To permit reduction of side yard setbacks to allow for construction of
• two single-family dwellings located on the south side of Memphis Ave-
nue, approximately 100 feet west of Huntington Street.
This request is a categorical exemption, Class 5, California Environ-
mental Quality Act, 1970.
Acting -Secretary Lipps informed the Board that the applicant had
requested withdrawal of his request in order to submit a revised
plan which will meet code requirements. Board concurred with with-
drawal of the application.

THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE
EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION
NO. 79-22 WITH THE MITIGATING MEASURES CONTAINED IN ADMINISTRAT-
IVE REVIEW NO. 79-22 GENERAL CONDITION B-2 IMPOSED ON THE AD-
MINISTRATIVE REVIEW APPLICATION, BY THE FOLLOWING VOTE:

Messrs. Scott and Cathcart were present to represent the appli-
cation.
Acting Secretary Lipps stated that the application had been
continued previously due to concerns with the layout of the build-
ing and parking on the site. The applicants have met with staff
to modify some concerns and presented a revised plan for review.
Board discussed with the applicant to reorient Building "C" to
10' property line rear yard setback. Additional parking was
discussed to accommodate people using the upstairs units. The
applicant's were agreeable to provide additional parking at the
north and south ends of Buildings "G" and "H" adjacent to the
elevators. The removal of the rampway between Buildings "E" .
and "D" was discussed. It was determined that if.the rampway
was to remain, the buildings would be counted as one building
and additional setbacks would have to be complied with.
The applicants presented a "mock up" of additional
parking proposed outlining that parking has been situated as such
to alleviate stacking of vehicles at entry gates to the project.
Bruce Greer and John Thomas were present and expressed concern
over the street improvements along the proposed project. The
Board stated that the applicants were required to make full
street improvements along the proposed construction. Undergrounding
of utilities was discussed and the applicants stated that the
utility company had indicated to them that they had set a special
fund aside to provide underground utilties in the project area.
They further stated, however, if the undergrounding of the utilities
was their responsibility, that they would do so.
Board reviewed the aesthetic recommendations set forth by the
Design Review Board and found same to be acceptable.
Board discussed the security fencing proposed with the applicants
and requested a plan be brought back to the Secretary of the
Board outlining the entry gate locations. Parking along Ernest
Street was discussed and it was the consensus of the Board .
to request the applicant to paint the curb red along Ernest
Street and post "No Parking" signs to prohibit parking along
that street.

Additional conditions of approval were discussed including the
request of a lighting plan to be submitted to the Secretary of
the Board.

79-22 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING
VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received March 8, 1979,
shall be the approved layout, subject to the modifications
described herein:
a. Reorient Building "C" to Zero property line rear yard setback.
b. Provide narking at north and south ends of Buildings "G" and
"H" as shown on modified conceptual plan.
C. Provide two (2) parking spaces adjacent to office structure.
• d. Remove rampway between Buildings "E" and "D".
e. The security fencinq between Buildings "E" and "D"
shall be set back easterly a minimum of five (5) feet
from exterior of building walls.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
Traffic circulation and drives;
Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity
Past administrative action regardinq this property.
2. The following plans shall be submitted to the Secretary of
the Board:
a. Landscape and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works.
• b. Rooftop mechanical equipment screening plan. Said plan
shall indicate screening of all rooftop mechanical equip-
ment and shall delineate the type of material proposed to
screen said equipment.

C. A plan of entry gate location shall be submitted reflecting
a minimum twenty (20) foot setback from property line.
d. A lighting plan shall be submitted to the Secretary
of the Board prior to issuance of building permits
B. GENERAL CONDITIONS:
1. All recommendations of the Design Review Board shall be inte-
grated into the structural elevations or landscape plan.
2. Developer shall comply with all mitigating measures as set
out in Negative Declaration No. 79-22.
3. Walls of Buildings at Zero setback shall be constructed of
maintenance free masonry.
4. No parking signs and red curb shall be provided along the
south side of Ernest.

CONDITIONAL EXCEPTION NO. 79-8 •
Applicant: Dave McGuiness
To permit a reduction in sideyard setbacks for the construction of
a single family dwelling located on the south side of Memphis
Avenue, approximately 100 feet west of Huntington Street.
This request is a categorical exemption, Class 5, California
Environmental Quality Act, 1970.
Mr. Anthony Boles, representing the applicant, was present. Chairman
Crosby outlined the proposal to the Board. The public hearing was
opened.
Mr. Boles stated that the applicant was proposing two single
family structures, however, a variance is requested on one struct-
ure only. He further stated that due to necessary dedication
required by the City, the width of the proposed structure would
be too narrow if built to code requirements. The applicant
proposes to provide a distance of 4'6" between the garages rathen
than the 5' required by code.
Acting Secretary Lipps stated that in reviewing other similar
structuresin the neighborhood, that other corner lots have complied
with similar setbacks for 25' lots. Board members Ott and Crosby
agreed with Mr. Lipps in that if other similar properties have
complied with proper setbacks, that the applicant could also
meet code requirements.
The public hearing was closed. Board discussion ensued.

Acting Secretary Lipps noted that without a conditional exception
the garage structure could not be built, however, he saw no reason
why the residential structure could not be built to code conformance.
Board members Crosby and Ott felt that the building could be designed
to fit the lot. It was further noted that the application could be
continued to allow applicant time to revise his plan to bring resi-
dential structure into code conformance. The applicant was not
amenable to a continuance.
A MOTION WAS MADE BY LIPPS TO DENY CONDITIONAL EXCEPTION 79-8
WITH THE FOLLOWING FINDINGS:
1. The granting of this conditional exception would be a grant
of special privilege inconsistent with similar properties with
the same zoning classification in the vicinity.
2. The applicant demonstrated a self-imposed hardship by the design
of the building.
3. Other properties in the area with similar constraints were built
without an exception to code requirements.
•The applicant requested to speak to the Board again. Mr. Boles stated
that due to time constraints he did not wish a continuance on the
application, however, he would like the portion of the conditional
exception dealing with distance between garages approved.
ACTING SECRETARY LIPPS WITHDREW HIS MOTION FOR DENIAL.
Mr. Lipps requested the Board to address themselves only to the
shortage of distance between the garages and stated that in order
for the applicant to provide the required parking spaces for the unit,
the request was valid.
Further discussion ensued. It was the consensus of the Board to
grant the applicant that portion of the conditional exception.
ON MOTION BY LIPPS AND SECOND BY CROSBY, CONDITIONAL EXCEPTION
NO. 79-8 WAS APPROVED WITH THE FOLLOWING VINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDING:
1. Due to lot width, applicant is unable to provide required parking
in order to obtain parity with surrounding properties in the
same zoning classification.

CONDITIONS OF APPROVAL:
1. The conceptual plan received and dated March 12, 1979, shall be
the approved layout, subject to the modifications described herein:
a. Revise plan to show the setbacks for all residential portions
of the building in compliance with the requirements of the
Huntington Beach Ordinance Code.
2. The reduction in setbacks shall apply to the garage structure
only.

Applicant: P. I. & I. Inc.
To permit a reduction in side yard setback from five feet to four
feet located on the west side of 9th Street, approximately 200 feet
north of Acacia Avenue.
This application is a Class 5 Categorical Exemption, California •
Environmental Quality Act, 1970.
The Chairman outlined the proposal to the Board. The public hearing
was opened.
Mr. Hoeflieger was present to represent the application. Mr.
Hoeflieger stated that he chose to break up the straight wall
of the project to enhance the area. The Board agreed with the
applicant that the proposal would enhance the area, however, they
were bound by the necessity for the demonstration of a hardship
for the granting of a conditional exception. Acting Secretary
Lipps stated that perhaps this type of a variation to setback
requirements could be handled through a code amendment.
There being no other parties present to speak on the application,
the public hearing was closed.
Further Board discussion ensued. It was the consensus of the Board
that in order to allow the granting of a conditional exception,
that sufficient hardship must be demonstrated, and that in this
case, the applicant did not do so.

Mr. Hoeflieger was present to represent the application. Mr.
Hoeflieger did not wish to continue with this application due to
the denial of the previous application (Conditional Exception No.
79-10). He requested denial of this request.
There being no further parties present, the public hearing was closed.

Board reviewed the proposal and found same to be within substantial
Ordinance Code conformance. Landscaping requirements and proper
setbacks were discussed.as well as the necessity of a tentative
parcel map consolidating existing parcels.

1979, shall be the approved layout, subject to the modifications

a. A minimum 11 ft. landscaped area shall be provided along
Engineer Drive and Connector Lane.
b. A minimum 18 ft. setback fully landscaped shall be pro-
vided along the building facing Pipeline Lane.
C. A minimum 11 ft. landscaped area shall be provided south
of the driveway approach on Pipeline Lane.
A plan delineating said modifications shall be submitted to
the Secretary of the Board. If such plan complies with the
modifications outlined by the Board, said plan shall be
approved and made a permanent part of the administrative file.

This request is covered by Environmental Impact Report No. 73-16,
approved by the City Council on March 18, 1974.
Board reviewed the proposal and found same to be within substantial
Ordinance Code conformance. Landscaping requirements and proper
setbacks were discussed as well as the necessity of a tentative
parcel map consolidating existing parcels.

Mr. Alderson, the applicant was present.
The Acting Secretary informed the Board that this application
was approved previously in 1977. The applicant has made some
modifications to his original proposal, however, the plan
seems to be in substantial compliance with the Ordinance Code.
