OF THE REGULAR MEETING OF OCTOBER 25, 1978, WERE APPROVED AS TRANS-

CONDITIONAL EXCEPTION NO. 78-54 (Cont. from 11-1-78)
Applicant: The Buccola Company
To permit reduction in height of a required separation wall from
6 feet to 5 feet + located at the northeast corner of Beach Boule-
vard and Garfield Avenue in a C4, Highway Commercial District.
This request is a Categorical Exemption, Class 5, California Environ-
mental Quality Act, 1970.
Secretary Spencer informed the Board that the applicant had requested
a one week continuance of this application to allow him time to
solicit permission from adjacent property owners to add a wall to
his proposed project. Board concurred with continuance.

Applicant: Donald G. Brown, President, db Design Group Inc.
To permit the construction of ten (10) units abutting an arterial
highway located on a triangular lot surrounded by Delaware and
Seventeenth Streets and Clay Avenue in an R4, High Density
Residential District.
This request is covered by Negative Declaration No. 78-111.
Chairman Crosby opened the public hearings on the Negative Declara-
tion and Use Permit applications. Donald G. Brown was present to
represent the application.
The Board reviewed the information contained in the negative dec-
laration request form and considered the mitigating measures appli-
cable to the project which had been recommended by the Environ-
mental Resources section of the Planning Commission.
ON MOTION BY SPENCER AND SECOND BY CROSBY THE BOARD, HAVING FOUND
THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE
EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION
NO. 78-111 WITH THE MITIGATING MEASURES CONTAINED IN GENERAL CON-
DITIONS 3 THROUGH 8 IMPOSED ON THE USE PERMIT, BY THE FOLLOWING
VOTE:

Board review of the proposed plan found it to be in general confor-
mance with requirements. Mr. Brown addressed the Board and presented
his subterranean parking proposal.
Mr. Paul Hill and Rev. Albert Jansen, representing the Methodist
Church located across the street from proposed project, addressed
the Board and stated their concerns regarding
excessive parking along Delaware Street, between 17th Street and
Clay Avenue. Chairman Crosby, however, assured them that the
curb line along the east side of Delaware Street between 17th Street
and Clay Avenue would be painted red to restrict any parking and
that this would be incorporated as a condition of approval for the
construction of the project.

There being no other persons present to address the Board for or
against the proposed project, the public hearing was closed.
ON MOTION BY SPENCER AND SECOND BY CROSBY USE PERMIT NO. 78-61 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING
VOTE:

FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in
the vicinity;
b. Property and improvements in the vicinity of such use
or building.
2. The granting of a Use Permit will not adverseley affect the
General Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of
Land Use.
CONDITIONS OF APPROVAL:
1. The plot plan and elevations received and dated October 17, 1978
shall be the approved plans.
2. The curb line along the east side of Delaware Street between
17th Street and Clay Avenue shall be painted red and shall
be approved by the Department of Public Works.
GENERAL CONDITIONS:
3. Natural gas and 220V electrical shall be stubbed in at the
location of clothes dryers.
4. Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units.
5. Low volume heads shall be used on all spigots and water faucets.
6. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at
an offsite facility equipped to handle them.
7. The structures on the subject property, whether attached or
detached, shall be constructed in compliance with the state
acoustical standards set forth for all units that lie within
the 60 CNEL contours of the property.
8. Four (4) 24 inch box trees replacing two (2) mature existing
onsite shall be provided in addition to the standard land-
scaping requirements. The species and location of the new
trees shall be reviewed by the landscape division of the
Public Works Department.

CONDITIONAL EXCEPTION NO. 78-59
Applicant: James M. Martin (for Harbour Pacific Ltd.)
Tb permit reduction in side yard setback from the required 10 feet
to 7 feet located on the corners of Typhoon Lane and Walrus and
Venture Drives in an Rl, Low Density Residential District.
This request is a Categorical Exemption, Class 5, California
Environmental Quality Act, 1970.
Chairman Crosby opened the public hearing. Jim Whitelaw and James
Martin were present. Secretary Spencer informed the applicant
that the rear yard dimension of 24 feet as depicted on the site
plan should be corrected to read 25 feet.
Mr. Whitelaw addressed the issue of hardship as the proposed homes
requiring an exception are to be located on an irregular shaped
lot, whereas similar homes would not need an exception on a regular
sized lot. Mr. Whitelaw further stated that the design as proposed
would preserve the architectural theme of the development.
There being no persons present to speak for or against the proposal
the public hearing was closed.
The Board discussed the orientation of the proposed structures, and
concurred that a conditional exception was warranted and further -
discussed findings for approval.
ON MOTION BY CROSBY AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO.
78-59 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The granting of the Conditional Exception will not constitute
a grant of special privilege inconsistent upon other properties in
the vicinity and under an identical zone classification.
2. The granting of the Conditional Exception will not adverseley
affect the General Plan of the City of Huntington Beach.
3. Because of the shape of subject properties, the strict application
of the ordinance is found to deprive the subject properties of
privileges enjoyed by other properties in the vicinity under like
zone classifications.
3. The encroachments are minimal in that they consist of triangular
areas less than thirty (30) square feet, the remainder of the
structures would meet or exceed code requirements.

MISCELLANEOUS AGENDA ITEMS:
ADMINISTRATIVE REVIEW NO. 78-90 (Reconsideration)
Applicant: Hedley Beesley
For amendment to conditions of approval previously applied
to the construction of a 24,000 square foot industrial building
located on the north side of McFadden Avenue, approximately
107 feet east of Chemical Lane in an M1-A, Restricted Manu-
facturing District.

ment located on the southeast corner of Heil Avenue and Gothard
Street in an Ml, Light Manufacturing District.
ON MOTION BY SPENCER AND SECOND BY CROSBY THE BOARD OF ZONING
ADJUSTMENTS APPROVED THE PRELIMINARY LANDSCAPING DRAWINGS,
ELEVATIONS, AND THE MASONRY WALL ALONG THE EASTERLY LINE
AS DEPICTED BELOW BY THE FOLLOWING VOTE:
The masonry wall along the easterly property line shall
be of slumpstone material, color to be approved by the
Planning Department. Final landscape and irrigation drawings
shall be submitted for approval to the Planning Department
prior to issuance of a Certificate of Occupancy on any
building in the subject complex.

an R3, Medium -High Density Residential District.
ON MOTION BY SPENCER AND SECOND BY CROSBY BOARD INCORPORATED FOLLOWING
FINDINGS OF APPROVAL INTO PREVIOUSLY APPROVED CONDITIONS OF APPROVAL
BY THE FOLLOWING VOTE:
FINDINGS OF APPROVAL:
1. The proposed subdivision of this 0.875 acre parcel of land zoned R3,
high density residential is being proposed to be constructed having
20 units per gross acre.
2. Subject property meets both size and locational criteria of the
General Plan and furthers policies of the General Plan.
3. The property was previously studied for this intensity of land use
at the time the land use designation of Medium Density Residential
was placed on subject property.
4. The lot size, depth, frontage, street widths, and all other design
and improvements features of the proposed subdivision are proposed
to be constructed in compliance with the State Map Act and supple-
mentary City Subdivision Ordinance.
