BOARD MEMBERS: LIPPS (SPENCER 1:45 p.m.), CROSBY, BURNEY MINUTES: ON MOTION BY CROSBY AND SECOND BY LIPPS, THE MINUTES OF THE REGULAR MEETING OF DECEMBER 6, 1978, WERE TABLED AND THE MINUTES OF THE REGULAR MEETING OF DECEMBER 13, 1978, WERE APPROVED AS TRANSCRIBED BY THE FOLLOWING VOTE: AYES: Lipps, Crosby NOES: None ABSENT: None ABSTAIN: Burney REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 78-63 Applicant: John D. Lusk & Son Company To permit reduction in front yard setback to five (5) feet located on the south side of Engineer Drive, east of Graham Street (Lot 6). IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 78-103 (Continued from 11/22/78) Applicant: John D. Lusk & Son Company To permit construction of an 11,760 square foot industrial building on property located on the south side of Engineer Drive, east of Graham Street (Lot 6). Conditional Exception No. 78-63 is a Class 5 Categorical Exemption of the California Environmental Quality Act, 1970. Administrative Review No. 78-103 is covered by Environmental Impact Report 73-16 which was adopted by the City Council on March 18, 1974. Acting Secretary Lipps announced that Administrative Review No. 78-103 had been continued to allow the applicant time to revise plan and to file conditional exception application. No plans were included in the Conditional Exception file but the Board would review the plans included with the Administrative Review file. Chairman Crosby opened the public hearing on Conditional Exception No. 78-63. Minutes: H.B. Board of Zoning Adjustments Wednesday, December 20, 1978 Page 2 Mr. Arthur Williams, owner of Lot 17, and Mr. George Dube', representing the owner of Lot #2, questioned the Board and applicant regarding the nature of the applications filed. Both were in opposition to the proposal as presented. Mr. Dan MacLellan, applicant representative, explained the proposal as being only a 35 square foot encroachment with additional landscaping being provided to offset the setback deficiency. There being no other parties present to speak, the public hearing was closed. Board discussion ensued. ON MOTION BY CROSBY AND SECOND BY LIPPS CONDITIONAL EXCEPTION NO. 78-63 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. Due to the shape and configuration of the lot, (ranting_ of the conditional exception does not: constitute the clrantinq of any special privilege of the property. 2. ON MOTION BY CROSBY AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 78-103 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The conceptual site plan received and dated October 30, 1978, shall be the approved layout. 2. Prior to the issuance of building permits, the approved layout shall be revised to more clearly define the lot lines and shall be submitted to the Planning Department for inclusion in the Administrative Review file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan. Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 3. The following plans shall be submitted to the Secretary of the Board prior to issuance of building permits: a. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. Lusk & Son Company To permit construction of a 10,680 square foot industrial building located on the north side of Engineer Drive, east of Graham Street (Lot 9). Conditional Exception No. 78-64 is a Class 5, Categorical Exemption, California Environmental Quality Act, 1970. Administrative Review No. 78-106 is covered by Environmental Impact Report 73-16 which was adopted by the City Council on March 18, 1974. Due to the shape and configuration of the lot, granting of the conditional exception does not constitute the granting of any special privilege of the property. 2. The request entails only the encroachment of 35+ square feet of building area. 3. Strict compliance with the Ordinance Code would impose a greater overall average setback than that required of other developments in the vicinity. 4. The item had been continued from December 13, 1978, at the request of the Planning Commission which had reviewed the project and had found no problems. Mr. Spencer arrived and assumed the duties of the Secretary. Mr. Lipps subsequently left the meeting. A modified plan was displayed and Wally Nickle, representing the applicant, noted the revisions. There being no other parties present to speak, the public hearing was closed. Secretary Spencer stated that the Planning Commission had requested the opportunity to review the project in relation to the ultimate plans for the site. Mr. Clyde Carpenter asked for clarification of this point and requested to be notified of pending meetings on the project. This application is covered by Negative Declaration No. 78-96 approved November 21, 1978, by the Planning Commission. ON MOTION BY CROSBY AND SECOND BY SPENCER, TENTATIVE PARCEL MAP NO. 78-42 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS: 1. The proposed division of one (1) residential parcel into two (2) parcels for purposes of residential development is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for Medium Density Residential was placed on the property. 4. The size, depth, frontage, street width, and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with the State Map Act and supplemental City Subdivision Ordinance. To permit the modification of an existing service station located on the southeast corner of Bolsa Avenue and Springdale Street. Mr. Clyde Carpenter, representing the applicant, was present and requested receipt of conditions of approval for this project. Board discussion ensued. The Planning Commission requested the Planning Department to obtain a legal opinion on the use of the American flag at the service station. The site plan received November 27, 1978, shall be the approved layout, subject to the modifications described herein: a. Lighting and signing must meet the criteria as outlined in the Ordinance Code. b. Driveway approach on Springdale Street shall be radius type. C. Fire hydrant shall be relocated and subject to Fire Department approval. d. Section 948, Service Station Standards, of the Huntington Beach Ordinance Code shall be complied with. No one was present to speak for or against the proposal. Mr. Palmer had requested continuance to the meeting of December 27, 1978. The public hearing was closed. ON MOTION BY SPENCER AND SECOND BY BURNEY, USE PERMIT NO. 78-71 WAS CONTINUED TO DECEMBER 27, 1978, AT THE APPLICANT'S REQUEST BY THE FOLLOWING VOTE: AYES: Crosby, Spencer, Burney NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 78-118 Applicant: Circus Vargas by Ralph Oliver To permit a special event in order to allow a circus to be held between March 8 and March 13, 1979, in the parking lot at Huntington Center located on Edinger Avenue at Beach Boulevard. This special event is a Categorical Exemption, Class 4, California Environmental Quality Act, 1970. Mr. Oliver was present to answer any questions from the Board. The Fire Department had several concerns which were incorporated into the conditions of approval for the proposal. ON MOTION BY SPENCER AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 78-118 WAS APPROVED BY THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received December 5, 1978, shall be the approved layout. 2. A complete plot plan delineating access and its relationship to buildings and operation of the tent activities shall be submitted to the Fire Department. All exit dimensions shall be indicated on this plan. 3. Prior to issuance of building permits, applicant shall obtain approval of the new detailed site plan from the Fire Department. 4. The applicant shall obtain all necessary electrical permits. 5. An on -site inspection by the Fire Department shall be required prior to the event. 6. A certificate of insurance form shall be filed in the License Division of the Finance Department ten (10) days prior to the event. Minutes: H.B. Secretary Spencer indicated that the plan now substantially meets Code requirements as the lot line has been revised. Board discussion followed. ON MOTION BY SPENCER AND SECOND BY CROSBY, TENTATIVE PARCEL MAP NO. 78-39 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS: 1. The proposed division of one (1) individual parcel into two (2) parcels for purposes of industrial development is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for Restricted Manufacturing, which allows industrial buildings, was placed on subject property. 11 1 4. The size, depth, frontage, street width, and other design and improve- ment features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: 1. The tentative parcel map received by the Planning Department on December 12, 1978, shall be the approved layout. 2. A parcel map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County Recorder prior to issuance of building permits. Minutes: H.B. A reciprocal easement for parking and a fire lane on the rear of the parcels must be submitted and approved by the Fire Department, and recorded with the Orange County Recorder prior to issuance of buildinq permits. 4. Copies of the recorded parcel map shall be filed with the Planning Department and the Department of Public Works.
