TENTATIVE PARCEL MAP NO. 78-40
Applicant: David Silver
To permit division of one parcel of land into two (2) parcels
located on the west side,bf'Beach Boulevard, approximately 307
feet south of Cypress Avenue in an R2 and C4 District.
This request is covered by Negative Declaration No. 78-116.
Mr. Walker was present to -represent the application.
Chairman'Crosby informed Mr. Walker that the application had been
continued from the meeting of November 29, 1978 because the
applicant or his representative was not present to acknowledge
receipt of the suggested conditions of approval and that no
written communication was received by the Planning Department
acknowledging receipt'of the suggested conditions of approval.
Mr. Walker reviewed the suggested conditions of approval. Board
reviewed the proposed parcel map and found same to be within
Ordinance Code conformance. Board reviewed findings and conditions.

FINDINGS•
1. The proposed division of land into two parcels for purposes of
commercial and residential development is in compliance with
the size and shape of property necessary for common medium
density development.

2. The General Plan has set forth provisions for this type of land use
as well as setting forth objectives for implementation of this type
of use.
3. The property was previously studied for thisintensity of land use
at the time the land use designation for General- Commercial,
and medium density, was placed on subject property.
4. The size, depth, frontage, street width; -and other'design and improve-
ment features of the proposed subdivision are proposed -to be con-
structed in compliance with standard plans and specifications on
file with -the City as well as in compliance with -the State Map Act
and supplemental City Subdivision Ordinance.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF -SAID PARCELS FOR
ANY PURPOSE:
1. The tentative parcel map received by the'Planning Department
on November 13, 1978 shall be the approved layout.
2. A parcel man shall be filed with, and approved by, the Planning
Department and recorded with the Orange County Recorder.
3. Elm Street shall be dedicated to City standards at the time said
parcel is developed.
4. A copy of the recorded parcel map shall be filed with the
Planning Department and Department of Public Works.

TENTATIVE PARCEL MAP NO. 78-39

To permit division of one parcel of land into two (2) separate
parcels located on the south side of Bolsa Avenue approximately
900 feet east of Bolsa Chica Street in an Ml-A,Restricted Manu
facturing District.
This request is covered by Environmental Impact Report No. 73-16
approved by the City Council on March 18, 1974.
Mr. Paul Licata was present to represent the application. Mr.
Licata reviewed the suggested conditions of approval. The Board
informed the applicant that the parcel map as proposed would
create a non -conforming -structure and suggested that the appli-
cant revise his map to meet proper setbacks for the partially
completed structure. Secretary -Spencer informed the Board that
a structure must be setback a minimum of 15 feet or "Zero" feet
to meet Ordinance -Code requirements. Board suggested a one week
continuance to allow applicant time to revise the parcel map
to meet proper setback requirements. Applicant concurred with
continuance.

This request is covered by -Negative Declaration No. 76-16.
Messrs. Charles Hermansen-and Larry Johnson were present to repre-
sent the application. The -applicants reviewed the suggested con-
ditions of approval.
The,,Board reviewed the, -proposed parcel map and found same to be
within Ordinance Code conformance. Board reviewed findings and
conditions.

Mr. Gary Potter and Wally Nickel were present to represent the
application.
The Chairman opened the public hearing.
The Board informed the applicant that the site.plan would be reviewed
by the Planning Commission at its meeting of December 12, 1978
due to a condition of approval imposed on Zone Change No. 78-1
approved by the Planning Commission on June 6, 1978 stating
"A site plan shall be submitted to the Planning Commission for
approval,"prior to action by the Board of Zoning Adjustments.
Board reviewed the proposal. A shortage of open space, fire hydrant
location_, emergency access location, and relocation of several
parking stalls was discussed. The applicant was informed that
a revised plan should be submitted to the Planning Department
for review by.the Planning Commission and Board of Zoning Adjust-
ments depicting exact locations and dimensions of existing power
poles, existing fire hydrant, bringing open space into conformance,
nd relocation of several parking stalls.

public hearing was closed.

NOTE: Applicant is informed that the Fire Department will require
hydrants at both the southeasterly and the southwesterly property lines
as Well as either sprinklering of the building or separation to comply
with code standards.
2. The following plans shall be submitted to the Secretary of the
Board for review and approval:
a. Landscape and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works.
Said plan shall depict interior property line.trees as
20" box specimen trees located 30 feet on center.
b. Rooftop mechanical equipment screening plan. Said plan
shall indicate screening of all rooftop mechanical equip-
ment and shall delineate the type of material proposed
to screen said equipment.
C. East and north elevations, depicting special treatment
adjacent to the abutting residential properties.
B. GENERAL CONDITIONS:
1. Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units.
2. Low -volume heads shall be used on all spigots and water
faucets.
3. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.-
4. If outside lighting is included onsite, high-pressure
sodium vapor lamps shall be used to prevent "spillage"
onto adjacent areas and for energy savings.
5. The easterly driveway shall be increased to the width of
thirty (30) feet and shall incorporate radius type curb
returns per Department of Public Works standards.
