BOARD MEMBERS: LIPPS, CROSBY, BURNEY REGULAR AGENDA ITEMS: USE PERMIT NO. 79-1 Applicant: La Cuesta Tract 7596 To permit the construction of a 76 unit apartment building located at the northwest corner of Atlanta and extension of Delaware. This request is covered by Environmental Impact Report No. 78-1, approved July 18, 1978. Chairman Crosby introduced the application to the Board. The public hearing was opened. Mr. Ren Newcomb was present to represent the application. Secretary Lipps stated that the plan check showed no significant. deficiencies to the proposal. He did state, however, that a slight problem existed with building separation between carports and driveway unit, however, parking and open space requirements were within ordinance code conformance. Secretary Lipps further noted that the trash disposal area would have to be relocated and that it would be made part of the conditions of approval. There being no parties present to speak for or against the application, the public hearing was closed. Board discussion ensued. Findings and conditions of approval were discussed. ON MOTION BY LIPPS AND.SECOND BY CROSBY, USE PERMIT NO. 79-1 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE:' FINDINGS: 1. The establishment, maintenance, and operation of the use will not be detrimental -to: a. The general welfare -of persons residing or working in the vicinity; b. The granting of a Use Permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A." TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan and elevations received January 30, 1978, shall be the approved layout, subject to the modification described herein: a. Show location of trash receptacle areas. A plan delineating said modification shall be submitted to the Secretary of the Board. If such plan complies with the ,modification outlined by the Board, said plan shall be ap- proved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. A landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works shall be submitted to the Secretary of the Board. 3. Building elevations shall be submitted to the Secretary of the Board for approval prior to issuance of permits. B. GENERAL CONDITIONS: 1. All requirements of Article 916 of the Huntington Beach Ordinance Code shall be complied with. 2. No structures, including fences or walls, shall be added without further review by the Board of Zoning Adjustments. AYES: Lipps, Crosby, Burney NOES: None ABSENT: None Minutes: H.B. Board of Zoning Adjustments Wednesday, January 31, 1979 Page Three USE PERMIT NO. 78-62 Applicant: Department of Recreation, Parks, & Human Services City of Huntington Beach To permit the landscaping of the Newland House located at 16820 Beach Boulevard (east side of Beach Boulevard, approximately 1/4 mile north of Adams Avenue). This application is covered by Negative Declaration No. 78-113. Chairman Crosby outlined the proposal to the Board. The Chairman opened the public hearing. Mrs. Shirley Kerins was present to represent the application. Mrs. Kerins stated that she was the landscape designer of the project, then gave a brief history of the Newland House. She stated that the Historical Society had asked her to draw the landscaping plans for the Newland House, which is City -owned property, however, is operated by the Historical Society. She stated that she attempted to reproduce landscaping of a farm house of that period, however, public access to property and the large amount of visitors anticipated were considered when the plans were drawn. Mrs. Kerins further stated that it was not her intention to harm the archaeology in any way. She asked an archaeology expert whether it was alright to plant trees, etc. and he found no objection to the planting of trees. She further pointed out the most sensitive areas where archaeological finds could be made. Mrs. Kerins then presented overlays to the proposed plan and concluded by stating that it was her intention, after working two years on the landscaping project, to present a thoughtful and sensitive way to preserve the historical and archaeological aspects of the Newland House. Mr. Jim Barnes, of the Planning Department, addressed the Board. Mr. Barnes gave a brief background of the City's involvement in the proposal. In August, 1977, the City determined that a use permit application should be filed for the landscaping proposal subject to Code Section 9730.31. The City's Environmental Review Committee addressed the project at their December 18, 1978 meeting at which time they adopted a motion to recommend to the BZA that a negative declaration be issued subject to the completion of a test level archaeological investigation upon the site whereby the archaeological investigation recommended by the Environmental Review Committee shall consist of field tests on approximately 5 or 6 percent of the site and the preparation of a written report analyzing material collected during the field tests. Discussion ensued regarding the method of financing of the test level archaeological report. Minutes: H.B. Board of Zoning Adjustments Wednesday, January 31, 1979 Page Four Mr. Franklin G. Chapel Jr. addressed the Board and stated that he is the President of the Pacific Coast Archaeological Society, a non-profit educational institution of avocat'ional and professional people interested in archaeology. Mr. Chapel proceeded to review some of the history of the Newland House property stating that in December 1972 and January 1973 a series of excavations were performed along the bluffs on which the Newland House stands. These excavations identified the House as being in the center of one of the four aboriginal middens located along the bluff, and further expressed the importance of the materials on which the House stands. Mr. Chapel further stated that when the planting of three trees came to his attention'in the spring of 1977, his organization began a salvage excavation'at the Newland House under scientific direction. The Pacific Coast Archaeological Society members worked weekends excavating'the ground; however, the work of cleaning, catalogueing and analyzing the materials is in process at'this time. Mr. Chapel "further stated that at'the'December'18; 1978'Environmental Review Committee meeting, the Restoration Committee, the Capistrano Indian Council, and the Pacific,Coast Archaeological Society presented their case. The final outcome was aIunariimou's recommendation by the three-man committee to require a scientific investigation of the midden, even though no funds were available for the project. Mr. Chapel concluded by stating that his interest in the archaeology of this site has,been well demonstrated and that the Society for California Archaeology has volunteered to perform the'actual excavation for the test level archaeological investigation upon the site. However, funds are not available for the laboratory testing'at this Itime. Time limits for the excavation report were discussed'. Mr,. Chapel stated that he was agreeable for landscaping to proceed in the minimum sensitive areas; however, he''expressed great concern about the irrigation system pipe placement. Ms. Constance Cameron addressed the Board and cited concern over, the disturbance of possible Indian burial grounds. There being no further parties present to speak on the application, the public hearing was closed. Mr. Jim Barnes suggested that the Board defer a decision on the use permit until such time that the report has been completed and subject to the findings of the archaeological study. Mr. Vic Morris of the Recreation and Parks Department stated that he has inquired about receiving a federal grant to finance the laboratory work of the suggested scientific study. Minutes: H.B. Board of Zoning Adjustments Wednesday, January 31, 1979 Page Five ON MOTION BY CROSBY AND SECOND BY LIPPS, NEGATIVE DECLARATION NO. 78-113 WAS APPROVED WITH THE RECOMMENDATION THAT A TEST LEVEL ARCHAEOLOGICAL INVESTIGATION BE COMPLETED UPON THE SITE. THE ARCHAEOLOGICAL INVESTIGATION RECOMMENDED BY THE ENVIRONMENTAL REVIEW COMMITTEE AND SHALL CONSIST OF FIELD TESTS ON APPROXIMATELY 5 OR 6 PERCENT OF THE SITE AND THE PREPARATION OF A WRITTEN REPORT ANALYZING MATERIAL COLLECTED DURING*THE FIELD TESTS BY THE FOLLOWING VOTE: AYES: Lipps, Crosby, Burney NOES: None ABSENT: None It was the consensus of the Board to continue Use Permit No. 78-62 indefinetely to allow for the completion and submission of the report to the Board. Foxx To permit remodeling of an -existing structure and the construction of a new structure on contiguous properties located at the north- west corner of Seventeenth Street and Olive Avenue. Secretary Lipps stated that this application was being recon- sidered to be heard in conjunction with Conditional Exception No. 79-4 and Tentative Parcel Map No. 79-554.
