This application is covered by Negative Declaration No. 76-113, previously approved. Mr. Ray Miller was present to represent the application. Secretary Lipps reviewed the plan check with the Board and noted that plan was in substantial compliance with Ordinance Code requirements. It was noted that the applicant had revised his original plan whereby the proposed building was somewhat set back to allow proper turning radius for emergency equipment access. Mr. Miller explained the proposed use to be strictly for office purposes. Board discussion followed. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening -of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. B. GENERAL CONDITIONS: 1. All mitigating measures as set out in Negative Declaration No. 76-113 shall be complied with. 2. Mr. Robert Faxon, Architect, was present to represent the appli- cation. Chairman Crosby outlined the proposal to the Board. Mel Ott expressed concern over the possibility of vehicles extending into drives while waiting in the service lanes. The appli- cant's representative assured the Board that ample room was provided so that the vehicles wanting in line for service, would not extend into the drive areas. The applicant was made aware that a 30 foot clear accessway between the kiosks and the bank building was required and would be made a condition of approval. Board discussion followed. ON MOTION BY OTT AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 79-18 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: :1. The conceptual plot plan and elevations received March 2, 1979, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity, Past administrative action regarding this property. Stagliano To permit the construction of a 10,045 square foot industrial building located on the northwest corner of Manufacture Lane and System Drive. This request is covered by Environmental Impact Report No. 73-16, approved by the City Council on March 18, 1974. Mr. Stagliano, the applicant, was present. Chairman Crosby outlined the proposal for the Board. It was noted that the proposal was within substantial Ordinance Code conformance, however, a separate application would have to be filed if the applicant wished to pursue the truck well and overhead door at the southeast -corner of the building. Board discussion followed. ON MOTION BY CROSBY AND SECOND BY OTT, ADMINISTRATIVE REVIEW NO. 79-19 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: J . The conceptual plot plan and elevations received March 5, 1979, shall be the approved layout, subject to the modification described herein: a. A revised plan deleting truck well and overhead door at southeast corner of building. A plan delineating said modification shall be submitted to the Secretary of the Board. If such plan complies with the modification outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. Stagliano To permit the construction of a 9600 square foot industrial building located on the south side of Research Drive, directly across from Computer Lane. This application is covered by Environmental Impact Report No. 73-16, approved by the City Council on March 18, 1974. Mr. Stagliano, the applicant, was present. Chairman Crosby outlined the proposal for the Board. It was noted that the plan as proposed, was within substantial Ordinance Code conformance. It was noted that the use was one parking space short, however, since the proposal is a one -user building, the shortage of that parking space was acceptable. Board discussion followed. ON MOTION BY OTT AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 79-20 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. AYES: Lipps, Crosby, Ott NOES: None ABSENT: None USE PERMIT NO. 79-7 Applicant: John E. Schwartz To permit construction of a coin -operated car wash facility located on the north side of Warner Avenue, approximately 300 feet west of Springdale Street. The environmental review for this application has been conducted under a previous application (Use Permit No. 76-63). Mr. Schwartz, the applicant, was present. The Chairman outlined the proposal to the Board noting that this application had been granted a previous approval, however, time had run out on that approval. The public hearing was opened. Mr. Schwartz addressed the Board and stated that he had received previous approval for the proposed car wash in 1976, however, due to various soil problems, and weather conditions, the time had run out on his previous approval. ;fHe further stated that the plumbing for the proposal had already been completed, and that the site is now ready for the foundation to be poured. Board of Zoning Adjustments Wednesday, March 21, 1979 Page Seven Mr. James Callas addressed the Board and stated that he was representing Mr. Jim Bakalas and Mr. Evan Kitsigianis, who have recently purchased the adjacent shopping center, in opposition to the proposed car wash. Mr. Callas further stated that the owners of the Westfair Plaza Shopping Center were con- cerned over the creation of a public nuisance, whereby possibly creating trash and debris to accumulate due to this type of car wash being mostly unattended. Concerns were expressed over people working on their vehicles and creating visible debris,.i.e., oil stains, chemicals dumped, and also the possibility of winds blowing waste materials onto the adjacent shopping center. Mr. Schwartz again addressed the Board and stated that he had placed a considerable amount of money into this project already, and stated that it was up to the owner to take care of the property. He proposes to hire a maintenance service to visit the site on a daily basis to provide proper care and maintenance of the proposed facility. He further noted that the only spray that might blow onto the adjacent propery would be a slight water spray, which would only affect the very rear of the shop- ping center. Secretary Lipps discussed location of trash recepticles with the applicant, noting the strategic placement of containers might eliminate possible debris. Secretary Lipps further noted that the Ordinance Code does provide for the cleanliness of this type of facility. There being no further parties present to speak on the application, the public hearing was closed. Board discussion followed. ON MOTION BY LIPPS AND SECOND BY OTT, USE PERMIT NO. 79-7 WAS AP- PROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS• 1. The establishment, maintenance, and o_neration of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received March 2, 1979, shall be the approved layout, subject to the modifi- cations described herein: a. A revised plan showing structural materials for the proposed building as compatible and similar to those used within the existing shopping center. b. The parapet or roof treatment shall be of similar color and design to the roofs in the existing shopping center. A plan delineatinq said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments con- sidered the following issues relating to the conceptual plan: Traffic circulation and drives; Parkinq layout; Lot area; - Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. B. GENERAL CONDITIONS: 1. The flood control channel shall be fenced in compliance with the conditions of approval of Use Permit No. 68-15. The applicant was not present. Board reviewed the proposal noting that a more detailed plan must be provided by the applicant. ON MOTION BY LIPPS AND SECOND BY CROSBY SPECIAL EVENT NO. 79-4 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. A revised plot plan indicating precise location of sale area and drives shall be submitted to the Secretary of the Board. 2. The plot plan received February 14, 1979, shall be the approved ,layout. 3. An on -site inspection by the Fire Department shall be required prior to the event. 4. The applicant shall obtain all necessary electrical permits. 5. A certificate of insurance form shall be filed in the Finance Department five (5) days prior to the event. Board of Zoning Adjustments Wednesday, March 21, 1979 Page Ten REVOCATION PROCEEDINGS Brought by the Planning Department Proposal to institute revocation of a Home Occupation Permit for Stewart's Concrete Pump, located at 8032 Ebbtide Circle, Huntington Beach, California. Chairman Crosby opened the public hearing. Mr. Doug Stewart, the home occupation permit holder, was present. Secretary Lipps described the actions taken in response to citizens complaints by the Land Use Division, noting that no response has been received from the operator of the home occupation nor any apparent effort made to correct the violation. Mr. Stewart addressed the Board, noting that he was aware of the violation, but that due to financial constraints, was unable to move his pumping equipment to another location. He further stated that his equipment did not make any noise, was not leaking oil, and generally did not create any mess in the neighborhood. Secretary Lipps advised Mr. Stewart that a home occupation permit is only issued for office use, and that the garage was not to be utilized for this business, nor was the storage of any vehicles in connection with the business permitted in the residential area. Chairman Crosby suggested to the applicant if an extension of the revocation might help, to allow him time to locate an appropriate storage place for his pumps. Mr. Stewart was amenable to that suggestion. Secretary Lipps noted that such an extension would entail ad- ditional staff time,_ additional field trips, and felt such additional time expended by staff was unfeasible due to the extent of letters, field trips, and warnings already extended to Mr. Stewart. There being no further parties present to speak on the revocation proceedings, the public hearing was closed. Board discussion ensued. The applicant was not present. Board reviewed the proposal noting that a more detailed plan must be provided by the applicant. ON MOTION BY LIPPS AND SECOND BY CROSBY, SPECIAL EVENT NO. 79-5 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. A revised plot plan indicating precise location of equipment and sale areas and drives shall be submitted to the Secretary of the Board. 2. The plot plan received March 16, 1979, shall be the approved layout. 3. An on -site inspection by the Fire Department shall be required prior to the event. 4. The applicant shall obtain all necessary electrical permits. 5. A certificate of insurance form shall be filed in the Finance Department five (5) days prior to the event. ON MOTION BY LIPPS AND SECOND BY CROSBY THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO, 79-11 WITH THE MITIGATING MEASURES CONTAINED IN TENTATIVE PARCEL MAP NO. 79-555, BY THE FOLLOWING VOTE: AYES: Lipps, Crosby, Ott NOES: None ABSENT: None Messrs. John Michler, Goeden, and Fleener, were present to represent the application. Chairman Crosby outlined the proposal to the Board. Secretary Lipps gave a brief history of the proposal stating that the application had been referred to the Planning Commission for review in conjunction with Tentative Tract 10440, however, the applicant had withdrawn the tentative tract, subsequently, the application had been referred back to the Board of Zoning Adjust- ments. Board reviewed the proposal and discussed access to the various parcels. Landscaping and walkway treatment was also discussed. ON MOTION BY LIPPS AND SECOND BY OTT, TENTATIVE PARCEL MAP NO. 79-555 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS• 1. The proposed consolidation of six (6) parcels into four (4) parcels for purposes of a commercial and residential development, is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for Highway Commercial and High Density Residential which allows Commercial and Residential buildings, was placed on subject property. 4. The size, depth, frontage, street width, and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifi- cations on file with the City as well as in compliance with the State Map Act and supplementary City Subdivision Ordinance. The tentative parcel map received by the Planning Department on March 20, 1979, shall be the approved layout. 2. A parcel map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County Recorder. 3. A copy of the recorded parcel map shall be filed with the Planning Department and Department of Public Works. 4. Applicable mitigating measures as set out in Negative Declaration No. 79-11 shall be complied with. 5. Sections including landscaping and walkway treatment, on the 52 foot access easement along the south line of Parcel 44 shall be approved by the Board of Zoning Adjustments prior to approval of development of Parcel 43. 6. Access from Beach Boulevard to parcel Nos. 1 and 2 to be approved by the Board of Zoning Adjustments prior to further development of these parcels. 7.
