IN CONJUNCTION WITH: USE PERMIT NO. 78-57 Applicant: Commissariat Design To permit construction of a portion of a six -unit apartment more than 150 feet from a public street located on the south side of Aldrich Street, approximately 100 feet east of Parkside Lane in an R3 District. This application is covered by Negative Declaration No. 78-114. ON MOTION BY'SPENCER AND SECOND BY CROSBY THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT., ADOPTED NEGATIVE DECLARATION NO. 78-114 WITH THE MITIGATING MEASURES CONTAINED IN USE PERMIT NO. 78-57 GENERAL CONDITIONS 2 THROUGH 6 IMPOSED ON THE USE PERMIT REVIEW, BY THE FOLLOWING VOTE: AYES: SPENCER, CROSBY OTT NOES: NONE ABSENT: NONE Secretary Spencer introduced the proposals to the Board. He further stated that the plan check revealed that the Use Permit application was within ordinance code conformance except for the "zero" setback, for which the applicant filed a Conditional Exception. The public hearing was opened on Conditional Exception No. 78-55 and Use Permit No. 78-57. Messrs. Jim Moor and Jack Schmier were present to represent the application, and to present their justification for a Conditional Exception. Mel Ott expressed concern over parking in the driveway area, and suggested "no parking - fire lane" signs be posted along that driveway. There being no other persons present to speak on the applications, the public hearing was closed. Findings and conditions of approval were discussed. Minutes: H.B. The granting of the Conditional Exception will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 2. Because _ofspecial circumstances'applicable to the subject propperty, the strict'appiication of'the zoning ordinance is, ound to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 3. The granting of a Conditional Exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 4. The granting of a Conditional Exception will not be materially detrimental to the public welfare, or injurious to property in the same zone classification. 5. The granting of a Conditional Exception will not adversely affect the General Plcin of -the---City of Huntington Beach. CONDITION OF APPROVAL: 1. The conceptual plot plan and elevations received October 16, 1978 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity. 2. GENERAL CONDITIONS: 1. Applicant shall post the area along the west driveway wall from a point opposite the southerly edge of the garages to the drive entrance with "NO PARKING - FIRE LANE." 2. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers. 3. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 4. Low volume heads shall be used on all spigots and water faucets. 5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 6. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the state acoustical standards set forth for units that lie within the 60 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, with the application for building permits. This request is covered by Negative Declaration No. 78-93, adopted by the Board of Zoning Adjustments at its September 27, 1978 meeting. The applicant was not present. Secretary Spencer introduced the proposal to the Board. Board found proposal to be within substantial conformance with the Huntington Beach Ordinance Code. Conditions of approval were discussed. ON MOTION BY SPENCER AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 78-98 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE:, CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS 1. The revised plot plan'received and dated November 3, 1978 shall be the approved layout subject to the following modifications: a. The first material stacking tier at the southerly drive shall be altered to shorten the length of the tier by 35 or 40 feet to provide a better turning radius and to increase visibility on the property. b. The landscaping area in front of the parcel shall be increased to twenty (20) feet (rather than the 10 feet as shown) to coincide with the parcel to the north. A plan delineating the above modifications shall be submitted to the Secretary of the Board for review and approval prior to filing for permits on the site. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 2. If outside lighting is included onsite, high-pressure sodium vapor lamps shall be used to prevent "spillage" onto adjacent areas and for energy savings. IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 78-100 Applicant: John D._Lusk & Son To permit construction of a 12,208 square foot industrial building located on the south side of Engineer Drive, approximately 3,00 feet west of Pipeline Lane in an M1-A, Restricted Manufacturing District. These requests are covered by Environmental Impact Report 73-16, adopted by the City Council on March 18, 1974. Secretary Spencer introduced the applications to the Board. Elliot Boone, Mr. McLellan, and Jerry Tarrant, were present to represent the application. The public hearing was opened on Use Permit No. 78-64. Minutes: H.B. The Board noted that the plan was in compliance with Ordinance Code requirements. The public hearing was closed on Use Permit No. 78-64. Conditions of approval and findings for approval were discussed. ON MOTION BY CROSBY AND SECOND BY OTT USE PERMIT NO. 78-64 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: FINDINGS•- 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general -welfare of persons residing,or working,in the vicinity, b.' Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adverseley affect,the'General Plan of the City of Huntington Beach: 3, The proposal is consistent with the City's General Plan of Land Use.
