The public hearing on this continued item remains open; however, there were no persons present to address the Commission on the requests, and the public hearing was closed. Savoy Bellavia informed the Commission that the applicant has re- quested that his tentative tract application be withdrawn; the tentative parcel map filed for the parcel will be revised and a different proposal may be submitted for the site at a later date. Savoy Bellavia addressed the Commission to outline two suggested addi- tional conditions of approval which the Fire Department would like incorporated into any approval of this project; he also noted that a condition should be added prohibiting recreational vehicles within the project. The public hearing on all phases of the request was opened. Bill Wonacott addressed the Commission in support of the proposal. There being no other, persons present to speak in regard to the project, the public hearing was closed. The Commission reviewed the Fire Department's additional proposals and found them acceptable. The special permits needed for the project were also discussed and approved.- Commissioner Higgins expressed the opinion that this particular project points up the need for a special ordinance for small planned residential developments or condominium projects, noting that excessive amounts of paving and recreational open space for such small developments result from applying the existing PRD requirements to their design. The granting of a special permit will promote a better living en- vironment. 2. The granting of a special permit will provide better land planning techniques.with maximum use of aesthetically pleasing types of architecture, landscaping, site layout and design. 3.- The granting of the special permit will not be detrimental to the general health, welfare, safety, and convenience of the neighbor- hood or City in general. 4. The granting of this special permit will maintain the objectives of the Planned Residential Development standards in achieving a development adapted to the terrain and compatibility with the sur- rounding environment. CONDITIONS OF APPROVAL: 1. The site plan received and dated March 7, 1979, shall,be the approved layout. The floor plans and building elevations received and dated January 26, 1979, shall be!the approved floor plans and elevations. 2. All of the onsite streets shall be designated as approved fire lanes and parking shall be permitted only in those areas designated as parking spaces on the approved site plan. 3. The CC&Rs and the Association Rules for the project shall prohibit storage of recreational vehicles within the planned residential development. " 4. Natural gas and 220V electrical shall be stubbed in at locations of clothes dryers, cooking facilities, water heater, and central heating units. 5. Low -volume heads shall be used on all spigots and water faucets. 6. All building spoils, such as unused lumber, wire, pipe, and other surplus or unusable materials shall'be disposed of at an offsite facility euqipped to handle them. 7. All structures on the subject property, whether attached or detached, shall be constructed in compliance with the State acoustical stand- ards set forth for units that lie within the 60 CNEL contours of -3- 3-20-79 - P.C. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, with the application for building permits. 8. If lighting is included in the parking areas, high-pressure sodium vapor lamps shall be used for energy saving. All outside lighting shall be directed to prevent spillage onto adjacent property. 9. A detailed soil analysis shall be prepared by a registered soils engineer. This analysis shall include onsite soil sampling and laboratory testing of materials to provide detailed recommenda- tions regarding grading, chemical and fill properties, founda- tions, retaining walls, streets, and utilities. All access rights along Heil Avenue shall be dedicated to the City of Huntington Beach except for the areas designated on the approved site plan as points of ingress and egress for the project. 7. An underground conduit shall be installed per the Department of Public Works standards to accommodate the erection of a traffic signal at the intersection of Algonquin Street and Heil Avenue. AYES: Higgins, Russell, Stern, Finley, Cohen, Bazil NOES: None' ABSENT: Paone ABSTAIN: None TENTATIVE TRACT 10658/CONDITIONAL USE PERMIT NO. 79-3/NEGATIVE DECLARATION NO. 79-8 Applicant: Charles Hermansen & Frank Woolsey To permit construction of 120 condominium units within a one -lot subdivision located on the southwest corner of Heil Avenue and Green Street. Savoy Bellavia informed the Commission that on this map as well the Fire Department is requesting added conditions regarding inner turning radii and street designation as approved fire lanes. The public hearing was opened on all phases of this request. Craig Combs, architect for the development, addressed the Commis- sion in support of the project. He asked for relief from the provisions of proposed condition of approval No. 5, which required gas and 220V electrical stub -ins for appliances, describing the "hydronics" system the developer is proposing for water and area heating purposes which in his opinion would preclude the need for the condition. There were no other persons to speak in regard to the project, and the public hearing was closed. The Commission discussed the applicant's proposed heating system, considering the future availability of alternative energy sources, cost to users, and possible -energy savings. It was the consensus that the condition should be retained but with some flexibility to allow the developer to provide staff with statistics and further information on the system. Commissioner Cohen expressed concern with the revenue vs. expendi- ture ratios of developments of this nature and discussed the timing on the proposed fiscal impact model; Mr. Palin reviewed -5- 3-20-79 - P.C. Minutes, H.B. Planning Commission March 20, 1979 Page 6 the progress of the contractual arrangements for that study. Ron Lacher informed the Commission that sewers in the area are adequate to accept the proposed development. Commissioner Stern discussed problem areas in the proposal; namely, the distances from some of the units to their assigned parking spaces and the proximity of the main entry off Green Street to Heil Avenue, which he felt could create a bad traffic situation. Craig Combs said.that no distance from parking to units is greater than 200 feet, an acceptable distance in their experience. He added that it is planned to install dumb waiters for the second story units to aid residents in transporting groceries, etc. Commissioner Bazil indicated his opinion that the distance of the entry street from Heil Avenue should not pose a problem since the entry is from a residential street. Savoy Bellavia informed the Commission that this distance may change slightly, as the staff is requesting.the Commission for authorization to work with the Fire Department and the developer to try to reduce the width of the drive; this would cut down on the amount of paved surface and also increase the open space area. Mr. Combs expressed his willingness to continue to work with the City staff in this regard. The proposed subdivision of this 8.3 acre parcel of land, zoned R2 which allows 15 units per gross acre, is proposed to be developed at 14.4 units per gross acre. 2. The site plan received and dated February 28, 1979, shall be the approved layout as amended and revised to reflect the corrections to interior turning radii on all streets as required by the Fire Department at the February 22, 1979, Subdivision Committee meeting. This revised plan shall also reflect a reduction in the width of the main entry drive from 68 to 47 feet of paved area, or to a width mutually acceptable to the Fire and Planning Departments. 2. All of the onsite streets shall be designated as approved fire lanes and parking shall be permitted only in those areas designated as parking spaces on the approved site plan. 3. The exterior elevations of all buildings proposed for construction within the project shall comply with the architectural design of the units submitted in conjunction with the site plan and tentative map. 4. The CC&Rs and association rules shall prohibit the storage of recreational vehicles within the planned residential development. Natural gas and 220V electrical shall be stubbed in at all locations of clothes dryers, cooking facilities, water heaters, and central heating units within the project except that if the developer can present adequate statistical information in regard to energy saving and cost effectiveness of his proposed "hydronics" system the staff is authorized to amend or modify this condition accordingly. 6. The public hearing on the zone change and the negative declaration was opened; there were no persons to address the Commission in regard to the proposal, and the public hearing was closed. The Commission reviewed the request in light of both Council and Commission actions on the subject parcels during approval of General Plan Amendment 79-1. The Land Use Element.of the General Plan designated the sub- ject properties for medium density residential use. 2. The R2 zoning district is consistent with the adopted General Plan designation. 3. The public hearing was opened; there were no persons present to address the Commission on the proposed zone change, and the public hearing was closed. Savoy Bellavia noted that there is no additional information to present to the Commission beyond that contained in the staff report. The public hearing was opened. Al Collins, owner of a shopping complex on the southwest corner of Talbert and Beach Boulevard, ad- dressed the Commission in opposition to the change of zone, citing the need for residential uses in the area to provide patrons to the shopping center. There being no other persons to address the Com- mission, the public hearing was closed. Commission discussion ensued, taking into consideration action on General Plan Amendment 79-1 and other uses and zoning designations in the vicinity of the shopping center. Savoy Bellavia informed the Commission that no additional informa- tion beyond that reviewed in General Plan Amendment No. 79-1 was available. ON MOTION BY COHEN AND SECOND BY BAZIL ZONE CHANGE NO. 79-5 WAS APPROVED FOR RECOMMENDATION TO THE CITY COUNCIL WITH THE FOLLOWING FINDINGS, BY THE FOLLOWING VOTE: FINDINGS: 1. The zone change is compatible with'surrounding land uses. 2. The zone change is consistent with the General Plan land use designation. AYES: Higgins, Russell, Stern, Finley, Cohen, Bazil NOES: None ABSENT: Paone ABSTAIN: None PRECISE PLAN OF STREET ALIGNMENT NO. 79-1 Initiated by Development Services , A proposal to precise plan an 80 foot wide secondary arterial street commencing from Ellis Avenue, curving westerly to align with Crystal Street at Ernest Avenue, ending at Garfield Avenue. The public hearing was opened. Don Weir, Property owner in the area, addressed the Commission to discuss the proposed precise plan. He -11- 3-20-79 - P.C. Minutes, H.B. Planning Commission March 20, 1979 Page 12 questioned whether or not the street will go through to Main Street, and when told that it would not at the present time but would eventually go through he suggested that traffic impacts in the interim could present problems. He also discussed how the existing oil wells in the right-of-way would be handled. Mr. Palin informed him that it will be some time before the full width of the street is needed and it is possible that the wells will be phased out before that time. If not, there are ways to handle them; e.g, a modified intersection for the first half block or burial of the units within the right-of-way, which has been done with utility junctions. There being no other persons to address the Commission, the public hearing was closed. Commission discussion ensued. Commissioner Stern pointed that one section of Ernest Street beginning about halfway between Stewart,and Crystal narrows to 30 feet rather than the 60 feet existing west of that point, and suggested that it be widened to improve the intersec- tion of Ernest and Crystal. The Commission reviewed this concept and it was the consensus that such action should not be included on this precise plan but could be submitted as a recommendation to the City Council for future action. ON MOTION BY HIGGINS AND SECOND BY STERN THE COMMISSION RECOMMENDED ADOPTION OF PRECISE PLAN OF STREET ALIGNMENT NO. 79-1 TO THE CITY COUNCIL, BY THE ADOPTION OF RESOLUTION NO. 1245, BY THE FOLLOWING VOTE: AYES: Higgins, Russell, Stern, Finley, Cohen, Bazil NOES: None ABSENT: Paone ABSTAIN: None ON MOTION BY STERN AND SECOND BY COHEN:•THE COMMISSION DETERMINED TO RECOMMEND TO THE CITY COUNCIL THAT THE CITY REQUIRE, AT THE TIME OF THE -PROPOSED ABANDONMENT OF A SECTION OF THE GOTHARD STREET RIGHT-OF- WAY AND THE AGREEMENT OF EXCHANGE WITH ADJOINING PROPERTY OWNERS, THE DEDICATION OF A 30 FOOT STRIP OF LAND NORTH OF THE EXISTING CENTER- LINE OF ERNEST STREET FROM 330 FEET EAST OF CRYSTAL STREET TO CRYSTAL STREET TO ADJUST THE ALIGNMENT OF THE INTERSECTION, BY THE FOLLOWING VOTE: AYES: Higgins, Russell, Stern, Finley, Cohen, Bazil NOES: None ABSENT: Paone ABSTAIN: None DISCUSSION ITEM: Bob Mickelson addressed the Commission on behalf of Stewart Con- struction in regard to commercial uses in an industrial development. He described two commercial uses which are considering leasing buildings in the industrial complex at Heil Avenue and Gothard Street 1 -12- 3-20-79 - P.C. Minutes( H.B. Planning Commission March 20, 1979 Page 13 and reviewed the history of the development at that location. The Commission discussed the mixed -use concept with Mr. Mickelson and concurred that he could proceed to file the required requests for en- titlement for the uses. Mr. Mickelson offered to review and critique the mixed -use ordinance the City had at one time considered; he also said he would prepare a list of such mixed -use developments in the area so that the Commission could visit them and observe at first hand how other such developments have been operating. COMMISSIONER'S COMMENTS: Commissioner Cohen requested to be kept up to date on possible County diversion of funds originally earmarked for sewer use; he also dis- cussed the zoning of the oil islands in the Seacliff project areas. After review, it was the consensus of the Commission that these areas should be studied with a view to making the island zoning compatible with the uses surrounding them. Commissioner Bazil discussed the importance of precise planning an alignment for 38th StreO-t as soon as possible. Commissioner Russell discussed the requirements for special event permits and the method of processing any future development request on the property included in the withdrawn Tentative Tract 10440. Commissioner Higgins pointed out the need for a small planned resi- dential development ordinance. PLANNING DEPARTMENT ITEMS: Acting Secretary Palin reported action from the City Council meeting of March 19: 1. Precise Plan of Street Alignment 70-4: Council continued action on the revocation of this precise plan, and directed the Commis- sion to review alternatives to provide an east/west intertie for Orange and Atlanta Avenues. This review of alternatives will be scheduled for Commission meeting of April 3, 1979. 2. General Plan Amendment No. 79-1 (A & B): The Council adopted the General Plan as recommended by Commission. The following direc- tives were given to staff: 1) Ellis Avenue realignment will be placed on a subsequent general plan amendment; 2) Main Street from Clay to Garfield will be placed back on the Circulation Element; 3) the southerly width of Lake Street will be reanalyzed; and 4) Pacific Coast Highway designation will be upgraded to major arterial. STAFF ITEMS: Savoy Bellavia informed the Commission of a subdivision committee meeting on March 29. He also noted that the conflict of interest reports are required to be submitted by March 30, and that Assembly- man Mangers has invited the Commission to an informal meeting in the -13- 3-20-79 - P.C.
