BOARD MEMBERS: SPENCER, CROSBY, OTT MINUTES: ON MOTION BY SPENCER AND SECOND BY CROSBY THE MINUTES OF THE REGULAR MEETING OF JANUARY 17, 1979 WERE APPROVED BY THE FOLLOWING VOTE: AYES: Spencer, Crosby, NOES: None ABSENT: None ABSTAIN: Ott REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 79-1 Applicant: Erminio H. Tafarella To permit a reduction in open space dimension from 20 ft. to 18 ft. located at 21031 Beckwourth Circle, at the west side of Beckwourth Circle, approximately 161 feet north of Cornerbrook Drive. This application is a Class 5 Exemption, California Environmental Quality Act, 1970. Mr. Tafarella, the applicant, was present. The Chairman outlined the proposal to the Board. The public hearing was opened. Mr. Tafarella outlined his justification to the Board stating that he had bought his home with the existing room addition and now attempted to acquire proper permits for the addition. Secretary Spencer stated that the applicant actually exceeded the open space requirements. Board discussion ensued. There being no other parties present to speak on the application, the public hearing was closed. Findings and reasons for approval were discussed. ON MOTION BY SPENCER AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 79-1 WAS APPROVED WITH THE FOLLOWING FINDINGS AND REASONS, BY THE FOLLOWING VOTE: Minutes: H.B. The granting of the Conditional Exception will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 2. The proposed project does not have a significant effect on adjacent properties. 3. The qranting of the Conditional Exception will not adversely affect the General Plan of the Citv of Huntington Beach. REASON FOR APPROVAL: 1. The applicant is required to provide 900 square feet of open space with a 20 foot dimension and on the proposed plan, he provides 516 square feet with that minimum dimension plus 648 square feet with an 18 foot dimension for a total of 1164 square feet. Therefore, the proposal exceeds the minimum required square footage for open space. AYES: Spencer, Crosby, Ott NOES: None ABSENT: None USE PERMIT NO, 78-73 Applicant: James L. Foxx To permit remodeling of an existing structure and the construction of a new structure on contiguous properties. Subject property is located at the northwest corner of Seventeenth Street and Olive Avenue. This request is covered by Negative Declaration No. 78-92, approved by the Planning Commission on October 3, 1978. Mr. Warren James was present to represent the application. The Chairman outlined the proposal to the Board. The public hearing was opened. Secretary Spencer outlined to the applicant that the proposed plan showed a deficiency in parking stall dimension. Mr. Spencer further outlined various alternatives the applicant could pursue in correctinq the deficiency. There being no other parties present to sneak on the application, the ?public hearing was closed. Board dis.cussion ensued. Findings and conditions of approval were discussed. Minutes: H.B. Board of Zoning Adjustments Wednesday, January 24, 1979 Page Three ON MOTION BY SPENCER AND SECOND BY OTT USE PERMIT NO. 78-73 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS• 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received January 12, 1979, shall be the approved layout, subject to the modifi- cation described herein: a. Revised plan shall meet parking requirements of both Article 945 and 979 of the Huntington Beach Ordinance Code. A plan delineating said modification shall be submitted to the Secretary of the Board. If such plan complies with the modification outlined by the Board, said nlan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan; Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical , equipment and shall delineate the type of material proposed to screen said equipment. B. GENERAL CONDITIONS: 1. The one (1) tandem parking space shall be designated as employee parking. 2. The driveway approaches along 17th Street shall be removed. 3. If a lot line adjustment is proposed, a tentative parcel map shall be filed and approved prior to the issuance of building permits. Final parcel map shall be recorded prior to certificate of occupancy being granted. AYES: Spencer, Crosby, Ott NOES: None ABSENT: None MISCELLANEOUS AGENDA ITEMS: ADMINISTRATIVE REVIEW NO. 78-49 - REVISED ELEVATIONS Applicant: William B. Burke To permit construction of a 160,601 square foot industrial development located on the southeast corner of Heil Avenue and Gothard Street. Board reviewed revised elevations dated January 22, 1979 and found same to be within Ordinance Code conformance. ON MOTION BY SPENCER AND SECOND BY CROSBY, REVISED ELEVATIONS FOR ADMINISTRATIVE REVIEW NO. 78-49 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Spencer, Crosby, Ott NOES: None ABSENT: None Minutes: H.B. Board of Zoning Adjustments Wednesday, January 24, 1979 Page Five ADMINISTRATIVE REVIEW NO. 78-66 - REVISED SITE PLAN Applicant: Stephen Davis To permit construction of a 2,072 square foot office building located on the south side of Walnut Avenue, approximately 50 feet west of Third Street. Secretary Spencer stated that the loading area as previously approved by the Board was not acceptable by the Coastal Commission, therefore,the applicant had revised his plans to meet the require- ments set forth by the Coastal Commission. Board reviewed the revised site plan dated January 10, 1979 and found same to be within Ordinance Code conformance. ON MOTION BY SPENCER AND SECOND BY OTT, REVISED SITE PLAN FOR ADMINISTRATIVE REVIEW NO. 78-66 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Spencer, Crosby, Ott NOES: None ABSENT: None EL CAMINO REAL RESTAURANT - ADDITION (Use Permit No. 75-16) Mr. Fred Scalzo addressed the Board and presented a possible proposal to the Board. He stated that the restaurant is contem- plating enclosing a portion of the outdoor area, however, no seating increase is proposed. The Board reviewed his proposal. Secretary Spencer stated that the concept as presented was in order, and that he would have to present an architectural rendering to the Secretary of the Board depicting precise elevations for consideration by the Board.
