This application is covered by Negative Declaration No. 79-1. ON MOTION BY CROSBY AND SECOND BY LIPPS THE BOARD, HAVING FOUrD THAT THE PROPOSED PROJECT WILL NOT HPVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 79-1 WITH THE MITIGATING MEASURES CONTAINED IN ADMINISTRATIVE REVIEW NO. 79-3 GENERAL CONDITION NO. 1 IMPOSED ON THE ADMINI- STRATIVE REVIEW, BY THE FOLLOWING VOTE: AYES: Lipps, Crosby, Burney NOES: None ABSENT: None Mr. King You Chai, the applicant, and Mr. Richard Hull, were present to represent the application. Secretary Lipps stated that the proposal was within substantial code conformance. However, he stated concern over the location of a parking space which may possibly hinder proper maneuverability around the driveway and suggested that parking space #28 be re- moved entirely. The applicant had no objection to this proposal. The applicant was further made aware of the requirement of a parcel map on subject property. Minutes: H.B. Board of Zoning Adjustments Wednesday, February 7, 1979 Page Two Chuck Burney, representing the Fire Department, made the ap- plicant aware of the necessity of fire hydrants and their location and the requirement of water main extensions. Conditions of approval were discussed. ON MOTION BY CROSBY AND SECOND BY BURNEY ADMINISTRATIVE REVIEW NO. 79-3 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received January 2, 1979, shall be the approved layout, subject to the modifica- tions described herein: a. Parking space 428 located at the southwesterly corner of the site shall be removed and replaced with land- scaping. b. Parking space 416 located at the northwesterly corner of the site shall be removed and relocated adjacent to the building and the landscaping at that location shall be relocated into the area originally shown as parking space 416. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following idsues relating to the conceptual plan: Traffic circulation and drives; Parking layout; ii Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. Minutes: H.B. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. C. Submit lighting plan to the Secretary of the Board of Zoning Adjustments for approval prior to issuance of Building Permits. B. GENERAL CONDITIONS: 1. All standard mitigating measures as recommended by Negative Declaration No. 79-1 shall be complied with. 2. Any proposed signing shall comply with Article 976 of the Huntington Beach Ordinance Code. 3. A parcel map consolidating Parcels 7 and 8 into one parcel shall be recorded prior to issuance of building permits. Schmidt To permit the construction of a 10,376 square foot industrial building located on the south side of Slater Avenue, approximately 385 feet west of Morgan Lane. IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 79-4 Applicant: Gary M. Schmidt To permit the construction of a 4,737 square foot industrial building located on the south side of Slater Avenue, approximately 330 feet west of Morgan Lane. These applications are covered by Negative Declaration No. 79-7. ON MOTION BY LIPPS AND SECOND BY CROSBY THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECTS WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 79-7 WITH THE MITIGATING MEASURES CONTAINED IN ADMINISTRATIVE REVIEW NOS. 79-1 AND 79-4 GENERAL CONDITIONS NO. 5 THROUGH 10 IMPOSED ON THE ADMINISTRATIVE REVIEWS, BY THE FOLLOWING VOTE: AYES: Lipps, Crosby, Burney NOES: None ABSENT: None Minutes: H.B. Board of Zoning Adjustments Wednesday, February 7, 1979 Page Four Mr. Gary Schmidt, the applicant, was present. The Chairman outlined the proposals to the Board. Chairman Crosby presented a recommendation from the City Engineer to the Board whereby a reciprocal easement between the two properties be provided to aid with ease of entry to the project and to provide better circulation throughout the proposals. Mr. Schmidt stated that the intended use_of the proposed _buildings was for light industrial shops and that no automotive uses were proposed. Conditions of approval were discussed. ON MOTION BY LIPPS AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 79-1 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The driveway approach shall be designed to Public Works standards and be relocated so that the center line of the drive is along the easterly property line of this parcel. GENERAL CONDITIONS: 1. A reciprocal parking and access agreement between this parcel and Parcel 42, shall be recorded prior to issuance of a certificate of occupancy. 2. No parking signs shall be posted along the wall separating Parcel 41 and Parcel 42. Size and location of signs to be approved by the Fire Department. 3. Any storage of dismantled or inoperative vehicles shall be limited to the excess parking spaces along the rear property line. 4. No structures, including fences and walls, other than those shown on the approved plot plan shall be erected without approval of the Board of Zoning Adjustments. 5. Natural ga$ shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 6. Low volume heads shall be used on all spigots and water faucets. 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 8. If lighting is included in the parking lot,high pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 9. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Department. 10. The applicant was not present. The Chairman noted that since the applicant did not acknowledge receipt of the suggested conditions of approval, either written or oral, the Board had no alternative but to continue the application to allow applicant to respond to the suggested conditions of approval. ON MOTION BY CROSBY AND SECOND BY LIPPS, TENTATIVE PARCEL MAP NO. 79-552 WAS CONTINUED TO FEBRUARY 14, 1979, BY THE FOLLOWING VOTE: AYES: Crosby, Lipps, Burney NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 79-2 Applicant: Paul Ledbetter To permit the reduction in minimum dimension for private open space located on the west side of Cameron Street, approximately 1400 feet north of Newman Avenue. IN CONJUNCTION WITH: USE PERMIT NO. 79-2 Applicant: Paul Ledbetter To permit the construction of a six (6) unit apartment building located on the west side of Cameron Street, approximately 1400 feet north of Newman Avenue. Mr. Ledbetter, the applicant, Bob Fowler, and John Hartman, were present to represent the application. The Chairman opened the public hearing on Conditional Exception No. 79-2 and Use Permit No. 79-2. Chairman Crosby outlined the proposals to the Board. Secretary Lipps stated that the applicant has provided a total square footage of open space greater than that required by the ordinance code, and that a similar exception has been granted in the vicinity, thus establishaent of a Precedence has commenced. Mr. Fowler further outlined justification for a conditional exception by stating that the unusal shape of the property makes development difficult. Mr. Fowler then addressed himself to the use permit request and stated that he has attempted to design the proposal with little disturbance to the neighbors by providing no windows facing adjacent property owners, providing private patio areas,and a play yard in the rear that will be fenced. There being no other parties present to speak on the application, the Chairman closed the public hearing on Conditional Exception No. 79-2 and Use Permit No. 79-2. J L, J Minutes: H.B. ON MOTION BY LIPPS AND SECOND BY BURNEY CONDITIONAL EXCEPTION NO. 79-2 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS• 1. The size of the lot and its ratio of depth to width are such ,.to impose physical restraint upon its development. The appli- cant has provided a total square footage of open space greater than that required by ordinance code. 2. Precedence for exception of open space requirements has been established in this neighborhood. 3. The granting of a conditional exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 4. The granting of a conditional exception will not be materially detrimental to the public welfare, or injurious to property in the same zone classification. 5. The granting of the conditional exception will not adversely affect the Master Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: 1. The conceptual plot plan and elevations received January 15, 1979, shall be the approved layout. 2. All conditions of approval of Use Permit No. 79-2 shall apply to this application. AYES: Lapps, Crosby, Burney NOES: None ABSENT: None ON MOTION BY LIPPS AND SECOND BY CROSBY, USE PERMIT NO. 79-2 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: Minutes: H.B. Board of Zoning Adjustments Wednesday, February 7, 1979 Page Ten FINDINGS: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 4. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received January 15, 1979, shall be the approved layout, subject to the modifications described herein: a. Revise plan to reflect true dimensions after ten (10) foot dedication along Cameron St. b. Revise plan to reflect relocation of stairway at north- westerly corner of Building 41 to provide area to relocate parking space #9 east of the westerly line of said building. c. Revise plan to reflect reduction in bedroom count to 8 - 2 bedroom units and 2 - 1 bedroom units. d. Revise parking layout at westerly end of site. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. No other structures including fences and walls shall be con- structed upon the site without approval of the Board of Zoning Adjustments. 4. Mitigating measures Nos. 1, 2, 3, 4, and 7 as recommended in Negative Declaration No. 78-42, shall be complied with. 5. Prior to issuance of Building Permits, the applicant shall file with the City and record with the County, an irrevocable offer of dedication to provide for a common reciprocal drive in the future with the property to the north. Said offer shall be to the approval of the Office of the City Attorney as to form and content. Board of Zoning Adjustments Wednesday, February 7, 1979 Page Twelve ON MOTION BY CROSBY AND SECOND BY LIPPS, BOARD INCORPORATED FOLLOWING FINDINGS OF APPROVAL INTO PREVIOUSLY APPROVED CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: FINDINGS• 1. The proposed consolidation of three (3) lots into one (1) parcel for purposes of office professional development is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for office -professional commercial which allows professional buildings, was placed on subject property. 4. The size, depth, frontage, street width, and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifi- cations on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance.
