This request is a Categorical Exemption, Class 5, California Environ- mental Quality Act, 1970. The applicant was not present. Secretary Spencer suggested that Conditional Exception be continued indefinitely to permit determination to be made concerning the responsibility of subject developer or adjacent developer to construct the wall to ordinance code required height. Board concurred with continuance. This request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Secretary Spencer suggested that this application be continued to December 20, 1978 to be.heard in'conjunction with Conditional Exception No. 78-63. Board concurred with continuance. ON MOTION BY SPENCER AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 78-111 WAS CONTINUED TO DECEMBER 20, 1978 BY THE FOLLOWING VOTE: AYES: SPENCER, CROSBY, BURNEY NOES: NONE ABSENT: NONE USE PERMIT NO. 78-68 Applicant: Helmut Cook To permit use of 25 percent of the floor area of an industrial building to be used for retail sales located on the east side of Gothard Street, approximately 75 feet north of Murdy Circle in an Ml, Light Industrial District. This request is a Class 1 exemption, California Environmental Quality Act, 1970. •Chairman Crosby introduced the application to the Board. Mr. Helmut Cook, applicant, was present. The public hearing was opened. Mr. Cook explained his proposal stating that he intends to use the building for rental of medical supplies, some repair work, and incidental retail sales. Secretary Spencer informed the applicant that he was not allowed any signs for his proposed use. There being no other persons present to speak on the application, the public hearing was closed. Board discussion ensued. Conditions of approval and findings were discussed. ON MOTION BY SPENCER AND SECOND BY CROSBY USE PERMIT NO. 78-68 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITION, BY THE FOLLOWING VOTE: Minutes: H.B. Board of Zoning Adjustments Wednesday, November 29, 1978 Page Four FINDINGS• 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely-- affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITION OF APPROVAL: 1. Applicant shall adhere to the criteria as set forth in Section 9530.2(b) of the Huntington Beach Ordinance Code. I hereby certify that Use Permit No. 78-68 was approved by the Board of Zoning Adjustments of the City of Huntington Beach, California on November 29, 1978 upon the foregoing findings and conditions of approval. AYES: SPENCER, CROSBY, BURNEY NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 78-40 Applicant: David Silver To permit division of one parcel of land into two (2) parcels located on the west side of Beach Boulevard, approximately 307 feet south of Cypress Avenue in an R2 and C4 District. This request is covered by Negative Declaration No. 78-116. The applicant was not present. Secretary Spencer suggested a one week continuance on this appli- cation because applicant failed to appear or to submit written concurrence with the suggested conditions of approval. Board concurred with continuance. ON MOTION BY SPENCER AND SECOND BY CROSBY, TENTATIVE PARCEL MAP. NO. 78-40 WAS CONTINUED TO DECEMBER 6, 1978 BY.THE FOLLOWING VOTE: AYES: SPENCER, CROSBY, BURNEY NOES: NONE ABSENT: NONE 1 Minutes: H.B. Board of Zoning Adjustments Wednesday, November 29, 1978 Page Five ADMINISTRATIVE REVIEW NO. 78-112 Applicant: Eugene B. Zwick To permit the construction of a 15,000 foot industrial building located on the northwest corner of Argosy Lane and Graham Street in an M1-A, Restricted Manufacturing District. This request is covered by Negative Declaration No. 73-16 approved by the City Council March 18, 1974. Mr. Eugene Zwick the applicant was present. Chairman Crosby outlined the proposal to the Board. He stated that the applicant had submitted a previous application (Admini- strative Review No. 77-101) to the Board and had received approval of that application. However, Administrative Review No. 77-101 was expired and thus the applicant had refiled present application. Board reviewed the proposal and found same to be within Ordinance Code conformance. The applicant was made aware that the previous conditions of approval would still apply. Chuck Burney notifi6d the applicant that a fire hydrant was required on site. Conditions of approval were discussed. ON MOTION BY SPENCER AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 78-112 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plan received and dated November 5, 1978 shall be the approved layout for the 15,000 square foot building to be constructed on the parcel located at the immedi- ate intersection of Argosy Drive and Graham Street only, subject to the modifications described herein: a. The plan shall be revised to show the location of a wall around the northerly parking and loading area to screen such facility and parking spaces 9 through 18 from view from the arterial highway, Graham Street. b. Parking space #32 shown on the plan shall be deleted. C. The width of the entry into the loading area shall be in- creased and a landscaped area of minimum width of four (4) feet shall be provided along parking space 431. d. A minimum of 12'6" shall be provided for a reciprocal drive along the westerly property line for ingress -egress and reciprocal easement with the -parcel to the west. Said easement shall continue for a depth of 77 feet from the ultimate right-of-way on Argosy Drive. f. A common reciprocal driveway with a minimum width of 25 feet shall be provided, 1216" of which will be along the total width of the northerly property line of the subject property and 1216" along the southerly property line of the parcel to the north for a depth of 175 feet from the ultimate right-of-way line on Graham Street. g. Concurrence shall be obtained from the property owner to the west for an additional easement area which shall form a triangle along his northeast property line, to assure that the area adjacent to the reciprocal driveway which is to provide access from Graham will not be fenced and that there will be free and easy access to the fire hydrant proposed alongside parking space #45 for all emergency vehicles and occurrences. h. The plan shall reflect either a chain link fence with slat or a wall along the westerly property line from the most northerly point on the reciprocal driveway off Argosy to a point at the truck entry into the loading area. The changes and modifications outlined above shall be delineated upon the plot plan submitted to the Department of Building and Community Development upon application for building permits. 2. All applicable fees shall be paid prior to issuance of build- ing permits. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout, - Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Parkway areas shall be improved in compliance with the condi- tions imposed upon the approval of TT 8688. 2. Street trees shall be installed in compliance with the condi- tions imposed upon the approval of TT 6948. Minutes: H.B. Board of Zoning Adjustments Wednesday, November 29, 1978 Page Seven C. GENERAL CONDITIONS: 1. Parcel Map No. 77-19 shall be recorded prior to occupancy of the building. AYES: SPENCER, CROSBY, BURNEY NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 78-113 Applicant: Professional Design Concepts, Inc. To permit the construction of a 16,632 square foot industrial building located on the east side of Enterprise Lane, approxi- mately 300 feet north of Mountjoy Drive in an Ml, Light Industrial District. This request is covered by Exemption Declaration No. 74-150, adopted by the Planning Commission on November 19, 1974. Mr. Bissinger was present to represent the application. Chairman Crosby outlined the proposal to the Board. Mr. Bissinger stated that he had to eliminate an additional parking, space --to accommodate the lighting area, however, he further stated that the remaining parking was still within ordinance code conformance. Building setback along the "zero" property lot lines were discussed as well as the location of the overhead loading door. Board discussion ensued, and it was noted that the application was in compliance with Huntington Beach Ordinance Code requirements. ON MOTION BY CROSBY AND SECOND BY BURNEY ADMINISTRATIVE REVIEW NO. 78-113 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received November 2, 1978, shall be the approved layout, subject to the modifications described herein: a. The setback of the building along the "zero" lot lines along the southerly building line shall be a maximum of three (3) inches. Minutes: H.B. Board of Zoning Adjustments Wednesday, November 29, 1978 Page Eight b. The overhead loading door shall be set back a distance of twenty (20) feet from the right-of-way line. c. The loading area in back of the door shall be striped and posted "LOADING AND UNLOADING ONLY" for a distance of 45 feet from the right-of-way line. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following -issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment.
