BOARD MEMBERS PRESENT: LIPPS, CROSBY, OTT BOARD MEMBERS ABSENT: NONE MINUTES: ON MOTION BY CROSBY AND SECOND BY OTT THE MINUTES OF THE REGULAR MEETING OF NOVEMBER 29, 1978, WERE APPROVED AS TRANSCRIBED BY THE FOLLOWING VOTE: AYES: CROSBY, OTT NOES: NONE ABSENT: NONE ABSTAIN: LIPPS REGULAR AGENDA ITEMS: TENTATIVE PARCEL MAP NO. 78-39 Applicant: Alfonso & Paul Licata (Cont. from 12/6/78) To permit division of one parcel of land into two (2) separate parcels located on the south side of 5olsa Avenue, approximately 900 feet east of Bolsa Chica Street in an MI -A, Restricted Manufacturing District. This request is covered by EIR 73-16, approved by the City Council on March 18, 1974. The applicant was not present. Chairman Crosby informed the Board that the applicant had acknowledged receipt of the suggested conditions of approval at the December 6, 1978 meeting. Board reviewed revised parcel map. It was the concurrence of the Board to continue this application for one week to allow staff time to research and compile proper findings. Board of Zoning Adjustments Wednesday, December 13, 1978 Page Two USE PERMIT NO. 78-69 (Cont. from 12/6/78) Applicant: Gary D. Potter To permit construction of a 32-unit apartment complex with attached parking located on the south side of Edinger Avenue, approximately 400 feet west of Bolsa Chica Street in an R3-Q zone. This request is covered by Negative Declaration No. 78-118. Secretary Lipps informed the Board that this plan was to be reviewed by the Planning Commission at its December 12, 1978 meeting due to a condition of approval -imposed on Zone Change No. 78-1 approved by the Planninq Commission on June 6, 1978 stating "A site plan shall be submitted to the Planning Commission for approval," prior to action by the Board of Zoning Adjustments. The Planning Commission, however, continued the item to its December 19, 1978 meeting and subsequently Use Permit No. 78-69 was rescheduled to the December 20, 1978 Board of Zoning Adjustments meeting. ON MOTION BY LIPPS AND SECOND BY CROSBY USE PERMIT NO. 78-69 WAS CONTINUED TO DECEMBER 20, 1978 BY THE FOLLOWING VOTE: AYES: LIPPS, CROSBY, OTT NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 78-114 (Cont. from 12/6/78) Applicant: Huntington Beach Company To permit construction of a self-service gasoline station to be located on the northeast corner of Yorktown Avenue and Goldenwest Street in a C2-CD-SS District. This request was covered by Environmental Impact Report No. 74-5. Secretary Lipps informed the Board that this plan was to be reviewed by the Planning Commission at its December 12, 1978 meeting due to a request made by the Planning Commission for such review at the October 3, 1978 approval of Zone Change No. 78-13 prior to action by the Board of Zoning Adjustments. The Planning Commission, how- ever, continued the item to its December 19, 1978 meeting and subsequently Administrative Review No. 78-114 was rescheduled to the December 20, 1978 Board of Zoning Adjustments meeting. Board of Zoning Adjustments Wednesday, December 13, 1978 Page Three CONDITIONAL EXCEPTION NO. 78-62 Applicant: Erik Lundquist To permit construction of 3 garages at ten (10) foot setback in lieu of the required 22 foot setback, in conjunction with con- struction of a new dwelling unit located at the southwest corner of Eleventh and Lake Streets in an R3, Medium High Density Resi- dential District. IN CONJUNCTION -WITH: USE PERMIT NO. 78-70 Applicant: Erik Lundquist To permit construction of a 689.75 square foot unit to a property containing one unit, abutting an arterial highway located at the southwest corner of Eleventh and Lake Streets in an R3, Medium High Density Residential District. Conditional Exception No. 78-62 is a categocial exemption, class 5, California Environmental Quality Act,_1970. Use Permit No. 78-70 is a categorical exemption, class 3, California Environmental Quality Act, 1970. Mr. Erik Lundquist was present to represent the application. Mr. Lundquist presented his proposal to the Board citing that he had been granted approval of the identical request approximately a year ago, but that his time limit for construction had run out, and subsequently had to file new applications. Chairman Crosby opened the public hearing. Board reviewed proposals. Alternatives to the proposal were discussed, as well as proper turning radius. The former approved applications (Use Permit No. 77-65 and Conditional Exception No. 77-44) were reviewed by the Board and further discussed. There being no other parties present to speak, the public hearing was closed. Board discussion ensued. Special circumstances existing on the subject property pose certain developmental constraints on the site: namely, a prior lot split has deprived the site of the original access to -,an alley which was previously afforded it; the lot split also resulfed in an unusual ratio of lot width to lot depth on the subject site; and there is a significant grade differential on the property. The reorientation of the project on the site.to comply with the setback requirements would severely _and•negati;vely±i' ac:r1.the ability to comply with open spade requirements. 3. There is a garage presently existing on the site at a.ten (10) foot setback to serve the existing dwelling unit, and revision to provide the required setback would necessitate significant altera- tion to that existing dwelling and garage. 4. ON MOTION BY CROSBY AND SECOND BY LIPPS USE PERMIT NO. 78-70 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOL- LOWING VOTE: FINDINGS OF THE BOARD:, 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: 1. The conceptual site plan received and dated November 16, 1978, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: Traffic circulation and drives; 'Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. All applicable fees shall be paid prior to issuance of building permits. AYES: LIPPS, CROSBY, OTT NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 78-115 Applicant: John D. Lusk & Son To permit construction of eight (8) industrial buildings with a total of 91,350 square feet to be located on the southwest corner of Springdale Street and Engineer Drive in an M1-A, Restricted Manufacturing District.. This request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Jerry Tarrant was present to represent the application. Secretary Lipps informed the Board that a plan check revealed that the proposal was within Ordinance Code conformance. Chairman Crosby made the applicant aware of the requirement of a ten foot easement for sidewalk purposes on Springdale Avenue. The applicant was also made aware that he was required to provide a minimum 30 foot wide radius type drive entry at the main access off Springdale Street, and a minimum 15 foot wide drive was required at the southerly access along Springdale Street. Board of Zoning Adjustments Wednesday, December 13, 1978 Page Six ON MOTION BY OTT AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 78-115 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received December 4, 1978 shall be the approved layout, subject to the modifications described herein: a. Show meandering sidewalk within the eighteen (18) foot pedestrian easement and right-of-way along Springdale Street. b. Provide a minimum thirty (30) foot wide radius type drive entry at main access off Springdale Street which conforms to Standard Plan 212 A & B on file in the Public Works Department. c. Provide a minimum fifteen (15) foot wide drive entry at the southerly access along Springdale Street. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. A reciprocal access agreement between this parcel and the parcel to the south shall be recorded and filed with the City prior to occupancy of the buildings AYES: LIPPS, CROSBY, OTT NOES: NONE ABSENT: NONE MISCELLANEOUS AGENDA ITEMS: TENTATIVE TRACT 8040 (Siting on Lots) Applicant: La Solana Corporation Siting of lots per previous conditions of approval for Tract 8040 located in Huntington Harbour in an R1, Low Density Residential District. The Board reviewed the plot plans submitted for Lot 18 of the tract. ON MOTION BY OTT AND SECOND BY LIPPS THE LAYOUT SUBMITTED DECEMBER 13, 1978, WAS APPROVED BY THE FOLLOWING VOTE: AYES: LIPPS, CROSBY, OTT NOES: NONE ABSENT: NONE THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED.
