BOARD MEMBERS PRESENT: LIPPS, CROSBY, OTT BOARD MEMBERS ABSENT: NONE CITY STAFF PRESENT: SPENCER (for reconsideration of Use Permit No. 78-61) MINUTES: ON MOTION BY CROSBY AND SECOND BY OTT THE MINUTES OF THE REGULAR MEETING OF NOVEMBER 1, 1978, WERE APPROVED AS TRANSCRIBED, BY THE FOLLOWING VOTE: AYES: CROSBY, OTT NOES: NONE ABSENT: NONE ABSTAIN: LIPPS REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 78-54 (Cont. from 11-8-78) Applicant: The Buccola Company To permit reduction in height of a required separation wall from 6 feet to 5 feet + located at the northeast corner of Beach Boule- vard and Garfield Avenue in a C4,, Highway Commercial District. This request is a Categorical Exemption, Class 5, California Environ- mental Quality Act, 1970. Secretary Lipps informed the Board that the applicant had requested a continuance to allow him time to solicit permission from adjacent property owners to add a wall to his proposed project. He further stated that staff would require a continuance to allow time to contact the adjacent residential property owner for wall height correction. ON MOTION BY LIPPS AND SECOND BY OTT, CONDITIONAL EXCEPTION NO. 78-54 WAS CONTINUED TO NOVEMBER 29, 1978 BY THE FOLLOWING VOTE: AYES: LIPPS, CROSBY, OTT NOES: NONE ABSENT: NONE Minutes: H.B. Board of Zoning Adjustments November 15, 1978 Page 2 CONDITIONAL EXCEPTION NO. 78-50 (Cont. from 11-1-78) Applicant: Tony Massod To permit use of a twenty (20) foot alley as access to a property located approximately 275 feet north of Pearce Street and 175 feet west of Green Street in an R2, Medium Density Residential District. This request is a Categorical Exemption, Class 5, California Environ- mental Quality Act, 1970. Secretary Lipps informed the Board that this application had been previously approved by the Board, but had been reconsidered to promote proper advertising of the application. The public hearing was opened. Mr. Tony Massod, applicant was present and addressed the Board stating that he had nothing further to add to the application. Ellen McMahon addressed the Board and spoke in opposition of the proposal. Ms. McMahon questioned whether the applicant had other access to his property. She stated that the traffic in the alley whereby the access is proposed is already crowded, and that the alley was not intended for major access. She cited concern over parking along the accessway stating that an overflow of parking already exists. Secretary Lipps stated that parking concerns would be addressed at the time of development plan review. Mel Ott was concerned with Fire Department maintaining access along the alleyway. Bruce Crosby noted that if access was not granted to the applicant, a possibility of a land locked parcel would be created. There being no other persons present to speak for or against the proposal, the public hearing was closed. Board discussion followed. ON MOTION BY CROSBY AND SECOND BY LIPPS, CONDITIONAL EXCEPTION NO. 78-50 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. Because of the following special circumstances applicable to the subject property, the strict application of the zoning ordin- ance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and in the same zoning classification: BZA 11-15-78 Page 2 Minutes: H,B. The lot has existed for some years in the present configura- tion. C. The commonly owned private access easement has existed for 25 to 30 years for the use of the properties on either side. d. The existing easement is of no lesser width than a legal - width public alley. 2. The granting of the conditional exception will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and in the same zoning classification. 3. The granting of the conditional exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 4. The granting of the conditional exception will not be materially detrimental to the public welfare or injurious to property in the same zone classification. 5. The granting of the conditional exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: 1. The access layout received and dated August 28, 1978, showing access via the twenty (20) foot alley shall be the approved layout. 2. The approval of the -conditional exception is limited to Section 9166.9(c) of the Huntington Beach Ordinance Code. Stern To permit a reduction of the minimum dimension from 25 to 16 feet located on the east side of Sparkman Lane, approximately 240 feet north of Kite Drive in an Rl, Low Density Residential District. This request is a Categorical Exemption, Class 5, California Environ- mental Quality Act, 1970. BZA 11-15-78 Page 3 Minutes: H.B. Board of Zoning Adjustments November 15, 1978 Page 4 Secretary Lipps introduced the application to the'Board. The public hearing was opened., Mr. & Mrs Stern, applicants, were present and stated they had nothing further to add in that the letter submitted by them was self-explanatory. The Board discussed the,proposal and found that the plan check revealed that the application already contains 1200 square feet of open space and that the addition does not encroach into the required minimum square footage of open space. There being no persons present to speak for or against the appli- cation, the public hearing was closed. Board discussed findings for approval. ON MOTION BY CROSBY AND SECOND BY OTT'CONDITIONAL EXCEPTION NO. 78-60 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1: The proposed addition will not decrease the required open space area, as the remaining open space on the lot will still comply with code requirements. 2. The granting of -the Conditional Exception will not constitute a grant of special privilege inconsistent upon other properties in.the vicinity and under an identical zone classification. 3. Because of special circumstances applicable to the subject property, including size, shape, topography, location, or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 4. The granting of a Conditional Exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 5. The granting of a Conditional Exception will not be materially detrimental to the public welfare, or injurious to property in the same zone classification. 6. The granting of the Conditional Exception will not adversely affect the General Plan of the City of Huntington Beach. IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 78-99 (In Conj./UP 78-63) Applicant: Shaw & Talbot To permit the construction of one industrial building of 20,000 square feet located on the east side of Pipeline Lane, approximately 400 feet south of Engineer Drive in an M1-A, Restricted Manufacturing District. These requests are covered by EIR 73-16, adopted by the City Council on March 18, 1974. Secretary Lipps informed the Board that the applicant had submitted a letter requesting withdrawal of Use Permit No. 78-63 and Administrative Review No. 78-99. Board concurred with withdrawal. The proposed consolidation of three (3) individual lots into one parcel for purposes of commercial development is in compliance with the size and shape of property necessary for commercial development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The Board discussed the application and found same to be within Ordinance Code conformance. ON MOTION BY LIPPS AND SECOND BY OTT ADMINISTRATIVE REVIEW NO. 78-102 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received October 30, 1978, shall be the approved layout, subject to the.modifications described herein: a. The setback of the building along the easterly property line shall be a maximum of 2 inches. b. Property boundaries shall be clearly shown. A plan delineating said modifications shall be submitted to the Secretary of the Board. The Board discussed the application and found same to be deficient in front yard setback. The filing of a conditional exception to alleviate the required setback was discussed. It was the concensus of the Board to continue the application to allow applicant time to redesign the proposal or file for a conditional exception to reduce the front yard setback. The conceptual plot plan and elevations received October 30, 1978, shall be the approved layout, subject to the modifications described herein: a. The setback of the building along the northerly and easterly property lines shall be a maximum of two inches. b. Property boundaries shall be clearly shown.
