SITE PLAN, BY THE FOLLOWING VOTE:

USE PERMIT NO. 78-60 (In Conj./AR 78-90)
Applicant: Hedley Beesley
To permit overhead loadinq doors to face a public street on property
located on the north side of McFadden Avenue approximately 107
feet east of Chemical Lane in an Ml-A, Restricted Manufacturing
District.
This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
Kurt Baba was present to represent the application.
The Board reviewed the loadinq doors, discussing distance from
the right-of-way and architectural treatment of the doors.
ON MOTION BY LIPPS AND SECOND BY CROSBY USE PERMIT NO. 78-60 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE
FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to the general welfare or injurious to
property and improvements in the vicinity.
2. The granting of the use permit will not adversely affect the
General Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of
Land Use.

CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plan received and dated October 17, 1978,
shall pe the approved layout.
In its approval action the Board of Zoning Adjustments consid-
ered the following issues in relation to the conceptual plan:
. Type of use and its relation to property and improvements in
the immediate vicinity;
Past administrative action regarding this property.
2. The overhead doors shall be treated in a manner compatible
in color and materials with the building elevation on
which they are located.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. The building inside the loading door shall be striped and
posted "Loading Zone Only" for a total of forty-five
feet from the street right-of-way.

Applicant: Hedley Beesley
To permit the construction of a 24,000 square foot industrial
building located on the north side of McFadden Avenue approximately
107 feet east of Chemical Lane in an M1-A, Restricted Manufactur-
ing District.
Board review found the layout substantially in compliance with
code. Access to the site and maneuverability into parking spaces
were considered.
ON MOTION BY LIPPS AND SECOND BY SPENCER ADMINISTRATIVE REVIEW
NO. 78-90 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL-
LOWING VOTE:

A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plan and elevations received and dated
October 17, 1978, shall be the approved layout, subject
to the modification described herein:

a. The two easterly drive approaches shall he increased
to a width of 35 feet, with radius type curb returns.
The modification outlined above shall be delineated upon the
plan submitted to the Department of Development Services upon
application for building permits.
In its approval action, the Board of Zoning Adjustments consid-
ered the following issues relating to the conceptual plan:
. Traffic circulation and drives;
Parking layout;
. Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity;
Past administrative action regarding this property.
2. The following plans shall be submitted to the Secretary
of the Board:
a. Landscape and irrigation plan complying with Article
979 of the Huntington Beach Ordinance Code and land-
scaping specifications on file in the Department of
Public Works.
b. Rooftop mechanical equipment screening plan. Said
plan shall indicate screening of all rooftop mechani-
cal equipment and shall delineate the type of material
proposed to screen said equipment.
3. The project shall be sub34�_,ct to all Conditions of Approval
imposed upon Use Permit No. 78-60.

MISCELLANEOUS AGENDA ITEMS:
SPECIAL EVENT NO. 78-14
Applicant: Huntington Beach -Fountain Valley Board of Realtors
To permit a rummage sale on Saturday and Sunday, December 2 and 3,
1978, for the benefit of the Huntington Beach and Fountain Valley
paramedics, said project to be located in Seacliff Village at the
northwest corner of Main Street and Yorktown Avenue.
The request was reviewed by the Board.

COND [`['IONS OF APPROVAL:
1. The layout and description received and dated October 26,
1978, shall be the approved layout.
2. The applicant shall obtain all necessary electrical permits.
3. An onsite inpsection by the Fire Department shall be required
prior to the event.
4. A certificate of insurance form shall be filed in the License
Division of the Finance Department ten (10) days prior to
the event.

CONDITIONAL EXCEPTION NO. 78-50 (Reconsideration)
Applicant: Tony Massod
To permit use of a twenty (20) foot alley as access to a property
located approximately 275 feet north of Pearce Street and 175
feet west of Green Street in an R2, Medium Density Residential
District.
Secretary Spencer informed the Board that an error of omission
had been made in the previous mailing of legal notices on this
proposal; therefore, it will be necessary to send out a new
notice and reconsider the application.
ON MOTION BY SPENCER AND SECOND BY LIPPS THE BOARD DETERMINED TO
RECONSIDER CONDITIONAL EXCEPTION NO. 78-50 FOR THE PURPOSE OF
READVERTISING THE REQUEST FOR THE REGULAR MEETING OF NOVEMBER 15,
1978, BY THE FOLLOWING VOTE:

USE PERMIT NO. 78-24 (Revision on Conditions)
Applicant: Paul Ledbetter
Request for construction of five (5) new units to an already
existing four -unit dwelling complex located on the east side of
Cameron Street approximately 360 feet north of Newman Avenue in
an R3 District.

Secretary Spencer informed the Board that the applicant and the Fire
Department had reached an agreement in regard to access to the rear
of the sub]ect property, and that agreement will require a modification
to the conditions imposed upon the request. The future drive access
on the northerly side of this property will be required to be a total
width of twenty-four (24) feet and the applicant will submit an irrevo-
cable offer of dedication for a portion of this future common recipro-
cal drive between his lot and the property to the north.
ON MOTION BY SPENCER AND SECOND BY CROSBY THE CONDITIONS OF APPROVAL
FOR USE PERMIT NO. 78-24 WERE AMENDED AS FOLLOWS, BY THE FOLLOWING VOTE:
ADDED CONDITION OF APPROVAL:
A-2: Prior to issuance of building permits, the applicant shall file
with the City and record with the County an irrevocable offer of dedi-
cation to provide for a common reciprocal drive in the future with the
property to the north. Said offer of dedication shall be to the approval
of the office of the City Attorney as to form and content.
